Women's exclusion from political enfranchisement in Kant's political writings has frequently been noted in the literature, and yet has not been closely scrutinized. More often than not, commentators suggest that this reflects little more than Kant's sharing in the prejudices of his era. This paper argues that, for Kant, women's civil incapacities stem from defects relating to their capacities as moral agents, and more specifically, to his teleological account of the conditions within which we, as imperfect beings, develop our moral (...) capacities. Women are not incidentally or tangentially excluded from the boundaries of political and moral agency, but rather must adopt an explicitly nonmoral character if we are to understand humanity as moving toward its naturally given, moral ends. I argue (1) that Kant's teleological view of human development requires women to develop an explicitly nonmoral character; (2) that this teleology is inextricable from his view of the moral agency that human—and not merely rational—beings are capable of; and (3) that taken together, these suggest that women's subordinate status is internally connected to Kant's view of moral personhood. Should we conceive of corporations as entities to which moral responsibility can be attributed? This contribution presents what we will call a political account of corporate moral responsibility. We argue that in modern, liberal democratic societies, there is an underlying political need to attribute greater levels of moral responsibility to corporations. Corporate moral responsibility is essential to the maintenance of social coordination that both advances social welfare and protects citizens' moral entitlements. This political account posits a special capacity of self-governance (...) that corporations can intelligibly be said to possess. Corporations can be said to be "administrators of duty" in that they can voluntarily incorporate moral principles into their decision-making processes about how to conduct business. This account supplements and partly transforms earlier pragmatic accounts of corporate moral responsibility by disentangling responsibility from its conventional linkages with accountability, blame and punishment. It thereby represents a distinctive way to defend corporate moral responsibility and shows how Kantian thinking can be helpful in disentangling the problems surrounding the concept. (shrink)

Kant infamously opposes not only revolution but also any resistance or disobedience by citizens that aims to compel states to reform themselves. This paper argues that, in fact, the Kantian account of the legitimate state has the resources for a distinctive justification of principled disobedience, including even violent or destructive resistance, that applies to citizens of contemporary Western democracies. When a state fails to enforce the law equally, this lack of equal enforcement can deprive some citizens of the equal assurance (...) of the security of their rights that, on the Kantian account, forms part of the very basis of the state’s claim of legitimate authority. This failure of equal enforcement of the law will thus be a defect of legitimacy and, as a result, those citizens may engage not only in civil disobedience but also in uncivil disobedience, even violent or destructive resistance, in order to compel the state to reform itself. In this context, such disobedience or resistance will count as furthering rather than undermining the project of governance by legitimate law. (shrink)

The chapter begins with an initial survey of ups and downs of contextualist history of philosophy during the twentieth century in Britain and America, which finds that historically serious history of philosophy has been on the rise. It then considers ways in which the study of past philosophy has been used and is used in philosophy, and makes a case for the philosophical value and necessity of a contextually oriented approach. It examines some uses of past texts and of history (...) that reveal limits to noncontextual history, including Strawson's Kant, Rorty's grand diagnosis of the Western tradition, and Friedman on Kant's philosophy of mathematics. It then considers ways in which the history of philosophy may become philosophically deeper by becoming more historical, and instances in which history of philosophy of various stripes has or may deliver a philosophical payoff. Along the way, it urges historians of philosophy to attend not only to individual philosophers and their problems and projects, but also to the larger shape of the history of philosophy and its narrative themes. Kant’s political theory stands in the social contract tradition, but departs significantly from earlier versions of social contract theory. Most importantly Kant holds, against Hobbes and Locke, that we have not merely a pragmatic reason but an obligation to exit the state of nature and found a state. Kant holds that each person has an innate right to freedom, but it is possible to simultaneously honor everyone’s right only under the rule of law. Since we are obligated to respect each (...) person’s right to freedom, and can do so only in a state, we are obligated to submit to the authority of the state if we have one, and to establish one if we do not. In the first half of the essay I reconstruct this argument in more detail. In the second half I survey four points of controversy: (i) What is the relationship between Kant’s political philosophy and his moral philosophy? (ii) How does the innate right to freedom support the postulate that we are permitted to acquire property and other private rights? (iii) How does the postulate support an obligation to found the state? (iv) How should we understand Kant’s views about political revolutions? (shrink)

