The power to promise is morally fundamental and does not, at its foundation, derive from moral principles that govern our use of conventions. Of course, many features of promising have conventional components—including which words, gestures, or conditions of silence create commitments. What is really at issue between conventionalists and nonconventionalists is whether the basic moral relation of promissory commitment derives from the moral principles that govern our use of social conventions. Other nonconventionalist accounts make problematic concessions to the conventionalist's core (...) instincts, including embracing: the view that binding promises must involve the promisee's belief that performance will occur; the view that through the promise, the promisee and promisor create a shared end; and the tendency to take promises between strangers, rather than intimates, as the prototypes to which a satisfactory account must answer. I argue against these positions and then pursue an account that finds its motivation in their rejection. My main claim is: the power to make promises, and other related forms of commitment, is an integral part of the ability to engage in special relationships in a morally good way. The argument proceeds by examining what would be missing, morally, from intimate relationships if we lacked this power. (shrink)

This paper argues that promises are proposals in joint practical deliberation, the activity of deciding together what to do. More precisely: to promise to ϕ is to propose (in a particular way) to decide together with your addressee(s) that you will ϕ. I defend this deliberative theory by showing that the activity of joint practical deliberation naturally gives rise to a speech act with exactly the same properties as promises. A certain kind of proposal to make a joint decision regarding (...) one's own actions turns out to have the very same normative effects, under the very same conditions, as a promise. I submit that this cannot be a coincidence: we should conclude that promises and the relevant kind of proposals in joint practical deliberation are one and the same. (shrink)

Accepting a promise is normatively significant in that it helps to secure promissory obligation. But what is it for B to accept A’s promise to φ? It is in part for B to intend A’s φ-ing. Thinking of acceptance in this way allows us to appeal to the distinctive role of intentions in practical reasoning and action to better understand the agency exercised by the promisee. The proposal also accounts for rational constraints on acceptance, and the so-called directedness of promissory (...) obligation. Finally, the proposal, conjoined with Cognitivism about intentions, addresses recent criticism of Scanlon’s expectation-based view of promissory obligation. (shrink)

I argue that an act can be wrong _because_ it wrongs a particular person. I then show how this thesis serves as a constraint on moral theories, using Kantian ethics as a case study.

I defend two collapsing or reductionist arguments against Weak Pro-Natalism (WPN), the view that procreation is generally merely permissible. In particular, I argue that WPN collapses into Strong Pro-Natalism (SPN), the view that procreation is generally obligatory. Because SPN conflicts with the dominant view that procreation is never obligatory, demonstrating that WPN collapses into or entails SPN establishes epistemic parity (at least as concerns reproductive liberty) between WPN and Anti-Natalism (AN), the view that procreation is always impermissible. First, I distinguish (...) between two moral goods: the good of procreation itself and the good of procreative potential. Second, I contend that the average moral agent is obligated to assist needy children via adoption, fostering, or other financial or interpersonal support. Third, I present the first collapsing argument: If an agent’s justification for not assisting needy children is preservation of their resources (financial or interpersonal) for their actual future offspring, that justification is preserved only if they eventually and actually procreate. Thus, their eventual procreation is morally obligatory, and SPN follows. Fourth, I present the second collapsing argument, which assumes procreative potential as the relevant good: If an agent’s justification for not assisting needy children is preservation of their resources for their potential future offspring, that justification holds only if (a) the objective or subjective valuation of the opportunity is of the relevant type and valence to justify not assisting needy children and (b) the agent sincerely values the opportunity. Fifth, I argue that (a) is unsatisfied and that while (b) is satisfied in most cases, it entails that most agents are obligated to desire or be behaviorally disposed to pursue procreation for themselves (i.e., SPN). Thus, I conclude that both actual procreation and procreative potential are either insufficient justifications for not assisting needy children or that they entail obligatory pro-reproductive attitudes or behaviors. This article argues that the dominant “nonconventionalist” theories of promising cannot account for the moral impact of two basic commercial practices: the transfer of contractual rights and the discharge of contractual debt in bankruptcy. In particular, nonconventionalism’s insensitivity to certain features of social context precludes it from registering the moral significance of these social phenomena. As prelude, I demonstrate that Seana Shiffrin’s influential position concerning the divergence between promise and contract commits her to impugning these features of the modern economy. (...) Can appealing to children’s rights help to solve the non-identity problem in cases of procreation? A number of philosophers have answered affirmatively, arguing that even if children cannot be harmed by being born into disadvantaged conditions, they may nevertheless be wronged if those conditions fail to meet a minimal standard of decency to which all children are putatively entitled. This paper defends the tenability of this view by outlining and responding to five prominent objections that have been raised against it (...) in the contemporary literature: the identifiability objection; the non-existence objection; the waiving of rights objection, the lack of legitimate complaint objection; and the unfairness objection. Considerable attention has been devoted to the peculiar obligating force of interpersonal promises. But paradigmatic promising is not an orphan in the family of our moral concepts, and the focus on interpersonal promises has overshadowed sibling phenomena that any account of promises should also cover. I examine the case of single-party promises and argue, against the prevailing view, that we have good reason to take the phenomenon of making promises to oneself seriously. This supports what I call ‘the breadth criterion’: (...) theoretical accounts of promising should cover the entire breadth of the phenomenon of promising. I then argue that the breadth criterion poses a novel and formidable obstacle for two prominent views of promising, the social practice view and the expectation view. I conclude by suggesting that there is reason to think that the normative power view of promising may fare better. (shrink)

