Survey of different definitions of lying and deceiving, with an emphasis on the contemporary debate between Thomas Carson, Roy Sorensen, Don Fallis, Jennifer Saul, Paul Faulkner, Jennifer Lackey, David Simpson, Andreas Stokke, Jorg Meibauer, Seana Shiffrin, and James Mahon, among others, over whether lies always aim to deceive. Related questions include whether lies must be assertions, whether lies always breach trust, whether it is possible to lie without using spoken or written language, whether lies must always be false, whether lies (...) that are unsuccessful are still lies, and whether deception must aim at creating false beliefs as opposed to preventing people from acquiring true beliefs. In the world of philosophy of science, the dominant theory of confirmation is Bayesian. In the wider philosophical world, the idea of inference to the best explanation exerts a considerable influence. Here we place the two worlds in collision, using Bayesian confirmation theory to argue that explanatoriness is evidentially irrelevant.

We have good reason to condemn lying more strongly than misleading and to condemn bullshit assertion less harshly than lying but more harshly than misleading. We each have good reason to mislead rather than make bullshit assertions, but to make bullshit assertions rather than lie. This is because these forms of deception damage credibility in different ways. We can trust the misleader to assert only what they believe to be true. I give a new argument for the moral difference between lying and misleading. First, following David Lewis, I hold that conventions of truthfulness and trust fix the meanings of our language. These conventions generate fair play obligations. Thus, to fail to conform to the conventions of truthfulness and trust is unfair. Second, I argue that the liar, but not the misleader, fails to conform to truthfulness. So the liar, but not the misleader, does something unfair. The aim of this paper is to argue that lying differs from mere misleading in a way that can be morally relevant: liars commit themselves to something they believe to be false, while misleaders avoid such commitment, and this difference can make a moral difference. Even holding all else fixed, a lie can therefore be morally worse than a corresponding misleading utterance. But, we argue, there are also cases in which the difference in commitment makes lying morally better than misleading, (...) as well as cases in which the difference is not morally relevant. This view conflicts with the two main positions philosophers have defended in the ethics of lying and misleading, which entail either that lying is in virtue of its nature worse than misleading or that there is no morally relevant difference between lying and misleading. The view that lying is morally worse than merely misleading is a very natural one, which has had many prominent defenders. Nonetheless, here I will argue that it is misguided: holding all else fixed, acts of mere misleading are not morally preferable to acts of lying, and successful lying is not morally worse than merely deliberately misleading. I argue that lying is generally morally better than mere deliberate misleading because the latter involves the exploitation of a greater trust and more seriously abuses our willingness to fulfil epistemic and moral obligations to others. Whereas the liar relies on our figuring out and accepting only what is asserted, the mere deliberate misleader depends on our actively inferring meaning beyond what is said in the form of conversational implicatures as well. When others’ epistemic and moral obligations are determined by (...) standard assumptions of communicative cooperation and no compelling moral reason justifies mere deliberate misleading instead, one had better lie. This chapter explores the prospects for justifying the somewhat widespread, somewhat firmly held sense that there is some moral advantage to untruthfully implicating over lying. I call this the "Difference Intuition." I define lying in terms of asserting, but remain open about what precise definition best captures our ordinary notion. I define implicating as one way of meaning something without asserting it. I narrow down the kind of untruthful implicating that should be compared with lying for purposes of evaluating whether (...) there is a moral difference between them. Just as lying requires a robust form of assertion, so the kind of untruthful implicating to be compared with lying requires a robust form of implicating. Next, I set out various ways of sharpening the Difference Intuition and survey a range of approaches to justifying one class of sharpenings. I finish by sketching an approach to justifying an alternative sharpening of the Difference Intuition, which is inspired by John Stuart Mill's discussion of lying. (shrink)

Sam Berstler defends a general moral advantage for misleading over lying by arguing that liars, but not misleaders, act unfairly toward the other members of their linguistic community. This article spells out three difficulties for Berstler’s account. First, though Berstler aims to avoid an error theory, it is dubitable that her account fits with intuitions on the matter. Second, there are some lies that do not exhibit the unfairness Berstler identifies. Third, fairness is not the only morally relevant difference between (...) lying and misleading. (shrink)

