Priority setting in health care is ubiquitous and health authorities are increasingly recognising the need for priority setting guidelines to ensure efficient, fair, and equitable resource allocation. While cost-effectiveness concerns seem to dominate many policies, the tension between utilitarian and deontological concerns is salient to many, and various severity criteria appear to fill this gap. Severity, then, must be subjected to rigorous ethical and philosophical analysis. Here we first give a brief history of the path to today’s severity criteria in (...) Norway and Sweden. The Scandinavian perspective on severity might be conducive to the international discussion, given its long-standing use as a priority setting criterion, despite having reached rather different conclusions so far. We then argue that severity can be viewed as a multidimensional concept, drawing on accounts of need, urgency, fairness, duty to save lives, and human dignity. Such concerns will often be relative to local mores, and the weighting placed on the various dimensions cannot be expected to be fixed. Thirdly, we present what we think are the most pertinent questions to answer about severity in order to facilitate decision making in the coming years of increased scarcity, and to further the understanding of underlying assumptions and values that go into these decisions. We conclude that severity is poorly understood, and that the topic needs substantial further inquiry; thus we hope this article may set a challenging and important research agenda. (shrink)

Karsten Schubert liefert die erste systematische Rekonstruktion der sozialphilosophischen Debatte um Freiheit bei Foucault und eine neue Lösung für das Freiheitsproblem: Freiheit als die Fähigkeit zur reflexiven Kritik der eigenen Subjektivierung – kurz: Freiheit als Kritik – ist das Resultat von freiheitlicher Subjektivierung in politischen Institutionen. Der Band zeigt so die Konsequenzen von Foucaults Freiheitsdenken für die Demokratietheorie und die allgemeine sozialphilosophische Freiheitsdiskussion auf.

Identity politics is commonly criticized as endangering democracy by undermining community, rational communication, and solidarity. Drawing on both radical democratic theory and standpoint theory, this article posits the opposite thesis: identity politics is pivotal for the democratization of democracy. Democratization through identity politics is achieved by disrupting hegemonic discourse and is, therefore, a matter of power, while such forms of power politics are reasonable when following minority standpoints generated through identity politics. The article develops this approach by connecting radical democratic (...) theories with standpoint theories and highlighting their commonalities and potential for mutual enhancement. Standpoint theory allows us to substantiate and reconcile two initially contradictory claims: particular minority standpoints are necessary to criticize the prevailing discursive and institutional orders, and these standpoints stem from intersubjective reason and embody ‘strong objectivity.’ This discussion presents a new perspective on the tension between particularity and universality, as well as the relationship between power and reason in democracy. Democratization is an oscillation between these polarities, and political theory should not aim to resolve this tension but to recognize and articulate it. Such recognition might involve elevating knowledge emerging from oppressed groups and exercising epistemic modesty when assessing specific forms of identity politics. (shrink)

Foucault's theory of power and subjectification challenges common concepts of freedom in social philosophy and expands them through the concept of 'freedom as critique': Freedom can be defined as the capability to critically reflect one's own subjectification, and the conditions of possibility for this critical capacity lie in political and social institutions. The article develops this concept through a critical discussion of the standard response by Foucault interpreters to the standard objection that Foucault's thinking obscures freedom. The standard response interprets (...) Fou-cault's later works, especially The Subject and Power, as a solution to the problem of freedom. It is mistaken, because it conflates different concepts of freedom that are present in Foucault's work. By differentiating these concepts, this paper proposes a new institutionalist approach to solve the problem of freedom that breaks with the partly anarchist underpinnings of Foucault scholarship: As freedom as critique is not given, but itself a result of subjectification, it entails a demand for 'modal robustness' and must therefore be institutionalized. This approach helps to draw out the consequences of Foucault's thinking on freedom for postfoundationalist democratic theory and the general social-philosophical discussion on freedom. (shrink)

Phillips argues that blindsight is due to response criterion artefacts under degraded conscious vision. His view provides alternative explanations for some studies, but may not work well when one considers several key findings in conjunction. Empirically, not all criterion effects are decidedly non-perceptual. Awareness is not completely abolished for some stimuli, in some patients. But in other cases, it was clearly impaired relative to the corresponding visual sensitivity. This relative dissociation is what makes blindsight so important and interesting.

