This paper draws on the 'Fitting Attitudes' analysis of value to argue that we should take the concept of fittingness (rather than value) as our normative primitive. I will argue that the fittingness framework enhances the clarity and expressive power of our normative theorising. Along the way, we will see how the fittingness framework illuminates our understanding of various moral theories, and why it casts doubt on the Global Consequentialist idea that acts and (say) eye colours are normatively on a (...) par. We will see why even consequentialists, in taking rightness to be in some sense determined by goodness, should not think that rightness is conceptually reducible to goodness. Finally, I will use the fittingness framework to explicate the distinction between consequentialist and deontological theories, with particular attention to the contentious case of Rule Consequentialism. The rightness and wrongness of actions fits on a continuous scale. This fits the way we evaluate actions chosen among a diverse range of options, even though English speakers don’t use the words “righter” and “wronger”. I outline and defend a version of scalar consequentialism, according to which rightness is a matter of degree, determined by how good the consequences are. Linguistic resources are available to let us truly describe actions simply as right. Moral agency is limited, imperfect, and structurally constrained. This is evident in the many ways we all unwittingly participate in widespread injustice through our everyday actions, which I call ‘structural wrongs’. To do justice to these facts, I argue that we should distinguish between summative and formative moral criticism. While summative criticism functions to conclusively assess an agent's performance relative to some benchmark, formative criticism aims only to improve performance in an ongoing way. I show that the negative sanctions associated (...) with summative responses are only justifiably imposed under certain conditions when persons exercise their agency wrongly — conditions that do not always hold for structural wrongs. Yet even in such cases we can still use formative responses, which are warranted whenever agents fall short of moral ideals. Expanding our repertoire of moral criticism to include both summative and formative responses enables us to better appreciate both the powers and limitations of our agency, and the complexity of moral life. Satisficing Consequentialism is often rejected as hopeless. Perhaps its greatest problem is that it risks condoning the gratuitous prevention of goodness above the baseline of what qualifies as "good enough". I propose a radical new willpower-based version of the view that avoids this problem, and that better fits with the motivation of avoiding an excessively demanding conception of morality. I further demonstrate how, by drawing on the resources of an independent theory of blameworthiness, we may obtain a principled specification of (...) what counts as "good enough". (shrink)

The concept of exploitation brings many of our ordinary moral intuitions into conflict. Exploitation—or to use the commonly accepted ordinary language definition, taking unfair advantage—is often thought to be morally impermissible. In order to be permissible, transactions must not be unfair. The claim that engaging in mutually beneficial transactions is morally better than not transacting is also quite compelling. However, when combined with the claim that morally permissible transactions are better than impermissible transactions, these three imply the counterintuitive claim that (...) it is obligatory to engage in mutually beneficial transactions. In this paper I outline the conditions that comprise this ‘paradox of exploitation’ along with a solution that involves replacing one of the original conditions with a condition I call Weak Non-worseness. The solution captures the priority of our concerns about exploitation by making a concern for the fairness of a transaction subsidiary to a concern for the welfare of the would-be exploited. It is widely accepted that morality does not demand that we do our very best, but our most significant moral traditions do not easily accommodate this intuition. I will argue that the underlying problem is not specific to any particular tradition. Rather, it will be difficult for any moral theory to account for binary moral concepts like permissible/impermissible while also accounting for scalar moral concepts like better/worse. If only the best is considered permissible, morality will seem either unreasonably demanding or (...) implausibly minimal. But if we draw a line of duty below the optimal, then we must explain how the act that is worse is nonetheless permissible. Some have tried to explain this by appealing to non-moral considerations, and others have appealed to agent-relative moral considerations. I argue that no such approach will work. We should instead exploit the distinction between reasons for performing an act and reasons for holding someone accountable for an act’s performance. This approach will also help to clear up a confusion regarding the notion of a moral demand. (shrink)

