Logic is usually thought to concern itself only with features that sentences and arguments possess in virtue of their logical structures or forms. The logical form of a sentence or argument is determined by its syntactic or semantic structure and by the placement of certain expressions called “logical constants.”[1] Thus, for example, the sentences Every boy loves some girl. and Some boy loves every girl. are thought to differ in logical form, even though they share a common syntactic and semantic (...) structure, because they differ in the placement of the logical constants “every” and “some”. By contrast, the sentences Every girl loves some boy. and Every boy loves some girl. are thought to have the same logical form, because “girl” and “boy” are not logical constants. Thus, in order to settle questions about logical form, and ultimately about which arguments are logically valid and which sentences logically true, we must distinguish the “logical constants” of a language from its nonlogical expressions. This paper discusses two passages from Alexander of Aphrodisias’s commentary on Aristotle’s Topics that are transmitted in Ps-Jābir’s Kitāb al-Nukhab. It argues that the Arabic translation of Alexander’s commentary may have been made from a fuller version than what came down to us in Greek. Especially since the author(s) of the Jābir-corpus form a tradition different from the school of Ḥunayn b. Isḥāq (d. 873) and authors associated to the ‘Baghdad school’, whose earliest figure is Abū Bishr Mattā b. Yūnus (...) (d. 940), the Arabic fragments of Alexander’s commentary preserved in the Kitāb al-Nukhab promise to shed more light on the early reception of the Topics and the different contexts in which Aristotelian dialectic was studied in the Islamic world. The detection of hate speech and fake news in political discourse is at the same time a crucial necessity for democratic societies and a challenge for several areas of study. However, most of the studies have focused on what is explicitly stated: false article information, language that expresses hatred, derogatory expressions. This paper argues that the explicit dimension of manipulation is only one – and the least problematic – of the risks of political discourse. The language of the unsaid is (...) much more dangerous and incomparably more difficult to detect, hidden in different types of fallacies and inappropriate uses of emotive language. Through a threefold coding scheme based on the instruments of argumentation theory and pragmatics, a corpus of argumentative tweets published by 4 politicians (Matteo Salvini, Donald Trump, Jair Bolsonaro, and Joseph Biden) within 6 months from their taking office (corresponding to the official end of their election campaign) is analyzed, detecting the types of argument, the fallacies, and the uses and misuses of “emotive words.” This coding results in the argumentation profiles of the speakers, which are compared statistically to show their different implicit strategies and deceptive tactics. The reasoning process of analogy is characterized by a strict interdependence between a process of abstraction of a common feature and the transfer of an attribute of the Analogue to the Primary Subject. The first reasoning step is regarded as an abstraction of a generic characteristic that is relevant for the attribution of the predicate. The abstracted feature can be considered from a logic-semantic perspective as a functional genus, in the sense that it is contextually essential for the attribution of (...) the predicate, i.e. that is pragmatically fundamental (i.e. relevant) for the predica-tion, or rather the achievement of the communicative intention. While the transfer of the predicate from the Analogue to the analogical genus and from the genus to the Primary Subject is guaranteed by the maxims (or rules of inference) governing the genus-species relation, the connection between the genus and the predicate can be complex, characterized by various types of reasoning patterns. The relevance relation can hide implicit arguments, such as an implicit argument from classification , an evaluation based on values, consequences or rules, a causal relation, or an argument from practical reasoning. The purpose of this paper is to analyze the structure and the defeasibility conditions of argument from analogy, addressing the issues of determining the nature of the comparison underlying the analogy and the types of inferences justifying the conclusion. In the dialectical tradition, different forms of similarity were distinguished and related to the possible inferences that can be drawn from them. The kinds of similarity can be divided into four categories, depending on whether they represent fundamental semantic features of the (...) terms of the comparison or non-semantic ones, indicating possible characteristics of the referents. Such distinct types of similarity characterize different kinds of analogical arguments, all based on a similar general structure, in which a common genus is abstracted. Depending on the nature of the abstracted common feature, different rules of inference will apply, guaranteeing the attribution of the analogical predicate to the genus and to the primary subject. This analysis of similarity and the relationship thereof with the rules of inference allows a deeper investigation of the defeasibility conditions. (shrink)

Argumentation schemes are forms of reasoning that are fallible but correctable within a self-correcting framework. Their use provides a basis for taking rational action or for reasonably accepting a conclusion as a tentative hypothesis, but they are not deductively valid. We argue that teleological reasoning can provide the basis for justifying the use of argument schemes both in monological and dialogical reasoning. We consider how such a teleological justification, besides being inspired by the aim of directing a bounded cognizer to (...) true belief and correct choices, needs to take into account the attitudes of dialogue partners as well as normative models of dialogue and communicative activity types, in particular social and cultural settings. Yarbrough Department of English The University of North Carolina at Greensboro What are the conditions of discursive competence? In "A Nice Derangement of Epitaphs" Donald Davidson explains how it is possible that in practice we can, with little effort, understand and appropriately respond (...) to linguistic anomalies such as the malapropism—anomalies because, by