Breaking a promise is generally taken to involve committing a certain kind of moral wrong, but what (if anything) explains this wrong? According to one influential theory that has been championed most recently by T.M. Scanlon, the wrong involved in breaking a promise is a matter of violating an obligation that one incurs to a promisee in virtue of giving her assurance that one will perform or refrain from performing certain acts. In this paper, we argue that the “Assurance View”, (...) as we call it, is susceptible to two kinds of counterexamples. The first show that giving assurance is not sufficient for incurring the kind of obligation of fulfillment that one violates in breaking a promise. The second show that giving assurance is not necessary. Having shown that the Assurance View fails in these ways, we then very briefly sketch the outline of what we take to be a better view—a view that we claim is not only attractive in its own right and that avoids the earlier counterexamples, but that also affords us a deeper explanation of why the Assurance View seems initially plausible, yet nonetheless turns out to be ultimately inadequate. An oft-rehearsed objection to the claim that an intention can give one reasons is that if an intention could give us reasons that would allow an agent to bootstrap herself into having a reason where she previously lacked one. Such bootstrapping is utterly implausible. So, intentions to φ cannot be reasons to φ. Call this the bootstrapping objection against intentions being reasons. This essay considers four separate interpretations of this argument and finds they all fail to establish that non-akratic, nonevil, (...) and deliberatively sound intentions cannot be reasons. The first argument is the argument from evil intentions, the second is the argument from akratic intentions, the third is the argument from errors in deliberation, and the last is what I call the ‘wizardry’ argument. This ‘argument’, put forward most clearly by John Broome, claims that intentions are so insubstantial that were they on their own reasons for action, that would amount to creating something out of nothing and that is impossible. The essay argues that the claim that intentions are insubstantial is too strong a premise to put forward without argument. For there are other attitudes that are on their own sufficient to generate reasons, such as loving attitudes. The essay then argues that the bootstrapping objection’s status as dogma in the philosophy of action has led to insufficient attention being paid to the entirely reasonable question of whether intentions are sufficiently like other reason-giving attitudes, such as loving and valuing. It may turn out that, just as loving someone can give the loving person a reason to act in a certain, so too can intending to do something give someone a reason to act in a certain way, but we cannot effectively engage this question without first giving up our commitment to the bootstrapping objection as a central “insight” in philosophy of action. The essay concludes by proposing two research questions that are opened up by the abandonment of the bootstrapping objection as dogma, and proposes that we turn our philosophical attentions to those questions. How do promissory obligations get created? Some have thought that the answer to this question must make reference to our social practice of promising. Recently, however, T.M. Scanlon has argued (in his book What We Owe to Each Other) for a pure ‘expectation view’ of promising, according to which promissory obligations arise as a result of our producing certain expectations in others. He formulates a principle of fidelity (Principle F) that tells us when one has gained an obligation due to (...) producing expectations in another, and he maintains that breaking one's promise is merely a special instance of violation against Principle F. Though initially compelling, Scanlon’s account is ultimately unsatisfactory because it is subject to a vicious circularity. In order to get out of the circle, we are forced to resort back to elements of a social practice view of promising. Thus we arrive at a hybrid view of promissory obligation, which weds parts of Scanlon’s expectation view with parts of a social practice view. After briefly examining and rejecting Scanlon’s pure expectation view, I consider the hybrid view of Niko Kolodny and R. Jay Wallace. I present a serious objection to the hybrid view as they formulate it and go on to construct a modified hybrid view. Finally, I defend my modified hybrid view from certain pressing objections. The explanation of promising is fraught with problems. In particular the problem that promises can be valid even when nothing good comes of keeping the promise (the problem of ‘bare wrongings’), and the bootstrapping problem with explaining how the mere intention to put oneself under an obligation can create such an obligation have been recognized since Hume’s famous discussion of the topic. There are two influential accounts of promising, and promissory obligation, which attempt to solve the problems: The expectation account (...) and the practice account. While those accounts solve both the bootstrapping problem and the problem of bare wrongings, it turns out that they encounter numerous problems of their own. (shrink)