In this paper I respond to Mathias Risse's objections to my critique of his views on racial profiling in Philosophy and Public Affairs. I draw on the work of Richard Sampson and others on racial disadvantage in the USA to show that racial profiling likely aggravates racial injustices that are already there. However, I maintain, clarify and defend my original claim against Risse that racial profiling itself is likely to cause racial injustice, even if we abstract from unfair background (...) conditions. I then respond to Levin's claims that there is no serious racial injustice in the contemporary USA and differentiate between Risse's attempt - albeit unsuccessful - to provide an egalitarian justification for racial profiling from the frankly inegalitarian assumptions that underpin the claims of Michael Levin. One problem often associated with identity politics is “positional fundamentalism,” the equating of social positions with epistemic possibilities and political dispositions. The criticism is that identity politics is usually more about who says something than what is said. This goes hand in hand with perspective relativity, which no longer allows for a common, universal position and therefore also prevents emancipative politics. To respond to this critique of positional fundamentalism and perspective relativism, I develop a new account of identity politics as (...) inherently intersubjective and fundamental to democracy. This approach is necessary to address the philosophical problem at the heart of debates about identity politics: the tension between particularist power politics, on the one hand, and politics as a universalist appeal to reason, on the other. In der sozialphilosophischen Debatte um Freiheit bei Foucault wird das ‚Freiheitsproblem‘ verhandelt: Wie können Freiheit und Widerstand innerhalb von Foucaults Theorie der Macht und Subjektivierung konzipiert werden? Die Arbeit unterscheidet systematisch vier verschiedene Interpretationsstrategien von Foucaults Werk, die es als kohärente sozialphilosophische Theorie konstruieren und dabei das Freiheitsproblem lösen sollen; sie rekonstruiert die Arbeiten von exemplarischen Vertreter_innen dieser Strategien: 1. Foucault ist kohärent (Paul Patton), 2. Foucault korrigiert sich (Thomas Lemke), 3. Foucault kritisiert kohärent (Martin Saar), 4. Foucault ist nicht (...) genug (Amy Allen). Das erste Ziel der Arbeit ist, die Debatte und die in ihr verhandelten Probleme und Begriffe durch die systematische Rekonstruktion zu differenzieren und klarer zu fassen. Dafür werden einige neue systematische Unterscheidungen entwickelt: u.a. das Freiheitsproblem der Machtdetermination im Gegensatz zum Freiheitproblem der Subjektivierung, Freiheit als Anders-handeln-Können im Gegensatz zu Freiheit als Kritik, verschiedene Modalitäten dieser Freiheitsbegriffe und eine Foucault-Lesart der Regierungstranszendenz im Gegensatz zu einer Lesart der radikalen Immanenz. Das zweite Ziel der Arbeit ist die Entwicklung einer neuen These zur Freiheit im Rahmen einer Subjektivierungstheorie durch die interne Kritik der vier Interpretationsstrategien auf Grundlage der dort entwickelten Differenzierungen. Freiheit als die Fähigkeit zur reflexiven Kritik der eigenen Subjektivierung ‒ kurz: Freiheit als Kritik ‒ kann verstanden werden als das Resultat von freiheitlicher Subjektivierung, deren gesellschaftlicher Ort politische Institutionen sind, die im Rahmen einer postfundamentalen, pluralen und liberalen politischen Theorie bestimmt werden können. Drittens verfolgt die Arbeit das Ziel, durch den Begriff der Freiheit als Kritik die allgemeine sozialphilosophische Debatte um Freiheitsbegriffe zu erweitern und ihn als einen Kandidaten neben der negativen, reflexiven und sozialen Freiheit zu präsentieren, der einerseits plausible Einsichten dieser drei Ansätze aufnimmt und andererseits ihre blinden Flecken korrigiert. This essay considers how scholarly approaches to the development of molecular biology have too often narrowed the historical aperture to genes, overlooking the ways in which other objects and processes contributed to the molecularization of life. From structural and dynamic studies of biomolecules to cellular membranes and organelles to metabolism and nutrition, new work by historians, philosophers, and STS scholars of the life sciences has revitalized older issues, such as the relationship of life to matter, or of physicochemical inquiries to (...) biology. This scholarship points to a novel molecular vista that opens up a pluralist view of molecularizations in the twentieth century and considers their relevance to current science. (shrink)

Wissenschaftsfreiheit wird vorherrschend als Freiheit der Wissenschaft von politischer Einmischung verstanden. Der Artikel kritisiert dieses negative Verständnis von Wissenschaftsfreiheit anhand einer Analyse seines prominentesten Vertreters, dem Netzwerk Wissenschaftsfreiheit, das damit eine Politisierung einseitig den Vertreter*innen gesellschaftskritischer Ansätze zuschreibt, während es die eigene Position als ‚rein wissenschaftlich‘ und politisch neutral dargestellt. Demgegenüber schlägt der Artikel ein kritisches Verständnis von Wissenschaftsfreiheit vor, das seine Politizität reflektiert. Ausgehend von der Analyse, dass starre Macht- und Privilegienstrukturen das zentrale Hindernis für die gemeinsame Arbeit an (...) wissenschaftlicher Objektivität sind, geht es beim kritischen Begriff der Wissenschaftsfreiheit um die Reflexion und Transformation des Verhältnisses von Wissenschaft und Politik. Dabei steht die Diversifizierung von Zugangschancen und Standpunkten innerhalb der Wissenschaft im Mittelpunkt – also die Neuverteilung von Macht und Privilegien. Der Artikel entwickelt dieses Verständnis aus einer Diskussion des Verhältnisses von Wissenschaft und Politik in zwei philosophischen Begründungsmöglichkeiten der Wissenschaftsfreiheit und aus einer Rekonstruktion der kritischen politischen Theorie, insbesondere der foucaultschen Machttheorie und der feministischen Standpunkttheorie. Er zeigt auf dieser Grundlage, dass drei verschiedene Arten der Diversifizierung der Wissenschaft – intern, extern-institutionell und extern-aktivistisch –, die vom vor dem Hintergrund des negativen Begriffs als Einschränkung der Wissenschaftsfreiheit verstanden werden, tatsächlich zu ihrer Verbesserung beitragen. -/- . While ‘cancel culture’ is commonly regarded as limiting freedom of speech and artistic freedom, this article proposes a new understanding of ‘cancel culture’ as emancipatory norm-setting that is key for democratization. On a non-governmental level of the self-regulation of the art world, the argument for artistic freedom ignores the fact that art is permeated by power. The introduction of ‘politically correct’ norms leads to a justified redistribution of such power. On a parastatal level of public broadcasting and state cultural funding, (...) neutrality is necessary but should be understood materially to include marginalized voices. Restrictions of freedom of speech and artistic freedom do occur on the state-level of hate-speech regulation. Here, the danger of a potential shift from emancipatory regulation to a harmful restriction is particularly virulent, as a discussion of the German BDS ban shows. (shrink)

In this short survey, I show that one can argue that Peirce’s reception is just starting, with a strong scholarship that has been developing in the last thirty years in France, even if the reception dates, as in Peirce’s own country, back to the 1870s, after a kind of Peircean “craze” in the 1960s and 1970s.

