Moral particularists argue that because reasons for action are irreducibly context-dependent, the traditional quest in ethics for true and exceptionless moral principles is hopelessly misguided. In making this claim, particularists assume a general framework according to which reasons are the ground floor normative units undergirding all other normative properties and relations. They then argue that there is no cashing out in finite terms either (i) when a given non-normative feature gives rise to a reason for or against action, or (ii) (...) how the reasons that are present in a given context play off each other to determine one’s overall duties. However, the conjunction of these two theses leaves particularists without a coherent notion of a reason for action: posit too much irreducible context-dependence in the behavior of reasons, and the reasons-based framework breaks down. One upshot is that the particularists’ challenge to principle-based approaches to ethics has not, at present, been successfully made out; another upshot is that perhaps the best way to formulate that challenge involves renouncing the reasons-based framework all together. John Rawls’ method of reflective equilibrium is the most influential methodology in contemporary ethics.This paper argues that this influence is undeserved, for two reasons. First, reflective equilibrium fails to accomplish two tasks that give us reason to care about methodology. On the one hand, it fails to explain how (or whether) moral knowledge is possible.This is because the method is explicitly oriented towards the distinct (and less interesting) task of characterizing our moral sensibilities. On the other hand, the method fails (...) to provide an informative way of adjudicating central methodological debates in ethics. Second, where Rawls’ method –and the background methodology he uses to motivate it –do have substance, that substance is implausible. The role of dispositions in the method entails that it endorses obviously irrational inferences. Further, the method makes substantively implausible distinctions between the dispositions that are allowed to play a methodological role. Rawls' background methodology appeals to the idea of a psychology in ‘wide reflective equilibrium’. However, both formal and empirical path-dependence considerations strongly suggest that there is nothing even minimally determinate that is someone’s psychology in ‘wide reflective equilibrium’. I close by exploring salient attempts to salvage the spirit of reflective equilibrium by abandoning elements of Rawls’ approach. I argue that none of these attempts succeed. I conclude that appeal to the method of reflective equilibrium is not a helpful means of addressing pressing methodological questions in ethics. This paper defends a novel account of how to determine the intrinsic value of possible worlds. Section 1 argues that a highly intuitive and widely accepted account leads to undesirable consequences. Section 2 takes the first of two steps towards a novel account by clarifying and defending a view about value-contribution that is based on some of W. D. Ross’ claims about the value of pleasure. Section 3 takes the second step by clarifying and defending a view about value-suppression that (...) is based on Ross’ claims about the interplay between prima-facie duties. Section 4 states and defends the account that I call Rossian Totalism. According to this account, the atoms of intrinsic value within a world only sometimes contribute their intrinsic value to the value of that world. (shrink)

This paper explores two models using which we might understand Heidegger's notion of ‘Eigentlichkeit’. Although typically translated as ‘authenticity’, a more literal construal of this term would be ‘ownness’ or ‘ownedness’; and in addition to the paper's exegetical value, it also develops two interestingly different understandings of what it is to have a judgment of one's own. The first model understands Heideggerian authenticity as the owning of what I call a ‘standpoint’. Although this model provides an understanding of a number (...) of key features of authenticity, it also invites an important objection—which I call ‘the closure objection’—that can be found in, for example, the work of Steven Galt Crowell and Tony Fisher. Although I argue that this objection can be met, the response for which it calls reveals that the feat of authenticity as understood through the standpoint model rests upon a further feat, and one which may itself have a stronger claim to be identified with Heideggerian authenticity. I develop this thought, introducing what I call the ‘all-things-considered judgment model’ of authenticity, the basis of which lies in, among other sources, Heidegger's appropriation of themes from Aristotle's discussion of phronesis. I explain the exegetical benefits of adopting this model and consider some objections that it invites, before closing with a discussion of how the two models understand the notion of ‘a judgment of one's own’. The ‘standard interpretation’ of John Taurek’s argument in ‘Should the Numbers Count?’ imputes two theses to him: first, ‘numbers scepticism’, or scepticism about the moral force of an appeal to the mere number of individuals saved in conflict cases; and second, the ‘equal greatest chances’ principle of rescue, which requires that every individual has an equal chance of being rescued. The standard interpretation is criticized here on a number of grounds. First, whilst Taurek clearly believes that equal chances are all-important, (...) he actually argues for a position weaker than the equal greatest chances principle. Second, the argument Taurek gives for the importance of equal chances ought to commit him to being more hospitable to the significance of numbers than he seems to be. Third, and as a result, Taurek should not have dismissed the significance of numbers but embraced a form of pluralism instead. Fourth, this result should be welcomed, because pluralism is more plausible than either the equal greatest chances principle or the saving the greater number principle. (shrink)