In his Groundwork of the Metaphysics of Morals , Kant explains that ethics, like physics, ‘will have its empirical part, but it will also have a rational part, … though here [in ethics] the empirical part might be given the special name practical anthropology’ . In the Groundwork, Kant suggests that anthropology, or the ‘power of judgment sharpened by experience’, has two roles, ‘to distinguish in what cases [moral laws] are applicable’ and ‘to gain for [moral laws] access to the (...) human will’ . Twelve years later, the first function, of applying the categorical imperative to specifically human situations, is incorporated into Kant's Metaphysics of Morals. (shrink)

Ever since Kant asked: “How am I to develop the sense of freedom in spite of the restraint?” in his lecture on education, the tension between necessary educational influence and unacceptable restriction of the child’s individual development and freedom has been considered an educational paradox. Many have suggested solutions to the paradox; however, this article endorses recent discussions in educational philosophy that pursue the need to fundamentally rethink our understanding of education and upbringing. In this article it is argued that (...) it is incomprehensible to describe an intervention of an educator as a constraint on a child’s actions and that such an intervention would be in need of justification; as Kant and many others after him have done. Educational intervention should not be understood as a restriction of a child’s endeavour to learn, because any educational intervention is educational. Furthermore, it is argued that the notion of restraint is based on the concept of human beings as radically separated which lead to the assumption that education is restrictive per se. In contrast, this article argues that indoctrination, manipulation, and coercion are rather phenomena within our educational forms of life. Recognizing the interrelations between human beings should play a constitutive part in the conceptualisation of individual freedom. A bond with others is the foundation upon which a child develops its own identity and an understanding of itself as an agent who can express its own will and takes responsibility for its words and actions. 'Corporate Social Responsibility (CSR) is conceptualized in many ways. We argue that one cannot be indifferent about the issue of its conceptualization. In terms of methodology, our position is that any conceptual discussion must embed CSR in political theory. With regard to substance, we link up with the discussion on whether CSR must be defined on the basis of a tripartite or a quadripartite division of business responsibilities. We share A. B. Carroll's intuition that a quadripartite division is called for (...) as a basis to define CSR. However, defending the quadripartite division of business responsibilities requires that the distinctions between economic, legal, ethical and discretionary business responsibilities be made intelligible. Carroll's account is defective in this respect. We argue that contemporary Neo-Kantian political ethics is able to make sense of these distinctions, because of its specific interpretation of liberalism. Interestingly, from a conventional liberal perspective this interpretation of liberalism is atypical, as it extends public morality beyond the domain of the law. (shrink)

Es werden zwei unterschiedliche Modelle vorgestellt: zum einen die Autonomie-Konzeption Kants, die auf dem Begriff des freien Willens gründet, der sich selbst dem Vernunftgesetz unterstellt; zum anderen die von Platon inspirierte Moralphilosophie Iris Murdochs, in der die moralische Sehkraft, die sich an der aufmerksamen Wahrnehmung des konkreten Einzelnen orientiert, im Mittelpunkt des guten Lebens steht. In der Auseinandersetzung mit den beiden Entwürfen werden deren Stärken und (...) Schwächen deutlich. Die Arbeit mündet in einen Vorschlag, wie Kants und Murdochs Grundintuitionen konstruktiv miteinander versöhnt werden können. (shrink)

