Abstract In his paper “The Opposite of Human Enhancement: Nanotechnology and the Blind Chicken problem” ( Nanoethics 2: 305-36, 2008) Thompson argued that technological attempts to reduce or eliminate selected non-human animals’ capabilities (animal disenhancements) in order to solve or mitigate animal welfare problems in animals’ use pose a philosophical conundrum, because there is a contradiction between rational arguments in favor of these technological interventions and intuitions against them. In her response “Animal Disenhancement and the Non-Identity Problem: A Response to (...) Thompson” ( Nanoethics 5:43–48, 2011), Palmer maintained that the philosophical conundrum is even deeper if we introduce the non-identity problem into the discussion. In my brief response, I claim that in order to avoid the pitfalls of speculative ethics, empirical facts related to the technologies involved as well as costs for the non-human animals have to be taken into account. Depending on which changes we are referring to, ethical problems can be seen very differently. Widening the consideration to the socio-economic context in which non-human animals are currently used by humans, I challenge the idea of genuine philosophical conundrums from an antispeciesist and abolitionist perspective. Only in a context of exploitation, in which non-human animals are deprived of basic rights and their existence is totally dependent on human exploitation, the contradictions between improvement of welfare and disenhancement of capabilities make sense. Abstract Drawing upon evolutionary theory and the work of Daniel Dennett and Nicholas Agar, I offer an argument for broadening discussion of the ethics of disenhancement beyond animal welfare concerns to a consideration of animal “biopreferences”. Short of rendering animals completely unconscious or decerebrate, it is reasonable to suggest that disenhanced animals will continue to have some preferences. To the extent that these preferences can be understood as what Agar refers to as “plausible naturalizations” for familiar moral concepts like beliefs (...) and desires, then they can make moral claims on us and provide support for intuitive opposition to disenhancement. We are entering an era in which “cultural construction of the body” refers to a literal technological enterprise. This era was anticipated in the 1920s by geneticist J. B. S. Haldane in a lecture which inspired Aldous Huxley's Brave New World. In that lecture, Haldane reinterpreted the Greek myth of Daedalus and the Minotaur as heroic fable. Seventy years later another geneticist, François Jacob, used the same myth as cautionary tale. Here I explain the Minotaur's “genetic” monstrosity in terms of (...) disability and hybridity, using the movie Gattaca to argue that ancient fears of monstrously disabled bodies are being recycled as bioethics. In this paper I deal with ethical implications arising from animal biotechnology. I analyse some general questions surrounding the production of transgenic animals through a specific case study: the oncomouse. In particular, I explore ethical factors involved in the production of oncomice. This is because biologists genetically modify animals’ germ cells and refuse to modify human germ cells. I will underline how the international community has thus far justified this ‘ethical difference’.

A critique is made of Bernard Rollin''s examination of the ethics of cloning adult mammalian cells. The primary concern is less to propound an anticloning or procloning position than to call for full exploration of the ethical complexities before a rush to judgment is made. Indeed, the ethical examination in question rushes toward an ethical position in such a way that does not appear consistent with Rollin''s usual methodology. By extending this methodology – which entails full weighing of benefits and (...) costs – it becomes apparent that there are real potential risks to this type of cloning in both animals and humans, besides the possible benefits, and that the scientific, political, philosophical, and broader academic communities should explore these risks and benefits extensively. Rollin''s usual methodological call for hesitation before risks would translate into hesitation before the ethical risks of adult mammalian cell cloning instead of his paper''s curiously laissez-faire stance. The 1992 incorporation of an article by referendum in the SwissConstitution mandating that the federal government issue regulations onthe use of genetic material that take into account the dignity ofnonhuman organism raises philosophical questions about how we shouldunderstand what is meant by ``the dignity of nonhuman animals,'' andabout what sort of moral demands arise from recognizing this dignitywith respect to their genetic engineering. The first step in determiningwhat is meant is to clarify the difference between dignity when appliedto humans and (...) when applied to nonhumans. Several conceptions of humandignity should be rejected in favor of a fourth conception: the rightnot to be degraded. This right implies that those who have it have thecognitive capacities that are prerequisite for self-respect. In the caseof nonhuman organisms that lack this capacity, respecting their dignityrequires the recognition that their inherent value, which is tied totheir abilities to pursue their own good, be respected. This value isnot absolute, as it is in the case of humans, so it does not prohibitbreeding manipulations that make organisms more useful to humans. But itdoes restrict morally how sentient animals can be used. In regard togenetic engineering, this conception requires that animals be allowedthe uninhibited development of species specific functions, a positionshared by Holland and Attfield, as opposed to the Original Purposeconception proposed by Fox and the Integrity of the Genetic Make-upposition proposed by Rolston. : The current difference in attitude toward germ-line enhancement in humans and nonhumans is unjustified. Society should be more cautious in modifying the genes of nonhumans and more bold in thinking about modifying our own genome. I identify four classes of arguments pertaining to germ-line enhancement: safety arguments, justice arguments, trust arguments, and naturalness arguments. The first three types are compelling, but do not distinguish between human and nonhuman cases. The final class of argument would justify a distinction between human (...) and nonhuman germ-line enhancement; however, this type of argument fails and, therefore, the discrepancy in attitude toward human and nonhuman germ-line enhancement is unjustified. As a relational concept, responsible innovation can be made more tangible by asking innovation of what and responsibility of whom for what? Arranging the scattered field of responsible innovation comprehensively, starting from an anthropological point of view, into five fields of tension and five categories of spearheads, may be theoretically and practically helpful while offering suggestions for both research and management.

