The paper distinguishes between two conceptions of kinds defined by constitutive rules, the one suggested by Searle, and the one invoked by Williamson to define assertion. Against recent arguments to the contrary by Maitra, Johnson and others, it argues for the superiority of the latter in the first place as an account of games. On this basis, the paper argues that the alleged disanalogies between real games and language games suggested in the literature in fact don’t exist. The paper relies (...) on Rawls’s distinction between types of practices and institutions defined by constitutive rules, and those among them that are actually in force, and hence are truly normative; it defends along Rawlsian lines that a plurality of norms apply to actual instances of rule-constituted practices, and uses this Rawlsian line to block the examples that Maitra, Johnson and others provide to sustain their case. This paper continues the discussion of three values of sport (safety, fairness, inclusion) that has developed around the theme of inclusion of transwomen in the female category in World Rugby, as discussed by Pike, Burke and Imbrišević. In contrast to their discussion, in which these three values have been seen from the limited perspective of the inclusion of one group of athletes into a specific category of one sport, they are here discussed in the context of the categorization in sport (...) in general, with a focus on constitutive and eligibility rules. Constitutive rules give a strong foundation for eligibility rules. From the perspective of eligibility rules, the value of inclusion is identified as the underlying main value, while fairness and safety are its functions. This view rehabilitates the value of inclusion and has implications for how we think about the inclusion of athletes in sport, and for the creation of categories. (shrink)

ABSTRACTBernard Suits and other formalists endorse both the logical incompatibility thesis and the view that rule-breakings resulting in penalties can be a legitimate part of a game. This is what Fred D’Agostino calls ‘the problem of penalties’. In this paper, I reject both Suits’ and D’Agostino’s responses to the problem and argue instead that the solution is to abandon Suits’ view that the constitutive rules of all games are alike. Whereas the logical incompatibility thesis applies to games in which players’ (...) actions are perfectly controlled, it does not apply to sports. This insight not only justifies the rejection of formalism as a theory about the nature of sport but it also helps explain the greater normative complexity of sports, which in turn leads to the idea that in sports ‘cheating’ should be interpreted as a genus. Sport occupies a significant role in modern society and has a wide following. In his Leftist Theories of Sport, Morgan examines what he considers to be a degradation of modern sport and the lack of proper critical theory to address this challenge. In the latter part of LTS, Morgan presents a reconstructed critical theory with ‘a liberal twist’ in terms of an analysis of what he sees as the internal ‘gratuitous’ logic of sport, and a call for critical deliberation in (...) sporting practice communities. I depart from Morgan’s ideas of the ‘gratuitous’ logic of sport which, I believe, has significant potential and operative force. I interpret the logic of sport as forms of self-imposed constraints at three levels: in the logic of the rules, in norms for fair play, and in a particular interpretation of sporting excellence as a form of human excellence. There are well-known problems for formalist accounts of game-play with regards to cheating. Such accounts seem to be committed to cheaters being unable to win–or even play–the game, yet it seems that there are instances of cheaters winning games. In this paper, I expand the discussion of such problems by introducing cases of pre-game cheating, and see how a formalist–specifically a Suitsian–account can accommodate such problems. Specifically, I look at two (fictional) examples where the alleged game-players cheat prior to a (...) game-instance in such as a way as to cast doubt on whether the alleged game-players are truly playing the game. To escape the worries brought about by these examples of pre-game cheating, I will appeal to the concept of nested games. This concept will give us the needed tools to explain how the alleged players are cheating and how the alleged players are players. On the whole, this discussion should help illuminate some important issues with regards to cheating and rules on a Suitsian account of game-play, and help give support for formalist accounts more generally. We present and defend a view labeled “practiceism” which provides a solution to the incompatibility problems. The classic incompatibility problem is inconsistency of:1. Someone who intentionally violates the rules of a game is not playing the game.2. In many cases, players intentionally violate the rules as part of playing the game.The problem has a normative counterpart:1’. In normal cases, it is wrong for a player to intentionally violate the rules of the game.2’. Unlike Dickens’s novel, this is not a tale of light and darkness, order and chaos, good and evil… It is, though, a story worth to be told about two standpoints about games and sports, teaching and research, physical education simply