What is objectionable about “blacking up” or other comparable acts of imagining involving unethical attitudes? Can such imaginings be wrong, even if there are no harmful consequences and imaginers are not meant to apply these attitudes beyond the fiction? In this article, we argue that blackface—and imagining in general—can be ethically flawed in virtue of being oppressive, in virtue of either its content or what imaginers do with it, where both depend on how the imagined attitudes interact with the imagining’s (...) context. We explain and demonstrate this using speech act theory alongside a detailed case study of blackface. (shrink)

ABSTRACT In ‘Scorekeeping in a Pornographic Language Game’, Rae Langton and Caroline West borrow ideas from David Lewis to attempt to explain how pornography might subordinate and silence women. Pornography is supposed to express certain misogynistic claims implicitly, through presupposition, and to convey them indirectly, through accommodation. I argue that the appeal to accommodation cannot do the sort of work Langton and West want it to do: Their case rests upon an overly simplified model of that phenomenon. I argue further (...) that, once we are clear about why Langton and West's account fails, a different and more plausible account of pornography's influence emerges. (shrink)

Objectification is a notion central to contemporary feminist theory. It has famously been associated with the work of anti-pornography feminists Catharine MacKinnon and Andrea Dworkin, and more recently with the work of Martha Nussbaum. However, objectification is a notion that has not yet been adequately defined. It has been used rather vaguely to refer to a broad range of cases involving, in some way or another, the treatment of a person as an object. My purpose in this paper is to (...) offer a plausible understanding of objectification. I do that by focusing on the work of four prominent thinkers: Immanuel Kant, and contemporary feminists Catharine MacKinnon, Andrea Dworkin and Martha Nussbaum. Through drawing on these thinkers' conceptions of objectification, I am finally led to a more complete and coherent understanding of this notion. (shrink)

The gender concept woman is central to feminism but has proven to be notoriously difficult to define. Some feminist philosophers, most notably Sally Haslanger, have recently argued for revisionary analyses of the concept where it is defined pragmatically for feminist political purposes. I argue against such analyses: pragmatically revising woman may not best serve feminist goals and doing so is unnecessary. Instead, focusing on certain intuitive uses of the term ‘woman’ enables feminist philosophers to make sense of it.

Since its influential rendering by Rae Langton in her 1993 paper, “Speech Acts and Unspeakable Acts,” the “silencing argument” against pornography has become the subject of a lively debate that continues to this day. My intention in this paper is not to join in the existing debate, but to give a critical overview of it. In its current form, I suggest, it is going nowhere . Yet the silencing argument, I believe, nevertheless contains an indispensable insight—and more radical potential than (...) is usually acknowledged either by its defenders or its opponents. I argue that in order to preserve this insight and unleash its potential, we should begin by adopting the following motto: MacKinnon, not Austin! (shrink)