T. M. Scanlon has alleged that the social practice of promising fails to capture the sense in which when I break my promise I have wronged the promisee in particular. I suggest the practice of promising requires the promisee to have a normatively significant status, a status with interpersonal authority with respect to the promisor, and so be at risk of a particular harm made possible by the social practice of promising. This formulation of the social practice account avoids Scanlon’s (...) concern without collapsing into what Elinor Mason has recently referred to as deflationism about promising. (shrink)

Much of the literature on practical authority concerns the authority of the state over its subjects—authority to which we are, as G. E. M. Anscombe says, subject “willy nilly”. Yet many of our “willy” (or voluntary) relationships also seem to involve the exercise of practical authority, and this species of authority is in some ways even more puzzling than authority willy nilly. In this paper I argue that voluntary authority relies on a form of voluntary obligation that is akin (in (...) some respects) to the kind of obligation one undertakes in making a promise. Voluntary authority depends, that is, on the possibility of taking on certain obligations more or less at will. It is generated through an interpersonal transaction that involves a directed act of deference, on one side, paired with appropriate uptake of that deference, on the other. Deference, in the relevant sense, should be understood as a normative power that is exercised when agents transfer deliberative discretion to others, undertaking directed obligations to treat others’ directives as content-independent and peremptory reasons. Voluntary authority, thus understood, is both grounded in and constrained by the equal moral authority or autonomy of the participants, since only autonomous agents have the standing to defer in a normatively significant way. On some popular accounts of promissory obligation, a promise creates an obligation to the person to whom the promise is made . On such accounts, the wrong involved in breaking a promise is a wrong committed against a promisee. I will call such accounts ‘directed obligation’ accounts of promissory obligation. While I concede that directed obligation accounts make good sense of many of our promissory obligations, I aim to show that directed obligation accounts, at least in their current forms, cannot (...) accommodate an obligation to keep deathbed promises. While the term 'deathbed promise' refers to any promise made to a person who is dying, I focus specifically on deathbed promises which will not, or even cannot, be fulfilled until after the promisee's death. In what follows, I examine two prominent types of directed obligation account: rights-based accounts, which argue that a promissory obligation is a directed obligation because a promise gives the promisee certain rights, and harm accounts, which argue that a promissory obligation is a directed obligation because a promise puts the promisee in a special position to be harmed. I argue that neither version can accommodate an obligation to keep deathbed promises. (shrink)