put, that have pursued similar interests on parallel tracks for too long, despite their apparent closeness and expected shared cultural grounds. The objective of this conceptual analysis is to try and reconcile two perspectives, namely motor praxeology and teaching games for (...) understanding (TGfU), born in the last third of the XX century in France and England with the intention to rethink the foundations of physical education (PE) and sports teaching. Pierre Parlebas, from the French side of the English Channel, claimed in 1967 that sports make part of PE, that team sports must be considered from a specific, sociomotor point of view, and that motor conducts (i.e. the significative organization of motor behaviour), not sports techniques, are the corner-stone of PE and sports coaching. In the early 1980s, from the English side of La Manche, Almond, Thorpe, and Bunker made a plea for a shift in the way to teach games (sporting collective duels mostly), deeply concerned by the negative impact of the traditional technics-centred approach on motivation, competence and attained level of the least able in school situations. Our conclusion is that TGfU, or game-based approaches to sports coaching and teaching, can take great advantage of the motor-praxeological rationale for three reasons: firstly, because concepts like understanding, game sense and action principles are operatively, semiotically linked to the reality of the playing process; secondly, because the inner structures of the games that constrain players and guide their motor conducts, permit to integrate games in the general system of sporting games, no matter their level of institutionalisation; finally, because the intervention practice is better thought of and more systematically developed upon the operational concepts of internal logic and expected practical effects of game playing. A commonly accepted feature of commonsense morality is that there are some acts that are supererogatory or beyond the call of duty. Recently, philosophers have begun to ask whether something like supererogation might exist in other normative domains such as epistemology and esthetics. In this paper, I will argue that there is good reason to think that sporting supererogation exists. I will then argue that recognizing the existence of sporting supererogation is important because it highlights the value of sport as (...) a mutual pursuit of excellence and reinforces the value of sportsmanship. The first goal of this paper is to reply to a number of criticisms levied by Gunnar Breivik and Robert L. Simon against an account of sporting skills I published almost 20 years ago in which I distinguished between constitutive and restorative skills and examined their normative significance. To accomplish this goal, I first summarize my characterization and classification of skills and then detail the criticisms. After responding to the latter, and thus reconsidering and hopefully strengthening my account of skill (...) in sport, I turn my attention to Scott Kretchmar and Tim Elcombe’s inquiry into the skills involved in competitive sport. These authors claim that contesting skills demand the same respect usually accorded to testing skills. The second goal of this paper is then to explore Kretchmar and Elcombe’s inquiry under the light of my reconsidered analysis of skill. I specifically advocate a plausible relationship, both in terms of their distinctive character and relative import, between testing and contesting skills and constitutive and restorative skills. In doing so, I seek to present a more comprehensive account of skill in non-competitive and competitive sport. (shrink)

Almost four decades ago, Kathleen Pearson examined deceptive practices in sport using a distinction between strategic and definitional deception. However, the complexity and dynamic nature of sport is not limited to this dual-categorization of deceptive acts and there are other features of deception in sport unaccounted for in Pearson's constructs. By employing Torres’s elucidation of the structure of skills and Suits's concept of the lusory-attitude, a more thorough taxonomy of in-contest sport deception will be presented. Despite the ubiquitous presence of (...) deception in sport, few scholars have examined this concept in the sport philosophy literature since Pearson’s contribution. This paper hopes to advance a deeper understanding of deceptive practices in competitive sport and also comment on the ethical permissibility of certain sport skills from a moral perspective. In life there can be good reasons to break the rules. Some sports philosophers have suggested that this also holds for games. In this essay I will compare and contrast reasons for rule-breaking in life and in sports. Some of my focus will be on recent attempts to defend strategic fouling (by Eylon & Horowitz, Russell, and Flynn). Supporters of strategic fouling try to provide a philosophical underpinning for the practice, but they ignore the genealogy of such rule-violations. I will (...) also discuss how some legal theorists view rule-breaking and contrast this with sport. Lastly, I will introduce the idea of ‘transcendental rules’ in games. They are the conditions for the possibility of playing a game. Following Aurel Kolnai, I will argue that strategic fouling violates a transcendental rule – it is not just a moral error, it is also a conceptual error. (shrink)