In both The Right and the Good and Foundations of Ethics, W. D. Ross maintains that any amount of the non-instrumental value of virtue outweighs any amount of the non-instrumental value of pleasure or avoidance of pain. The chapter raises two challenges to the status that Ross accords the value of virtue relative to the value of pleasure (pain). First, it argues that Ross fails to provide a good argument for thinking that virtue is always better than pleasure and that (...) it is in any case implausible to think that any amount of virtue (or avoidance of vice) is better than the avoidance of any amount of pain or suffering. Second, it argues that the inflexibility of Ross’s value theory exhibited in his claim about the relative value of virtue produces tension with and mars the attractive heterarchical structure of his theory of rightness or prima facie duties. Ethical non-naturalists often charge that their naturalist competitors cannot adequately explain the distinctive normativity of moral or more broadly practical concepts. I argue that the force of the charge is mitigated, because non-naturalism is ultimately committed to a kind of mysterianism about the metaphysics of practical norms that possesses limited explanatory power. I then show that focusing on comparative judgments about the explanatory power of various metaethical theories raises additional problems for the non-naturalist, and suggest grounds for optimism that a (...) naturalistic realist about practical normativity will ultimately be able to explain the distinctive normativity of practical norms. I then show that radical pluralism or particularism about the structure of normative ethics would complicate the naturalistic strategy that I defend. This suggests a perhaps surprising way in which the resolution of the debate between ethical naturalists and non-naturalists may rest in part on the answers to substantive normative questions. I develop an anti-theory view of ethics. Moral theory (Kantian, utilitarian, virtue ethical, etc.) is the dominant approach to ethics among academic philosophers. But moral theory's hunt for a single Master Factor (utility, universalisability, virtue . . .) is implausibly systematising and reductionist. Perhaps scientism drives the approach? But good science always insists on respect for the data, even messy data: I criticise Singer's remarks on infanticide as a clear instance of moral theory failing to respect the data of moral (...) perceptions and moral intuitions. Moral theory also fails to provide a coherent basis for real-world motivation, justification, explanation, and prediction of good and bad, right and wrong. Consider for instance the marginal place of love in moral theory, compared with its central place in people's actual ethical outlooks and decision making. Hence, moral theory typically fails to ground any adequate ethical outlook. I propose that it is the notion of an ethical outlook that philosophical ethicists should pursue, not the unfruitful and distorting notion of a moral theory. (shrink)

In this article I attempt to show conclusively that the apparent intrinsic difference between causing collateral damage and directly attacking innocents is an illusion. I show how eleven morally irrelevant alterations can transform an apparently permissible case of harming as a side-effect into an apparently impermissible case of harming as a means. The alterations are as obviously irrelevant as the victims’ skin colour, and consistently treating them as relevant would have unacceptable implications for choices between more and less harmful ways (...) of securing greater goods. This shows not only how the principles philosophers have proposed for distinguishing between these cases cannot withstand scrutiny, but how we can be sure that there are no relevant differences yet to be discovered. I conclude by considering reasons to think that there are deontological constraints against harming, but that they apply just as forcefully against collateral harms as they do against intended harms. This paper presents four arguments in favour of respecting Ulysses Contracts in the case of individuals who suffer with severe chronic episodic mental illnesses, and who have experienced spiralling and relapse before. First, competence comes in degrees. As such, even if a person meets the usual standard for competence at the point when they wish to refuse treatment (time 2), they may still belesscompetent than they were when they signed the Ulysses Contract (time 1). As such, even if competent at (...) time 1andtime 2, there can still be a disparity between thelevelsof competence at each time. Second, Ulysses Contracts are important to protect people’smost meaningfulconcerns. Third, on the approach defended, the restrictions to people’s liberty would be temporary, and would be consistent with soft paternalism, rather than hard paternalism: the contracts would be designed in such a way that individuals would be free to change their minds, and to change or cancel their Ulysses Contracts later. Finally, even if one rejects the equivalence thesis (the claim that allowing harm is as bad as doing harm), this is still consistent with the claim that, inparticular cases, it can be as wrong toallowa harm as to do a harm. Nevertheless, controversies remain. This paper also highlights several safeguards to minimise risks. Ultimately, we argue that people who are vulnerable to spiralling deserve a way to protect their autonomy as far as possible, using Ulysses Contracts when necessary. (shrink)