Francis Hutcheson's An Inquiry Into the Original of Our Ideas of Beauty and Virtue, published in 1725, arguably contains the first broadly utilitarian theory of rights ever formulated. In this essay, I argue that, despite its subtlety, there are crucial lacunae in Hutcheson's theory. One of the most important, which Mill seeks to repair, is that his theory of rights lacks a conceptually necessary companion, namely, a corollary account of obligation. Hutcheson has no theory of fully deontic obligations, much less (...) an account of the relational obligations that, as Hohfeld famously argued, are the conceptually necessary correlates of claim rights of the kind Hutcheson wishes to theorise. Like Hume, Hutcheson subversively redefines ‘obligation’ as a motive of self-interest or the approval of morally good motives by moral sense. This leaves Hutcheson without any account of the obligations that are the necessary correlates of claim rights. Mill does significantly better on this score but ends up giving a pragmatic ‘reason of the wrong kind’ for rights and obligations. Hutcheson thus begins a line of thought shown by him to have been powerless to ground rights without independent deontic premises from the start. (shrink)

Dogged resistance to demanding moral views frequently takes the form of The Demandingness Objection. Premise (1): Moral view V demands too much of us. Premise (2): If a moral view demands too much of us, then it is mistaken. Conclusion: Therefore, moral view V is mistaken. Objections of this form harass major theories in normative ethics as well as prominent moral views in applied ethics and political philosophy. The present paper does the following: (i) it clarifies and distinguishes between various (...) demandingness objections in the philosophical literature, (ii) identifies a formidable and interesting form of the demandingness objection that targets a wide scope of moral views, and (iii) defuses this objection by developing a local skeptical argument from unreliability the form of which may, interestingly, be effectively deployed in other areas of philosophy. It is often alleged that an agent is morally responsible in a liability sense for a transgression just in case s/he deserves a negative interpersonal response for that transgression, blaming responses such as resentment and indignation being paradigms. Aside from a few exceptions, guilt is cited in recent discussions of moral responsibility, if at all, as merely an effect of being blamed, or as a reliable indicator of moral responsibility, but not itself an explanation of moral responsibility. In this paper, (...) I argue that an agent is morally responsible in a liability sense for a transgression just in case s/he deserves to feel moral guilt for that transgression. I argue that this alternative view offers all that the predominant blame-focused view offers, while also solving some puzzling features of moral responsibility. Specifically, it offers a compelling way to reconcile conflicting intuitions about the suberogatory, and allows those who do not understand what Darwall calls ‘second-personal’ reasons to be morally responsible for their immoral acts. In the long history of moral theory, non-human animals—hereafter, just animals—have often been neglected entirely or have been relegated to some secondary status. Since its emergence in the early 19th century, utilitarianism has made a difference in that respect by focusing upon happiness or well-being (and their contraries) rather than upon the beings who suffer or enjoy. Inevitably, that has meant that human relations to and use of other animals have appeared in a different light. Some cases have seemed easy: (...) once admit that the interests of animals matter and there can be little hesitation in condemning their cruel treatment. Among the more difficult cases has been the bearing of utilitarianism upon the use of animals in various kinds of research where, though the animals might suffer, there were believed to be prospects of great human benefit and where no cruel or malicious motives need be involved. What I shall provide in the current paper is an extended discussion of the bearing of utilitarianism upon practices of animal research. Since such practices have attracted both utilitarian criticism and defense, this will require the examination of arguments on both sides, including consideration of the human benefits, the animal costs, and the ways in which the one can be weighed against the other. I first argue that there are many true claims of the form: Φ-ing would be morally required, if anything is. I then explain why the following conditional-type is true: If φ-ing would be morally required, if anything is, then anything is actually morally required. These results allow us to construct valid proofs for the existence of some substantive moral facts—proofs that some particular acts really are morally required. Most importantly, none of my argumentation presupposes any substantive moral claim; I use (...) only plausible claims that most moral skeptics and error theorists can and do accept. The final section diagnoses why my arguments work. Here, I offer an explanation for the supervenience of the moral on the non-moral that may help those worried that the strategy is a sophisticated trick. I conclude by considering two objections. In replying to these objections, I explain why the strategy may allow us to demonstrate more than “obvious” moral truths, and why it may also address a stronger version of error theory, according to which, moral truths are not possible. Scalar utilitarianism, a form of utilitarianism advocated by Alastair Norcross, retains utilitarianism's evaluative commitments while dispensing with utilitarianism's deontic commitments, or its commitment to the existence or significance of moral duties, obligations and requirements. This article disputes the effectiveness of the arguments that have been used to defend scalar utilitarianism. Morality is demanding; this is a platitude. It is thus no surprise when we find that moral theories too, when we look into what they require, turn out to be demanding. However, there is at least one moral theory – consequentialism – that is said to be beset by this demandingness problem. This calls for an explanation: Why only consequentialism? This then leads to related questions: What is the demandingness problematic about? What exactly does it claim? Finally, there is the (...) question of what we do if we accept that there is a demandingness problem for consequentialism: How can consequentialists respond? The present chapter sets out to answer these questions (or at least point to how they could be answered). (shrink)

