I present and defend Reinach's theory of ownership according to which, prior to the positive law, one finds a distinction between possession, ownership and property rights. Ownership is not a bundle of positive rights, but a primitive natural relation that grounds the absolute right to behave as one wishes towards the thing one owns. In reply to some objections raised against it, I argue that Reinach's theory of property is morally and politically non-committal; and that it in fact has the (...) ressources for dealing with the vexing issue of the origin of ownership. As common experience confirms, procrastination seems not only possible, but widespread. However, procrastination should not be taken for granted. Often, the procrastinator harms herself knowingly. It thus clearly seems that such a person lacks the self-concern that usually characterises us. After having spelled out what procrastination is, and having explored its main varieties, I consider the relation between procrastination and risk-taking. After this, I discuss the implications of this phenomenon for the debates about personal identity. The upshot, I argue, is (...) that reductionist accounts, according to which identity is a matter of psychological continuity, are in a better position as might have been thought. (shrink)

As Kevin Mulligan, more than anyone else, has demonstrated, there is a distinction within the philosophy of the German-speaking world between two principal currents: of idealism / transcendentalism, characteristic of Northern Germany; and of realism / objectivism, characteristic of Austria and the South. We explore some of the implications of this distinction with reference to the influence of Austrian (and German) philosophy on philosophical developments in Hungary, focusing on the work of Ákos von Pauler, and especially on Pauler’s reading of (...) In this paper, the aim is to explore how there can be a role for expression of affect in illocution, drawing upon some ideas about expression put forward by Karl Bühler. In a first part of the paper, I map some active discussions and open questions surrounding phenomena that seem to involve “expression of affect”. Second, I home in on a smaller piece of that larger puzzle; namely, a consideration of how there may be non-conventional expression of affect. I provide (...) some examples of what I take that to involve and set out some premises for approaching it. In a third section, I motivate such an interest by pointing to a question in speech act theory concerning ‘force conventionalism’. This is whether and how illocution can be performed non-conventionally—that is, whether (at least some) utterances can be communicated with illocutionary force without need of convention. I propose that where expression of affect may occur non-conventionally, it may in turn constitute one important route through which at least some kinds of illocution are achieved. In the fourth part of the paper, I sketch an account of such non-conventional expression of affect for the purposes of illocution, by exploring a broadly Bühlerian account of some affects; namely, that some affects are teleological in character, that coordinations may be involved in their satisfactional states, and that uptake of the expressed affect constitutes one subset of such satisfactional states. That exposition points to the contemporary relevance of the “action theory of expression” proposed by Bühler. (shrink)

This paper presents and evaluates the early Husserl’s account of typicality. In the Logical Investigations, Husserl holds that the meaning of ordinary language (common) names is sensitive to typicality: this meaning depends on typical examples which vary in different contexts and are more or less similar to one another. This seems to entail that meanings, which according to Husserl are concepts, are “fluctuating” (schwankend) and vague. Prima facie, such a claim contravenes his theory of ideal meanings, or concepts, which are (...) “fixed” (fest) and sharp. However, Husserl wants to save this theory. He claims that the fluctuation and vagueness in question are not to be found in the meaning itself, or the concept, but rather derive from the act of meaning. Thus, he apparently manages to make room for typicality in ordinary language while accepting only fixed and sharp meanings. After presenting Husserl’s theory, I evaluate it and ask whether he will still be committed, despite his own claims, to accepting prototype concepts to account for typicality in ordinary language. This paper explores how Wundt’s and Bühler’s respective conceptions of gestural expression have implications for how each conceives of what, in broad terms, may be understood as a ‘grammar of gestures’: that is, the rules for the formation and performance of gestures with and without speech. Unlike previous scholarship that has looked at the relationship of Wundt and Bühler, the aim here will be to give particular attention to the relevance of their respective accounts for current philosophical and linguistic research (...) on gesture. Building off of Bühler, we can offer an alternative to the psychologistic and solipsistic model of gestural expression that can be found in Wundt and that seems to be resurgent today in work by McNeil and others. Via Bühler’s notions of diacrisis and of the underlying functions that guide human communication, we propose an understanding of the relationship between gestures and speech that aims to render accurately both the highly contextualised and the highly structured conditions of their mutual employment. Though the divide between reason-based and causal-explanatory approaches in psychiatry and psychopathology is old and deeply rooted, current trends involving multi-factorial explanatory models and evidence-based approaches to interpersonal psychotherapy, show that it has already been implicitly bridged. These trends require a philosophical reconsideration of how reasons can be causes. This paper contributes to that trajectory by arguing that Donald Davidson’s classic paradigm of 1963 is still a valid option.

Resumo O objetivo deste artigo é apresentar os temas do “novo método” filosófico e da “Filosofia da Psicologia”, nos escritos tardios de Ludwig Wittgenstein, como relacionados prática e necessariamente. Para o proposto, a estratégia expositiva segue a seguinte ordem: analisam-se os pressupostos filosóficos relativamente irrefletidos que determinam a visão que o jovem Wittgenstein tinha do “método correto da Filosofia” e da “Filosofia da Psicologia”; interpreta-se a volta filosófica de 1929 como comprometida em apresentar o rosto ainda informe do “novo método” (...) e retomar criticamente os alvos do TLP, sob essa nova perspectiva metodológica; e considera-se a Filosofia da psicologia de Wittgenstein inserida numa perspectiva diferente da perspectiva da ciência psicológica do fim do século XIX e início do século XX, fundamentada em investigações empíricas. Essas observações constituem propriamente uma prática do “novo método” de apresentação perspícua e se caracteriza como um aspecto-chave e necessário, um filtro, para a compreensão das observações do filósofo em torno da psicologia e de seu objetivo em dissolver os problemas metafísicos ali presentes.The main purpose of this article is to present the themes of the philosophical “new method” and the “philosophy of psychology” in Ludwig Wittgenstein’s late writings as practically and necessarily related. For the proposed, our expository strategy follows the following order: we analyzed the relatively unreasonable philosophical presuppositions that determine the young Ludwig’s view of the “correct method of philosophy” and of “philosophy of psychology”; we interpreted the philosophical turn of 1929 as committed to presenting the still-informed face of the “new method” and to critically revisiting the TLP targets under this new methodological perspective; and we considered Wittgenstein’s philosophy of psychology inserted in a different perspective from the perspective of the psychological science of the late nineteenth and early twentieth century based on empirical investigations. These observations are properly a practice of the “new method” of perspicuous presentation and they are characterized as a key and necessary aspect, a filter, for the understanding of the philosopher’s observations about psychology, and his goal in dissolving the metaphysical problems present there.
