Defenders of deontological constraints in normative ethics face a challenge: how should an agent decide what to do when she is uncertain whether some course of action would violate a constraint? The most common response to this challenge has been to defend a threshold principle on which it is subjectively permissible to act iff the agent's credence that her action would be constraint-violating is below some threshold t. But the threshold approach seems arbitrary and unmotivated: what would possibly determine where (...) the threshold should be set, and why should there be any precise threshold at all? Threshold views also seem to violate ought agglomeration, since a pair of actions each of which is below the threshold for acceptable moral risk can, in combination, exceed that threshold. In this paper, I argue that stochastic dominance reasoning can vindicate and lend rigor to the threshold approach: given characteristically deontological assumptions about the moral value of acts, it turns out that morally safe options will stochastically dominate morally risky alternatives when and only when the likelihood that the risky option violates a moral constraint is greater than some precisely definable threshold (in the simplest case, .5). I also show how, in combination with the observation that deontological moral evaluation is relativized to particular choice situations, this approach can overcome the agglomeration problem. This allows the deontologist to give a precise and well-motivated response to the problem of uncertainty. (shrink)

Decision-making under normative uncertainty requires an agent to aggregate the assessments of options given by rival normative theories into a single assessment that tells her what to do in light of her uncertainty. But what if the assessments of rival theories differ not just in their content but in their structure -- e.g., some are merely ordinal while others are cardinal? This paper describes and evaluates three general approaches to this "problem of structural diversity": structural enrichment, structural depletion, and multi-stage (...) aggregation. All three approaches have notable drawbacks, but I tentatively defend multi-stage aggregation as least bad of the three. (shrink)

How ought you to evaluate your options if you’re uncertain about which axiology is true? One prominent response is Expected Moral Value Maximisation, the view that under axiological uncertainty, an option is better than another if and only if it has the greater expected moral value across axiologies. EMVM raises two fundamental questions. First, there’s a question about what it should even mean. In particular, it presupposes that we can compare moral value across axiologies. So to even understand EMVM, we (...) need to explain what it is for such comparisons to hold. Second, assuming that we understand it, there’s a question about whether EMVM is true. Since there are many plausible rivals, we need an argument to defend it. In this paper, I’ll introduce a representation theorem for axiological uncertainty to answer these two questions. Roughly, the theorem shows that if all our axiologies satisfy the von Neumann–Morgenstern axioms, and if the facts about which options are better than which in light of your uncertainty also satisfy these axioms as well as a Pareto condition, then these facts have a relevantly unique expected utility representation. If I’m right, this theorem at once affords us a compelling way to understand EMVM—and specifically intertheoretic comparisons—and a systematic argument for its truth. (shrink)

How ought you to evaluate your options if you're uncertain about what's fundamentally valuable? A prominent response is Expected Value Maximisation (EVM)—the view that under axiological uncertainty, an option is better than another if and only if it has the greater expected value across axiologies. But the expected value of an option depends on quantitative probability and value facts, and in particular on value comparisons across axiologies. We need to explain what it is for such facts to hold. Also, EVM (...) is by no means self-evident. We need an argument to defend that it’s true. This book introduces an axiomatic approach to answer these worries. It provides an explication of what EVM means by use of representation theorems: intertheoretic comparisons can be understood in terms of facts about which options are better than which, and mutatis mutandis for intratheoretic comparisons and axiological probabilities. And it provides a systematic argument to the effect that EVM is true: the theory can be vindicated through simple axioms. The result is a formally cogent and philosophically compelling extension of standard decision theory, and original take on the problem of axiological or normative uncertainty. (shrink)

Morally speaking, what should one do when one is morally uncertain? Call this the Moral Uncertainty Question. In this paper, I argue that a non-ideal moral theory provides the best answer to the Moral Uncertainty Question. I begin by arguing for a strong ought-implies-can principle---morally ought implies agentially can---and use that principle to clarify the structure of a compelling non-ideal moral theory. I then describe the ways in which one's moral uncertainty affects one's moral prescriptions: moral uncertainty constrains the set (...) of moral prescriptions one is subject to, and at the same time generates new non-ideal moral reasons for action. I end by surveying the problems that plague alternative answers to the Moral Uncertainty Question, and show that my preferred answer avoids most of those problems. (shrink)

Several philosophers have recently argued that decision-theoretic frameworks for rational choice under risk fail to provide prescriptions for choice in cases of moral uncertainty. They conclude that there are no rational norms that are “sensitive” to a decision-maker's moral uncertainty. But in this paper, I argue that one sometimes has a rational obligation to take one's moral uncertainty into account in the course of moral deliberation. I first provide positive motivation for the view that one's moral beliefs can affect what (...) it's rational for one to choose. I then address the problem of value comparison, according to which one cannot determine the expected moral value of one's actions. I argue that we should not infer from the problem of value comparison that there are no rational norms governing choice under moral uncertainty. (shrink)