Scalar Utilitarianism eschews foundational notions of rightness and wrongness in favor of evaluative comparisons of outcomes. I defend Scalar Utilitarianism from two critiques, the first against an argument for the thesis that Utilitarianism's commitments are fundamentally evaluative, and the second that Scalar Utilitarianism does not issue demands or sufficiently guide action. These defenses suggest a variety of more plausible Scalar Utilitarian interpretations, and I argue for a version that best represents a moral theory founded on evaluative notions, and offers better (...) answers to demandingness concerns than does the ordinary Scalar Utilitarian response. If Utilitarians seek reasonable development and explanation of their basic commitments, they may wish to reconsider Scalar Utilitarianism. (shrink)

According to an influential and intuitively appealing argument, morality is usually continuous, namely, a gradual change in one morally significant factor triggers a gradual change in another; the law should usually track morality; therefore, the law should often be continuous. This argument is illustrated by cases such as the following example: since the moral difference between a defensive action that is reasonable and one that is just short of being reasonable is small, the law should not impose a severe punishment (...) when the action is almost reasonable and no punishment at all when the action is reasonable. In this Article, I consider two doubts regarding this argument. First, the premise that morality is continuous in such cases is incompatible with the common view that the moral status of actions is not continuous since there is an important difference between actions that are permissible and actions that are wrong— even if this difference is due to a difference that is very small, such as the one between an action whose consequences are the best and an action whose consequences are just slightly less good. This view extends also to the overall moral status of agents given the common assumption that it depends on the moral status of their actions. This is an important challenge that the Continuity Argument should confront. However, I argue that the best account of morality is more scalar than the common view in these respects. Therefore, I conclude that the first premise of the Continuity Argument is correct in this regard, although it is based on a minority view. The second doubt concerns the scope of the second premise: since there are reasons both in favor and against legal continuity, and the applicability and force of these reasons depend not only on various moral propositions but also on contingent non-moral facts, we often lack the evidence to determine the degree to which the law, at a certain place and time, should be continuous, and specifically that it should often be continuous. A general introduction to consequentialism.

Define teleology as the view that requirements hold in virtue of facts about value or goodness. Teleological views are quite popular, and in fact some philosophers (e.g. Dreier, Smith) argue that all (plausible) moral theories can be understood teleologically. I argue, however, that certain well-known cases show that the teleologist must at minimum assume that there are certain facts that an agent ought to know, and that this means that requirements can't, in general, hold in virtue of facts about value (...) or goodness. I then show that even if we grant those 'ought's teleology still runs into problems. A positive justification of teleology looks like it will require an argument of this form: O(X); if X, then O(Y); therefore O(Y). But this form of argument isn't in general valid. I conclude by offering two positive suggestions for those attracted to a teleological outlook. (shrink)

Consequentialist views have traditionally taken a maximizing form, requiring agents to bring about the very best outcome that they can. But this maximizing function may be questioned. Satisficing views instead allow agents to bring about any outcome that exceeds a satisfactory threshold or qualifies as “good enough.” Scalar consequentialism, by contrast, eschews moral requirements altogether, instead evaluating acts in purely comparative terms, i.e., as better or worse than their alternatives. After surveying the main considerations for and against each of these (...) three views, I argue that the core insights of each are not (despite appearances) in conflict. Consequentialists should be deontic pluralists and accept a maximizing account of the ought of most reason, a satisficing account of obligation, and a scalar account of the weight of reasons. The following is an advertisement for scalar epistemic consequentialism. Benefits include an epistemic consequentialism that (i) is immune from the the no-positive-epistemic-duties objection and (ii) doesn’t require bullet-biting on the rightness of epistemic tradeoffs. The advertisement invites readers to think more carefully about both the definition and logical space of epistemic consequentialism.

