1795 erschien die 1. Auflage von Kants Schrift Zum ewigen Frieden. Zu einer der vordringlichsten, von der Philosophie aber häufig vernachlässigten Aufgaben der Politik stellt sie bis heute den wichtigsten klassischen Text dar. Kant entfaltet in ihm die philosophischen Grundlagen für eine internationale Rechts- und Friedensgemeinschaft. Gleichzeitig stellt er sich aber auch die Frage nach einer Vermittlung von normativer Theorie und politischer Praxis. In 12 Beiträgen wird Kants Text in diesem Band 'entschlüsselt', interpretiert, auf seine systematische Überzeugungskraft und auf seine (...) politische Tragweite hin untersucht und in seinen und unseren sozialgeschichtlichen Kontext gestellt. This article argues that, far from being a merely defensive act of individual protest, civil disobedience is a much more radical political practice. It is transformative in that it aims at the politicization of questions that are excluded from the political domain and at reconfiguring public space and existing institutions, often in comprehensive ways. Focusing on the reconstitution of the political community also allows us to reconceptualize constituent power. Rather than portraying it as a quasi-mythical force erupting only in extraordinary (...) moments, constituent power can be conceptualized as a dynamic situated within established orders, transgressing their logic and reconfiguring them from within. Civil disobedience as a transformative and potentially comprehensive practice aimed at reconstituting the political order can then be seen as an internal driving force keeping this dialectic in play. Immanuel Kants Metaphysische Anfangsgründe der Rechtslehre, 1797 als erster Teil der Metaphysik der Sitten erschienen, stellen einen Beitrag zur neuzeitlichen Rechts- und Staatsphilosophie dar. Hinsichtlich der normativen Prinzipien von Recht und Staat entwickelt Kant eine erfahrungsunabhängige, insofern metaphysische Theorie. Sie beginnt mit einem angeborenen und unveräußerlichen Menschenrecht und geht dann zu den Institutionen des Eigentums und des Rechtsstaates über. Besonders aktuell ist die Formulierung eines rechts- und friedensfunktionalen Völkerrechts und eines Weltbürgerrechts. Darüber hinaus behandelt Kant auch das Ehe und Familienrecht, (...) das Verhältnis von Staat und Kirche und das Straf- und Begnadigungsrecht. El ideal cosmopolita desarrollado por Kant en su breve escrito La paz perpetua , publicado en 1795, ha gozado de una inmensa influencia y conserva aún hoy una indiscutible vigencia. En su formulación original el ideal kantiano se encontraba íntimamente ligado a la necesidad de encontrar medios adecuados para superar el estado de guerra en el que la historia humana se ha instalado. Tres son las principales propuestas kantianas al respecto: la formación de gobiernos democráticos, la instauración de una federación (...) de Estados libres y la constitución de un derecho cosmopolita. Estas ideas son examinadas a lo largo del presente artículo a la luz de los problemas de las actuales relaciones internacionales, y con especial referencia a dos recientes textos de Rawls y Habermas. Normative questions concerning political authority and political obligation are widely seen as central questions of political philosophy. Current global transformations require an innovative response from normative political thinking about these two topics. In light of a concrete example of the supranational forms of authority and obligation that have been and are emerging beyond the national state and beyond the traditional domains of international law, I lay out what has become the standard approach to authority and obligation and indicate why this (...) approach is inadequate in contemporary circumstances. I sketch an alternative approach and suggest how the most promising exemplar of this kind, Habermas’ discourse theory of law and politics, can better deal with the example. Having thus made plausible the advantages of the discourse theory of the alternative approach, I end with an ‘internal’ critique of Habermas’ own recent writings on the global political order. In 1992, the Frankfurt scholar Ingeborg Maus launched a polemical attack against then current narratives of democratic protest, objecting to the languages of ‘resistance’ or ‘civil disobedience’ as defensive, servile and insufficiently transformative. This article explores in how far the language of constituent power can be adopted as an alternative justificatory strategy for civil disobedience in transnational protests. In contrast to current approaches that look at states as agents of international civil disobedience-as-constituent power, I suggest we look at political movements. (...) I focus on the example of the Democracy in Europe Movement 2025 which understands itself as a pan-European movement of civil disobedience, at the same time working towards an articulation and exercise of constituent power among the people of Europe. For Kant, the contents of cosmopolitan law are to be ‘limited’ to non-citizens' subjective rights to hospitality. Although hospitality yields universal and far-reaching communicative rights, its limits may seem overly restrictive at first. I argue that this narrow focus is intended to fend off justifications for colonial occupation that could otherwise draw support from Kant's own doctrine of private law. Kantian hospitality is further limited in that it does not cover all forms of communicative exchange. As can be shown from (...) his endorsement of China's and Japan's protectionist policies, Kant is not averse to limiting cosmopolitan citizens' commercial speech. In conclusion, I discuss rivalling interpretations of Kant's justification of hospitality. I argue that this justification cannot rest exclusively on the innate human right to freedom, but must draw on facts about the world as well. (shrink)