The goal of this article is to try to resolve two key problems in the duty-based approach of W. D. Ross: the source of principles and a process for moving from prima facie to actual duty. I use a naturalistic explanation for the former and a nine-step method for making concrete ethical decisions as they could be applied to journalism. Consistent with Ross's position, the process is complicated, particularly in tougher problems, and it cannot guarantee correct choices. Again consistent with (...) Ross, such complexity and uncertainty speak in the method's favor, given the difficulty—factual, motivational, and organizational—of ethics problems and decision making. (shrink)

In this article I describe the theoretical underpinnings of 20th-century British philosopher W. D. Ross's approach to linking deontological and teleological decision making. I attempt to fill in what Ross left on the whole unanswered, that is, how to use his duties to resolve dilemmas. A case study in journalism demonstrates how to apply the theory. I conclude with an analysis of what I take to be the strengths and weaknesses in Ross's theory.

Normative ethics asks: What makes right acts right? W. D. Ross attempted to answer this question inThe Right and the Good(1930). Most theorists have agreed that Ross provided no systematic explanatory answers. Ross's intuitionism lacks any decision procedure, and, as McNaughton (2002: 91) states, it ‘turns out after all to have nothing general to say about the relative stringency of our basic duties’. Here I will show that my own Rossian intuitionism does have a systematic way of explaining what makes (...) right acts right. Deontological theories have struggled to say what internal to acts could make them right. From Price to Ross, the striking but uninformative answer has beenthe natureof the act. In this paper I will provide a Rossian theory of the moral natures of acts. It contains a set of self-evident principles of moral stringency and other considerations that can assist agents in deciding what prima facie duty overrides what. (shrink)

Most people believe some moral propositions are true. Most people would say that they know that rape is wrong, torturing people is wrong, and so on. But despite decades of intense epistemological study, philosophers cannot even provide a rudimentary sketch of moral knowledge. In my view, the fact that we have very strong epistemic confidence in some fundamental moral propositions and the fact that it is extremely difficult for us to provide even the basics of an account of moral knowledge (...) gives us an important clue. Both of these facts stem from the very nature of moral knowledge. In this paper I provide an intuitionist account of moral knowledge. I try to remove misunderstanding and add to our understanding of the contemporary account of self-evident moral propositions. For a theory of moral knowledge to be acceptable it must explain both the moral knowledge we have and why it is so very difficult for us to explain. My theory meets both requirements. (shrink)

I take the debate between the particularists and the principlists to be centered on the issue of whether there are true moral principles. One argument the principlists often appeal to in support of their claim that there are true moral principles is the argument from supervenience. Roughly, the argument is made up of the following three statements: (P1) If the thesis of moral supervenience holds, then there are true moral principles. (P2) The thesis of moral supervenience holds. (C) There are (...) true moral principles, and hence particularism is false. In this paper, I argue that the above argument is not sound by attacking (P1). I hold that no general supervenient/resultance base has a robust enough configuration of contextual features as to ground the existence of true moral principles. If I am right about this, I think it would be indicative of a reason to be less confident about the truth of principlism and more confident about the truth of particularism. (shrink)

