A key and continuing concern within the pragma-dialectical theory of argumentation is how to account for effective persuasion disciplined by dialectical rationality. Currently, van Eemeren and Houtlosser offer one response to this concern in the form of strategic manoeuvring. This paper offers a prior/passing theory of communicative interaction as a supplement to the strategic manoeuvring approach. Our use of a prior/passing model investigates how a difference of opinion can be resolved while both dialectic obligations of reasonableness and rhetorical ambitions of (...) argumentative success are simultaneously accommodated. The paper explores the model with particular reference to the pragma-dialectical rules of critical discussion, strategic manoeuvring and fallacious reasoning. (shrink)

The main stream of formal and informal logic as well as more recent work in discourse analysis provides a way of understanding certain arguments that particularly lend themselves to rational analysis. I argue, however, that these, and allied modes of analysis, be seen as heuristic models and not as the only proper mode of argument. This article introduces three other modes of argumen tation that emphasize distinct aspects of human communication, but that, at the same time, must be considered for (...) the full understanding of argumentation. These modes are (1) the emotional, which relates to the realm of feelings, (2) the visceral, which stems from the area of the physical, and (3) the kisceral, which covers the intuitive and non-sensory arenas. At its most extreme the view holds that arguments may be given (almost) wholly within one mode and not be at all susceptible to those methods of argument analysis previously used. A more cautious statement allows that any interactive argument will (possibly) contain elements from various modes, and that to attempt to reduce these all to the rational is prejudiced reductionism. This paper investigates the construction of social identity in Israeli historian of religion Gershom Scholem's letter to American political theorist Hannah Arendt in the wake of the Eichmann trial. The paper asks, first, whether Arendt is depicted as a natural insider or a moral outsider of the relevant human community and what this construction entails as to the nature of the group itself. And second, what the relationship may be between members of the group and the universal demand of writing (...) about the Holocaust in a morally just way. In pursuing these issues, it is suggested that Scholem's ultimate account as to Arendt's subject position is that of the Jewish anti-Semite: a person who is Jewish but by her acts effectively renounces this position. The closing parts of the paper analyse the implications of the letter and the resulting relationship constructed between the political tradition of Judaism and that of liberalism. (shrink)

The article focuses on the new rhetoric category of quasi-logical arguments, defined as arguments similar to logical or mathematical demonstrations, and therefore having an effect on the audience. Connecting the similarity of arguments to formal demonstrations with the claim of effect on audience is conceived in this article as the thesis of effectiveness of quasi-logical arguments. The components of the thesis are reconstructed and analyzed, and their precise definitions are proposed. The analysis shows that the category of quasi-logical arguments is (...) ambiguously defined and currently includes three different concepts based on a different understanding of similarity. Subsequently, it is showed that based on Perelman and Olbrechts-Tyteca’s works, the explanation of quasi-logical arguments’ effect on an audience can be offered in terms of socially shared standards of community or in terms of individual processing of arguments. It is shown that these explanations can be in conflict each other regarding the assumption of the addressee’s acquaintance with formal principles. (shrink)

The notions of “rational” and “reasonable” have much in common but are not synonymous. Conducting a review of the literature points to (at least) two distinct but related ideas as well as a middle “grey” area. This paper investigates and compares some characterizations of these notions and defends the view that focusing on reasonableness is best for those interested in human instances of reasoning and argumentation.

This paper attempts to sort out some of the current tensions and ambiguities inherent in the field of bioethics as it continues to mature. In particular it focuses on the question of the methodological relevance of theory or ethical principles to the domain of clinical ethics. I offer an approach to reasoning about moral conflict that combines the insights of contemporary moral theorists, the philosophy of American pragmatism, and the skills of rhetorical deliberation. This synthetic approach locates a proper role (...) for moral theory in the practice of clinical ethics, thus linking abstract philosophical ideas about morality, humanity, suffering, and health to specific deeds, actions, and decisions in the concrete lives of particular individuals. The aim of this synthetic approach of bioethical inquiry is a rapprochement between theoretical knowledge in moral philosophy and the contextualized, relational, and practical understanding of what morality demands of us in our daily lives. I argue for a conception of bioethical inquiry that takes morality to be a study of certain practical, socially embedded concerns about matters of right and wrong, good and evil, as well as a study of the moral theories by which these actual concerns can be explored and critically evaluated. Perelman’s discussion about the distinction and relation between the rational and the reason-able could be seen as an attempt to bring forward a new understanding of rationality. In light of the concep-tion of situated reason, this paper argues that Perelman’s explication of the dialectic of the rational and the reasonable highlights the balance of universality and contexuality, and could contribute a fuller conception of rationality to establishing a solid philosophical foundation for Johnson’s informal logic.

One of the most crucial questions in the philosophy of law deals with the very nature of legal reasoning. Does this reasoning belong to logic or to rhetoric? This debate, increasingly centered on rhetoric, is not merely a question of language use; it covers and indicates a more basic choice between formal legalism — focusing on rational deduction from the law — and pragmatic judiciarism — focusing on reasonable debate in the court.Today, it is necessary to circumscribe the respective fields (...) of logic and rhetoric in the language of law, while showing how they are sometimes complementary in the resolution of legal problems.But, even when we have acknowledged the need for a rhetoric accompanied by logic, we have to define that rhetoric cautiously. I confront a narrow rhetoric, often called argumentation, with a wider one of interrogative nature. There are two conceptions of rationality at stake. Their comparison enables us to raise the question of the foundation of law, as a locus to use arguments, as well as to solve social problems. (shrink)

Resumen En este trabajo analizo algunos de los argumentos clásicos que la tradición retórica contrapone al discurso filosófico. Para ello, comienzo sobrevolando las características que definen al discurso filosófico de filiación platónico-cartesiana, y que son relevantes para la querella con la retórica. Luego intento elaborar un ataque en dos frentes. Por un lado, me detengo en la rehabilitación de la doxa como elemento vital del discurso práctico, en contra de la depreciación a que se ve sometida bajo el enfoque universalista (...) de la filosofía. Luego, tomando como base la noción de sentido común, analizo la idea de "auditorio", esencial para la retórica, y la consiguiente pluralidad de esferas de validez que conlleva. Dicha pluralidad horizontal contrasta con el monismo verticalista del discurso filosófico. Finalmente, en la conclusión dejo abierto uno de los problemas más urgentes de este movimiento pluralista que propone la retórica.In this paper I analyze some classical arguments used by rhetorical tradition to oppose philosophical discourse. To do this, I give a brief account of the characteristics defining the philosophical discourse of Platonic-Cartesian affiliation that are relevant for the dispute with Rhetoric. Then, on the one hand, I dwell upon the rehabilitation of doxa as a vital element of practical discourse in order to countering the downgrading of doxa by the universalistic approach of philosophy. On the other hand, based on the notion of common sense, I analyze the idea of "audience", essential for Rhetoric, as well as the resulting plurality of spheres of validity. This horizontal plurality contrasts with the vertical monism of philosophical discourse. Finally, in the conclusion I point out one of the most urgent problems of this pluralistic movement that rhetoric has proposed. (shrink)