El presente trabajo reconstruye algunos de los momentos principales del debate acerca del concepto de "raza humana" que tuvo lugar hacia finales del siglo xviii entre Kant, Forster y Herder. El objetivo de esta reconstrucción es mostrar, en una primera instancia, que esa polémica se hallaba determinada por la necesidad de adaptar las herramientas histórico-naturales heredadas a la emergencia de una concepción irreversible de la variable temporal. En un segundo momento, es analizada la posición asumida por Kant frente a los (...) problemas epistémicos que generaba la progresiva temporización de los fenómenos naturales. Según se demuestra a partir del presente análisis, la introducción de principios regulativos y el giro kantiano hacia el ámbito de la subjetividad se hallaban orientados a respaldar la vigencia de la comprensión clásica de las formas orgánicas naturales, de modo a garantizar el carácter sistemático del orden natural en un contexto en el cual las transformaciones histórico-naturales ya no resultaban concebibles bajo el modelo clásico de la reversibilidad temporal. This work reconstructs some key moments of the debate on the concept of "human race" that took place in the late eighteenth century among Kant, Forster and Herder. It aims to show, first, that this controversy was defined by the need to adapt the natural-historical tools inherited from the emergence of a conception of irreversible temporality. Secondly, it analyses Kant´s position regarding the epistemic problems generated by the progressive temporization of natural phenomena. Based on this analysis, it is shown that the introduction of regulative principles and the Kantian turn toward subjectivity tended to support the validity of the classic understanding of natural-organic forms, and thus, to guarantee the systematic character of natural order in a context in which historical and natural transformations could no longer be conceived under the classic model of temporal reversibility. It is generally acknowledged that Kant's political philosophy stands on a par with the great works of the Western liberal tradition. It is also a matter of agreement that the rational principles on which it rests represent an adequate philosophical expression of the progressive agenda that was inaugurated by the Enlightenment and fulfilled, with varying degrees of success, by the French Revolution. Yet Kant's philosophical position is ambiguous when it comes to evaluating that momentous event in modern history. We know, (...) from anecdotal evidence, some surviving letters, several cryptic references in his published works, as well as a number of posthumously published reflections, that Kant was enthusiastic about and strongly approved of the changes that were taking place in France at the time. He certainly condemned, in strong and unequivocal terms, the execution of Louis XVI. But this did not translate into a repudiation of his support for the revolution. And he seems to have found even in this case mitigating circumstances that explained the revolutionaries' decision to execute the monarch, thus in fact excusing their action. Moreover, he argued that all post-revolutionary governments ought to command the same kind of loyalty from their subjects as the ones they replaced, which appears to justify Kant's contention in the Idea for a Universal History that political violence can be a vehicle of progress. Furthermore, in the Contest of Faculties Kant went so far as to identify in the enthusiastic response of the ‘spectators’ to the French Revolution a clear sign of the moral disposition of humankind. Although no one can deny the profound importance of John Rawls's work in political philosophy, which covered both an original theory of justice and extensive work and teaching on the history of moral and political philosophy, we are now at the point where his contributions more clearly suggest certain historical limitations. Such topics as gender justice, racial justice, and environmental justice figured in Rawls's work only belatedly and in less than satisfactory ways. Surely the wide influence of the Rawlsian revolution (...) should suggest that the erasures and blindspots in his historical reconstructions ought to be acknowledged and addressed, rather than avoided out of some misguided conception of charity in interpretation. This paper operates from the assumption that revolution is a legitimate tool for members of oppressed minority groups to secure their rights. I argue that this type of robust right of revolution cannot be derived from Locke’s justification of revolution in the Second Treatise. For Locke, revolution is justified when the government uses its power in a manner contrary to the principles on which the state was established. Whether or not an action is contrary to these principles is determined by (...) the people as a whole (i.e., the majority). Members of oppressed minority groups, therefore, would be justified in exercising their right of revolution only if they could garner support from a majority of the citizenry. In many instances, satisfying this criterion would require oppressed individuals to receive support from their oppressors—a practical impossibility. Since this requirement is rooted in Locke’s account of the origins of civil society, if it is the case that revolution is a legitimate tool for members of oppressed minority groups to secure their rights, then it would be necessary to look elsewhere for theoretical support to justify a robust right of revolution. I argue that such support can be found in a deontological account of civil society. (shrink)