Tom Beauchamp and I were asked by the editors of The Journal of Medicine and Philosophy to prepare “intellectual autobiographies,” with particular attention to sources and influences on our work, including but not limited to Principles of Biomedical Ethics. Of course, it is artificial and even impossible to try fully to separate the “intellectual” from other aspects of our lives. So, while emphasizing the “intellectual” aspects of my autobiography, I have attended to other aspects, too. The huge debts of gratitude (...) This paper presents a dilemma for the additive model of reasons. Either the model accommodates disjunctive cases in which one ought to perform some act $$\phi $$ just in case at least one of two factors obtains, or it accommodates conjunctive cases in which one ought to $$\phi $$ just in case both of two factors obtains. The dilemma also arises in a revised additive model that accommodates imprecisely weighted reasons. There exist disjunctive and conjunctive cases. Hence the additive model (...) is extensionally inadequate. The upshot of the dilemma is that one of the most influential accounts of how reasons accrue to determine what we ought to do is flawed. What role do the first principles of morals play in Reid's moral theory? Reid has an official line regarding their role, which identifies these principles as foundational propositions that evidentially ground other moral propositions. I claim that, by Reid's own lights, this line of thought is mistaken. There is, however, another line of thought in Reid, one which identifies the first principles of morals as constitutive of moral thought. I explore this interpretation, arguing that it is a fruitful way of (...) understanding much of what Reid wants to say about the role of moral first principles and drawing some connections between it and recent work on moral nonnaturalism. Whereas most moral philosophers believe that the facts as to what we’re morally required to do are grounded by the facts about our moral reasons, which in turn are grounded by non-normative facts, I propose that moral requirements are directly grounded by non-normative facts. This isn’t, however, to say that there is no place in the picture for moral reasons. Moral reasons exist, and they’re grounded by moral requirements. Arguing for this picture of the moral sphere requires playing both offense (...) and defense; this article provides the defense. I defend this view against the objections that it must deny that one is generally blameworthy for having violated a moral requirement, that it implies the existence of genuine moral dilemmas, that it runs counter to an obviously true view of how moral deliberation should work, and that it cannot explain why it feels as though figuring about what one is morally required to do often takes the form of thinking about what one’s moral reasons are. According to the eligibility theory of meaning, often attributed to David Lewis, the referent of a predicate is the property that best balances the twin constraints of charity and eligibility, where eligibility is a function of metaphysical naturalness. This sort of metasemantics, which is motivated by its ability to resolve problems of indeterminacy and secure shared reference between disputing parties, can be somewhat friendly towards revisionary theories, since highly natural properties can act as “reference magnets,” securing our reference despite some (...) mismatch with usage. In this paper, I apply these considerations to normative ethics and argue that the theory of rule utilitarianism achieves a high balance of charity and eligibility. I proceed by comparing rule utilitarianism to two of its well-known rivals, act utilitarianism and Rossian pluralism. I show how the former achieves a high degree of eligibility but only at a significant cost of charity, while the latter does the opposite, fitting very nicely with our considered judgments but at the price of very low eligibility. Rule utilitarianism, on the other hand, strikes a good balance between these extremes; it assigns to our core moral term a relatively natural property without doing too much damage to our moral convictions. Thus, rule utilitarianism should be regarded as a promising moral theory by any philosopher who takes seriously considerations of eligibility and naturalness. (shrink)

Despite its several variations, the central position of equipoise is that subjects in clinical experiments should not be randomized to conditions when others believe that better alternatives exist. This position has been challenged over issues of which group in the medical or research community is authorized to make that determination, and it has been argued that informed consent provides sufficient ethical protection for participants independent of equipoise. In this paper I frame ethical participation in clinical research as a two-party decision (...) process involving offering and accepting participation under informed consent. Nine conditions are identified in which it is possible that potential participants and researchers or care professionals can rationally choose divergent actions based on identical understandings of the situation. Under such circumstances, researchers or care professionals cannot ethically substitute their understanding of equipoise in the situation for the patients’ choices, or vice versa. (shrink)

The aim of this article is to review the recent popularity of casuistry as a model of moral inquiry. I argue that proponents of casuistry do not endorse the particularist epistemology that seems to be implied by their position, and that this is why casuistry does not seem to present something really new in comparison to 'top-down' generalist approaches. I contend that casuistry should develop itself as a (moderately) particularist position and that the challenge for the defender of casuistry is (...) to come up with ideas that strengthen the ('intuitionist') model of rationality that underlies most forms of particularism. This paper presents a non-consequentialist defense of Rawls’s general conception of justice requiring that primary social goods be distributed so that the least share is as great as possible. It suggests that a defense of this idea can be offered within a Rossian framework of prima facie duties. The prima facie duty not to harm constrains people from supporting social institutions which do not leave their fellows with goods and resources above a certain threshold. The paper argues that societies in (...) accord with the Rawlsian general conception come closest to meeting this requirement. This way of arguing for the conception enables the defenders of the theory to elude standard objections offered by utilitarians, libertarians, and even other egalitarians. (shrink)