There is a clear intuitive difference between lying and attempting to mislead. Recent efforts to analyse this difference, and to define lying in ways that respect it, are motivated by the conviction that the difference is important or significant in some way. Traditionally, the importance of the lying-misleading distinction has been cashed out in moral terms, but this approach faces a number of challenges. The purpose of this paper is to suggest and develop a different way in which the lying-misleading (...) distinction might be important: it might matter aesthetically. I propose that the aesthetic significance of the distinction inheres in a more prominent experienced disharmony in lying as compared with attempting to mislead. (shrink)

Should people who perform equal work receive equal pay? Most would say ‘yes’, at least insofar as this question is understood to be asking whether employers should be permitted to discriminate against employees on the basis of race or sex. But suppose the employees belong to all of the same traditionally protected groups. Is (what I call) nondiscriminatory unequal pay for equal work wrong? Drawing an analogy with price discrimination, I argue that it is not intrinsically wrong, but it can (...) be deceptive, in which case it is wrong. (shrink)

Spoofing—placing orders on financial exchanges intending to withdraw them prior to execution—is widely legally prohibited. I argue instead on two main grounds that spoofing should be permitted and legalised. The first is that spoofing as a form of bluffing remains within the market practice of making legally binding offers—as opposed to lying or betraying trust—and primarily concerns the spoofer’s personal information. As a form of bluffing spoofing helps prevent financial speculators, in particular high-frequency algorithmic traders, from easily profiting by other (...) market actors reliably revealing their underlying preferences through their market activity. The second is that at the systemic level permitting spoofing would benefit non-speculative actors who place orders to hedge economic risk and whose activities provide the raison d’être for financial exchanges, differentiating them from simple forums for gambling. I also address potential concerns that legalised spoofing would drive speculators out of financial markets entirely and, therefore, undermine market liquidity. This work contributes to the wider debate in business ethics regarding bluffing by illustrating the acceptability of bluffs which do not betray counterparty trust or reliance on testimony by remaining within the framework of market practices. A central debate in the ethics of deception concerns the moral comparison among the three media through which deception is executed: lying, falsely implicating, or nonlinguistic deception. The two prominent views are that lying is morally worse or that the choice of medium is morally insignificant. This article refutes both and argues for a new position. The article first presents a theory on the moral significance of the medium of deception as such: it argues that the medium of communication affects (...) the reliability of beliefs formed through it, which amounts to gradations in the warrant of truth of different media. Breach of lower warrant of truth is a lesser breach of trust; it therefore deserves lighter condemnation. Consequently, the article shows that, morally speaking, lying is either worse than or equal to falsely implicating and that there is no a priori gradation between nonlinguistic deception and the two linguistic media. Einer weit verbreiteten Auffassung zufolge ist es moralisch besser, eine andere Person in die Irre zu führen als sie anzulügen. Diese Auffassung ist in neuerer Zeit jedoch ausführlich von Bernard Williams und Jennifer Saul kritisiert worden – ihnen zufolge verdankt sich unsere moralische Präferenz für Irreführungen einem Irrtum und lässt sich bei näherer Betrachtung nicht aufrechterhalten. Im ersten Teil des Aufsatzes versuche ich demgegenüber zu zeigen, dass es in manchen Fällen tatsächlich moralische Gründe gibt, statt zu lügen in die Irre (...) zu führen. Im Mittelpunkt steht dabei eine expressive und beziehungsorientierte Analyse von Irreführungen: Wir können mit Irreführungen, so die zentrale These, im Unterschied zu Lügen zumindest in manchen Fällen zum Ausdruck bringen, dass wir die andere Person respektieren und uns die Fortführung einer vertrauensvollen Beziehung mit ihr am Herzen liegt. Im zweiten Teil weise ich dann allerdings nach, dass die moralische Präferenz für Irreführungen nicht in allen Fällen gerechtfertigt ist – zum einen, weil der mit Irreführungen zum Ausdruck gebrachte Respekt gegenüber anderen Personen nicht immer angemessen ist, und zum anderen, weil mit Irreführungen nicht in allen Situationen Respekt vor der anderen Person und ein Interesse an einer vertrauensvollen Beziehung mit ihr zum Ausdruck gebracht werden kann. This paper discusses a novel kind of argument for assessing the moral significance of acts of lying and misleading. It is based on considerations about valuable social norms that might be eroded by these actions, because these actions function as signals. Given that social norms can play an important role in supporting morality, individuals have a responsibility to preserve such norms and to prevent ‘cultural slopes’ that erode them. Depending on whether there are norms against lying, misleading, or both, and (...) how likely it is that they might be eroded, these actions can thus have different moral significance. In cases in which the rule ‘do not lie’, as a relatively simple rule, functions as a ‘focal point’, acts of misleading are often morally preferable. In other words, in such cases the possibility of ‘cultural slopes’ can ground a context-dependent slippery slope argument for a moral difference between lying and misleading. (shrink)