The primary responsibility of the US Food and Drug Administration is to protect public health by ensuring the safety of the food supply. To that end, it sometimes conducts risk assessments of novel food products, such as genetically modified food. The FDA describes its regulatory review of GM food as a purely scientific activity, untainted by any normative considerations. This paper provides evidence that the regulatory agency is not justified in making that claim. It is argued that the FDA’s policy (...) stance on GM food is shaped by neoliberal considerations. The agency’s review of a genetically engineered animal, the AquAdvantage salmon, is used as a case study to track the influence of neoliberalism on its regulatory review protocol. After that, an epistemic argument justifying public engagement in the risk assessment of new GM food is outlined. It is because risk evaluations involve normative judgments, in a democracy, layperson representatives of informal epistemic communities that could be affected by a new GM food should have the opportunity to decide the ethical, political or other normative questions that arise during the regulatory review of that entity. In recent years, humans’ ability to selectively modify genes has increased dramatically as a result of the development of new, more efficient, and easier genetic modification technology. In this paper, we argue in favor of using this technology to improve the welfare of agricultural animals. We first argue that using animals genetically modified for improved welfare is preferable to the current status quo. Nevertheless, the strongest argument against pursuing gene editing for welfare is that there are alternative approaches to addressing (...) some of the challenges of modern agriculture that may offer ethical advantages over genetic modification; namely, a dramatic shift towards plant-based diets or the development of in vitro meat. Nevertheless, we provide reasons for thinking that despite these possible comparative disadvantages there are important reasons for continuing the pursuit of welfare improvements via genetic modification. The meteoric rise of CRISPR/Cas9 gene editing technology has ignited discussions of engineering agricultural animals to improve their welfare. While some have proposed enhancing animals, for instance by engineering for disease resistance, others have suggested we might diminish animals to improve their welfare. By reducing or eliminating species-typical capacities, the expression of which is frustrated under current conditions, animal diminishment could reduce or eliminate the suffering that currently accompanies industrial animal agriculture. Although diminishment could reduce animal suffering, there is a (...) widespread intuition that it would be wrong. One attempt to justify this intuition has been to claim that inhibiting the development of species-typical functions is wrong, even if it improves welfare. This has often been couched in terms of violating an animal’s dignity. I argue that the dignity objection to diminishment fails. In the first place, it fails to apply to some of the most troubling cases of diminishment, the creation of so-called animal microencepahlic lumps. In the second place, dignity views misplace the normative relevance of species norms; I argue that considerations from evolutionary biology should lead us to treat species norms - such as the possession of typical capacities - as merely a heuristic for rendering judgments about welfare. But diminishment cases are precisely the cases where the heuristic breaks down, and becomes a bias. I close my discussion with a sketch of my Historical Injustices Approach to animal ethics, and how it may help us vindicate our intuition that diminishment is wrong without appeal to species norms. Pedigree dog breeding has been the subject of public debate due to health problems caused by breeding for extreme looks and the narrow genepool of many breeds. Our research aims to provide insights in order to further the animal-ethical, political and society-wide discussion regarding the future of pedigree dog breeding in the Netherlands. Guided by the question ‘How far are we allowed to interfere in the genetic make-up of dogs, through breeding and genetic modification?’, we carried out a multi-method case-driven (...) research, reviewing literature as well as identifying the perceptions of pedigree dog breeding of a variety of parties in the Netherlands. We examined what moral arguments and concepts different stakeholders, including breeders, veterinarians and animal protection societies, put forward when considering this question. While welfare arguments were often used as a final justification, we also frequently encountered arguments beyond welfare in practice, in particular the arguments that certain adaptations were unnatural, that they instrumentalised animals, or that they amounted to playing God. We argue that the way these arguments are employed points to a virtue ethical approach, foregrounding the virtue of temperance, as a balance between extreme positions was sought by our respondents in a variety of ways. Moreover, we argue against a rejection of unnaturalness arguments based on the naturalistic fallacy, as philosophers tend to do. We point out that unnaturalness arguments are related to people’s worldviews, including views on the proper human–animal relationship. We argue that such arguments, which we label ‘life-ethical’, should be the subject of more public discussion and should not be relegated to the private sphere. (shrink)

