The paper distinguishes between two conceptions of kinds defined by constitutive rules, the one suggested by Searle, and the one invoked by Williamson to define assertion. Against recent arguments to the contrary by Maitra, Johnson and others, it argues for the superiority of the latter in the first place as an account of games. On this basis, the paper argues that the alleged disanalogies between real games and language games suggested in the literature in fact don’t exist. The paper relies (...) on Rawls’s distinction between types of practices and institutions defined by constitutive rules, and those among them that are actually in force, and hence are truly normative; it defends along Rawlsian lines that a plurality of norms apply to actual instances of rule-constituted practices, and uses this Rawlsian line to block the examples that Maitra, Johnson and others provide to sustain their case. The purpose of this article is to explore the intersection between the ancient philosophical concept of àskēsis and contemporary boxing discipline, investigating boxing’s potential as an educational tool for cultivating ethics, personality, and virtues. Drawing on Hadot and Foucault’s theories, the study analyzes the ethopoietic purposes of Stoic spiritual exercises and technologies of the self, examining their relevance to modern boxing practices. By scrutinizing the cultural practices of boxing, the article elucidates how they can judiciously be employed to foster ethical (...) development. By analyzing the parallels between philosophical doctrines and boxing ethics, an attempt is made to emphasize the embodiment of virtues that boxing champions could potentially have. In addition, the author, a former boxer turned coach, reflects on the changes in sporting values within boxing over the past two decades and discusses the practical and moral paradox of the problem of sub-concussions and concussions versus the formative purposes of ethos. While acknowledging the risk of chronic traumatic encephalopathy, the author argues that boxing, if approached consciously, can contribute positively to the development of personality and ethical behavior. This paper deals with the question of whether nature sports are to be counted among the (traditional) sports and Kevin Krein’s recent argument, based on sporting excellence, as to why they should. Krein argues that sports as such are ultimately about sporting excellence and because both so-called traditional sports and nature sports fulfil that criterion, nature sports belong in the sport domain. Here, I show that Krein’s argument rests on an equivocation between two concepts of sporting excellence. Sporting excellence in (...) traditional sports is connected to sporting success. Here agon (contest or competition) dictates or frames areté (striving for excellence). This is not the case for sporting excellence in nature sports, as these are not competitions. We are dealing with two different concepts of sporting excellence and Krein’s argument, based on sporting excellence, must be rejected. It gives no basis for including nature sports in the sport domain. (shrink)

This research revisits the conceptual foundations and definitions of ‘game’, distinguishing it from ‘sport’ and ‘play’ through an etymological and philosophical lens. Given the vast range of ‘game’ in everyday use and the enormous diversity of the activities called games, Wittgenstein argued that games cannot be defined at all but have only ‘Family Resemblances’. Philosophers such as Bernard Suits have rejected Wittgenstein’s claim that there is no commonality among all games. But in recent years, some researchers have questioned Suits’ failure (...) to refute Wittgenstein’s claim that games are definable on the basis of Wittgenstein’s anti-essentialist stance. Our analysis incorporates the interplay of etymology, historical context and philosophical discourse, clarifies the incompleteness of Suits’s definition, and addresses Meier’s physical-skill-fixed logical difficulties regarding conceptual models of ‘game’. By proposing a nuanced Venn diagram illustrating the intersections and divergences among play, game, and sport, we offer a redefinition that integrates the intrinsic motivations and societal influences underlying these activities. This redefinition emphasizes the voluntary goal-oriented, rule-constrained and non-utility nature of games while acknowledging the complex relationships between play, games, and sports within a broader socio-historical framework. The natural-artificial distinction is not only an abstract metaphysical question dedicated to classifying and differentiating between entities and phenomena that occur in nature from man-made objects. The distinction between the natural and the artificial is central to the philosophy of technology and an interesting heuristic to discuss important notions about the growing process of technologization in sport. For example, if one accepts the natural-artificial distinction, one is against