A common objection to a pragmatist perspective on scientific expertise is that, while there is a well-known pragmatist theory of inquiry, which was formulated first by Peirce, then refined by Dewey and others, this theory cannot provide a clear-cut account of scientific expertise. In this paper, after addressing this objection in the second section, I claim that, on the contrary, pragmatism offers robust tools to think scientific expertise. In Sections 3 to 7, I present five important insights that one can (...) derive from a pragmatist epistemology when responding to contemporary problems posed by expertise: about science and scientific expertise in a legal context (sections 3 and 4), about collective expertise (sections 5 and 6), and even about expertise on ignorance (section 7). La thèse du présent article est que l’opposition factice entre James, repré- sentant supposé des « relations externes », d’une part, et Bradley, représen- tant supposé des « relations internes », d’autre part, est due à une mauvaise appréhension des thèses de ce dernier. Ce premier contresens conduit alors à manquer le propos même de James.

Identitätspolitik ist die politische Praxis von marginalisierten und diskriminierten Gruppen, die sich in Bezug auf eine kollektive Identität gegen ihre Benachteiligung durch Strukturen, Kulturen und Normen der Mehrheitsgesellschaft wehren. Ein oft an Identitätspolitik kritisiertes Problem ist „positionaler Fundamentalismus“ (Villa Braslavsky 2020, S. 74), also das Gleichsetzen sozialer Positionen mit epistemischen Möglichkeiten und politischen Einstellungen. Die Kritik lautet, bei Identitätspolitik käme es meist mehr darauf an, wer etwas sagt, als was gesagt wird. Dies gehe mit Relativismus einher, der keine gemeinsame, universelle (...) Position mehr ermögliche und deshalb auch emanzipative Politik verhindere (Feddersen/Gessler 2021, S. 101ff., 208f.). Um auf diese Kritik des positionalen Fundamentalismus und Relativismus zu antworten, entwickle ich eine neue Darstellung der Identitätspolitik als inhärent intersubjektiv und grundlegend für die Demokratie. Dabei stütze ich mich auf die radikale Demokratietheorie und die feministische Standpunkttheorie. Dieser Ansatz ist notwendig, um das philosophische Problem zu lösen, das im Mittelpunkt der Debatten über Identitätspolitik steht: die Spannung zwischen partikularistischer Machtpolitik einerseits und Politik als universalistischer Appell an die Vernunft andererseits. Der Bund-Länder-Beschluss zu Weihnachten erlaubt „Treffen mit 4 über den eigenen Hausstand hinausgehenden Personen“, aber nur bezüglich Mitglieder des „engsten Familienkreis[es], also Ehegatten, Lebenspartnern und Partnern einer nichtehelichen Lebensgemeinschaft sowie Verwandten in gerader Linie, Geschwistern, Geschwisterkindern und deren jeweiligen Haushaltsangehörigen.“ Obwohl es bei diesen Regelungen gar nicht um die sexuelle Orientierung oder Geschlechtsidentität der Personen geht, sind sie dennoch heteronormativ, bevorteilen also solche Lebensformen, die nach den Normen klassischer heterosexueller Beziehungsmodelle funktionieren. Oder andersherum gesagt: Sie benachteiligen zwar Singles und Menschen (...) ohne klassische Familie unabhänging davon, ob sie hetero, schwul, lesbisch, trans* oder non-binary sind, aber sie werten darüber hinaus queere Lebensformen ab. Ein Grundprinzip der Demokratie ist die Gleichheit der Bürger_innen. Das Prinzip der Gleichheit ist zentral für demokratische Repräsentation. Es bedeutet, dass die Stimmen der Bürger_innen gleich viel zählen und dass ihre Interessen durch Repräsentant_innen möglichst gut abgebildet und vertreten werden. Es gilt sowohl für formale Repräsentation in den poli- tischen Institutionen, insbesondere bei Wahlen, als auch für sogenannte informelle Repräsentationsverhältnisse in der Öffentlichkeit, Kultur und Wissenschaft. Doch die real existierende Demokratie ist vom Ideal der Gleichheit weit entfernt. Sie ist asymmetrisch (...) und exkludierend. Die Stim- men privilegierter Menschen sind überrepräsentiert, während die Stimmen von diskriminierten Menschen unterrepräsentiert oder sogar ganz ausge- schlossen sind. (shrink)