I argue that in purely professional games of pure chance, such as slot machines, roulette, baccarat or pachinko, any instance of cheating that successfully deceives the judge can be ‘part of the game’. I examine, and reject, various proposals for the ‘ethos’ that determines how we ought to interpret the formal rules of games of pure chance, such as being a test of skill, a matter of entertainment, a display of aesthetic beauty, an opportunity for hedonistic pleasure, and a fraternal (...) activity. Ultimately, I argue that ‘winning the benefit’ is the only ethos that can apply in purely professional games of pure chance, and that if we interpret the formal rules according to this ethos, cheating that is undertaken with respect for the judge’s authority, but that attempts to cause the judge of the game to ‘voluntarily’ relinquish the benefit of the game by deceiving them into thinking that the formal rules of the game have been followed, is impermissible but acceptable cheating, and is therefore within, rather than outside, the game. Here, I define ‘games of pure chance’ as games in which chance is the only determinant of winning. (shrink)

Given Bernard Suits’ stature in the philosophy of sport, his take on strategic fouling, surprisingly, hasn’t been given much attention in the literature. Rather than relying on a purely empirical or ‘ethos’ approach to justify the Strategic Foul he provides a mixed justification. Suits’ account combines a priori and a posteriori elements. He introduces a third kind of rule, which appears to be unlike rules of skill or constitutive rules, into his conceptual scheme. Suits claims that it is sometimes tactically (...) correct to break such a rule in order to gain an advantage. I will argue that the a priori element in his justification of strategic fouling is unconvincing because there is nothing special about ‘third type’ rule-violations, which incur a ‘fixed penalty’. Furthermore, the a posteriori element ultimately reduces to a rule of skill, and it is doubtful whether it has sufficient normative force to warrant breaking a rule. But, most importantly, the a posteriori element degrades the power of the a priori element. (shrink)

ABSTRACT It is argued that sport, like science or medicine, is a valued human practice and is characterised as much by the moral manner in which its participants conduct themselves as by the pursuit of its own skills, standards and excellences. Virtues, such as justice, honesty and courage, are not only necessary to pursue its goals but to protect it from being corrupted by external interests. After explicating the practice view of sport in contrast to the sociological view, the nature (...) of competition in sport is discussed before examining two related issues: winning at all costs and the taking of performance-enhancing drugs. In recent years it has become increasingly the norm in football1 to kick the ball out of play when a player is, or appears to be, inadvertently injured. Kicking the ball out of play in football represents a particular instantiation of a generally understood fair play norm, the voluntary suspension of play (VSP). In the philosophical literature, support for the VSP norm is provided by John Russell (2007) who claims that his interpretivist account of sport is helpful for evaluating complex (...) moral issues in sport in general and issues related to injury in football in particular. This paper examines whether Russell's interpretivist-backed account of autonomy can adequately inform football players as to the nuanced and ambiguous moral considerations that arise in relation to the VSP norm. The paper goes on to identify the highly complex dynamic circumstances football players need to consider in order to better discharge their moral responsibilities when faced with inadvertent injuries. Traditionally, acts of sportsmanship have been upheld as worthy of praise. The purpose of this paper is to discern whether Bernard Suits’ Grasshopper -- in "The Grasshopper: Games, Life and Utopia" -- would share this approval. The paper begins with a conceptual analysis of good sportspersonship. From this, four action categories are identified including good sportspersonship in the forms of game desertion, changing the game, not trying, and lusory self-handicapping. A strategy for evaluation is derived from the Grasshopper’s theory. Game-playing (...) is defined as action reflecting lusory attitude acknowledgement. Game-spoiling is introduced as action demonstrating lusory attitude abandonment. Three of the four actions categories are characterized as game-spoiling including good sportspersonship in the forms of game desertion, changing the game, and not trying. It is concluded that genuine good sportspersonship is characterized solely by altruistic forms of lusory self-handicapping. (shrink)

Wittgenstein did not claim that the ordinary language concept ‘game’ cannot be defined: he claimed that there are multiple definitions that can be adopted for special purposes, but no single definition applicable to all games. I will defend this interpretation of Wittgenstein’s position by showing its compatibility with a pragmatic argumentative view of definitions, and how this view accounts for the diversity of disagreeing game definitions in definitional disputes.