definition, the "language" cannot account for how we understand them. Such anomalies, Davidson concludes, are the exceptions that do not prove but refute the traditional rule that antecedent linguistic systems govern discursive meaning. If that is so, then meanings are not a property of a linguistic system and are not "governed by learned conventions or regularities" (1986, 436); therefore, learning and sharing such conventions, what we traditionally call "language," is not a necessary condition of successful communication. He shows this by arguing that two conditions must be met for successful interlocution and that meeting these sufficiently allows successful interlocution to take place. A third condition—that the interlocutors share a language, an organized set of learned conventions or regularities "learned in advance of occasions of interpretation" (436) for which phenomena such as malapropisms would be anomalous—is neither a necessary nor sufficient condition of discursive competence.What I hope to show in this paper is that the two conditions Davidson argues interlocution must meet in order to succeed both involve the interlocutor's implicit knowledge of what since Aristotle the rhetorical tradition has called topical heuristics. [End Page 72] Inferential method Davidson argues that the first condition necessary for successful interlocution is that "the interpreter can learn the semantic role of each of a finite number of words or phrases and can learn the semantic consequences of a finite number of modes of expression" (1986, 437). "For this to be possible," says Davidson, "there must be systematic relations between the meanings of utterances" (436). Here he is not talking about grammatical systems but about systematic relations between and among the interlocutors' discursive actions and the world with its objects to which their actions refer. As I'll explain more fully shortly, these are topical relations. What makes these relations possible, Davidson argues, is that the interlocutors share, not a set of learned conventions, but a "recursive characterization of the truth conditions of all possible utterances of the speaker" (437).Such a theory of truth can be something like a Tarski truth definition, the explanation of which can be extremely convoluted (see Davidson 1984), but it boils down to saying that an utterance is true if the anticipations raised by a belief in an interpreted utterance are met by the consequences of believing the utterance; or, to put it another way, if the utterance is an answer to the question that solicited it or a solution to the problem to which it responds. Thus, an example of such a truth definition would be "The grass is green (an utterance made by someone, somewhere, somewhen, under certain conditions) is true if and only if the grass is green (to that person, at that place, at that time, under those conditions)." This paper investigates the emotive (or expressive) meaning of words commonly referred to as “loaded” or “emotive,” which include slurs, derogative or pejorative words, and ethical terms. We claim that emotive meaning can be reinterpreted from a pragmatic and argumentative perspective, which can account for distinct aspects of ethical terms, including the possibility of being modified and its cancellability. Emotive meaning is explained as a defeasible and automatic or automatized evaluative and intended inference commonly associated with the use of specific (...) terms, which can be represented and assessed considering its logical structure and its defeasibility conditions. This automatic inference is conceived as part of the connotation of an ethical term, and is not necessarily stable. By means of quasi-definitions, it is possible to modify the emotive meaning while maintaining the descriptive one, automaticizing the inferences drawn from an ethical word. Through examples drawn from the recent US presidential campaign, we show how re-contextualization and emotive contexts can affect emotive meaning. (shrink)

In this paper it is shown how certain defeasible argumentation schemes can be used to represent the logical structure of the most common types of argument used for statutory interpretation both in civil and common law. The method is based on an argumentation structure in which the conclusion, namely, the meaning attributed to a legal source, is modeled as a claim that needs that is be supported by pro and con defeasible arguments. The defeasible nature of each scheme is shown (...) by means of critical questions, which identify the default conditions for the accepting interpretative arguments and provide a method for evaluating a given argument as weak or strong. In the tradition stemming from Aristotle through Aquinas, rational decision making is seen as a complex structure of distinct phases in which reasoning and will are interconnected. Intention, deliberation, and decision are regarded as the fundamental steps of the decision-making process, in which an end is chosen, the means are specified, and a decision to act is made. Based on this Aristotelian theoretical background, we show how the decision-making process can be modeled as a net of several patterns of reasoning, (...) involving the classification of an action or state of affairs, its evaluation, the deliberation about the means to carry it out, and the decision. It is shown how argumentation theory can contribute to our understanding of the mechanisms involved by formalizing the steps of reasoning using argumentation schemes, and setting out the value-based criteria underlying the evaluation of an action. Representing each phase of the decision-making process as a separate scheme allows one to identify implicit premises and bring the roots of ethical dilemma to light along with the means to resolve them. In particular, we will show the role of framing and classification in triggering value-based reasoning, and how argumentation theory can be used to represent and uproot the grounds of possible manipulations. The modern tradition of informal logic has relied heavily on accepting, modifying, or criticizing the patterns of reasoning mentioned in Aristotle's Sophistical Refutations. However, already in 1971, Stachowiak focussed his attention on the muc h neglected Topics and enumerated in his work, Rationalismus im Ursprung some of the Aristotelian rules governing the formation of definitions and principles for correct reasoning. The paper will try to examine how these principles might ap ply to informal arguments today.