According to Joseph Raz, the fact of making a valid promise creates “promissory reasons”: it constitutes for the promisor a reason for performing her promise and a reason for not acting for at least some of the reasons that recommend something different than performing. In his latest work on promising, Raz provides a novel account of the grounds of promissory reasons—an account which is different in important respects to the one he defended decades ago. Common accounts of relational duties do not explain how we can have obligations to people who do not yet exist. I present a novel way to think about promising: Promising as Doxastic Entrustment. The main idea is that promising is inviting another to entrust her belief to you, and that taking a promiser’s word is freely choosing to accept this invitation. I explicate this through considering the special kind of reason for belief issued by a promiser: a reason whose rational status depends both on the will of the promiser to provide it, and on the will of the promisee to (...) accept it. Though this may seem to raise worries about believing at will, I show how such concerns can be navigated. I then argue that the view provides a rich, attractive understanding of the interpersonal bond forged through promising. According to the Doxastic Entrustment view, that bond results from freely given trust, in exchange for freely assumed responsibility for what is entrusted: namely, a bit of the promisee’s own mind. A number of philosophers have resisted impersonal explanations of our obligation to mitigate climate change, and have developed accounts according to which these obligations are explained by human rights or harm-based considerations. In this paper I argue that several of these attempts to explain our mitigation obligations without appealing to impersonal factors fail, since they either cannot account for a plausibly robust obligation to mitigate, or have implausible implications in other cases. I conclude that despite the appeal of the motivations (...) for rejecting the appeal to impersonal factors, such factors must play a prominent role in explaining our mitigation obligations. (shrink)

In a recent paper, I launch an attack on a fundamental doctrine of legal positivism. I argue that nonnormative facts cannot themselves constitutively determine the content of the law. In a response published in this journal, Ram Neta defends the view that nonnormative social facts are sufficient to determine normative facts, including both moral and legal facts. Neta's paper provides a useful opportunity to address a spelled-out version of this view, which in various forms is widely held in philosophy of (...) law and other areas of philosophy. I begin by addressing Neta's attempts to show that descriptive facts can alone determine moral and legal facts. First, Neta's account of why it is wrong to break promises fails. In addition to other problems, it begs the question by taking for granted that a person's desires or other motivational states necessarily justify the actions that they motivate. Next, I turn to Neta's attempt to provide a counterexample to my view about law. In my original paper, I claim that the nature of the constitutive determination relation in the legal domain is what I call rationaldetermination. Roughly speaking, a full constitutive account of the legal facts must include reasons that explain the relation between the determining facts and the legal facts. The facts on which Neta's putative counterexample depends cannot be reasons of the required sort because they take for granted what they are supposed to explain—the way in which nonnormative social facts contribute to the content of the law. Finally, I address the larger issue of how far my argument applies to other domains. I consider and reject Neta's argument that purports to show that all normative domains have the relevant features of the legal domain. I then sketch a competing picture of some normative domains. This essay investigates the structure of fiduciary obligations, specifically the obligation of loyalty. Fiduciary obligations differ from promissory obligations with respect to the possibility of “accidental compliance.” Promissory obligations can be satisfied through behavior that conforms to a promise, even if that behavior is done for inappropriate reasons. By contrast, fiduciary loyalty necessarily has an intentional dimension, one that prevents satisfaction through accidental compliance. The intentional dimension of fiduciary loyalty is best described by what we call the “shaping” account. This (...) account both explains the conscientiousness that loyalty demands and improves on other accounts of the intentional dimension of loyalty. Our analysis challenges two of the most prominent ways of conceptualizing fiduciary obligations. “Contractarianism” configures fiduciary obligations as a species of contractual duties. The view that we call “proscriptivism” reduces fiduciary obligations to the juridical prohibitions that apply to fiduciaries. Neither of these approaches is satisfactory, because each neglects the intentional dimension of fiduciary loyalty. (shrink)

This paper develops a new theory of the morality of promissory obligations. T. M. Scanlon notoriously argued that promising consists in assuring the promisee that we will do something. I disagree. I argue that it is true that promising consists in assuring the promisee, but what the promisor gives to the promisee is not an assurance that they will do something, but that the normative situation is in a certain way.

Why do we have a moral duty to fulfill promises? Hume offers what today is called a practice theory of the obligation of promises: he explains it by appeal to a social convention. His view has inspired more recent practice theories. All practice theories, including Hume’s, are assumed by contemporary philosophers to have a certain normative structure, in which the obligation to fulfill a promise is warranted or justified by a more fundamental moral purpose that is served by the social (...) practice of promising or adherence to it. Recent practice theories do have this structure, but, I argue, Hume’s own does not. Hume’s account, while it does trace the origin of promises to convention, is instead a causal explanation of the moral sentiments we have toward fulfillment and violation of promises, sentiments he regards as normative in themselves and not susceptible of further warrant. He explains how a collectively-invented social practice becomes morally obligatory for us to conform to, without deriving its moral authority from a more basic principle. I discuss one objection often made to practice theories that, in its application to Hume, presupposes the incorrect interpretation, and show that while it is telling for Hume’s descendants, for Hume it misses the mark. Instead I make a different challenge to Hume, and suggest how he might meet it. (shrink)