Animal ethicists have recently debated the ethical questions raised by disenhancing animals to improve their welfare. Here, we focus on the particular case of breeding hens for commercial egg-laying systems to become blind, in order to benefit their welfare. Many people find breeding blind hens intuitively repellent, yet ‘welfare-only’ positions appear to be committed to endorsing this possibility if it produces welfare gains. We call this the ‘Blind Hens’ Challenge’. In this paper, we argue that there are both empirical and (...) theoretical reasons why even those adopting ‘welfare-only’ views should be concerned about breeding blind hens. But we also argue that alternative views, which (for example) claim that it is important to respect the telos or rights of an animal, do not offer a more convincing solution to questions raised by the possibility of disenhancing animals for their own benefit. Animal models are used in experiments in the behavioural neurosciences that aim to contribute to the prevention and treatment of cognitive and affective disorders in human beings, such as anxiety and depression. Ironically, those animals that are likely to be the best models for psychopathology are also likely to be considered the ones that are most morally problematic to use, if it seems probable that (and if indeed they are initially selected as models because) they have experiences that are similar (...) to human experiences that we have strong reasons to avoid causing, and indeed aim to alleviate (such as pain, anxiety or sadness). In this paper, against the background of contemporary discussions in animal ethics and the philosophy of animal minds, we discuss the views that it is morally permissible to use animals in these kinds of experiments, and that it is better to use less cognitively complex animals (such as zebrafish) than more complex animals (such as dogs). First, we criticise some justifications for the claim that human beings and more complex animals have higher moral status. We argue that contemporary approaches that attribute equal moral status to all beings that are capable of conscious strivings (e.g. avoiding pain and anxiety; aiming to eat and play) are based on more plausible assumptions. Second, we argue that it is problematic to assume that less cognitively complex animals have a lesser sensory and emotional experience than more complex beings across the board. In specific cases, there might be good reasons to assume that more complex beings would be harmed more by a specific physical or environmental intervention, but it might also be that they sometimes are harmed less because of a better ability to cope. Determining whether a specific experiment is justified is therefore a complex issue. Our aim in this chapter is to stimulate further reflection on these common assumptions behind the use of animal models for psychopathologies. In order to be able to draw more definite conclusions, more research will have to be done on the influence of cognitive complexity on the experience of (human and non-human) animals. (shrink)

I argue in this paper that animal biotechnology constitutes a dangerous ontological collapse between animals and the technical-economic apparatus. By ontological collapse, I mean the elimination of fundamental ontological tensions between embodied subjects and the principles of scientific, technological, and economic rationalization. Biotechnology imposes this collapse in various ways: by genetically “reprogramming” animals to serve as uniform commodities, by abstracting them into data and code, and, in some cases, by literally manipulating their movements with computer technologies. These and other forms (...) of ontological violence not only lead to profound physical suffering for the animals involved, but also distort the phenomenological basis of their existence, especially their perceptual experience and expression of subjective time and space. In subordinating nonhuman animals to the logic of “technological rationality” or “technique,” to borrow Herbert Marcuse and Jacques Ellul’s respective terms, biotechnology perpetuates the productive extermination of animals. Biotech animals are exterminated in the sense of being “drive[n] beyond the boundaries” of meaningful existence and “destroyed completely” or “completely wiped out” as subjects. But they are also exterminated in the sense of being “overproduced” and “overgenerated,” both quantitatively and qualitatively. I go on to argue that the collapse of the ontological is accompanied by a collapse of the ethical. This ethical collapse is characterized by the internalization of the logic of technique and the corresponding failure both within technoscientific culture itself and within some scholarly discourses about biotechnology to evaluate from a genuinely critical vantage point the fundamental ethical issues that animal biotechnology raises. The aim of this paper is to offer an alternative analysis of the ontological and ethical implications of biotechnology from the standpoint of Marcuse and Ellul’s critical theory of technology. To explore other ramifications of animal biotechnology, I draw on Theodor Adorno and Max Horkheimer’s insights into ideologies of extermination and Maurice Merleau-Ponty’s phenomenology of embodiment. The combination of breeding for increased production and the intensification of housing conditions have resulted in increased occurrence of behavioral, physiological, and immunological disorders. These disorders affect health and welfare of production animals negatively. For future livestock systems, it is important to consider how to manage and breed production animals. In this paper, we will focus on selective breeding of laying hens. Selective breeding should not only be defined in terms of production, but should also include traits related to animal (...) health and welfare. For this we like to introduce the concept of robustness. The concept of robustness includes individual traits of an animal that are relevant for health and welfare. Improving robustness by selective breeding will increase (or restore) the ability of animals to interact successfully with the environment and thereby to make them more able to adapt to an appropriate husbandry system. Application of robustness into a breeding goal will result in animals with improved health and welfare without affecting their integrity. Therefore, in order to be ethically acceptable, selective breeding in animal production should accept robustness as a breeding goal. (shrink)