Je montre dans ce texte que la thèse de Jean Wahl sur les Pluralistes d'Angleterre et d'Amérique n'est pas tant un tableau des pensées pluralistes qu'une problématisation du pluralisme. La révélation que Wahl va trouver à rebours de certains textes de William James, c'est celle d'un restant moniste, attentif au fond non relationnel de l'expérience, ce qui va le conduire à explorer, beaucoup plus hardiment que nombre de ses contempo- rains, les proximités entre James et Bradley. Cette voix moniste, que (...) l'on retrouverait derrière la lettre des «philosophies pluralistes», est le véritable enjeu de la thèse de 1920 qui, après un inventaire des critiques de l'unité abstraite, propose dans sa méditation conclusive une vision du monde dans laquelle, une fois la critique des abstractions du pluralisme opérée, subsiste ce sens du « particulier concret » qui en est la marque propre. Ce sera l'objet de la deuxième section. Alors qu'une partie du public français lit l'empirisme radical à travers la «volonté de croire», les derniers textes à partir des premiers, traduits et présentés dès leur parution par Renouvier dans La Critique, Wahl semble au contraire retrouver, dans les premiers textes l'accent des derniers, à travers l'insistance sur le fait brut de l'existence, hypothèse qui sera éclairée dans la troisième section. In 1977, Deleuze and Foucault found themselves in opposite camps in the public dispute among French intellectuals, resulting in a parting of the ways between two colleagues who had for many years been friends. This article argues that Deleuze considered the reason for the split to have been their differing views on the connection between the historical situation and philosophical thought. In his view, the split was occasioned by the debate over the New Philosophers, in which Foucault supported those intellectuals (...) who opposed the creative thinking of philosophy. After Foucault's death in 1984, Deleuze sought to reconcile the two positions, but his attempt only highlighted the depth of the division between them. (shrink)

This article focuses on the distinction between psychosocial types and conceptual personae advanced by Gilles Deleuze and Félix Guattari in What is Philosophy? The conceptual persona is the tool that a philosopher invents in order to create new concepts with which to bring forth new events. Although they present it as one of the three elements of philosophy, its nature and function and, above all, its conjunctions with psychosocial types have been overlooked by scholars. What is Philosophy? contains a list (...) of character traits of which each conceptual persona is composed. The central argument of this article is that this list can well be regarded as a table of categories that enable the exercise and experience of philosophy’s creative thinking. Since the character traits of a conceptual persona match the characteristics of the given psychosocial types, it is necessary to keep inventing new conceptual personae always starting from the historical presuppositions. The philosopher requires the conceptual persona to transfer his or her movements of thought to philosophy’s plane of immanence and thereby transform them in such a manner that philosophy can unfold as a creative power. It emerges as the subject of creative thinking at the same time as the concepts that subject creates, with which it coincides in the moment of creation. With the conceptual persona in What is Philosophy?, Deleuze and Guattari determine the one element of philosophy that makes the transcendental empiricism a method of creation that appears as a precise operation with all its convincing and transparent results. The present paper deals thus with some fundamental agreements and disagreements between Peirce and James, on crucial issues such as perception and consciousness. When Peirce first read the Principles, he was sketching his theory of the categories, testing its applications in many fields of knowledge, and many investigations were launched, concerning indexicals, diagrams, growth and development. James's utterances led Peirce to make his own views clearer on a wide range of topics that go to the heart of the foundations of (...) psychology and that involve the relationship between perception and logic, between consciousness and the categories, between abstraction and the 'stream of thought'. The idea is to show that Peirce detected important discoveries and insights in the Principles, but felt that James could not make proper use of them because of logical confusions, and also because of his "clandestine" metaphysics. The point in this essay is thus not to look for remains of psychologism in Peirce's writings,13 but to look at Peirce's comments about James's psychology in an attempt to identify where and why Peirce amended James's views. Since the project to provide some insight on Peirce's extensive reading ofJames's Principles of Psycho/.ogy would deserve a full volume, I shall focus here on three occasions where Peirce explicidy commented on Jarnes's Principles. In the first section, I shall consider bis assessment of James's chapter on space, which was published as a series of articles in 1887, in Mind. I shall then turn to the 1891 review of the Principles in The Nation for important complements on perception as inference. In the third section, I shall deal with Peirce's manuscript "Questions on James's Principles"(Rl099). These "Questions" reveal a deep interest in psychological problems and suggest different ways along which Peirce's new advances in the field of the categories, of continuity, and abstraction could provide a proper basis for the philosophy of mind. In this paper we present applications of the ACGT Master Ontology (MO) which is a new terminology resource for a transnational network providing data exchange in oncology, emphasizing the integration of both clinical and molecular data. The development of a new ontology was necessary due to problems with existing biomedical ontologies in oncology. The ACGT MO is a test case for the application of best practices in ontology development. This paper provides an overview of the application of the ontology within (...) the ACGT project thus far. In addition to providing a rebuttal of the “paper-doubts” of the would-be skeptic, pragmatists have also been quite responsive to the social dimensions of doubt. This is true concerning the causes of doubt. This is true also regarding its consequences: doubt has consequences on epistemic trust; on the way we discuss truths, either about the sciences or about the “construction of good”. Readers of Dewey’s The Quest for Certainty and of some of his most important political writings can easily see (...) how practical uncertainty can degenerate into practical and political skepticism, preventing the emergence of the public. This social aspect of the question has received less attention, perhaps, than the general pragmatist stance towards skepticism, and the present symposium offers a rst round of insights into this aspect of the question: the papers retrieved below all cast light on important aspects of the debate on justi cation, on scienti c dogmatism, on irony and skepticism, on doubt and legal theory, on skepticism and political anarchism. Die Debatte um die politische Differenz stellt Kontingenz und Konfliktualität als fundamentale Eigenschaften des Politischen heraus. Dies birgt ein Problem für die postfundamentalistische Demokratietheorie, die auf Augenhöhe mit dieser Debatte argumentieren will: Durch die Kontingentsetzung aller normativen Begründungen ist zunächst unklar, welche Art von demokratischen Institutionen wie begründet werden kann, und sogar, ob es überhaupt eine von der postfundamentalistischen Sozialontologie ausgehend argumentierende normative Begründung für demokratische Institutionen geben kann. Meine These ist, dass Freiheit, verstanden als kontinuierliche selbstreflexive Kritik, derjenige normative (...) Begriff ist, der sich aus der Sozialontologie von Konflikt und Kontingenz herleiten lässt. Anders gesagt: Freiheit als Kritik ist derjenige Universalismus, der sich aus der Ontologie des Partikularismus ableitet. Freiheit als Kritik kann dabei einerseits das Operieren einiger Institutionen in liberal-pluralistischen Demokratien beschreiben, und andererseits als radikaldemokratisch-normativer Kritikbegriff für die Analyse ihrer Dysfunktionalität dienen. Um diese These zu begründen, gehe ich zurück zu einem Theoretiker, der eine Grundlage der aktuellen Debatte um das Politische bildet: Foucault, dessen Machttheorie als Ansatz einer Sozialontologie der Kontingenz und Konfliktualität gelten kann. Gleichzeitig hat Foucault den Begriff der Freiheit als den zu dieser Ontologie passenden normativen Begriff herausgestellt. (shrink)