any genetic intervention to improve sports performance because one would consider it unnatural. (...) In his work, Bernard Suits presents and pursues a stated objective: to define ‘game’ or, more precisely, ‘game-playing’. In The Grasshopper: Games, Life and Utopia, the author seeks a definition not as a ‘commitment to the universal fruitfulness of definition construction’, but rather with the idea ‘that some things are definable, and some are not’. This is something he believed could resolve many of the issues surrounding the debate on ‘game’ and ‘play’, such as those with Huizinga (in Homo Ludens) (...) or proposed by the anti-definitionism of Wittgenstein, a philosopher who did not accept that it was possible to define ‘game’. In this article, we will trace Suits’ definitional steps and aim to critique his resolution as a kind of ‘formalism’, as it tended to prioritize rules. Furthermore, notwithstanding the merit of his theoretical endeavor – seen in the attempt to define a social component that is so complex and the target of the most diverse interpretations and misconceptions –, it seems to us that, with his theoretical unifying element (lusory attitude), the author has summoned another problem to the debate, that of ‘subjectivism’, rather than a solution (especially to his formalism), even subjecting himself to comparisons with other conceptions (e.g. Fichte) that are also problematic. This aspect will also be criticized. The attention of this article will shift to these two lines of critique, drawing on an insightful analysis of Malaby’s work at a specific juncture, aiming to delve further into the subject and taking an additional step. There are well-known problems for formalist accounts of game-play with regards to cheating. Such accounts seem to be committed to cheaters being unable to win–or even play–the game, yet it seems that there are instances of cheaters winning games. In this paper, I expand the discussion of such problems by introducing cases of pre-game cheating, and see how a formalist–specifically a Suitsian–account can accommodate such problems. Specifically, I look at two (fictional) examples where the alleged game-players cheat prior to a (...) game-instance in such as a way as to cast doubt on whether the alleged game-players are truly playing the game. To escape the worries brought about by these examples of pre-game cheating, I will appeal to the concept of nested games. This concept will give us the needed tools to explain how the alleged players are cheating and how the alleged players are players. On the whole, this discussion should help illuminate some important issues with regards to cheating and rules on a Suitsian account of game-play, and help give support for formalist accounts more generally. In The Grasshopper: Games, Life, and Utopia, Suits maintains the following two theses: game-playing is defined as ‘activity directed towards bringing about a specific state of affairs, using only means permitted by rules, where the rules prohibit more efficient in favour of less efficient means, and where such rules are accepted just because they make possible such activity’ and ‘game playing is what makes Utopia intelligible.’ Observing that these two theses cannot be jointly maintained absent paradox, this essay explores the (...) logical possibility that if is true, then must be false. More specifically, in the tradition of conceptual analysis it is argued that Suits’ definition of game-playing is too narrow inasmuch as it excludes really magnificent Utopian games of significance. Johnson and Hudecki argue that Bernard Suits fails to refute Wittgenstein’s ‘family resemblance’ view of games because Suits’s account of how games begin, how they are played, and the ends they involve, fails to match basic facts of player experience. In reply, the current paper describes three keys to interpreting The Grasshopper: (1) distinguishing the four perspectives from which Suits describes games, (2) recognizing Suits' dispositional view of rule following, and (3) understanding the geometrical metaphor Suits uses to describe rules. In his recent address to the Aristotelian Society, Aurel Kolnai suggests that games exhibit what he calls a “genuine paradoxy.” I do not believe that he has shown this to be the case, even on the most permissive interpretation of what it means to be a paradox. Kolnai has, however, called attention to an aspect of games which invites further investigation, and I should like to advance the following considerations not so much as a criticism of Kolnai as an attempt (...) to take the investigation along a path which Kolnai has indicated, but which he has not himself, in my opinion, followed. It is not that Kolnai does not say many interesting, indeed penetrating, things about games, for he does. That Kolnai's inquiry is an important contribution to the philosophy of games is not in question. What is questionable is whether paradox has very much to do with that contribution. (shrink)