Em Uma Teoria da Justiça, John Rawls explicou o intuicionismo como a doutrina que professa o pluralismo irredutível de princípios morais, princípios estes cujos conflitos não poderiam ser resolvidos de maneira principiológica. Segundo Rawls, não se pode oferecer um argumento abstrato que prove que o pluralismo moral é falso. Mas seria possível mostrarmos aquilo que o intuicionista nega existir: o princípio moral mais fundamental, que sistematiza nossas obrigações morais. Este princípio, de acordo com Rawls, seria o princípio da equidade. Neste (...) artigo, eu argumento que Rawls fracassa diante dos intuicionistas. Meus argumentos se valem de uma análise da aplicabilidade do princípio da equidade ao caso das promessas. Primeiro, eu defendo que o princípio da equidade só poderia explicar obrigações morais em geral se ele pudesse conter em sua fórmula um caso paradigmático das obrigações que ele pretende explicar: justamente as obrigações promissórias. Depois, eu procuro mostrar que as mesmas obrigações promissórias contêm um traço essencial que o princípio da equidade não seria capaz de explicar, mesmo que pudesse explicar obrigações morais em geral: o caráter especial das obrigações para com os destinatários das promessas. No primeiro ponto, a minha investigação expande as críticas de Robert Nozick a uma versão do princípio da equidade apresentada por H.L.A. Hart. No segundo, eu desenvolvo objeções feitas por Stephen Darwall contra a teoria prática das promessas, incluindo a teoria de John Rawls. (shrink)

Conventionalism about promising is the view that the power to make binding promises depends essentially on the existence of a social practice or convention of promising. This paper explores an objection to conventionalism that says that—(allegedly) contra conventionalism—there is no morally acceptable world in which we lack the power of promise. Instead, normative powers theorists claim that our power of promise is morally basic or necessary. I argue that the conventionalist need not deny this claim. There are several ways to (...) develop a noncontingent conventionalism: a version of the view that can accommodate the insight that the power of promise is indispensable to morally acceptable lives. Then, I argue that the conventionalist is indeed on the hook for accommodating this insight. I wrap up by considering the state of play in the debate over conventionalism about promising. Once we note the theoretical possibility of noncontingent conventionalism, it looks like the theatre of battle shifts to the difficult question of whether “natural” morality always provides “moral necessities.”. To promise someone to do something is to commit oneself to that person to do that thing, but what does that commitment consist of? Some think a promissory commitment is an obligation to do what’s promised, and that while promising practices facilitate the creation of promissory obligations, they are not essential to them. I favor the broadly Humean view in which, when it comes to promises (and so promissory obligations), practices are of the essence. I propose the Practice Reason Account (...) of promises, according to which a promise is basically to give oneself a self-interested practice reason to do what’s promised. One achieves this feat by invoking self-enforcing independent practice rules thanks to which one’s doing what’s promised preserves one’s promissory trust(worthiness) and promising power. However, nothing in this account supports the Hume-Rawls claim that promise-keeping or promise-breaking is right just when and because it conforms to practice rules that are justified by their good- or right-making properties. I argue here that sometimes the seeking and securing of release from promissory obligation amounts to wrongful exploitation. I contend that this is true even though the promisee has viable alternatives to releasing the promisor from the promise, and even though the promisee is voluntarily releasing the promisor from the promise. I offer two methods by which someone can unfairly take advantage of the promisee's vulnerability that count as wrongfully exploitative. Next, I explain a variety of theories of promising and (...) how they handle promissory release. I explain the difference between coercive release‐seeking and exploitative release‐seeking, and I explain why the latter type of release can be morally legitimate—at least on some theories. I then demonstrate how these scenarios of exploitative release‐seeking pose interesting puzzles and applications for the theories of promising. I end the paper with some thoughts on what rules we can follow to avoid exploitative release‐seeking from our promises. (shrink)

The paper argues that promise rights presuppose independently existing (if not pre-existing) claims. The argument relies on the Bifurcation Thesis, according to which all claims, and all rights, can be exhaustively divided into two categories: capacity based and exercise based.