Gay men have been severely affected by the AIDS crisis, and gay subjectivity, sexual ethics, and politics continue to be deeply influenced by HIV to this day. PrEP (Pre-Exposure Prophylaxis) is a new, drug-based HIV prevention technique, that allows disentangling gay sex from its widespread, 40 yearlong association with illness and death. This article explores PrEP's fundamental impact on gay subjectivity, sexual ethics, and politics. It traces the genealogy of gay politics regarding homophobia and HIV stigma, suggesting a new biopolitical (...) and body political framework that accounts for the agency of activists as well as pharmapower, and proposing that PrEP is an example of democratic biopolitics. Highlighting the entanglement of medical technology, sexual ethics, and politics, the article shows how conservative and homonormative gay politics developed as a reaction to HIV stigma and how, by overcoming this stigma, PrEP enables a new era of intersectional queer politics and solidarities. It thereby develops a Foucauldian account of sexual liberation beyond the repression hypothesis that accounts for the ambivalence of sexual subjectification and the political potential of sexuality. In den aktuellen Kulturkämpfen kritisieren Konservative Identitätspolitik und “Cancel Culture” als Einschränkungen von individueller Freiheit. Der Artikel untersucht die dabei zugrundeliegenden Freiheitsbegriffe. Die konservative Kritik stützt sich in der Regel auf einen negativen Begriff von Freiheit als Nichteinmischung im Sinne der liberalen Tradition. In der politischen Theorie wird ein solcher negativer Freiheitsbegriff als Gegensatz zur Auffassung von sozialer Freiheit gesehen, die Freiheit in hegelianischer und kommunitaristischer Tradition als ein gemeinschaftliches Unternehmen begreift. Der Artikel zeigt, dass beide Konzepte – trotz ihrer (...) philosophischen Gegensätze – in der zeitgenössischen konservativen Kritik an Identitätspolitik übereinstimmen und daher politisch kompatibel sind. Beide Freiheitsbegriffe kranken an einem falschen Universalismus. Im Gegensatz dazu hilft die radikaldemokratische Tradition, Freiheit partikularistisch zu verstehen. Dabei wird verständlich, dass Identitätspolitik nicht in erster Linie eine Einschränkung individueller Freiheit ist, sondern als Demokratisierung der Demokratie ein Beitrag zur Freiheit aller ist. Wie Herrschaft kritisieren, wenn Kategorien wie Staat, Souveränität und Demokratie nicht mehr funktionieren? Der Regimebegriff verspricht einen Ausweg aus diesem praktischen wie theoretischen Dilemma. Er soll nicht nur helfen, Macht und Herrschaft besser zu verstehen, sondern auch eine neue Grundlage für tiefere und radikalere Gesellschaftskritik bieten: Das Denken in Regimen bezieht Denk- und Wahrnehmungsmuster in die Analyse und Kritik von gesellschaftlichen Strukturen, (politischer) Macht und alltäglichen Normen und Praxen ein. Kurz: Regimeanalysen helfen uns zu sehen, was sonst unsichtbar bliebe, wie (...) etwa die rassistische Regulierung von Migration, die Normierung von Geschlechterverhältnissen oder die Neoliberalisierung von Universitäten. Es wundert nicht, dass ein Begriff, mit dem solch verschiedene Phänomene beschrieben werden können, »sehr weitläufig und oft ungenau und spekulativ« ist. Die AutorInnen aus dem Umfeld der Wiener Akademie der Künste führen deshalb in ihren Buchbeiträgen zunächst in die unterschiedlichen Regimebegriffe ein und möchten untersuchen, »welchen diskursiven und politischen Gewinn er verspricht und tatsächlich bringt.«. „Political Correctness“, „Identitätspolitik“ und „Cancel Culture“ werden heutzutage überwiegend als Waffen von Konservativen eingesetzt, um ihre Privilegien gegen emanzipative Neuregelungen zu verteidigen. Solche Neuregelungen als Einschränkung der Kunst- und Meinungsfreiheit zu kritisieren ist deshalb meist falsch. Tatsächlich tragen „Political Correctness“, „Identitätspolitik“ und „Cancel Culture“ zur inklusiveren Verwirklichung der Demokratie bei. Im Artikel zeige ich, dass es darauf ankommt, auf welcher Ebene politische Regulierungen der Kunst stattfinden: nicht-staatlich im allgemeinen Kunstbetrieb, para-staatlich im öffentlich-rechtlichen Rundfunk, oder staatlich. Nur wenn der Staat mit (...) zentralisierter rechtlicher, ökonomischer und symbolischer Macht in laufende Debatten eingreift, kann man von problematischer Cancel Culture sprechen - das ist fast nie der Fall. "Biopolitics" has become a popular concept for interpreting the COVID-19 pandemic, yet the term is often used vaguely, as a buzzword, and therefore loses its specificity and relevance. This article systematically explains what the biopolitical lens offers for analyzing and normatively criticizing the politics of the coronavirus. I argue that biopolitics are politics of differentiated vulnerability that are intrinsic to capitalist modernity. The situation resulting from the COVID-19 pandemic is, therefore, less of a state of exception than it might appear; (...) COVID-19 is a continuation and intensification of the capitalist biopolitics of differentiated vulnerability. In order to critically evaluate this situation, the article proposes the concept of "democratic biopolitics" and shows how it can be used, among others, for a queer critique of the differentiated vulnerabilities that are produced by the coronavirus and its capitalist governance. In contrast to widespread interpretations of democratic biopolitics that focus on collective care in communities, this article highlights the role of the state and of the redistribution of political power and economic resources as key for biopolitical democratization. James a maintes fois célébré les rencontres philosophiques et l’on sait les efforts de James et de Bergson pour se voir, lors des passages de James en Europe. Proximité physique ne signifie évidemment pas convergence ni capillarité philosophiques, comme l’apprend à ses dépens Agathon dans le Banquet de Platon. Or, le rapprochement, mais aussi les confusions, entre la philosophie de Bergson et celle de James, voire entre « bergsonisme » et « pragmatisme », restent un passage obligé de l’étude des (...) deux hommes. Si cette confusion — peut-être ces familles de confusions — sont caractéristiques du début du XXe siècle , il serait sans doute illusoire de croire que nous en sommes sortis aujourd’hui. C’est en France une expérience encore très répandue chez le jamesien que devoir se justifier par rapport au « bergsonisme », et c’en est une autre pour le « bergsonien » que de devoir dire qu’il n’est pas forcément « pragmatiste ». Ces glissements ont déjà été maintes fois analysés et je tiendrai ici pour acquis que Horace Kallen , Floris Delattre , Ralph Barton Perry et Millic Capek , qui ont procédé à la revue de détail, nous ont donné suffisamment d’éléments pour qu’il ne soit pas nécessaire de reprendre le dossier dans son ensemble. Le propos sera plutôt de décomposer un travers de lecture que l’on inflige généralement aux deux auteurs à partir d’un terrain plus limité : le thème du « courant », ou flux (stream), de conscience, thème prétendument commun aux deux hommes. Je vais pour cela tenter d’identifier, dans la première section, deux grandes manières d’aborder le rapport entre les deux hommes qui ont conduit à méconnaître leur apport propre. L’une interdit tout simplement de les lire comme philosophes, même si elle est couramment pratiquée, ce que j’illustrerai à la lumière de deux exemples. L’autre type de lecture engage, lui, un contresens sur la thèse même de James, et c’est ici que la face critique de ce chapitre se retourne en argument positif. Le cœur de ce contresens est de croire que James aurait introduit le thème du courant de pensée ou de conscience, et que ce serait là son originalité. Or, comme il est normal chez un auteur pragmatiste après tout, l’originalité réside dans l’usage qui est fait de ce thème. En examinant dans la deuxième section les rouages de ce contresens, dont il n’est pas certain que tous les lecteurs de Bergson l’aient totalement évité alors même qu’ils pensaient le déposer, on tentera donc de préciser tout d’abord en quoi le thème lui-même n’est pas spécifiquement jamesien, ensuite en quoi le propos de James n’est pas tant de décrire ce flux pour lui-même que de nous expliquer ce qui nous guette si nous le négligeons systématiquement, enfin quelles sont les fonctions remplies par les passages sur le courant de conscience dans l’argument de James. Pour traiter de la question singulière de la relation entre James et Renouvier à la lumière de cette préoccupation plus générale, nous choisirons ici une période un peu plus limitée que la carrière de James dans son ensemble : depuis ses premiers écrits jusqu’à la série d’articles de 1884-1885, qui allaient être si importants à la fois pour la psychologie et pour l’oeuvre philosophique, c’est-à-dire précisément jusqu’au point où les itinéraires philosophiques de James et de Renouvier commencent à diverger. Il (...) s’agit de voir en quoi la Critique philosophique est un cadre hospitalier pour le jeune James, mais aussi en quoi, dès la fin de cette période, des différends importants se font jour, sur la conscience notamment, ce qui donne lieu à une situation paradoxale où l’organe même qui a contribué à faire connaître James se retrouve à rebours de plusieurs de ses thèses importantes, avant la publication des Principles of Psychology (1890) et encore plus avant le Pragmatisme (1907). Interpretations of Peirce’s development after 1898 often mix three kinds of arguments: one argument about belief, one argument about philosophy and practice, and one argument about the causal role of James’s writings on Peirce’s development. I shall focus here on the last two points: theory and practice and the alleged role of James. James’s role in Peirce’s development is somewhat overestimated and one can doubt Peirce’s worries about the dogmatic use of the scientific method and of philosophy in morals are (...) conditioned by James’s writings only. Peirce’s re-readings and refinements of his Illustrations started no later than the early 1880s, at a time when James was not as central a reference as it became after 1900 for the philosophic stage. To support that claim, I wish to focus here on one particular point: the distrust towards those who try to “mingle” philosophy and practice is by no means a new theme in the 1890s. One of the most telling examples of such a claim is the 1885 review of Royce’s The Religious Aspect of Philosophy, some thirteen years before the quarrel over pragmatism started. (shrink)