This paper argues for the need of philosophical translator-advocates to overcome the (would-be) limitations produced by the linguistic narrowness of analytic philosophy. It draws on a model used to analyze epistemic communities in order to characterize a form of linguistic injustice. In particular it does so by treating language as an epistemic barrier to entry of ideas and people and by treating philosophical translator-advocates as engaged in a form of arbitrage. Along the way I specify some necessary and jointly sufficient (...) characteristics of a philosophical translator-advocate. My argument is illuminated and vivified with examples from the history of analytic philosophy and other episodes from the history of philosophy. (shrink)

This volume presents a selection of papers reflecting key theoretical issues in argumentation theory. Its six sections are devoted to specific themes, including the analysis and evaluation of argumentation, argument schemes and the contextual embedding of argumentation. The section on general perspectives on argumentation discusses the trends of empiricalization, contextualization and formalization, offers descriptions of the analytical and evaluative tools of informal logic, and highlights selected principles that argumentation theorists do and do not agree upon. In turn, the section on (...) linguistic approaches to argumentation focuses on the problem of distinguishing between explanation and argument, while also elaborating on the role of verbal indicators of argument schemes. The thesis is defended that rhetoric is not, as is often said, a discipline which is hierarchically subordinate to dialectic. It is argued that the modalities of the links between rhetoric and dialectic must be seen in a somewhat different light: rhetoric and dialectic should be viewed as two complementary disciplines. On the basis of a historical survey of the views of various authors on the links between rhetoric and dialectic, it is concluded that efforts to establish clear boundaries or (...) unequivocal conceptual or moral hierarchical relationships between the two disciplines have failed and that therefore, they must be conceived as being mutually dependent. While the formal treatment of arguments in the late medieval modi arguendi owes much to dialectic, this does not remove the substance and function of the argumentative modes discussed from the realm of rhetoric. These works, designed to teach law students skills in legal argumentation, remain importantly focused on persuasive features of argumentation which have traditionally been strongly associated with a rhetorical approach, particularly in efforts to differentiate from it dialectic as a more strictly scientific and logical form of reasoning. (...) This also sheds some light on the relative roles logic and rhetoric play in the legal discourse of our own time. In their approach to persuasive legal discourse, the modi arguendi stand between the argumentative rhetorics of Antiquity and the rhetoricized dialectics of the Renaissance, and by linking the minute technicalities of professionalized law with broad general considerations of justice, utility, nature, and emotion, they mediate between the modem trend towards atomized field-specific rhetorics and the classical idea of a unified civic rhetoric. In the present article I attribute to the common topic in the Rhetoric a two-fold suggestive function and a guarantee function. These three functions are possible because this type of topic, while often quite abstract, nevertheless contains thought-steering, substantial terms, and formulates a generally empirical or normative endoxon. Assuming that according to Aristotle an enthymeme has at least two premises, it would appear that a common topic is the abstract principle behind the often implicit major premise. This means that the (...) topic may be regarded as the – generalizing – if-then statement in a modern argumentation scheme. Therefore it should be possible to see the enthymemes of Rhetoric 2.23 as a combination of a logical argument form (which can usually be reconstructed as modus ponens) and an argumentation scheme – even though we may not attribute this idea to Aristotle himself. In classical logic and rhetoric the strategies of argumentation known as topoi played a crucial role. Yet, topoi refer there to different kinds of strategies that this study intends to explain synoptically. Main focus will be on passages from Aristotle and Cicero. Indeed, these sources contain examples and theoretical considerations, which provide the basis for a general investigation of the complex phenomenon of topoi in the ancient world. Four main types of topoi will be juxtaposed and discusses comparatively as a (...) way to inspire historical reconstructions of the system of topoi, as well as modern theory formation on argumentation where topoi still receive much attention. The literature on argumentation and education