In the last twenty years, recorded messages and written notes have become a significant test and an intriguing puzzle for the semantics of indexical expressions (see Smith 1989, Predelli 1996, 1998a,1998b, 2002, Corazza et al. 2002, Romdenh-Romluc 2002). In particular, the intention-based approach proposed by Stefano Predelli has proven to bear interesting relations to several major questions in philosophy of language. In a recent paper (Saul 2006), Jennifer Saul draws on the literature on indexicals and recorded messages in order to (...) criticize Rae Langton's claim that works of pornography can be understood as illocutionary acts – in particular acts of subordinating women or acts of silencing women. Saul argues that it does not make sense to understand works of pornography as speech acts, because only utterances in contexts can be speech acts. More precisely, works of pornography such as a film may be seen as recordings that can be used in many different contexts – exactly like a written note or an answering machine message. According to Saul, bringing contexts into the picture undermines Langton's radical thesis – which must be reformulated in much weaker terms. In this paper, I accept Saul's claim that only utterances in contexts can be speech acts, and that therefore only works of pornography in contexts may be seen as illocutionary acts of silencing women. I will, nonetheless, show that Saul's reformulation doesn't undermine Langton's thesis. To this aim, I will use the distinction Predelli proposes in order to account for the semantic behaviour of indexical expressions in recorded messages – namely the distinction between context of utterance and context of interpretation. Jennifer Saul has argued that the speech acts approach to pornography, where pornography has the illocutionary force of subordinating women, is undermined by that very approach: if pornographic works are speech acts, they must be utterances in contexts; and if we take contexts seriously, it follows that only some pornographic viewings subordinate women. In an effort to defend the speech acts approach, Claudia Bianchi argues that Saul focuses on the wrong context to fix pornography’s illocutionary force. In response, I defend (...) Much of feminist philosophy of language so far can be described as critical—critical either of language itself or of philosophy of language, and calling for change on the basis of these criticisms. Those making these criticisms suggest that the changes are needed for the sake of feminist goals — either to better allow for feminist work to be done or, more frequently, to bring an end to certain key ways that women are disadvantaged. In this entry, I examine these criticisms. (...) I also examine work by feminists that seems to suggest some of the criticisms are misplaced: that, for example, philosophy of language is better able to help in feminist projects than critics suppose. Mary Kate McGowan’s Just Words offers an interesting account of exercitives. On McGowan’s view, one of the things we do with words is change what’s permitted, and we do this ubiquitously, without any special authority or specific intention. McGowan’s account of exercitives is meant to identify a mechanism by which ordinary speech is harmful, and which justifies the regulation of such speech. It is here that I part ways. I make three main arguments. First, McGowan’s focus on harm is misguided; (...) that ordinary speech is harmful is harder to support, and in turn does not less to support conclusions about whether it is wrong and warrants regulation, than Just Words suggests. Second, if the speech is harmful, McGowan’s account of exercitives is ill-suited to explain why; the relevant instances of ordinary speech seem to express speakers’ views about moral norms, not change social norms. Third, McGowan’s argument for why ordinary speech should be regulated because it is a form of discrimination presupposes a great deal that is controversial about what makes discrimination wrong and legally actionable, and even if it is right it may license the regulation of more speech than many, including McGowan, would deem acceptable. The aim of this paper is to evaluate which context determines the illocutionary force of written or recorded utterances—those involved in written texts, films and images, conceived as recordings that can be seen or heard in different occasions. More precisely, my paper deals with the “metaphysical” or constitutive role of context—as opposed to its epistemic or evidential role: my goal is to determine which context is semantically relevant in order to fix the illocutionary force of a speech act, as distinct (...) from the information the addressee uses to ascertain the semantically relevant context. In particular I will try to assess two different perspectives on this problem, a Conventionalist Perspective and an Intentionalist Perspective. Drawing on the literature on indexicals in written texts and recorded messages, I will argue in favor of the Intentionalist Perspective: the relevant context is the one intended by the speaker. Bringing intentions into the picture, however, requires qualification; in particular, I will distinguish my Weak Intentionalist proposal from a Strong Intentionalist one. I will show that the Weak Intentionalist Perspective is flexible enough to deal with cases of delayed communication, but not so unrestricted as to yield counter-intuitive consequences. (shrink)