Suppose that an altruistic agent who is uncertain between evidential and causal decision theory finds herself in a situation where these theories give conflicting verdicts. We argue that even if she has significantly higher credence in CDT, she should nevertheless act in accordance with EDT. First, we claim that the appropriate response to normative uncertainty is to hedge one's bets. That is, if the stakes are much higher on one theory than another, and the credences you assign to each of (...) these theories are not very different, then it is appropriate to choose the option that performs best on the high-stakes theory. Second, we show that, given the assumption of altruism, the existence of correlated decision makers will increase the stakes for EDT but leave the stakes for CDT unaffected. Together these two claims imply that whenever there are sufficiently many correlated agents, the appropriate response is to act in accordance with EDT. (shrink)

In this paper, I argue that the fetishism objection to moral hedging fails. The objection rests on a reasons-responsiveness account of moral worth, according to which an action has moral worth only if the agent is responsive to moral reasons. However, by adopting a plausible theory of non-ideal moral reasons, one can endorse a reasons-responsiveness account of moral worth while maintaining that moral hedging is sometimes an appropriate response to moral uncertainty. Thus, the theory of moral worth upon which the (...) fetishism objection relies does not, in fact, support that objection. (shrink)

We’re often unsure what morality requires, but we need to act anyway. There is a growing philosophical literature on how to navigate moral uncertainty. But much of it asks how to rationally pursue the goal of acting morally, using decision-theoretic models to address that question. I argue that using these popular approaches leaves some central and pressing questions about moral uncertainty unaddressed. To help us make sense of experiences of moral uncertainty, we should shift away from focusing on what it’s (...) rational to do when facing moral uncertainty, and instead look directly at what it’s moral to do about moral uncertainty—for example, how risk averse we morally ought to be, or which personal sacrifices we’re morally obligated to make in order to reduce our risk of moral wrongdoing. And orthodox, expectation-maximizing, decision-theoretic models aren’t well-suited to this task—in part because they presuppose the answers to some important moral questions. For example, if approaching moral uncertainty in a moral way requires us to “maximize expected moral rightness,” that’s, itself, a contentious claim about the demands of morality—one that requires significant moral argument, and that I ultimately suggest is mistaken. Of course, it’s possible to opt, instead, for a variety of alternative decision-theoretic models. But, in order to choose between proposed decision-theoretic models, and select one that is well-suited to handling these cases, we first would need to settle more foundational, moral questions—about, for example, what we should be willing to give up in order to reduce the risk that we’re acting wrongly. Decision theory may be able to formalize the conclusions of these deliberations, but it is not a substitute for them, and it won’t be able to settle the right answers in advance. For now, when we discuss moral uncertainty, we need to wade directly into moral debate, without the aid of decision theory’s formalism. (shrink)

There are cases in which, intuitively, an agent’s action is both morally right in one sense, and morally wrong in another sense. Such cases (along with other intuitions about blameless wrongdoing and action-guidance) support distinguishing between the objective moral ‘ought’ and the subjective moral ‘ought.’ This chapter argues against drawing this distinction, on the grounds that the prescriptions delivered by an adequate objective moral theory must be sensitive to the mental states of agents. Specifically, an adequate theory of the objective (...) moral ‘ought’ must respect a strong ought-implies-can principle—morally ought implies agentially can—in order to prescribe actions to real-life agents. An agent’s mental states determine what is agentially possible for that agent; thus, what an agent objectively morally ought to do is in part determined by the agent’s mental states. This chapter describes the structure of a compelling non-ideal moral theory that is both objective and mental state-sensitive. This non-ideal theory illuminates the shortcomings of extant objectivist and subjectivist moral theories, and illustrates how we can dispense with the subjective moral ‘ought.’. (shrink)