According to act-consequentialism the right action is the one that produces the best results as judged from an impersonal perspective. Some claim that this requirement is unreasonably demanding and therefore consequentialism is unacceptable as a moral theory. The article breaks with dominant trends in discussing this so-called Overdemandingness Objection. Instead of focusing on theoretical responses, it empirically investigates whether there exists a widely shared intuition that consequentialist demands are unreasonable. This discussion takes the form of examining what people think about (...) the normative significance of consequentialist requirements. In two experiments, the article finds that although people are sensitive to consequentialist requirements and, on average, find more extreme demands less reasonable, the level of disagreement with consequentialism falls short of qualifying as a widely shared intuition, even when demands are the highest. The article then ends with a general discussion of possible objections to its methods and its findings. (shrink)

We ought to perform our best option—that is, the option that we have most reason, all things considered, to perform. This is perhaps the most fundamental and least controversial of all normative principles concerning action. Yet, it is not, I believe, well understood. For even setting aside questions about what our reasons are and about how best to formulate the principle, there is a question about how we should construe our options. This question is of the upmost importance, for which (...) option will count as being best depends on how broadly or narrowly we are to construe our options. In this paper, I argue that we ought to construe an agent’s options at a time, t, as being those actions (or sets of actions) that are scrupulously securable by her at t. (shrink)

Actions are usually grouped into one of several moral categories. Familiar ones include the morally required, the morally permitted, and the morally prohibited. These categories have been expanded and/or refined to include the supererogatory and the “suberogatory”. Some eschew deontic categories such as the above, but nevertheless allow the existence of two comparative moral categories, i.e., the morally better or morally worse. At the risk of adding to the clutter, I want to explore the possibility of yet a further category, (...) viz., amoral action, or actions that, strictly speaking, lack any moral status whatsoever. I think admitting the existence of amoral actions is not only plausible in its own right, but has consequences for our understanding the nature of moral obligation. (shrink)

What does it mean to object to a moral theory, such as maximizing consequentialism, on the grounds that it is too demanding? It is apparently to say that its requirements are implausibly stringent. This suggests an obvious response: Modify the theory so that its requirements are no longer as stringent. A consequentialist may do this either by placing the requirement threshold below maximization – thereby arriving at satisficing consequentialism – or, more radically, by dispensing with deontological notions such as “requirement” (...) altogether – thereby arriving at scalar consequentialism. Suppose, however, that a moral theory’s demandingness is not a matter of its requirements being stringent, but whether it entails that we have most reason, all things considered, to undertake burdensome actions. If this is the right account of demandingness – as I shall argue – then neither modification necessarily alleviates demandingness. We are led to the surprising conclusion that neither satisficing consequentialism nor scalar consequentialism is inherently less demanding than their more familiar maximizing counterpart. They are less demanding only when supplemented with ancillary, and controversial, assumptions. (shrink)

A promising strategy to make progress in the debate between consequentialist and non-consequentialist moral theories is to unravel the background assumptions of the respective views and discuss their plausibility. This paper discusses a background assumption of consequentialism that has not been noticed so far. Consequentialists claim that morality is about maximizing the impersonal good, and the background assumption is that an appropriate response to the impersonal good is necessarily a response to the impersonal good as a whole. In this paper, (...) I argue that we should understand the impersonal good as a complex good, and that an appropriate responses to a complex good need not be a response to that good as whole. This constitutes a novel objection against consequentialism. (shrink)

In a very short article, James Sterba argues that there is a moral duty to sacrifice one’s life to save the lives of others. Sterba justifies this duty by drawing an analogy with a series of cases in which some degree of sacrifice would be commonly accepted for the benefit of third parties. In this paper, I argue that Sterba’s argument reaches the correct conclusion, but is invalid. In addition, I point out two different arguments to support the existence of (...) a duty to sacrifice one’s life to save the lives of others. (shrink)