There is a “revolving door” between federal agencies and the industries regulated by them. Often, at the end of their industry tenure, key industry personnel seek employment in government regulatory entities and vice versa. The flow of workers between the two sectors could bring about good. Industry veterans might have specialized knowledge that could be useful to regulatory bodies and former government employees could help businesses become and remain compliant with regulations. But the “revolving door” also poses at least three (...) ethical and policy challenges that have to do with public trust and fair representation. First, the presence of former key industry personnel on review boards could adversely impact the public’s confidence in regulatory decisions about new technology products, including agrifood biotechnologies. Second, the ‘‘revolving door’’ may result in policy decisions about technologies that are biased in favor of industry interests. And third, the ‘‘revolving door’’ virtually guarantees industry a voice in the policy-making process, even though other stakeholders have no assurance that their concerns will be addressed by regulatory agencies. We believe these three problems indicate a failure of regulatory review for new technologies. The review process lacks credibility because, at the very least, it is procedurally biased in favor of industry interests. We argue that prohibiting the flow of personnel between regulatory agencies and industry would not be a satisfactory solution to the three problems of public trust and just representation. To address them, regulatory entities must reject the traditional notion of objectivity. Instead they should adopt the conception of objectivity developed by Sandra Harding and re-configure their regulatory review on the basis of it. That will ensure that a heterogeneous group of stakeholders is at the decision-making table. The fair representation of interests of different constituencies in the review process could do much to inspire warranted public confidence in regulatory protocols and decisions. (shrink)

Nanotechnologies that have been linked to the possibility of enhancing cognitive capabilities of human beings might also be deployed to reduce or eliminate such capabilities in non-human vertebrate animals. A surprisingly large literature on the ethics of such disenhancement has been developed in response to the suggestion that it would be an ethically defensible response to animal suffering both in medical experimentation and in industrial livestock production. However, review of this literature illustrates the difficulty of formulating a coherent ethical debate. (...) Well structured arguments for disenhancement can be made on the basis of mainstream views on the basis of ethical obligations to animals, but these arguments have not been persuasive against the moral intuition that disenhancements are unethical. At the same time, attempts to ground these intuitions in a coherent philosophical doctrine have been plagued by logical fallacies and question begging assertions. As such, the debate over animal disenhancement forecasts an enduring conundrum with respect to the core question of transforming the nature of sentient beings, and this conundrum is logically independent of claims that relate either to the distinctive of human beings or to issues deriving from the emphasis on enhancement. The process of risk assessment of biotechnologies, such as genetically modified organisms (GMOs), has normative dimensions. However, the US’ Food and Drug Administration (FDA) seems committed to the idea that such evaluations are objective. This essay makes the case that the agency’s regulatory approach should be changed such that the public is involved in deciding any ethical or social questions that might arise during risk assessment of GMOs. It is argued that, in the US, neither aggregative nor deliberative (representative) democracy (...) ought to be used to make such determinations. Instead, participatory (deliberative) democracy should be the means by which members of the polity decide which normative concerns ought to underlie FDA’s assessment of GMOs. The Swiss expert report suggests thatthe inherent dignity of a living being be identifiedwith its inherent value. But the phrase ``inherentvalue of a living being'' seems to connote two conceptsof inherent value. One has a morally obligatingcharacter but is counterintuitive because of itsegalitarianism. The other is one of non-moral value.It is more compatible with considered intuitions butinsufficient for substantiating the expert report'sclaim that human beings have moral duties towardsanimals and plants. The paper discusses theseconcepts. Consideration is then given to the (...) problemof how discursive support can be generated for theexpert report's claim that human beings have the moralduty to abstain from impairing those functions andabilities of a nonuman being that members of itsspecies as a rule can practice. The term moral considerability refers to the question of whether a being or set of beings is worthy of moral consideration. Moral considerability is most readily afforded to those beings that demonstrate the clearest relationship to rational humans, though many have also argued for and against the moral considerability of species, ecosystems, and “lesser” animals. Among these arguments there are at least two positions: “environmentalist” positions that tend to emphasize the systemic relations between species, and “liberationist” positions that tend to (...) emphasize the attributes or welfare of a particular individual organism. Already, this classic conflict provides for some challenging theoretical clashes between environmentalists and animal liberationists. The question of moral considerability is complicated, however, by recent developments in genetic engineering. Some animals, like pigs and fish, have been genetically modified by humans to grow organs that can then be transplanted into humans. If environmental arguments for the moral consideration of species are correct, then we are released from our obligations to morally consider those animals that we have genetically modified, since they are by their nature always an “invader species.” If, instead, the welfare of the animal is of penultimate importance, then there is a case for strengthening the moral considerability of GM animals over “naturally-occurring” animals, since they bear a closer relationship to humans. This would appear to be an intractable problem, a “bad marriage,” as Mark Sagoff once proposed. This paper argues that the case of invasive transgenic animals exposes weaknesses in this classic conflict, and particularly, in the framing of this conflict. To remedy this framing problem, this paper argues for a reconceptualization of the term “moral considerability,” instead urging a strong distinction between moral considerability, moral relevance, and moral significance. Genetic engineering evokes a number of objections that are not directed at the negative effects the technique might have on the health and welfare of the modified animals. The concept of animal integrity is often invoked to articulate these kind of objections. Moreover, in reaction to the advent of genetic engineering, the concept has been extended from the level of the individual animal to the level of the genome and of the species. However, the concept of animal integrity was not (...) developed in the context of genetic engineering. Given this external origin, the aim of this paper is to critically examine the assumption that the concept of integrity, including its extensions to the level of the genome and the species, is suitable to articulate and justify moral objections more specifically directed at the genetic engineering of animals. Thecultural (...) resonances of the recent on-lineperformance of a ''Turing Test'' for computergenerated art are then explored. Arttraditionally taken to stand for all that isconsidered quintessentially human – andtherefore resistant to mechanisation –represents in this sense a kind of ''criticalcase'' in the advance of machine intelligence.The article focuses on the moral status of thebody, human agency, and social knowledge in theongoing (re-)constructions of copy, original,and of the difference between them. BackgroundAdvances in biomedicine can substantially change human life. However, progress is not always followed by ethical reflection on its consequences or scientists’ responsibility for their creations. The humanities can help health sciences students learn to critically analyse these issues; in particular, literature can aid discussions about ethical principles in biomedical research. Mary Shelley’sFrankenstein; or, the modern Prometheus(1818) is an example of a classic novel presenting complex scenarios that could be used to stimulate discussion.Main textWithin the framework of the 200th anniversary (...) of the novel, we searched PubMed to identify works that explore and discuss its value in teaching health sciences. Our search yielded 56 articles, but only two of these reported empirical findings. Our analysis of these articles identified three main approaches to usingFrankensteinin teaching health sciences: discussing the relationship between literature and science, analysing ethical issues in biomedical research, and examining the importance of empathy and compassion in healthcare and research. After a critical discussion of the articles, we propose usingFrankensteinas a teaching tool to prompt students to critically analyse ethical aspects of scientific and technological progress, the need for compassion and empathy in medical research, and scientists’ responsibility for their discoveries.ConclusionFrankensteincan help students reflect on the personal and social limits of science, the connection between curiosity and scientific progress, and scientists’ responsibilities. Its potential usefulness in teaching derives from the interconnectedness of science, ethics, and compassion.Frankensteincan be a useful tool for analysing bioethical issues related to scientific and technological advances, such as artificial intelligence, genetic engineering, and cloning. Empirical studies measuring learning outcomes are necessary to confirm the usefulness of this approach. (shrink)