Seine Macht- und Subjekttheorie ist die Basis für eine nicht- essentialistische Analyse von Sexualität und für die Kritik ihrer normierenden Wirkung, die Foucault selbst in Der Wille zum Wissen (1983, frz. 1976) begonnen hat und die das Kerngeschäft der Queertheorie ist. Während Foucault als Grundlage der Queertheorie insgesamt rezipiert wird, gibt es eine spezifisch schwule Rezeption von Foucault, (...) die an seine vielfältigen Äußerungen zur schwulen Politik anschließt und dessen Machtanalyse und seine späteren Arbeiten zur Ästhetik der Existenz mobilisiert, um damit das schwule Leben vor, während und nach der AIDS-Krise zu analysieren. This interconnection of Nietzsche's slave morality and 'PC' criticism is correct, as a systematic analysis of their common elements shows, which leads to a new description of 'PC' criticism as a defense of privilege. In contrast to the right-wing Nietzschean 'PC' critique, the left-wing Nietzschean concept of a privilege-critical ‘political judgement' understands politics as a struggle for power, in which the space of the (...) political and related discourses are always already regulated and determine the conditions under which resources and privileges are distributed. Therefore, it is appropriate for an emancipatory position to critically question the established norms and to support political projects that aim to rewrite them. Because 'PC', as emancipative political judgement, dismantles privileges, its restricting of the privileged is not a side effect to be avoided but one of its reasonable core effects. Left-wing Nietzscheanism helps to avoid being surprised by right-wing aggression and to counter it vigorously by setting strict political norms. (shrink)