In this dissertation, I argue that all extant theories of prudential value are either a) enumeratively deficient, in that they are unable to accommodate everything that, intuitively, is a basic constituent of prudential value, b) explanatorily deficient, in that they are at least sometimes unable to offer a plausible story about what makes a given thing prudentially valuable, or c) both. In response to the unsatisfactory state of the literature, I present my own account, the Disjunctive Hybrid Theory or DHT. (...) DHT answers to and remedies each of the above inadequacies in a way that no other approach can. This account has the following general structure:Disjunctive Hybrid Theory (DHT): Thing x is basically good for person P if and only if x is either a) cared about (sufficiently and in the right way) by P, b) a bearer of (the right kind of) attitude-independent value, or c) both.Although it follows other recent accounts in combining elements from objective and subjective theories, DHT is a hybrid theory of a quite new kind. This is because it denies both subjective necessity (the constraint that, if thing x is to be basically good for person P, P must have some pro-attitude toward x) and objective necessity (the constraint that, if thing x is to be basically good for person P, x must have some attitude-independent value). I argue that the rejection of both necessity claims is called for if we are to move beyond the enumerative and explanatory limitations of existing accounts.I begin by outlining the general structure of DHT. I then argue, against various recent authors, that desire-satisfactionism remains the most appealing subjectivist approach to prudential value, in that it is best able to capture the central subjectivist insight. This insight is that a person can confer prudential value upon things by caring about them (sufficiently and in the right way). The subjectivist strand of DHT will thus be a version of desire-satisfactionism, which must be interpreted in line with what I call the object, as opposed to the combo, view. I move on to further motivate and develop the second, objectivist strand of DHT. This part of the theory involves a commitment to robustly attitude-independent prudential goods. I close by addressing some puzzles for the theory, and considering some of its more specific applications. (shrink)

This article explores the characteristics and problems of moral pluralism, a model of theory of obligation in normative ethics according to which (1) there is a plurality of basic moral principles; (2) these different principles may conflict with one another; (3) there is no strict order of priority for resolving conflicts between them. The author argues that this kind of theory satisfies better than competing proposals the requirement of conformity with our reflexive intuitions and, while not having a general resolution (...) procedure, is able to settle the problem of conflict between the principles. He concludes pointing out that, despite all that can be done to improve conflict resolution methodologies, some margin of indeterminacy in moral theories is inevitable. And it is good that there is. Moral theories should not be a handbook of answers to be applied mechanically, without leaving room for autonomy of judgment by the evaluating subject. (shrink)

If one is in a moral quandary it is wise to look for ethical guidance if one has the time to do so. Ethical theories are, among other things, intended to be one possible source of ethical guidance. If such guidance is valuable, then in ethics there is an embarrassment of riches: There are multiple, well-accepted, yet mutually inconsistent theories. The disquieting thing is that, at present, it seems that we are not at all close to being able to determine (...) which of them, if any, is right. How can you know what you should do when ethicists, those who devote their careers to studying such theories, cannot reach a consensus on which one we should accept? Those who look to ethical theories for ethical guidance are apt to be disappointed. This situation is problematic, for if ethical theorizing is to have relevance to real-world ethical behavior, and not just be a way of examining ethical issues out of a love of arguments or puzzles, it must be possible for us to use ethical theories to inform ourselves of what we should do. It seems that philosophers have usually tried to address the issue of how one should act by advancing arguments for or against these theories (or certain parts of them). I want to approach this issue from a different angle. The question I will address is this: Can you get ethical guidance about what you should do in certain situations without knowing, or even having good reasons to believe, that any particular ethical theory is right? I think there is. My idea is that if you compare all the viable ethical theories that you know of, and find that all, or at any rate a great majority of them agree about whether an action you’re considering is right, wrong, or permissible, then you know that it is at least highly probable that that action really is right, wrong, or permissible. For if all ethical theories agree about the moral status of an action, it can only fail to have that status if they are all false. And if a great majority of ethical theories agree about the moral status of an action, it can only fail to have that status if all of the theories that agree about its status are false, which becomes more and more improbable as the number of the theories that agree increases. If this approach works, there is a way that one can be guided by ethical theories without having to attempt the difficult task of determining which of them is right. (shrink)

Rossian moral pluralism’s rejection of a founding moral principle and use of ‘prima facie duties’ as opposed to absolute duties makes it unique from most other major ethical theories. It has been attacked in a myriad of different ways because of this. Brad Hooker has proposed two objections based on these ideas. The first is that moral pluralism is lacking justification because of its rejection of a founding moral principle. The second is that because of this, and its lack of (...) absolute duties, moral pluralism is an indeterminate theory. In this paper I will look at Hooker’s objections as well as two responses that have been proposed as solutions. Having shown these solutions to be insufficient I will then propose a way to look at Ross’ moral pluralism that saves it from Hooker’s objections and clearly lays out Ross’ understanding of how we should deliberate about moral matters.