Public controversy over animalbiotechnology is analyzed as a case that illustratestwo broad theoretical approaches for linking science,political or ethical theory, and public policy. Moralpurification proceeds by isolating the social,environmental, animal, and human health impacts ofbiotechnology from each other in terms of discretecategories of moral significance. Each of thesecategories can also be isolated from the sense inwhich biotechnology raises religious or metaphysicalissues. Moral purification yields a comprehensive andsystematic account of normative issues raised bycontroversial science. Hybridization proceeds bytaking concern for all these (...) elements to be a mark ofsound moral character. The advocate of hybridizationinfers that those who employ a strategy ofpurification seek to avoid accountability by dividingissues, and hence are not to be trusted. Lack of trustincreases perceived risk and challenges the legitimacyof government regulations to control social,environmental, and human health risks that areestablished under separate mandate, and administeredby separate agencies.The close alignment between government agencies, theiracademic affines, and the categories of purificationplaces the purified analysis in a favored politicalposition. Legitimation of science-based policy inareas like animal biotechnology becomes problematicbecause the concern of those who would take a hybridapproach (arguably the majority of lay persons) tounderstanding controversial science are excluded.Ironically, this exclusion heightens the perception ofrisk from animal biotechnology. The paper concludeswith a call for procedural approaches to incorporatingthe hybrid view of science‘s moral significance. (shrink)

Articulating the public's widespread unease about animal biotechnology has not been easy, and the first attempts have not been able to provide an effective tool for navigating the moral permissibility of this research. Because these moral intuitions have been difficult to cash out, they have been belittled as representing nothing more than fear or confusion. But there are sound philosophical reasons supporting the public's opposition to animal biotechnology and these arguments justify a default position of resistance I call the Presumption (...) of Restraint . The Presumption of Restraint constitutes a justificatory process that sets out the criteria for permitting or rejecting individual biotechnology projects. This Presumption of Restraint can be overridden by compelling arguments that speak to a project's moral and scientific merit. This strategy creates a middle-of-the-road stance that can embrace particular projects, while rejecting others. The Presumption of Restraint can also serve as a model for assessing moral permissibility in other areas of technological innovation. (shrink)