In this paper, I'm giving an account of William James's reception in the columns of Charles Renouvier's journal, La Critique philosophique. The papers explores the discussions between James and Renouvier on Free Will, Philosophical systems, Consciousness and Pluralism.

Die Debatte um die politische Differenz stellt Kontingenz und Konfliktualität als fundamentale Eigenschaften des Politischen heraus. Dies stellt die postfundamentalistische Demokratietheorie, die auf Augenhöhe mit dieser Debatte argumentieren will, vor ein Problem: Durch die Kontingentsetzung aller normativen Begründungen ist zunächst unklar, welche Art von demokratischen Institutionen wie begründet werden kann, und sogar, ob es überhaupt eine von der postfundamentalistischen Sozialontologie ausgehend argumentierende normative Begründung für demokratische Institutionen geben kann. Meine These ist, dass Freiheit, verstanden als kontinuierliche selbstreflexive Kritik, derjenige normative (...) Begriff ist, der sich aus der Sozialontologie von Konflikt und Kontingenz herleiten lässt. Anders gesagt: Freiheit als Kritik ist derjenige Universalismus, der sich aus der Ontologie des Partikularismus ableitet. Freiheit als Kritik kann dabei einerseits das Operieren einiger Institutionen in liberal-pluralistischen Demokratien beschreiben, und andererseits als normativer Kritikbegriff für die Analyse ihrer Dysfunktionalität dienen. Um diese These zu begründen, gehe ich zurück zu einem Theoretiker, der eine Grundlage der aktuellen Debatte um das Politische bildet: Foucault, dessen Machttheorie als Ansatz einer Sozialontologie der Kontingenz und Konfliktualität gelten kann. Gleichzeitig hat Foucault den Begriff der Freiheit als den zu dieser Ontologie passenden normativen Begriff herausgestellt. Durch eine Rekonstruktion und Kritik der sozialphilosophischen Debatte um Freiheit in Foucaults Werk lässt sich der Begriff der Freiheit als Kritik systematisch bestimmen. So kann – mit Foucault gegen Foucault – gezeigt werden, dass er nur innerhalb einer pluralistischen und liberalen Demokratietheorie gedacht werden kann. (shrink)

In der Debatte um Freiheit bei Foucault wird das „Freiheitsproblem“ verhandelt: Wie können Freiheit und Widerstand innerhalb von Foucaults Theorie der Macht und Subjektivierung konzipiert werden? Der Aufsatz leistet eine Rekonstruktion und interne Kritik der besten Interpretationsstrategien von Foucaults Werk, die die Lösung dieses Problems zum Ziel haben, und entwickelt dabei eine neue These: Freiheit als Fähigkeit zur reflexiven Kritik der eigenen Subjektivierung ist abhängig von freiheitlicher Subjektivierung durch politische Institutionen. Die Interpretationsstrategien werden systematisch unterschieden und anhand der Arbeiten exemplarischer (...) Vertreter_innen diskutiert: 1. Foucault ist kohärent, 2. Foucault korrigiert sich, 3. Foucault kritisiert kohärent, 4. Foucault ist nicht genug. Gegen Lemke wird argumentiert, dass Freiheit nicht durch eine anarchistische, sondern nur durch eine institutionalistische Foucault-Lesart bestimmt werden kann. Mit Saar wird gezeigt, dass das Ziel einer eindeutigen Definition von Freiheit im Gegensatz zur Methode der genealogischen Kritik steht und nur im Rahmen der normativen politischen Theorie verfolgt werden kann. In Auseinandersetzung mit Allen wird argumentiert, dass Freiheit nicht in linken Bewegungen verortet werden kann, sondern nur in demokratischen Institutionen. (shrink)

