International law holds that states are holistically responsible for their acts. Yet what does the ascription of responsibility to the state imply about the responsibility of its citizens? This article argues that most citizens in a representative democracy bear culpability in association with their state's wrongful acts. Most democratic citizens can be blamed for empowering representatives to act on their behalf, and then failing to adequately oversee and dissent from the specific wrongful decisions their representatives made. This gives culpable citizens (...) duties that go beyond compensation, especially duties to foster a reparative social ethos towards state victims. (shrink)

This article seeks to illuminate the figure of the child in democratic politics by arguing that children play a constitutive role as temporary outsiders who present both renewal and risk to the demos. Using Hannah Arendt’s concept of natality, we begin with an ontological account of children as new individuals that are central to renewing democratic freedom and plurality. In the second section, we explore how children can be conceived in terms of political risk by focussing on Arendt’s debate with (...) Ralph Ellison concerning the desegregation of American schools in the 1960s. Their arguments about whether children should appear in politics underscores the constitutive role that child–adult relationships play in debates about the normative fabric of democratic society. Finally, we use the radical democratic theory of Chantal Mouffe to argue that children can be characterised as an excluded group of potential adversaries that appear in political contests over claims to represent the demos. From this perspective, the article reveals that children are central figures in democratic politics because they are constituents of an unknown future polity. (shrink)

Judith Shklar, David Runciman, and others argue against what they see as excessive criticism of political hypocrisy. Such arguments often assume that communicating in an authentic manner is an impossible political ideal. This article challenges the characterization of authenticity as an unrealistic ideal and makes the case that its value can be grounded in a certain political realism sensitive to the threats posed by representative democracy. First, by analyzing authenticity’s demands for political discourse, I show that authenticity has greater flexibility (...) than many assume in accommodating practices common to politics, such as deception, concealment, and persuasion through rhetoric. Second, I argue that a concern for authenticity in political discourse represents a virtue, not a distraction, for representative democracy. Authenticity takes on heightened importance when the public seeks information on how representatives will act in contexts where the public is absent and unable to influence decisions. Furthermore, given the psychological mechanisms behind hypocrisy, public criticism is a sensible response for trying to limit political hypocrisy. From the perspective of democratic theory and psychology, the public has compelling reasons to value authenticity in political discourse. (shrink)

Commercial companies are increasingly being recognized as agents of societal governance operating alongside the public authorities in their traditional role as governance bodies. In addition, companies are claiming to be ‘corporate citizens’ in the way they deal with their environmental, employment and social/ethical responsibilities. Given the fact that large corporations are now heavily internationalized in their operational characteristics – with branches, subsidiaries, affiliates and extended supply chains operating in multiple jurisdictions – can such organizations be brought into a democratic register? (...) Citizenship and democracy are conventionally associated with a territorial state, national sovereignty and jurisdictional independence. So, how can internationalized companies be subject to democratic forms of governance? An added problem arises with platform companies and blockchain organized digital currency providers whose operations transcend national borders from the start. This contribution discusses the issues of and provides a way for considering corporate democracy afresh in these rapidly evolving contexts. (shrink)

When states perpetrate injustices, do their individual citizens develop liabilities to repair such wrongdoings? Most existing accounts of citizens’ liabilities for state-perpetrated injustices, whilst applicable across certain democratic contexts, struggle to provide robust accounts of the grounds and nature of liabilities for citizens in non-democratic contexts. This problematically leaves a lacuna when it comes to the responsibilities and appropriate responses of citizens in these states. This article advances a distinctive two-pronged authorisation-based account applicable to non-democracies. Objective authorisers are individuals who (...) derive presumptive benefits, are comparably better-off under, and can reliably influence the decision-making processes over the injustice perpetrated by the state. Subjective authorisers are citizens who autonomously endorse their state as credible interpreters and upholders of their aims in relation to the injustices in question. Both objective and subjective authorisers of the state in relation to particular injustices perpetrated, are liable to compensate, actively oppose, and commemorate the victims of state-perpetrated injustices. This account will be shown to be empirically applicable to a large number of minimally decent non-democratic states, where the political elite enjoy moderate popular support over their incorporation and reflection of citizen interests and preferences in their governance, despite the absence of formal democratic electoral mechanisms. This authorisation-based view differs from existing accounts oriented around complicity and participatory intentions, in better accounting for non-participants who are nevertheless intuitively liable for the actions of their authorised state, as well as circumventing structural shortcomings affecting complicity-centric accounts. ABSTRACTIn Capitalism, Socialism and Democracy, Schumpeter contrasted his definition of democracy against what he called its “Classical Doctrine.” Received scholarly wisdom holds either that the classical doctrine had no real historical embodiments, or that it is a composite of historical arguments pieced together only so that Schumpeter could knock them down. Arguably, however, Schumpeter actually drew the classical doctrine from a very real source: Carl Schmitt.

Deploying a broadly interpretive approach, the article explores the extent to which, and the ways in which, equality is enacted in non-elective as well as elective representation. It argues that the fleeting and fragmentary equalities evident in non-elective representation are democratically significant, and that examining them can enhance understanding of the democratic promise and limits of different modes of representation.