Genetic modification leads to several important moral issues. Up until now they have mainly been discussed from the viewpoint that only individual living beings, above all animals, are morally considerable. The standpoint that also collective entities such as species belong to the moral sphere have seldom been taken into account in a more thorough way, although it is advocated by several important environmental ethicists. The main purpose of this article is to analyze in more detail than often has been done (...) what the practical consequences of this ethical position would be for the use of genetic engineering on animals and plants. The practical consequences of the holistic standpoint (focused on collective entities) of Holmes Rolston, III, is compared with the practical consequences of the individualistic standpoints (focused on individual living beings) of Bernard E. Rollin and Philipp Balzer, Klaus Peter Rippe, and Peter Schaber, respectively. The article also discusses whether the claim that species are morally considerable is tenable as a foundation for policy decisions on genetic engineering. (shrink)

This thesis is an analysis of the use and definition of the concepts health, well-being and welfare within the field called “the science of animal health and welfare”. The materials used are a literature survey of the field, qualitative interviews with Swedish veterinary surgeons and a study of the concepts in legislation concerning animals in England, Germany and Sweden. The main emphasis has been on theoretical definitions explicitly stated in the different texts or in the interviews. Two ways of distinguishing (...) between animals are used: according to species and according to the role that animals have for humans. As a result it becomes salient whether the definitions have limits with regard to species or role. In the thesis a great number of definitions of the three concepts are interpreted, compared and criticised. As a result a limited number of definitions have been categorised and collected into clusters which fulfil minimal requirements of consistency and practicability. The analysis supports the use of all three concepts – health, well-being and welfare – since they are all needed for making crucial distinctions in the science of animal health and welfare. (shrink)

Genetic engineering of life forms could well have a profound effect upon our sense of the sacred. Integrating the experience of the sacred as George Bataille does, we can characterize it as a phenomenological encounter with prelinguistic, noncategoreal experience. This view of the sacred is similar to Friedrich Nietzsche's Dionysian experience or Rudolf Otto's mysterium tremendum and diminishes one's sense of self. It seems similar to the eighteenth‐century aesthetic categorization of “the sublime.” Despite the dominant rational approach to religiosity in (...) the United States, intimations of this experience persist in popular culture. What possible relationship does genetic engineering have to this allegedly inevitable and profound experience? If certain modifications of life occur, they are likely to create such an experience of the sacred in us. In principle, we can now resurrect the mammoth or even create beings designed to directly potentiate our experience of the numinous such as satyrs or centaurs. The creation of such beings could become an art form associated with awaking the sacred, in turn appropriated by religion, as art has always been. Such experimentation, though morally questionable, is probably inevitable. (shrink)

In the face of criticisms about the current generationof agricultural biotechnology products, some proponents ofagricultural biotechnology offer a ``future benefitsargument''''(FBA), which is a utilitarian ethical argument thatattempts to justify continued R&D. This paper analyzes severallogical implications of the FBA. Among these are that acceptanceof the FBA implies (1) acceptance of a precautionary approach torisk, (2) the need for a more proportional and equitabledistribution of the benefits of agricultural biotechnology, andmost important, (3) the need to reorient and restructurebiotechnology R&D institutions (and (...) the agriculturalbiotechnology community''s values and attitudes) so that futurebenefits are indeed achieved through agricultural biotechnology. The concept of intrinsic value is often invoked to articulate objections to the genetic engineering of animals, particularly those objections that are not directed at the negative effects the technique might have on the health and welfare of the modified animals. However, this concept was not developed in the context of genetic engineering. Given this external origin, this paper critically examines the assumption that the concept of intrinsic value is suitable to articulate and justify moral objections more specifically directed at (...) the genetic engineering of animals. I discuss four different theories of intrinsic value, two of which defend a moral concept of intrinsic value and two a non-moral one. I conclude that only a particular non-moral concept of intrinsic value is suitable to express specific objections to genetic engineering, because these objections can only be defended in the form of indirect duties regarding animals. The industrialisation of agriculture has led to considerable alterations at both the technological and economical levels of animal farming. Several animal welfare issues of modern animal agriculture – e.g. stress and stereotypical behaviour – can be traced back to the industrialised intensification of housing and numbers of animals in production. Although these welfare issues dictate ethical criticism, it is the claim of this article that such direct welfare issues are only the forefront of a greater systemic ethical problem inherent to (...) industrialisation. Consequently, this article provides an analysis of the foundational ethical problems in animal agriculture which derive from overly positivistic science and free-market ideology. It will be argued that both these ways of thinking allow for a systematic reification and commodification of animals and that this contributes to language and attitudes which cannot encompass ethical consideration of animals. The emergent new science of synthetic biology is challenging entrenched distinctions between, amongst others, life and non-life, the natural and the artificial, the evolved and the designed, and even the material and the informational. Whenever such culturally sanctioned boundaries are breached, researchers are inevitably accused of playing God or treading in Frankenstein’s footsteps. Bioethicists, theologians and editors of scientific journals feel obliged to provide an authoritative answer to the ambiguous question of the ‘meaning’ of life, both as a scientific definition (...) and as an explication with wider existential connotations. This article analyses the arguments mooted in the emerging societal debates on synthetic biology and the way its practitioners respond to criticism, mostly by assuming a defiant posture or professing humility. It explores the relationship between the ‘playing God’ theme and the Frankenstein motif and examines the doctrinal status of the ‘playing God’ argument. One particularly interesting finding is that liberal theologians generally deny the religious character of the ‘playing God’ argument—a response which fits in with the curious fact that this argument is used mainly by secular organizations. Synthetic biology, it is therefore maintained, does not offend so much the God of the Bible as a deified Nature. While syntheses of artificial life forms cause some vague uneasiness that life may lose its special meaning, most concerns turn out to be narrowly anthropocentric. As long as synthetic biology creates only new microbial life and does not directly affect human life, it will in all likelihood be considered acceptable. (shrink)