In his influential book Truth, Paul Horwich deploys a philosophical method focused on linguistic usage, that is, on the function(s) the concept of truth serves in actual discourse. In doing so Horwich eschews abstract metaphysics, arguing that metaphysical or ontological conceptions of truth rest on basic misconceptions. From this description, one might reasonably expect Horwich's book to have drawn inspiration from, or even embodied philosophical pragmatism of some kind. Unfortunately Horwich relies upon Russell's tired caricature of pragmatism about truth (''p' (...) is true if and only if it is useful to believe p' (Ibid., p. 34, p. 47)), and as a result underestimates the challenge it poses to Minimalism. This paper develops a pragmatist critique of minimalism that focuses on the seemingly central, plausibly constitutive role played by the concept of truth in the speech-act of assertion. The critique suggests that Horwich's Minimalism does not and cannot accomplish its stated goal of explaining all of the facts involving truth. Indeed, the kind of thorough-going deflationism sought by Horwich and others (including pragmatist sympathizer Bob Brandom) is incompatible with an adequate account of assertion, and perhaps other concepts (like belief, judgement and inquiry) as well. In 2004, I explained the absurdity of Moore-paradoxical belief via the syllogism (Williams 2004): (1) All circumstances that justify me in believing that p are circumstances that tend to make me believe that p. (2) All circumstances that tend to make me believe that p are circumstances that justify me in believing that I believe that p. (3) All circumstances that justify me in believing that p are circumstances that justify me in believing that I believe that p. I then (...) took (3) to mean (EP) Whatever justifies me in believing that p justifies me in believing that I believe that p.1 Now suppose that I am justified in believing anything of the omissive Mooreparadoxical form: (Om) p and I do not believe that p. Then I am justified in believing the first conjunct. So by (EP) I am justified in believing that I believe that p. But since I am also justified in believing the second conjunct, I am justified in believing that I do not believe that p. I claimed that this is impossible, because anything that justifies me in believing that something is the case renders me unjustified in believing that it is not the case. This syllogism is plausible from an externalist view of justification, according to which circumstances such as seeming to see rain under normal perceptual conditions, justify me in believing that it is raining. In support of (1), if my apparent perceptions of rain are reliably connected with rain, so as to justify me in thinking that it is raining, they also tend to make me believe that it is raining. In support of (2), my apparent perceptions of rain are also reliably connected with my coming to believe that it is raining. However, Anthony Brueckner (2006) argues that (1) and (EP) are both false once justification is thought of evidentially. Against (EP), he claims that my evidence that p is not evidence that I believe that p unless I possess the evidence, in the sense that I believe it and were I to believe that p on its basis. The notion of ‘illocutionary silencing’ has been given a key role in defining the harms of pornography by several feminist philosophers. Though the literature on silencing focuses almost exclusively on the speech act of sexual refusal, oddly enough, it lacks a thorough analysis of that very act. My first aim is to fill this theoretical gap. I claim that refusals are “second-turn illocutions”: they cannot be accomplished in absence of a previous interrogative (or open) call by the hearer. Furthermore, I (...) maintain that refusals constitute authoritative illocutions only when preceded by requests for permission. The secondary goal of my paper is to assess Mary Kate McGowan’s (2009) account of silencing as authority denial. Despite its virtues, I argue that ultimately it should be rejected on two grounds: (i) it entails an objectification of female sexuality; (ii) if sexual advances are requests for permission (as McGowan implies), a man who asks a woman for sex cannot fail to ratify her authority over her own body. I conclude by sketching an alternative explanation for the failure of women’s refusals, according to which women may be unable to refuse sex for their interlocutors’ advances are intended as imperative (or closed) calls. How does pornography subordinate on the basis of gender? I provide part of an answer in this paper by framing subordination as something that works through everyday classification. Under certain material and social conditions, pornography classifies people through labeling them in ways that connect to structures of oppression. I hope to show two things. First, pornographic content is not the major driving force behind pornography’s subordination of women. Second, pornography, when repurposed in new ways, carries the potential to counter the (...) ill effects of other kinds of pornography, as feminist pornographers have attempted to show through their words and actions. The question which this paper examines is that of the correct scope of the claim that extra-linguistic factors (such as gender and social status) can block the proper workings of natural language. The claim that this is possible has been put forward under the apt label of silencing in the context of Austinian speech act theory. The ‘silencing’ label is apt insofar as when one’s ability to exploit the inherent dynamic of language is ‘blocked’ by one’s gender or social status (...) then one might justly be said to be silenced. The notion that factors independent of any person’s linguistic competence might block her ability to exploit the inherent dynamic of language is of considerable social as well as theoretical significance. I shall defend the claim that factors independent of a person’s linguistic competence can indeed block her ability to do things with words but I will show that the cases that have been previously considered to be cases of illocutionary failure are instances of rhetic or locutionary act failure instead. I shall refine the silencing claim as previously advanced in the debate in at least one fundamental respect. I also show that considering the metaphysics of speech acts clarifies many of the issues previously appearing as thorny bones of contention between those who hold that the only notion of silencing that is coherent is that of physically preventing someone from speaking or writing and those who hold the opposite sort of claim sketched above. Claudia Bianchi defends what she calls ‘MacKinnon's claim’: that ‘works of pornography can be understood as illocutionary acts of subordinating women, or illocutionary acts of silencing women’ in response to Saul , and by appeal to the formulations of Langton , Hornsby and Hornsby and Langton . I think Bianchi has two different claims in mind , and that it is important to distinguish the two, since the argument offered for either claim frustrates the aim sought by the other.Bianchi expresses (...) the first claim when she says ‘pornography is the subordination of women’, and that it subordinates ‘by conditioning people to regard women as willing sexual objects’ . I discuss a recent notable attempt to sharply distinguish pornography from erotic art, and argue that the attempt fails. I then turn to methodological questions about how we ought to go about defining ‘pornography’, questions which lead quickly to others about why we want such a definition. I believe that philosophers of art can make important contributions to this definitional project, but only if their contributions are informed by recent work in feminism, philosophical analysis, and art history.