The ‘constructivist turn’ in political representation literature has clarified that representation is crucial in forging identities – through the creation of ideological and symbolic representations that mobilize and coalesce otherwise scattered and undefined social forces – and thus also why it is essentially an interpretative and performative activity. In this article I argue that, as a consequence of this emphasis on interpretation and performativity, this approach makes clear why the ethos of representatives is important in representation. To prove this, I (...) employ some insights from rhetoric. Rhetorical persuasion and democratic representation, indeed, call for a similar kind of judgment, as they both need to mediate between opposing exigencies: rhetoric between attentiveness to the specificity of the audience and the creation of new beliefs, and representation between being responsive to specific interests and giving them a new articulation. Mediating this tension requires an exercise of judgment that, being directed toward the future, inevitably introduces uncertainty into the relation. This is why both in rhetoric and representation the ethos is an essential element. However, as I argue in the conclusion, the personal qualities that should be considered relevant here are above political qualities, rather than technical or moral ones. (shrink)

ABSTRACTPolitical rituals, like the sovereign acclamation described in Rousseau’s social contract, exhibit a logic of representation that seem to oscillate between presence and absence, and enact a problematic identification of the people as a multitude of individuals and as a whole. This article explores this logic of rituals by comparing problems of political representation in Rousseau and Agamben with the highest principle of Aristotle’s philosophy. It thus elucidates the problem of representation in rituals of political power.

The article argues that the theory of plebiscitary leader democracy, originally developed by Max Weber, is in its somewhat rejuvenated version a helpful framework in interpreting longer-term and more recent empirical trends in contemporary democracies, such as the growing personalization of politics, the emergence of populist leaders, rising levels of polarization, and the growing importance of social media. However, to realize the potential of the theory, it should be detached from Jeffrey Green’s most original, yet insufficiently realistic elaboration of plebiscitary (...) democracy that he made a decade ago. The article argues that instead of a passive and unifiable entity, the citizenry should be thought of as reactive and deeply divided, a setting which can be characterized by the metaphor of the infamous Byzantine chariot races rather than that of the theater, implicit in Green’s theory. Plebiscitary democracy should be thought of as representational, where popular control is manifested as the veto power of the popular voice. Additionally, despite its realist minimalism, the theory we propose may still have some critical potential, because it adopts the refurbished ideal of competition. ABSTRACT This article traces the considerable development of a language of representation derived from Cicero's De officiis from late antiquity into early modern scholastic political thought. Cicero turned to the term persona, which signified the mask worn by actors of ancient theatre, to describe the particular duty of a magistrate who was understood ‘to bear the person of the city [se gerere personam civitatis]’. Thomas Hobbes's reliance on this terminology for his theory of the state in Leviathan is well known, (...) and we are now increasingly aware of its centrality before Hobbes in parliamentary and humanist discourse. What we have yet to register, however, is the extent and depth of scholastic appropriations and refashionings of this vocabulary. Cicero's language of representation is persistently at work in scholastic writing, from Augustine and Aquinas to Suárez and Bellarmine, and it functions in ways that reveal remarkable continuities and discontinuities with respect to its classical origins. The first task of this article is to expose this neglected channel through which this language was transmitted into early modernity. The second is to begin illuminating the early stages of political representation in the ‘second scholastic’ with an analysis of Francisco de Vitoria's De potestate civili (1528). (shrink)

This article argues that Jeremy Bentham put forward a distinctive and original theory of representative democracy which can be helpfully analysed through his concept of the ‘deputy’. A deputy, Bentham argued, evoked a specific political relationship between governors and the governed – a relationship that was functionally different to that between the people and a ‘representative’ or a ‘delegate’. Whereas a representative was suggestive of too great a degree of governmental independence from the people and a delegate implied an excessive (...) dependency of governors upon the governed, a deputy for Bentham best described the relationship between the rulers and the ruled that should subsist in a representative democracy. A political form based on deputies, who were to be relatively free to conduct the business of government yet simultaneously accountable to their sovereign electors, was the only way in his eyes to guarantee the promotion of utility in politics and the security of the people from being misruled. "Transparency" is the constant refrain of democratic politics, a promised aid to accountability and integrity in public life. Secrecy is stigmatized as a work of corruption, tolerable by a compromise of democratic principles. My dissertation challenges both ideas. It argues that secrecy and transparency are best understood as complementary, not contradictory, practices. And it develops a normative account of liberal democratic politics in which duties of transparency coexist with permissions to act behind closed doors. The project begins with some history. (...) I show that the language of transparency gained currency only in the last quarter century, and explain how its proximate sources promote three dubious assumptions—that disclosure should in principle be maximized, that it prevents misrule more or less automatically, and that its value is either instrumental, or rooted in a reductive notion of democracy as the rule of popular opinion. Against these assumptions, I sketch an alternative account of liberal democracy centered on the logics of representation, liberty, and equality. These three "logics of self-government" give rise to duties of transparency binding on public and private actors alike. Such obligations have bite, I argue, but they are not all-encompassing. Indeed, the same ideals of representation, liberty, and equality license concealment in a range of important contexts, including deliberation and dissent. Having made this case, I go on to explain how secrecy and transparency can form a "democratic dyad," deepening rather than undermining the project of self-rule. Lastly, I address the limits of conventional transparency practices. Taken alone, disclosure is subject to a range of pitfalls, often failing to produce the results promised in transparency’s name. While my non-instrumental case for openness is not destabilized by this analysis, it does suggest that mandating disclosure is rarely enough. I therefore propose a series of adversarial practices to facilitate the checking of unjustifiable secrecy, and highlight the critical role of interpretation in efforts to make power intelligible. In the end, my dissertation offers a novel defense of secrecy and transparency that highlights rather than minimizes the hard work of political engagement. (shrink)