Biotechnology applied to traditional foodanimals raises ethical issues in three distinctcategories. First are a series of issues that arise inthe transformation of pigs, sheep, cattle and otherdomesticated farm animals for purposes that deviatesubstantially from food production, including forxenotransplantation or production of pharmaceuticals.Ethical analysis of these issues must draw upon theresources of medical ethics; categorizing them asagricultural biotechnologies is misleading. The secondseries of issues relate to animal welfare. Althoughone can stipulate a number of different philosophicalfoundations for the ethical assessment of welfare,most (...) either converge on Bernard Rollins principle ofwelfare conservation (Rollin, 1995), or devolve intodebates over the ethical significance of animaltelos or species integrity. The principle of welfareconservation prohibits disfunctional geneticengineering of food animals, but would permit alteringanimals biological functions, especially when (as inmaking animals less susceptable to pain or suffering)do so improves an individual animals well being.Objections to precisely this last form of geneticengineering stress telos or species integrity asconstraints on modification of animals, and thisrepresents the third class of ethical issues. Most whohave formulated such arguments have failed to developcoherent positions, but the notion of species being,derived from the 19th century German tradition,presents a promising way to analyze the basis forresisting the transformation of animal natures. Many people object to genetically engineerehd (GE) food because they believe that it is unnatural or that its creation amounts to playing God. These objections are often referred to as intrinsic objections, and they have been widely criticized in the agricultural bioethics literature as being unsound, incompatible with modern science, religious, inchoate, and based on emotion instead of reason. Many of their critics also argue that even if these objections did have some merit as ethicalobjections, their quasi-religious nature means that (...) they are entirely irrelevant when interpreted aspolitical objections regarding what public policy ought to be. In this paper, we argue that this widespread view is false. Intrinsic objections have much more political import than has previously been recognized, and indeed the requirements of political liberalism and its associated idea of liberal neutrality, once properly understood, protect intrinsic objections from many of the most common objections. That is, policy-makers may not legitimately base public policy on grounds that are inconsistent with intrinsic objections, even when they believe those objections to be flawed in the ways mentioned above. This means that in the context of a political debate about GE food, the discussion should not center on the substantive merits of the intrinsic objections themselves but rather on the appropriate political norms for achieving democratically legitimate policy on issues that touch people’s deepest religious and moral beliefs. The issues relating to the licensing of a biopharmaceutical are described. In particular attention is focused on the mind of the regulator who has the responsibility of recommending licensure. There are two key factors which operate on the mind when confronted with such a task: psychology and ethics. The different factors which influence the psychological acceptability of a product for licensure are many and varied; they include perceived need, novelty, education, context and others. Also involved is the regulator’s view of (...) the ethicality of such products and the organisms which make them, with particular reference to those which are genetically engineered. These ethical views are in turn derived by reference to basic systems of ethics which provide guidelines for behavior. It is important for the manufacturers of biopharmaceuticals to be aware of both the psychological and ethical aspects of the regulator’s mind when addressing such individuals with a view to obtaining a license to manufacture a particular biopharmaceutical. By many accounts, CRISPR gene-editing technology is revolutionizing biotechnology. It has been hailed as a scientific game changer and is being adopted at a break-neck pace. This hasty adoption has left little time for ethical reflection, and so this paper aims to begin filling that gap by exploring whether CRISPR is as much an ethical game changer as it is a biological one. By focusing on the application of CRISPR to non-human animals, I argue that CRISPR has and will continue (...) to result in significant shifts in the ethical debate landscape. For instance, the fact that many CRISPR edits are non-transgenic has important implications for the ethical debate, particularly the popular objection to genetic engineering that it objectionably involves “crossing species boundaries,” as well as the regulatory debate in the United States, where currently only transgenic organisms are officially genetically modified organisms. I also explore various impacts CRISPR may have on animal welfare, suggesting that although the improved precision of CRISPR suggests fewer unintended welfare problems in comparison to past techniques, the greater versatility means that more animals than ever will be engineered. Finally, I end my discussion of animal welfare issues by exploring the possibility of using CRISPR to directly improve animal welfare, for instance through introducing disease resistance. (shrink)