A growing body of literature in feminist philosophy exposes the way in which occupying a particular group identity inhibits an affected agent’s ability to engage in communicative exchange effectively. These accounts reveal a fault in standard liberal defences of free speech, showing how, if free speech is a goal worth pursuing, then it must involve both a concern about the legitimate limits of state interference and of the effect of social norms on an agent’s communicative capacities. Building on the emergence (...) of a ‘critical’ branch of neo-republicanism, this article argues that such speech-related injustices are best understood as a feature of structural domination that threatens the agency of those affected. Recalibrating our understanding of free speech along critical republican lines thus secures discursive agency in our communicative exchanges in a way that both ensures democratic legitimacy and realises equal status for all. I am grateful for Ted Nannicelli’s careful attention to my book. In his comment, Nannicelli makes two quite serious sets of objections to my views. The first set concerns my arguments against perspectivism, the view that the attitudes or perspectives manifested in artworks are morally evaluable. The second set concerns my arguments for meta-normative expressivism, the view that normative judgements are expressions of the attitudes of persons, not beliefs in mind-independent facts. In what follows, I offer responses to each of (...) these sets of objections, which I hope will go some way towards answering them. If my responses fail to fully answer the objections, perhaps they can at least shed further light on the reasons behind our disagreements. For the most part, I stand behind what I wrote, but Nannicelli’s criticisms have helped me to see the ways in which I might have said more to support certain points and in which I might have been clearer. I hope this short response can make clear what I was trying to do in the book and why I was trying to do it. (shrink)

Thousands of refugees die each year fleeing prosecution in their home state. But receiving states are often reluctant to admit, process and house refugees. This is in part because refugee protection is a public good, and so subject to free-riding. A promising, but controversial, solution is to set up markets in tradable refugee quotas (e.g., in the European Union). One of the main objections to such proposals is that they lead to the commodification and objectification of refugees. Another objection, less (...) often discussed, is that such markets seem to legitimate negative and prejudicial attitudes towards refugees. In this article, I defend markets in refugee quotas against such criticisms. Given how many die each year, we are more than ever in need of creative solutions. Tradable quotas provide a promising mechanism to increase the number of refugees processed and protected, especially in regional schemes like the EU. Ethical objections such as the ones canvassed here should not stand in our way. (shrink)

Radical self-silencing is a particular variety of speech act disablement where the subject silences themselves, whether knowingly or not, because of their own faults or deficiencies. The paper starts with some concrete cases and preparatory comments to help orient and motivate the investigation. It then offers a summary analysis, drawing on a small number of basic concepts to identify its five individually necessary and jointly sufficient conditions and discriminating their two basic forms, ‘internalist’ and ‘externalist’. The paper then explicates and (...) defends what has been proposed, where the most salient and pressing objections concern the use of two basic concepts: ‘uptake’ and ‘silencing’. Finally, the paper gives a longer-term motivation for deepening our understanding of radical self-silencing, what it is and what it implies. (shrink)