Where sporting games may be said to epitomize our species’ unique agential capacity for playful movement, sports played in nature differ from their equivalent played indoors in that they envelop the human agent within the living physical environment from which our agency originates. In this paper, we draw attention to how sporting sites differ according to origin by pursuing a biosemiotic line of reasoning. Here, the story of a meaningful human life begins with the eukaryotic cell, even though the human (...) subject itself arises much later. As such, the story of nature in relation to our agency, here, in sports, changes too. We present key concepts from biosemiotics, including its continuum life-as-semiotic-agency view, Umwelt, metasemiosis, and semiotic scaffolding to advance our argument that naturogenic sporting sites provide continuity to the macro processes that have generated our semiotic ability to play. Meanwhile, secluded anthropogenic environments constitute yet another discontinuity for the modern sportsperson where the moving body steps into an anthroposemiotic loop and its restricted signscapes from centralized agency. We conclude on the primacy of naturogenic sporting sites as they preserve the quality and complexity of animal ludens’ constitutive relations and therefrom semiotic freedom, on which current and future gameplaying depends. Commanders gain authority from obedience and lose authority from disobedience. We should expect commanders to therefore devise commands that reduce the probability of disobedience. To aid recognition of these techniques for reducing the risk of disobedience, I focus on the extreme of case of commands that reduce the probability to zero. Each of my ten commandments illustrates a logical technique for engineering out disobedience. Once you master these safety measures, you can confidently legislate your own universal maxims. Your innovations will (...) be good news for Immanuel Kant’s characterization of morality in terms of categorical imperatives. But even critical commentary, and perhaps especially critical commentary, is evidence of serious engagement. More importantly, the commentaries contained here have advanced our understanding of law in valuable ways. I respond to each in this reply, but with (...) full acknowledgment that my responses cannot do justice to the full breadth of their contributions and challenges. My hope is not that I will persuade readers that I am correct and my critics mistaken, but rather that the reader who absorbs both the challenges and my response will come away with a greater understanding of the issues that The Force of Law seeks to place on the agenda of contemporary jurisprudence. Are they really invitations or are they imperatives? What should we make of the apparently presumed connection between fitness and sex? Bernard Suits bequeathed a rich legacy of philosophical insights contributing to our developing a deeper understanding of sport-related issues, and his work has attracted much attention and stimulated valuable controversy over many years. However, the interest it has stimulated appears uneven. In this context and with reference to the former claims above, I focus on a part of his work that has received relatively less commentary, in the hope that it too will yield work of value. Given the imaginative quality (...) of Suits's writing, it is pessimistic to assume that attention to a relatively neglected part of his work will fail to bear fruit, if not as a result of my labours here, then perhaps of someone else's in further discussion. My concern is his account of ?play?, by which he meant to toy, fiddle or trifle with something or other, written over 30 years ago, and it stems from reflection on one recent effort to examine this part of Suits's work, namely Morgan's discussion of ?play?. My article attempts an analysis of the definition Suits gave and an evaluation of efforts he made to defend his understanding, alongside brief exploration of Morgan's work. Both of these tasks are undertaken against a background of Suits's broader concerns with the place of games in an ideal life. The conclusions I reach are that Suits's account embodies too many issues to be acceptable; that Morgan's attempt to rescue him from one of them is misdirected; but that even if my criticisms are damaging to the account of ?play? I examine, they leave Suits's main work on playing games seriously as sports unscathed. (shrink)