Abstract The ethics of technology use has tended to arise from the theory of the role of technology in human life and society and thus introduces a bias into moral assessment of such use. I propose a dialectical method of morally assessing a technology use without such a preset notion. Instead the assumption is that the moral agent is as responsible for use of a technology as for any other moral action of the agent, that is, the individual’s use of (...) a technology is a moral action that can be morally assessed. I apply this outlook to automobile use, weighing its moral pros and cons, such as in terms of autonomy, environmental degradation, land use, health hazards, and other moral drawbacks arising from the technology’s use or non-use. Although the conclusion leaves the final moral assessment undecided, the method points to a way fairly to assess morally the use of technologies in terms of human betterment and environmental and health concerns, minimizing biases from assumptions of the role or nature of technologies. I denne artikkelen drøfter vi hvordan norske forbrukeres holdninger til genmodifisert mat har endret seg gjennom årene. Allerede da genteknologi ble etablert som et eget forskningsfelt og utviklingsområde på 1980-tallet, viste den norske opinionen stor skepsis. Den norske lovgivningen tidlig på 1990-tallet utmerket seg også som den mest restriktive i Europa. Dette bildet endret seg ikke mye i løpet av 1990-tallet, mens opinionen i mange europeiske land i disse årene kom mer på linje med den norske. I hele denne perioden (...) var både forbrukeropinionen og lovgivningen i USA langt mer aksepterende enn i Europa, noe som ga seg utslag i en handelskonflikt som toppet seg med EU sitt moratorium for utsetting av genmodifiserte planter i 1999. I denne artikkelen stiller vi spørsmålet om norske forbrukeres holdninger til genmodifisert mat har endret seg de siste årene. Artikkelen viser at mellom 2002 og 2007 er det en voksende gruppe av forbrukere som ser ut til å akseptere genmodifiserte matvarer hvis det fører til en helse- eller miljøgevinst. Men til tross for dette så er nordmenn fremdeles skeptiske til genmodifisert mat. Det kan tolkes slik at genmodifisert mat ikke har ført til den nytten som ansees nødvendig for å ta den risikoen det innebærer å gjøre et betydelig skifte i matseddel. Matpatriotisme og en kulturell konservatisme når det gjelder skifte i matvaner bidrar også til å forklare den dominerende vente-og-se-holdningen. (shrink)

Three types of concern for animal welfare are widelyheld: Animals should feel well, they should function well, andthey should lead natural lives. The paper deals with a well-knownanswer to the question of why such concerns are morallyappropriate: Human beings have direct duties towards animals,because animals are beings that can flourish, the flourishing ofanimals is intrinsically or inherently valuable, and that whichis conducive to their flourishing is a legitimate object of moralconcern. Looking for a tenable conception of direct dutiestowards animals, the (...) following questions are discussed: Whatshould we take it to mean that ``animal flourishing isintrinsically or inherently valuable?'''' Under what conditions doesa living being''s ability to flourish create direct duties towardsthis being? Is awareness or sentience required for there to bedirect duties towards a living being? Does such a requirementimply that moral concerns for animals would be limited to theirfeeling well, or does it also give way to having moral concernsfor their functioning well and leading natural lives? Can onetake into account considered judgements that claim that towardsdifferent animals we have moral duties that differ in kind and/orstrength? If environmental ethics cannot be based on theconception of direct duties here discussed, should one draw adistinction between duties towards ourselves, our fellow humanbeings, or animals, and duties regarding plants, or collectiveentities such as populations, species, and ecosystems? The US Food and Drug Administration’s final Guidance for Industry on the regulation of transgenesis in animal agriculture has paved the way for the commercialization of genetically engineered (GE) farm animals. The production-related diseases associated with extant breeding technologies are reviewed, as well as the predictable welfare consequences of continued emphasis on prolificacy at the potential expense of physical fitness. Areas in which biotechnology could be used to improve the welfare of animals while maintaining profitability are explored along with regulatory (...) schema to improve agency integration in GE animal oversight.