One of the lessons of the COVID-19 pandemic is that the lay public relies immensely on the knowledge of public health officials. At every phase of the pandemic, the testimony of public health officials has been crucial for guiding public policy and individual behavior. The reason is simple: public health officials know a lot more than you and I do about public health. As lay people, we rely on experts. This seems straightforward. But the COVID-19 pandemic has shown that public (...) health officials seem undecided as to what, precisely, their role is; are they providing the public information as it presents itself, or are they informing the public in a way that produces a desired or optimal outcome? In this article, I answer the following question: what are public health officials morally obligated to tell the public? As I see it, these are the main options: (1) public health officials should tell the full truth, regardless of outcome; or (2) they should tell partial truths or lies that are aimed to promote a socially optimal outcome. My answer to this question is that public health officials are only allowed to lie under very narrow and rare conditions. -/- . (shrink)

In many places, it is possible to buy psychic services, including tarot card, palm, and mediumship readings. Yet we have powerful evidence that psychic abilities do not exist. This paper asks whether psychic services should be for sale. I begin by considering whether psychics deceive or mislead buyers. Next, I consider a harm-based argument against the sale of psychic services. Finally, I consider an argument in favor of their sale that appeals to expressive considerations. I conclude with a tentative policy (...) recommendation: the sale of psychic services should be permitted. This is so even though much of the money spent on them will be money wasted. (shrink)

The moral comparison of the three venues of deception—lying, falsely implicating, and nonverbal deception—is a central, ongoing debate in the ethics of deception. To date there has been no attempt to advance in the debate through experimental philosophy. Using methods of experimental economics, we devised a strategic game to test positions in the debate. Our article presents the experimental results and shows how philosophical analysis of the results allows drawing valid normative conclusions. Our conclusions testify against the dominant position in (...) the debate—that lying is morally worse than all non-lying deceptions. It is widely agreed that deception of the enemy can be morally permissible in war. However, the question of the morally acceptable limits to deception in war has barely been explored in contemporary ethics. This paper defends the thesis that there are no moral limits on military deception per se, that is, no limits based on the ethics of truthfulness. Rather, all moral restriction against deception in war is based on another moral principle: military deception is morally unacceptable only when (...) it violates the principle of not harming those who do not intend to harm us. ABSTRACT Argumentation theory tends to treat the distinction between intentional and unintentional fallacies—sophisms and paralogisms—as unimportant for the evaluation of argumentation. The article author believes this is so because argumentation theory tends to be focused on the epistemic functions of argumentation and fallacious arguments pose the same threat to the production of epistemic goods whether they are intentional or not, so the distinction is not needed for the epistemic evaluation of argumentation. This article argues that argumentation has a special connection (...) to respect for autonomy, one that enables it to also produce distinctly moral goods. Sophisms, but not paralogisms, spoil these goods. Worse—sophisms produce potentially continuing moral harms, while paralogisms do not. Therefore, the paralogism/sophism distinction should be reintegrated into argumentation theory’s evaluative toolbox. (shrink)