often conveys that children’s argumentation skills are not well developed; therefore, it would be difficult to find argumentation in small children, as well as in primary school classrooms. However, studies focusing on argumentation in less formal contexts show that there is no need to depart from such a negative stance. If children are given room to pursue their lines of thought, they often produce sophisticated spontaneous argumentation. In this paper I consider arguments from definition (...) introduced by children as a case in point. To do so, I use a corpus of data, in which small children under the age of six years, discuss with an adult and with peers. Results show two uses of arguments from definition by children: on the one hand, children may introduce a new issue and their standpoint supported by an argument from definition; on the other hand, children may contest or refute an issue that was proposed by an adult and put forward an argument from definition. This paper lists and examines the explicit references to Aristotle’s Topics in the Greek Neoplatonic commentaries on the Categories. The references to the Topics by Porphyry, Dexippus, Ammonius, Simplicius, Olympiodorus, Philoponus and David are listed according the usual prolegomena to Aristotle’s works. In particular, the paper reconstructs David ’s original thesis about the proponents of the title Pre-Topics for the Categories and compares Ammonius’, Simplicius’ and Olympiodorus’ doxographies about the postpraedicamenta. Moreover, the study identifies two general trends. The first one (...) is that all the commentators after Proclus share the same general view about: the authenticity of the Topics, Aristotle’s writing style in them, the part of philosophy to which they belong, their purpose, their usefulness and their place in the reading order. The second one is that whereas Porphyry, Dexippus and Simplicius use the Topics as an aid to understanding the Categories, Ammonius, Olympiodorus and David do not. (shrink)

In relation to the task of making an expedient selection from the available loci within the topical potential that strategic manoeuvring envisages for the argumentation stage, this paper proposes a version of topics, which is both inspired to the traditional doctrine of topics and consistent with the theoretical framing and the methodological tenets that are proper of modern semantics and current theory of argumentation. The argumentative relevance of communication context in its institutionalised and interpersonal components is brought to light. Three (...) main aspects are focussed on: the strong synergy of the topical and the endoxical components in argument construction, the use of topics in analysis and evaluation of arguments and the heuristic function of topics in the production process. Dans cet article sont examinés les différents sens du mot «probable» tel qu'il apparaît dans certains commentaires desTopiques d'Aristote, notamment ceux d'Alexandre d'Aphrodise, d'Averroès et surtout celui d'Agostino Nifo, ainsi que dans des traités qui s'en inspirent, notamment leDe dialogo de Carlo Sigonio et leDe inventione dialectica de Rudolph Agricola. On retrouve dans ces écrits les trois sens principaux de ce mot depuis Aristote et Cicéron: celui d'opinion communément admise, celui d'opinion qui correspond à «ce qui se passe la plupart (...) du temps» et celui d'opinion apte à produire la persuasion. À partir de cette polysémie du mot «probable», l'article met en évidence les différentes fonctions attribuées aux opinions probables dans ces divers écrits, plus particulièrement au XVIe siècle. L'association du mot «probable» avec la notion de vérité contingente conduit à mettre en valeur le lien entre hypothèse probable et conjecture. (shrink)

This paper aims to single out and to highlight the fundamental tenets of Agricola’s De inuentione dialectica. After the structure of the volume, its theoretical perspective and its educational concern are illustrated, Agricola’s understanding of the fundamental notion of locus is expounded. In this relation his particular use of the medieval term habitudo and the exclusion of maxims, which had been the main concern of the Medieval doctrine of loci, show a certain distance from the Medieval tradition. Several innovative and (...) constructive contributions of Agricola’s work are stressed, in particular the elaboration of a new taxonomy of loci and the discovery of the relevant role played by loci not only in argumentation but also in exposition and in explanation. In this way, loci acquire the status of intentiones secundae, i.e. of meta-categorical concepts which govern the connections ensuring textual congruity. A reading of this text in the light of contemporary argumentation theory reveals a surprising topicality and richness of concrete contributions in some dialectical and rhetorical domains, like argument schemes, topical potential, and presentational techniques.