This chapter explores the extent to which philosophy of language can be considered an applied discipline. I consider, first, ways in which sub-sections of philosophy of language may be considered as applied in terms of their subject matter and/or the kinds of questions being addressed (e.g. philosophy of language which deals with derogatory or inflammatory uses of language, or the role of philosophy of language within feminist philosophy). Then, in the second part of the chapter, I turn to consider a (...) more general (and perhaps more controversial) conception of philosophy of language as applied, which arises from the methodology adopted and the relationship of the discipline to empirical data. Rae Langton famously argues that pornographic speech illocutionarily subordinates and silences women. Making good this view hinges on identifying the context relevant for fixing such force. To do so, a parallel is typically drawn between pornographic recordings and multipurpose signs involved in delayed communication, but the parallel generates a dispute about the right illocutionary force-fixing context. Jennifer Saul and myself argue that if pornographic speech is akin to multipurpose signs, its illocutionary force is fixed by the actual decoding context: of (...) using/viewing pornographic recordings. By contrast, Claudia Bianchi argues that the relevant context is intended/expected decoding. Here I take issue with Bianchi’s view. Her intentionalist account faces two serious objections. First, the collapse objection: Bianchi’s intentionalist view is so formulated that it collapses into that endorsed by Saul and me. This undermines Bianchi’s case against us. Second, the dissonance objection: looking at a different aspect of Bianchi’s view, and one that does depart from the positions of Saul and myself, shows that her analysis is too intentionalist and cannot be used to elucidate pornography’s illocutionary force. Bianchi’s view should hence be rejected. This nevertheless leaves open further theoretical avenues of research, which I briefly discuss at the end of the paper. (shrink)