Many philosophers think that games like chess, languages like English, and speech acts like assertion are constituted by rules. Lots of others disagree. To argue over this productively, it would be first useful to know what it would be for these things to be rule-constituted. Searle famously claimed in Speech Acts that rules constitute things in the sense that they make possible the performance of actions related to those things (Searle 1969). On this view, rules constitute games, languages, and speech (...) acts in the sense that they make possible playing them, speaking them and performing them. This raises the question what it is to perform rule-constituted actions (e. g. play, speak, assert) and the question what makes constitutive rules distinctive such that only they make possible the performance of new actions (e. g. playing). In this paper I will criticize Searle’s answers to these questions. However, my main aim is to develop a better view, explain how it works in the case of each of games, language, and assertion and illustrate its appeal by showing how it enables rule-based views of these things to respond to various objections. The concept of metagames can be of use to philosophers of sport and games. However, the term “metagame” is used throughout the literature in several different, distinct senses, few of which are clearly defined, and as a result there remains ambiguity about what, precisely, this term means. In this paper, I attempt to disambiguate the term metagame. I have come across at least four different senses of “metagame” in academic literature about games. Of these four senses, most relevant to philosophers (...) of sport and games is what I have termed “ludic” metagames. Ludic metagames involve playing a game “on top of” another game. I attempt to spell out this concept in particular detail, distinguishing it from related – but distinct – ways in which the formal features of a game can be modified without giving rise to metagames. Der Beitrag gibt einen Überblick über den Ursprung und die Entwicklung der Sportphilosophie in Nordamerika und Deutschland. Hierbei wird versucht, das Profil der deutschen Sportphilosophie herauszuarbeiten und der Frage nach ihrem Selbstverständnis nachzugehen. Am Beispiel des Prinzips der Natürlichkeit soll gezeigt werden, dass die Sportphilosophie einen eigenständigen Beitrag zur philosophischen Theoriebildung leisten kann und sich auf dem Wege hin zu einer emanzipierten Sportphilosophie befindet. Ausgehend von der sportspezifischen Problemstellung des Dopings wird in Anlehnung an Aristoteles’ Unterscheidung zwischen dem „Gewachsenen“ und (...) „Gemachten“ ein Ansatz der „Biogenese“ vorgestellt, welcher kritisch Abstand nimmt zum kulturrelativistischen Blick auf das Gegensatzpaar Natürlichkeit/Künstlichkeit in der Naturethik und Medizinethik. Nicht nur in Bezug auf das Sportdoping, sondern auch für die Bereiche der Reproduktionsmedizin und des Neuroenhancement von Emotionen wird deutlich gemacht, dass das Natürlichkeitsprinzip als Grenzprinzip eine zentrale Rolle spielt und im Verbund mit den Prinzipien Authentizität und Echtheit auch als normatives Prinzip ein unverzichtbares Element bildet für tugendethische, pädagogische und allgemeine Fragen des guten Lebens. This paper aims to provide a conceptual analysis of blood-sport as a concept. Through utilising a generalised notion of sport as well as the concept of fair-play, the objective will be to examine whether blood-sports are games and analyse to what extent, if any, blood-sports can be properly called ‘sports’. For the purposes of application and because of the sheer numbers of birds used in the sports-shooting industry, the paper will focus on a discussion of game-birding, but the findings will (...) apply to the practice of ‘blood-sport’ more generally. Work by Sam P. Morris (IJAP, 2014) argues that ‘fair-chase hunting’ can be classified as a game, as well as a sport, although Morris stresses that answers to questions concerning the sport status of hunting do not provide answers to questions regarding the ethics of blood-sports. The author of this paper agrees with Morris regarding the latter point, but pace Morris, she argues that it is doubtful that blood-sport is a game let alone a sport, and that even if one assumes for argument's sake that it is indeed a game, it cannot be properly classed as sport, and that a fair-chase code undermines itself in the context of so called ‘blood-sports’.Footnote1. It is sometimes claimed that formalism and the logical incompatibility thesis together imply that fouls cannot be part of the game. Some philosophers think this proves that therefore strategic fouls are always morally wrong, but other philosophers think this result undermines formalism itself, since strategic fouls clearly are part of the game and are at least sometimes morally permissible. I show that formalism in fact does accommodate strategic fouls and that it is neutral about whether strategic fouls are morally permissible (...) or not. (shrink)