This article analyses the reception of John Rawls's thought by Otfried Höffe, Jürgen Habermas and other political theorists on the German liberal left. It argues that, ironically, as Rawls's theory has become more historically self-conscious and sociologically oriented since A Theory of Justice, Habermas, while denying any fundamental difference between him and Rawls in this `neo-Kantian family quarrel', has moved in the opposite direction. One might even say that there has been some mid-Atlantic convergence in political theory. Nevertheless, there remain (...) peculiarities of German political thought, in particular its more sociological bent, a (positive or negative) fixation on the state, and the persistently felt need finally to reconcile a perceived conflict between liberalism and democracy. Besides their skepticism about universal reason and universal morality, the Frankfurt Schools of Critical Systems Theory and Critical Theory share basic assumptions: (1) the thinking in societal-systemic, institutional concepts, which transcend simple reciprocal relations by dint of their complexity; (2) the assumption that society is based on fundamental paradoxes, antagonisms, antinomies; (3) the strategy to conceptualize justice as a contingent and transcendental formula; (4) the form of immanent (and not morality-based, external) critique as an attitude of transcendence; (5) the aim (...) of societal (and not only political) emancipation in an ‘association of free individuals’ (Marx). Radical democratic political theorists have used the concept of constituent power to sketch ambitious models of radical democracy, while many legal scholars deploy it to make sense of the political and legal dynamics of constitutional politics. Its growing popularity notwithstanding, I argue that the concept tends to impede a proper interpretation of civil disobedience, conceived as nonviolent, politically motivated lawbreaking evincing basic respect for law. Contemporary theorists who employ it cannot distinguish between civil disobedience and other related, yet ultimately different, (...) modes of political illegality. The essay also examines Jürgen Habermas’ recent contributions to a theory of mixed or dualistic constituent power, conceding that Habermas avoids many theoretical and political ills plaguing competing radical democratic theoretical retrievals. Recién designado como docente asistente de Husserl en la Universidad de Friburgo, Heidegger comienza a trabajar en dos proyectos que se dan en paralelo: la "transformación hermenéutica de la fenomenología" y el desarrollo de una fenomenología de la religión, que, en un principio, está centrada en el estudio de la mística medieval. El diálogo de ida y vuelta entre ambos proyectos produce las más importantes ideas de la filosofía (...) heideggeriana temprana. Este artículo se propone sostener que la lectura de ciertos autores místicos fue determinante para su reinterpretación de la fenomenología. Heidegger se apropia de la Hingabe mística dándole un sentido técnico de extrema importancia en su metodología fenomenológica. 1919 is a key year in Martin Heidegger's philosophical path. Recently appointed as Husserl's assistant professor at the University of Freiburg, Heidegger begins to work on two projects that occur in parallel: the "hermeneutical transformation of phenomenology" and the development of a phenomenology of religion, which initially focuses on the study of medieval mysticism. The back and forth dialogue between the two projects produces the most important ideas of Heidegger's early philosophy. This article aims to argue that the reading of certain mystical authors was determinant for his reinterpretation of phenomenology. Heidegger appropriates the mystical Hingabe by giving it a technical sense of extreme importance in his phenomenological methodology. (shrink)

In Between Facts and Norms, Jürgen Habermas points out an ambiguity in the Kantian concept of autonomy that would lead to an antagonism between human rights and popular sovereignty. He charges Kant of introducing this concept from the private point of view of the individual subject who judges morally and of elucidating it from the point of view of the discursive and democratic political formation of the will. Against this reading, Ingeborg Maus argues that Kant develops human rights and popular (...) sovereignty in the closest reciprocal complementarity. Nonetheless, she agrees with Habermas’s critique of the monological character of the Kantian principle of morality and reaffirms the ambiguity of the concept of autonomy. The aim of this article is to to shed light on Kant’s conceptions of Enlightenment and “public use of reason” developed in his political writings, in order to suggest that far from devaluating the political formation of the will, Kant establishes it as a fundamental step towards the realization of morality and, therefore, of the autonomy of the will. First, I will argue that in explaining the principle of autonomy with the idea of self-legislation of the will, Kant does not introduce ambiguity in this concept. On the contrary, it establishes a common normative structure between the domains of moral and right. Finally, I will return to the Doctrine of Right to argue that for Kant, interaction and communication between citizens is not lateral to the legitimation of right, since the members of the political community must consent and be convinced by reason. Democracy seems to be no longer self-evident. Colin Crouch and others describe a growing sense of alienation in politics: democratic institutions and procedures may be working properly, yet they themselves promote non-democratic values such technocracy, oligarchy, elitism. For the citizens, only an illusion of democracy persists. The article argues that the weakening of democracy in practice mirrors the vanishing of democracy in political theory and philosophy. We may face a crisis of democratic politics as a result of a crisis of (...) democratic theory. Predominant theories of democracy fail, for the most part, to adequately reflect the changing social conditions in democratic societies and to offer a conception of democratic politics that would address current legitimacy deficits. The article discusses prominent theoretical approaches and points out that all have difficulties conceptualizing possible resources for democratization adequate to contemporary issues and conditions. A new version of political theory is outlined and defended, such that builds upon a redefined notion of democratic sovereignty and communicative power, complex enough to reflect the sociological reality of today’s politics and to reach beyond the institutionalized and formalized setting of democracy. Democratic theorists are usually dismissive about the idea that citizens act “through” their representatives and often hold persons to exercise true political agency only at intervals in elections. Yet, if we want to understand representative government as a proper form of democracy and not just a periodical selection of elites, continuous popular agency must be a feature of representation. This article explores the Kantian attempt to justify that people can act “through” representatives. I call this the “exercise view” of representation (...) and defend its superiority to the “opportunity view,” which I attribute to Locke. It is superior because it has a robust conception of rationality and collective action, allowing us to understand how representation can mediate public reason. (shrink)