John Austin (1911-1960) è stato uno dei filosofi britannici più influenti del suo tempo, per il rigore del pensiero, la personalità straordinaria e il metodo filosofico innovativo. A parere di John Searle Austin era molto amato e molto odiato dai contemporanei – disorientati da un pensiero che sembrava distruggere più che costruire, sfidare l'ortodossia della filosofia tradizionale ma anche dell'allora imperante empirismo logico, senza sostituirvi nessuna confortante nuova ortodossia. L'opera di Austin è tuttavia oggi poco conosciuta e gli elementi di (...) novità della sua riflessione non sufficientemente apprezzati. Costituiscono un'eccezione due risultati, universalmente riconosciuti e celebrati: da un lato la tecnica di analisi filosofica – quella versione della "filosofia linguistica" praticata da Austin con la pazienza, il rigore e il talento di un entomologo; dall'altro la teoria degli atti linguistici. Austin viene ricordato soprattutto per aver evidenziato la dimensione performativa che permea ogni nostro proferimento: con uno slogan diventato famoso, ogni dire è anche un fare. Una tesi con ripercussioni in aree di ricerca molto diverse, dalla filosofia del linguaggio all'etica, dalla filosofia politica al diritto, dalla linguistica alla filosofia femminista. Ci concentreremo qui sui contributi di Austin alla filosofia del linguaggio, ma faremo cenni anche estesi ai suoi contributi in epistemologia e teoria dell'azione, nonché al vivace dibattito che a partire dalla teoria degli atti linguistici si è sviluppato negli anni '60 e '70. This paper defends the claim that there are two previously underexplored ways in which pornography silences women. These ways that pornography silences are (1) the smothering of refusal and (2) the smothering of sexual assault reports, and they can be explained in part through Kristie Dotson’s account of “testimonial smothering.” Unlike the work of other writers in the pornography as silencing literature, my discussion of silenced refusal of sex deals with the cases where women have said yes to sex but (...) would have said no if they had felt that they could have. I show that this, and cases where women do not report sexual assault, count as testimonial smothering through identifying rape myths as a species of “pernicious ignorance.” I make the connection to pornography in presenting evidence that pornography contributes to acceptance of rape myths. This takes us to my general conclusion: Dotson’s account of testimonial smothering gives us a way in which pornography contributes to the silencing of women, by silencing their refusal of sex and their reports of sexual assault. Considering the short history of the feminist philosophy of language, Rae Langton’s article “Speech Acts and Unspeakable Acts” was highly influential as one of the first positive research programs in the movement. In that paper, Langton – using John L. Austin’s speech act theory – tries to interpret Catharine MacKinnon’s thesis: pornography is a speech that subordinates and silences women. Despite the importance of the subject, those unfamiliar with certain historical and contextual features of the topic would hardly understand it. (...) My paper aims to introduce some of the major accounts in this special area in the intersection of speech act theory and feminist philosophy. Rather than just reconstructing Langton’s arguments and the most common objections against it, I will take a more holistic approach, examining its surrounding literature as well. This article has six sections. In Section 1, I contrast the conservative and liberal arguments against pornography and sketch MacKinnon’s liberal critique. In Section 2, I give alternative interpretations of MacKinnon’s thesis, “pornography is harm.” In Section 3, I try to make sense of the prima facie implausible assumption that pornography is speech. In Section 4 and 5, I will analyze the Langtonian theories about subordination and silencing. Finally, in Section 6, I will mention the most challenging problems for Langton’s approach, considering the verbal nature or pornography, the limits of the protection of free speech, and the different positions on sexual consent. Appeals to practices are common the humanities and social sciences. They hold the potential to explain interesting or compelling similarities, insofar as similarities are distributed within a community or group. Why is it that people who fall under the same category, whether men, women, Americans, baseball players, Buddhists, feminists, white people, or others, have interesting similarities, such as similar beliefs, actions, thoughts, foibles, and failings? One attractive answer is that they engage in the same practices. They do the same things, (...) perhaps as a result of doing things at the same site or setting, or perhaps as a result of being raised in a similar way among members of the same group. In the humanities, appeals to practices often serve as a move to point out diversity among different communities or diversity within the same community. Communities are distinct from one another in part because their members do different things or do things in different ways. The distinct and varied ways in which different communities enact social norms or formulate law, state institutions, and public policy might be explicable in part by the different practices their members are socialized into. Appeals to practices hold the promise of explaining these differences in terms of the different background practices of the groups, cultivated through a kind of cultural isolation or sense of collective identity. In the social sciences, appeals to practices have played a central role in fundamental theorizing and theory building. Appeals to practices in the social sciences are often much more systematic and theoretical, forming the core of the systematic theories of Pierre Bourdieu and Anthony Giddens in Anthropology and Sociology. Practice theory has thus become a growth industry in social scientific investigation, offering the promise of a central object of investigation that explains both unity and difference within and across communities and groups. But it is unclear just what practices are and what role, both ontological and explanatory, that practices are supposed to play. The term `practices' is used to pick out a wide range of things, and its relation to other terms, from `tradition' or `paradigm' to `framework' or `presupposition', is unclear. Practices are posited as ubiquitous, yet they are difficult to isolate and pin down. We are all said to participate in them, but they remain hidden. Their role, whether causal, logical, or hermeneutical, remains mysterious. After locating the historical origins of appeals to practices in the work of Ludwig Wittgenstein and Martin Heidegger, my dissertation uses Stephen Turner's broad and systematic critique of appeals to practices to develop a new type of account. My account is a phenomenological account that treats practices as human doings that show up to people in material and social environments and make themselves available for specific responses in those environments. I argue that a phenomenological account is an effective alternative to accounts that treat practices as either shared objects with properties or shared and implicit presuppositions. I use a phenomenological account of practices to treat important debates in feminist philosophy and the philosophy of the social sciences, particularly debates over pornography's subordination of women and the classification of mental disorders in psychiatry.