Stephen King’s novel The Long Walk, written under the pseudonym of Richard Bachman, offers a vision of sport in a near-future society, where death-sports serve as a major spectacle. This was designed as a critique of trends and problems in sport in the 1960s and 1970s, with over-commercialization and increased violence. One of the most pressing points in the philosophy of sport is the question of a definition of sport. Approaches towards sport vary based on a paradigm and position of a particular author. This article attempts to analyse and critically evaluates a recent definition of sport presented by Jim Parry in the context of argument that e-sports are not sports. Despite some innovations, his conclusions are in many ways traditional and build on the previous positions. His research, rooted in the (...) conceptual analysis, starts with a stipulation that sport is paradigmatically Olympic sport. He defines it then as an ‘institutionalised, rule-governed contest of human physical skill’ i.e., identifies six necessary elements of sport: human (not animals), physical (not chess), skill (not jogging), contest (not mountaineering), rule-governed (not ‘field sports’), institutionalized (not hula-hooping). Our claim is that this definition, despite its methodological clarity, is not accurate and does not sufficiently represent sport outside the Olympic context. First, to say for something to be a sport it is necessary to be a contest leads to a narrow concept of sport. Secondly, Parry’s account lacks the emphasis on game and play-like structures that are inherently present in sport (even in the Olympic sport), namely non-necessity, non-ordinariness, arbitrariness and gratuitousness. We try to direct the attention precisely on these structures and offer an alternative account of sport understood as a modern ‘hard core’ sport that nevertheless reaches important congruences with Parry’s definition. The originality of this contribution lies in presenting the essential qualities of modern ‘hard core’ sports, which, although sometimes hidden in the modern emphasis on high level performances, competition, and results, play an important role in the question how sport ought to be played and approached. The relation between sport and a good life presents a fruitful philosophical challenge and it has been discussed extensively within the philosophy sport literature. This paper will investigate the role of sport in a good life in the philosophical conceptions of Aristotle and Suits. Both authors paid attention to sport and its significance in the context of living well. However, their approaches differ, partly because they emerge in a different historical and cultural context. My aim is to analyse relevant texts (...) of these two authors, presenting their major points, commonalities, and differences. The debate, to a certain extent, highlights instrumental (educational) and autotelic (intrinsic) value of sport. In order to conceptualize properly the role of sport in a good life, we need to take into account both of these aspects. The originality of this contribution can be found in presenting relevant implications of the contrasting positions of Suits and Aristotle to our thinking about modern sport. Finally, I point to the complementarity of their positions and demonstrate their impact on the broader debate concerning good sport and its role in a good life. (shrink)

Unlike Dickens’s novel, this is not a tale of light and darkness, order and chaos, good and evil… It is, though, a story worth to be told about two standpoints about games and sports, teaching and research, physical education simply put, that have pursued similar interests on parallel tracks for too long, despite their apparent closeness and expected shared cultural grounds. The objective of this conceptual analysis is to try and reconcile two perspectives, namely motor praxeology and teaching games for (...) understanding (TGfU), born in the last third of the XX century in France and England with the intention to rethink the foundations of physical education (PE) and sports teaching. Pierre Parlebas, from the French side of the English Channel, claimed in 1967 that sports make part of PE, that team sports must be considered from a specific, sociomotor point of view, and that motor conducts (i.e. the significative organization of motor behaviour), not sports techniques, are the corner-stone of PE and sports coaching. In the early 1980s, from the English side of La Manche, Almond, Thorpe, and Bunker made a plea for a shift in the way to teach games (sporting collective duels mostly), deeply concerned by the negative impact of the traditional technics-centred approach on motivation, competence and attained level of the least able in school situations. Our conclusion is that TGfU, or game-based approaches to sports coaching and teaching, can take great advantage of the motor-praxeological rationale for three reasons: firstly, because concepts like understanding, game sense and action principles are operatively, semiotically linked to the reality of the playing process; secondly, because the inner structures of the games that constrain players and guide their motor conducts, permit to integrate games in the general system of sporting games, no matter their level of institutionalisation; finally, because the intervention practice is better thought of and more systematically developed upon the operational concepts of internal logic and expected practical effects of game playing. This time, Paris could be the place to go to in search of solutions, not the city to run away from in hope of consolation. (shrink)