As sports have become more professional, winning has become more important. This emphasis on results, rather than sporting virtue and winning in style, probably explains the rising incidence of the Strategic Foul. Surprisingly, it has found some apologists among the philosophers of sport. The discussion of the Strategic Foul in the literature has produced subtle distinctions (e.g. Cesar Torres: constitutive skills versus restorative skills) as well as implausible distinctions (e.g. D’Agostino: ‘impermissible’ but ‘acceptable’ behaviour). This article is an examination of the recent contribution in this journal by Kreider. In that publication he argued against formalist and non-formalist positions concerning our understanding of game-player and game-playing, focusing his discussion around game rules and their relationship to the two key concepts. This led him to produce alternative conceptions of game-player and game-playing, and it is these conceptions tied closely to the idea of commitment, and Kreider’s arguments surrounding them, which are the subject of my article. Following (...) an introduction, I summarize and evaluate Kreider's dissatisfaction with earlier accounts. Then I present and examine key aspects of his proposals for a different understanding of game-players and game-playing. While I remain uncertain about some of his claims, overall my conclusions are characterized more by disagreement with him than by a sense that he has overcome problems previously expressed theories contain. This paper explores how the phenomenon of Joint Attention (JA) drives certain core features of team sport and how sport illuminates the nature of JA. In JA, two or more agents focus on the same object in mutual awareness that the content of their experience is thus shared. JA is essential to joint sporting actions. The sporting context is particularly useful for illustrating the phenomenon of JA and provides a valuable lens through which to examine rival theoretical accounts of its (...) workings. This paper draws novel connections between the respective philosophical literatures on JA and sport, suggesting prospects for mutually advantageous cross-pollination. I contend that the workings of JA within joint sporting action are misconstrued on intellectualistic and individualistic theories which posit reductive explanations in terms of the contents of individual minds. The best evidence and strongest philosophical arguments support ‘relational’ accounts whereby joint sporting actions exceed the sum of their parts. I reject the ‘extensionalist’ contention, associated with ‘lean’ versions of the relationalist approach, that objects of JA are individuated in terms of causal properties not sensitive to how they are perceived. Siding instead with ‘rich’ versions of the view, I argue that team collaboration depends on convergence in terms of the ‘aspectual shape’ of the objects of JA. Finally, a further possible application for these ideas is suggested: that JA plays a central role in the constitution of sport-specific kinds. On this proposal, JA facilitates collective perceptual recognition of particular objects and situations as embodying the general types described in the rulebook, playing an important role in creating and sustaining the public ‘social space’ of sporting competition. A paradoxical attitude exists toward professional philosophy: philosophical inquiry is considered important and complex, but professionals are deemed irrelevant and unnecessary. This paradox doubly affects sport philosophy as evidenced by the field’s marginalization in higher education and sociopolitical discourse. To counter the sport philosophy paradox, I present a pragmatically oriented three-dimensional approach to inquiry that turns the field “inside-out”. A community of engaged, melioratively oriented sport philosophy inquirers in this 3D model collectively conducts theoretical, applied, and instrumental inquiry. UEFA’s Financial Fair Play regulations represent the most restrictive regulatory intervention European club football has ever seen. Put simply, it demands from clubs to operate on the basis of their own football-related incomes. While the policy has attracted considerable attention from the economic and social sciences, very few contributions systematically investigate it from a philosophical-ethical perspective. The present paper fills this research gap by posing questions on FFP in relation to fair play as a normative concept. We draw on sport (...) economic assessments concerning potential outcomes of FFP and argue that the policy should go beyond the mere pragmatic goal of promoting financial sustainability and truly aim for creating a level playing field, otherwise it should not be labeled ‘fair play’. En este artículo analizaremos el impacto que el libro de Alasdair MacIntyre Tras la virtud ha tenido en el ámbito de la filosofía del deporte. Nuestro punto de partida será que los filósofos del deporte han diferenciado entre propuestas internalistas y externa-listas del deporte siguiendo la distinción de MacIntyre entre bienes internos y externos a las prácticas sociales. Con el fin de mostrar si esta apropiación del lenguaje de MacIntyre es adecuada, responderemos a la pregunta de si el deporte actual (...) puede ser considerado una práctica social en sentido macintyreano. Defenderemos que sólo el deporte amateur encaja con la definición de “práctica social” de modo que nuestro