Extremism about Demands is the view that morality is significantly more demanding than prevailing common-sense morality acknowledges. This view is not widely held, despite the powerful advocacy on its behalf by philosophers such as Peter Singer, Shelly Kagan, Peter Unger, and G.A. Cohen. Most philosophers have remained attracted to some version of Moderation about Demands, which holds that the behavior of typical well-off people is permissible, including the ways that such people tend to employ their economic and other resources. It (...) is difficult to resist the conclusion that proponents of Extremism have not taken sufficiently seriously the central convictions that motivate the Moderate view. -/- This dissertation offers an improved defense of Extremism about Demands. At its center is an argument that appeals dialectically to requirements of justice that Moderates themselves already implicitly accept. Specifically, I claim that any plausible set of Moderate moral principles will, when applied to a world like ours, yield demands on typical well-off people that far exceed the demands of common-sense morality. -/- My argument has two cruxes. The first is the idea that our concern for justice is at least partially grounded in a concern for individuals’ interests, broadly construed. The other is a principle that I call Injustice entails Obligations, which says that we are collectively subject to requirements of justice that, if fully complied with, would ensure the transition from current injustice to a just state of affairs. Any view that is compatible with both the interest-based view of (part of) our concern for justice and Injustice entails Obligations will, I argue, require sacrifices from typical well-off people that substantially exceed what prevailing common-sense morality requires of them. -/- Moderates typically emphasize the idea that each person has an important interest in pursuing the projects, plans, relationships, and commitments that are most important to her. But they also believe that acceptable Moderate principles will properly balance this idea with the idea that from a properly impartial perspective everyone, and everyone's interests, are equally morally important. Because Moderates accept the latter idea, they are already committed to thinking that in a just world, everyone would have a sufficient minimum share of society’s resources. I argue that even if we limit our focus to distributive justice in a single society such as the United States, and even if we assume that distributive justice requires only a sufficient minimum, the extent to which the status quo must be transformed in order for justice to be achieved is still too great to be compatible with Moderate demands on typical well-off people. -/- There are a number of ways to try to argue that Moderate principles and Injustice entails Obligations are compatible with Moderation about Demands. For instance, it might be argued that all or nearly all of the demands to sacrifice in order to promote justice can be assigned to the super-rich, rather than to typical well-off people. Or it might be argued that the sacrifices of a single well-off person cannot be required because they amount to a mere “drop in the bucket” relative to what needs to be done in order to fully achieve justice. I show that such arguments fail. -/- The argument that I consider in greatest detail derives from John Rawls’s view that the principles of justice apply to the institutions of the “basic structure of society,” and do not apply directly to the conduct of individuals. If this “Institutionalism” is right, then it cannot be the case that individuals are obligated to promote justice directly in the way that I suggest they are. Furthermore, it might seem that a view that assigns all of the burdens of promoting justice to the basic structure satisfies the imperative to transition from injustice to justice, since if the relevant institutions were to begin doing everything that the Rawlsian view says they ought to be doing, the requirements of justice would be met. I argue, however, that there is no understanding of Institutionalism on which it is itself consistent with the following desiderata: Moderate principles, and the associated interest-based view of (part of) the ground of our concern for justice; Injustice entails Obligations; and Moderate demands. So, Institutionalism cannot make Moderate principles and Injustice entails Obligations compatible with Moderate demands. -/- Moderate principles and Injustice entails Obligations, then, remain incompatible with Moderation about Demands. Since there are compelling reasons to accept both Moderate principles and In justice entails Obligations, I conclude that we must reject Moderation about Demands. The obligations that justice places on typical well-off people are substantially more extensive than is acknowledged by prevailing common-sense morality. (shrink)

Value-based epistemology sees epistemic norms as explained by or grounded in distinctively epistemic values. This paper argues that, no matter what epistemic value is, credences or beliefs about some topics have at most infinitesimal amounts of this value. This makes it hard to explain why epistemic norms apply at all to credences or beliefs on these topics. My argument is inspired by a recent series of papers on epistemic versions of Parfit’s Repugnant Conclusion. The discussion in those papers parallels work (...) in ethics, because it focuses on an epistemic value—accuracy—that shares features with ethical values like well-being. I argue that, because of this focus, this discussion is inconclusive and only relevant to accounts of epistemic value that share those features. My argument is more general and more conclusive. It uses four types of problem cases that have no parallel in ethics. It applies to all extant accounts of the value of individual beliefs or credences and all extant accounts of the value of total doxastic states. (shrink)