ABSTRACTBernard Suits and other formalists endorse both the logical incompatibility thesis and the view that rule-breakings resulting in penalties can be a legitimate part of a game. This is what Fred D’Agostino calls ‘the problem of penalties’. In this paper, I reject both Suits’ and D’Agostino’s responses to the problem and argue instead that the solution is to abandon Suits’ view that the constitutive rules of all games are alike. Whereas the logical incompatibility thesis applies to games in which players’ (...) actions are perfectly controlled, it does not apply to sports. This insight not only justifies the rejection of formalism as a theory about the nature of sport but it also helps explain the greater normative complexity of sports, which in turn leads to the idea that in sports ‘cheating’ should be interpreted as a genus. Decisions in democracy are binding not in virtue of being true or good, but on account of being an outcome of the majority voting procedure. For some, this is a proof of an intricate connection between democracy and moral relativism. The ‘militant democracy’ model, on the other hand, is premised on the idea that certain political actors and choices have to be banned for being fatally bad for democracy. This gives rise to the claim that protected democratic fundamental values of (...) freedom and equality enjoy the status of absolute moral standards. This article dismisses the intuition that justification of ‘militant democracy’ depends on unpacking the relation between democracy and meta-ethics. Instead, following Bernard Suits’ analytical exposition of the important features of games, it demonstrates, first, how democracy is like a game and, then, it argues that a plausible justification of ‘militant democracy’ stems from its game-like character. Although a sizable number of works on analytic philosophy are published in non-Western languages, the literature continues to be written mainly in Western languages, especially English and German. This article makes a case for discussing analytic philosophy in Chinese and argues that it entails a dilemma: it can fulfill either the audience-service or knowledge-service functions but not both at the same time. This is problematic because a standard original or critical philosophical article should fulfill both functions. Then, to challenge the (...) validity of this dilemma, I pose the hypothetical scenario of Jake, who writes a marvelous, purely original publication on analytic philosophy in Chinese. This article posits that the dilemma will not be undermined by such a case and suggests an alternative way to resolve it. (shrink)

How does match-fixing, or other unfair manipulation of matches, that involves under-performance by players, or refereeing and umpiring that prevents fair competition, be thought of in ethical terms? In this article, I outline the different forms that match-fixing can take and seek to comprehend these disparate scenarios within Kantian, Hegelian and contractualist ethical frameworks. I tentatively suggest that, by developing an ethical opposition to match-fixing in sport, we can give much greater substance to popular phrases such as ‘respect for the (...) game’, encompassing the value of sport itself and respect for other players, fans, sponsors and organisers. In 2011, Ingmar Riedel‐Kruse's bioengineering laboratory at Stanford University publicized an application that uses paramecia for what the researchers termed “biotic games.” These games make use of living organisms, computer programs, and lab equipment to implement games like Pong, Pac‐man, and soccer. Gamesand related activities are often considered nonserious or trivial, whereas life, biological systems, and science are treated very seriously in moral analysis and public perception. The manipulation of living matter frequently engenders at least some controversy in the marketplace (...) of ideas, and using living things in games is no exception. Some of the objections lodged against biotic games have appeared in the ethics literature on similar topics; however, the addition of an entertainment element introduces some objections distinct from those about similar cases, as the online comments vividly illustrate. We aim to explore and address the objections in this paper, using the comments to organize and launch the discussion. In scientific work, there is typically a presumption of some prospect of translation and application of generated knowledge for public benefit. In the case of biotic games, these applications are not self‐evident. Because of this, a serious analysis of the justifications, limitations, and features of biotic games is warranted. To this end, we outline key ethical limits that ought to be placed on these activities as well as the obligations that these activities generate for researchers, other professionals, and lay people who design, implement, use, and play them.