deporte contemporáneo no puede ser considerado como tal. Según esto, defenderemos que, en tanto que el paradigma internalista y externalista es una consecuencia de la recepción de la obra de MacIntyre, la filosofía del deporte debe ir más allá de este paradigma dualista hacia uno que no esté fundado en los conceptos de práctica social y bienes internos del filósofo escocés. "Sport, Tradition and Freedom" entails a philosophical examination of the relationship between traditions of rationality and understandings of freedom in sport. Chapter One introduces the ideas of freedom and virtue. Chapter Two involves a critical and historical exploration of the traditions of conservatism, liberalism and Marxism and the effects that these traditions have had on accounts of freedom in sport. Chapter Three examines the issue of freedom in sport from a social critical-formalist perspective, particularly addressing the influence that the process (...) of commodification in advanced capitalism has had on sport. It also endeavours to suggest that the virtues, as explained by Alisdair Maclntyre, are important to the protection of formal freedom in sport, from the effects of advanced capitalism. Chapter Four examines the link between the modern liberal tradition and the virtue tradition. This link is made via the ideas of self-determination and authentic social unions which both traditions share. This chapter also investigates the influence that these various traditions have had on the framing and solution to issues in sport, using the drug issue as a paradigm case. The conclusion suggests that it may be profitable to explore the rationality of less dominant traditions in society when investigating sport. Inquiry revealed that many traditions of understanding in sport rely heavily on elements from political traditions in society. Freedom in sport has been linked to conservative notions of a craft, to liberal notions of play and the independent individual and to accounts of freedom which support the dominant capitalist institutions of society. The examination by social critical theorists of the freedom of authentic social practices and the location of this freedom in the formal rules of sport, provided an alternative to these previous explanations which had located freedom in either the attitude of the player or the economic institutions of society. On the formalist view of sport, freedom is located in the pursuit of gratuitous difficulty, which the rules of sport make possible. The protection of this freedom from social abrogation involves virtue, the formation of authentic social unions, and judgement in sporting participation. The concluding chapter suggested that the protection of formal freedom and the importance of judgement and "seeing without illusion" in sport is critical to issues such as feminism, professionalism and creativity in sport. The idea that cheaters cannot (really) win in sports persists among philosophers, mainly due to the lingering influence of Bernard Suits’ logical incompatibility thesis. In this article I explain why the thesis does not apply to sports. I argue that the question whether cheating can be prohibited in sports is empirical rather than analytic, as is the case for games subject to the thesis. Thus, sports rules do not make cheating impossible and since game officials cannot always detect cheating and (...) punish cheaters, cheating is a part of sports and cheaters sometimes win. Even if advances in technology made it impossible for cheaters to evade detection, since in-game officials will never know whether their attempts to provide restorative justice to those victimized by acts of cheating are successful, and since cheaters exploit this fact, it follows that not only is cheating a part of sports, but it always will be. In this work I offer a panorama of the diverse areas where the philosophical reflection has been developed during these last years: the conceptual, ethical and aesthetic questions. The conceptual problems of the sport have turned around: 1) game and sport; 2) the paper of the rules and the values in the sportive normative system; 3) the competitive character and playful of the sport. The more debated ethical questions have been: 1) sport and gender; 2) sport and nationalism; 3) sport (...) and violence. (shrink)

The aim of the paper is confronting internal or intrinsic values of sport detected by different sport-philosophers, such as W. J. Morgan, J. S. Russell, R. L. Simon, N. Dixon, S. Kretchmar, to today’s bio-technologized sports in order to find the ethical guidance for (non)acceptance of new bio-technologies in sport. Thus, in the first part, I will produce an overview of the internal values of sport in the sports-philosophical literature. In the second part, I will provide my understanding of ‘bio-technologized (...) sports’, leaning mostly on W. J. Morgan’s and S. Loland’s previous work in this regard. In the third part, I will show that the key internal value of sport is ‘excellence’ and that the perfectionist account of sport dominates high-level professional competitive sports. However, I will show that ‘excellence’ is prone to different interpretations and understandings which (could) have different implications for the ‘bio-technologized sport’. Finally, I will propose going back to Aristotle and his account of _eudaimonia_ to build principles for the regulation of (non)acceptance of bio-technology in sport. (shrink)