Metanormativists hold that moral uncertainty can affect how we ought, in some morally authoritative sense, to act. Many metanormativists aim to generalize expected utility theory for normative uncertainty. Such accounts face the “easy problem of intertheoretic comparisons”: the worry that distinct theories’ assessments of choiceworthiness are incomparable. The easy problem may well be resolvable, but another problem looms: while some moral theories assign cardinal degrees of choiceworthiness, other theories’ choiceworthiness assignments are merely ordinal. Expected choiceworthiness over such theories is undefined. (...) Call this the “hard problem of intertheoretic comparisons.” This paper argues that to solve the hard problem, we should model moral theories with imprecise choiceworthiness. Imprecise choiceworthiness assignments can model incomplete cardinal information about choiceworthiness, with precise cardinal choiceworthiness and merely ordinal choiceworthiness as limiting cases. Generalizing familiar decision theories for imprecise choiceworthiness to the case of moral uncertainty generates puzzles, however: natural generalizations seem to require reifying parts of the model that don’t correspond to anything in normative reality. I discuss three ways of addressing this problem: by demystifying the reified elements by using them as promiscuously as possible; by constructing alternative decision theories that don’t require the troublesome elements; and by employing an alternative model of metanormative decision problems, and of moral uncertainty generally. Many people think that if you're uncertain about which moral theory is correct, you ought to maximize the expected choice-worthiness of your actions. This idea presupposes that the strengths of our moral reasons are comparable across theories – for instance, that our reasons to create new people, according to total utilitarianism, can be stronger than our reasons to benefit an existing person, according to a person-affecting view. But how can we make sense of such comparisons? In this article, I introduce (...) a constructivist account of intertheoretic comparisons. On this account, such comparisons don't hold independently of facts about morally uncertain agents. They're simply the result of an ideal deliberation in terms of certain epistemic norms about what you ought to do in light of your uncertainty. If I'm right, this account is metaphysically more parsimonious than some existing proposals, and yet has plausible and strong implications. (shrink)

How should an agent act under normative uncertainty? We might extend the orthodox theory of rational choice to the case of uncertainty between competing normative theories. But this requires that the values assigned by different normative theories be comparable. This paper defends a strategy for avoiding the need for intertheoretic value comparisons: instead of comparing competing moral theories, I argue that values can be represented in terms of a de dicto specification of value. I provide a decision theory for de (...) dicto values that generalises expected utility theory, and I compare the proposal with alternative strategies for avoiding the problem of intertheoretic comparisons. Automated decision making for sentencing is the use of a software algorithm to analyse a convicted offender’s case and deliver a sentence. This chapter reviews the moral arguments for and against employing automated decision making for sentencing and finds that its use is in principle morally permissible. Specifically, it argues that well-designed automated decision making for sentencing will better approximate the just sentence than human sentencers. Moreover, it dismisses common concerns about transparency, privacy and bias as unpersuasive or inapplicable. The (...) chapter also notes that moral disagreement about theories of just sentencing are plausibly resolved by applying the principle of maximising expected moral choiceworthiness, and that automated decision making is better suited to the resulting ensemble model. Finally, the chapter considers the challenge posed by penal populism. The dispiriting conclusion is that although it is in theory morally desirable to use automated decision-making for criminal sentencing, it may well be the case that we ought not to try. (shrink)

Even if I think it very likely that some morally good act is supererogatory rather than obligatory, I may nonetheless be rationally required to perform that act. This claim follows from an apparently straightforward dominance argument, which parallels Jacob Ross's argument for 'rejecting' moral nihilism. These arguments face analogous pairs of objections that illustrate general challenges for dominance reasoning under normative uncertainty, but (I argue) these objections can be largely overcome. This has practical consequences for the ethics of philanthropy -- (...) in particular, it means that donors are often rationally required to maximize the positive impact of their donations. (shrink)

This paper presents a unifying diagnosis of a number of important problems facing existing models of rational choice under moral uncertainty and proposes a remedy. I argue that the problems of (i) severely limited scope, (ii) intertheoretic comparisons, and (iii) 'swamping’ all stem from the way in which values are assigned to options in decision rules such as Maximisation of Expected Choiceworthiness. By assigning values to options under a given moral theory by asking something like “how much do I desire (...) this option, supposing this theory is true?” rather than “how much value does this theory assign to this option?” these problems can be avoided, while the appealing features of these accounts can be preserved. This amendment provides a role for the preferences, desires, or goals of rational agents that is curiously absent from the existing discussion of what individuals rationally ought to do when they are uncertain about what they morally ought to do. Jennifer Rose Carr’s (2020) article “Normative Uncertainty Without Theories” proposes a method to maximize expected value under normative uncertainty without Intertheoretic Value Comparison (hereafter IVC). Carr argues that this method avoids IVC because it avoids theories: the agent’s credence is distributed among normative hypotheses of a particular type, which don’t constitute theories. However, I argue that Carr’s method doesn’t avoid or help to solve what I consider as the justificatory problem of IVC, which isn’t specific to comparing theories as such. (...) This threatens the implementability of Carr’s method. Fortunately, I also show how Carr’s method can nevertheless be implemented. I identify a type of epistemic states where the justificatory problem of IVC is not a necessary obstacle to maximizing expected value. In such states, the uncertainty stems from indecisive normative intuitions, and the agent justifiably constructs each normative hypothesis on the basis of a consistent subset of her intuitions by reference to the same unit of value. This part of my argument complements not only Carr’s (2020) argument, but also some moderate defenses of IVC. The combination of Carr’s paper and mine helps to illuminate the conditions for maximizing expected value under normative uncertainty without unjustified value comparison. (shrink)