The challenge of developing humane migration and refugee politics in Western states is far from resolved. This ongoing failure is typically attributed to the increased influence of right-wing populism and neo-fascism in Western migration politics. In this article I discuss a more radical explanation: Christoph Menke argues that political liberalism and its framing of migration as an issue of subjective human rights is the deeper root of the problem. While the merit of Menke’s approach is its criticism of subjectification through (...) individual rights that blocks politics, I show that his Critique of Rights may lead to an anti-pluralist and paternalistic ‘radical republicanism’. To react to this problem, I propose a ‘reflective liberalism’ that allows to criticise subjectification without abandoning the form of individual rights. This position, which I develop through a discussion of Foucault’s concept of ‘freedom as critique’, shows that in addition to protecting minorities such as migrants, individual rights turn out to be part of a regime of critical subjectification that constitutes critical subjects. Such critical subjectification by law can help to break through the blockade of politics that prevent the development of humane migration and refugee politics. (shrink)

Wie können Freiheit und Widerstand innerhalb von Foucaults Theorie der Macht und Subjektivierung konzipiert werden? Karsten Schubert liefert die erste systematische Rekonstruktion der sozialphilosophischen Debatte um Freiheit bei Foucault und eine neue Lösung für das Freiheitsproblem: Freiheit als die Fähigkeit zur reflexiven Kritik der eigenen Subjektivierung – kurz: Freiheit als Kritik – ist das Resultat von freiheitlicher Subjektivierung in politischen Institutionen. Der Band zeigt so die Konsequenzen von Foucaults Freiheitsdenken für die Demokratietheorie und die allgemeine sozialphilosophische Freiheitsdiskussion auf.

Vor wenigen Tagen hat das Hamburger Kabarett-Theater Schmidts Tivoli die Zusammenarbeit mit dem Komiker Kay Ray beendet, offenbar weil rassistische Witze in der Show einen zentralen Platz einnehmen. Kurz nach der Cancel-Affäre zwischen Lisa Eckhart und dem Hamburger Nochtspeicher sieht sich nun auch Ray als Opfer von „Cancel Culture“, die die Kunstfreiheit immer weiter einschränke. Um die Kunst und Kunstfreiheit geht es dabei aber eigentlich gar nicht. Sie ist nur der Austragungsort gesellschaftspolitischer Auseinandersetzungen um Sexismus, Rassismus und Transphobie. Dabei sind (...) Kunstfreiheit und Meinungsfreiheit zentrale Argumente – oder besser: Waffen – des konservativen politischen Projekts geworden, mit dem emanzipative Änderungen abgewehrt werden (s. auch Schubert, in: Leviathan, 48 (1), S. 29–51). Dieser machtpolitische Missbrauch muss klar von der grundrechtlichen Dimension unterschieden werden. Dafür ist zwischen drei Ebenen Kunstfreiheit zu differenzieren: im nichtstaatlichen, parastaatlichen und staatlichen Bereich. Die Neuregelungen von Diskurs, Kultur und Kunst durch „Politische Korrektheit“, „Cancel Culture“ oder „Identitätspolitik“ bedeuten nicht den Zerfall der Demokratie, sondern sind ein Schritt in Richtung ihrer vollständigeren Realisierung. We live in very Foucauldian times, as the many think-pieces published on biopolitics and COVID-19 show. Yet what is remarkable—biopolitically—about the current situation has gone largely unnoticed: We are witnessing a new form of biopolitics today that could be termed populist biopolitics. Awareness of this populist biopolitics helps illuminate what is needed today: democratic biopolitics.

In der postmarxistischen politischen Philosophie wird die Veränderung gegenüber der Verstetigung analytisch und normativ bevorzugt. Deshalbleistet die postmarxistische Theorie keine realistische Analyse und normativ-differenzierende Bewertung von politischen Institutionen, insbesondere des Rechts. Der Beitrag liefert einen Ansatz, um diese Lücke zu schließen, indem er der Abblendung von institutionellen Fragen mit einer neuen postfundamentalistischen Institutionentheorie begegnet. Diese Theorie basiert auf dem Freiheitsbegriff der Kritik, der im Anschluss an Foucault entwickelt wird und zeigt, dass kritischer Subjektivität durch die Institutionalisierung von freiheitlichen Subjektivierungsregimen bedingt (...) ist. Dieser Freiheitsbegriff korrigiert den avanciertesten Ansatz der postmarxistischen Rechtstheorie, Menkes Rechtskritik. Deren Stärke ist es,die liberal entpolitisierende Subjektivierung des Rechts zu kritisieren, doch Menkes Vorschlag einer radikalen Politisierung ist paternalistisch. Mit Foucault lässt sich hingegen ein Recht denken, das Subjektivierung kritisiert und dennoch nicht paternalistisch ist, weil es die Subjekte zur Kritik der Institutionen befähigt. (shrink)
