This article examines Hannah Arendt’s bold and provocative proposal to institutionalize civil disobedience. First, I argue that the proposal follows from Arendt’s peculiar interpretation of this mode of protest. She sees it as an unexpected yet welcome echo of the revolutionary spirit that accompanied the foundation of the American republic. In seeking to bring civil disobedience into government, she aims to embed this spirit within the very institutional fabric of the polity. Second, I suggest that we have strong reasons to (...) take the proposal seriously as an account of how the constitutional state should respond to dissenting minorities. The call to institutionalize civil disobedience can be defended as an approach that is different to — and ultimately more appealing than — familiar liberal and democratic perspectives on this issue. Chantal Mouffe ha criticado con vehemencia la propuesta deliberativa de Jürgen Habermas por lo que interpreta como una negación del conflicto político. El objetivo de este trabajo es reconsiderar esta objeción. Para ello se reconstruye la crítica mouffeana a partir de cuatro diferentes planos analíticos en lo que refiere a las posibilidades de comprensión y aceptación del antagonismo. En contra de lo sostenido por Mouffe, afirmamos que a pesar de que el modelo deliberativo coloca un énfasis prioritario en la dimensión (...) consensual de la práctica comunicativa, el conflicto constituye un supuesto necesario e irreductible que está presente en la base del edificio teórico de la propuesta habermasiana. Chantal Mouffe has strongly criticized the Jürgen Habermas' deliberative proposal for what she asserts is the negation of political conflict. In this paper we reconsider this objection by rebuilding this critique through four different dimensions which consider the possibilities of comprehension and acceptation of antagonism. Thus, in opposition to what Mouffe supports, we assert that even though his deliberative model emphasizes the consensual dimension of the communicative practice, conflict lays on the basis of the Habermas' theoretical structure as a necessary and unavoidable concept. At a time when ideas of crisis and critique are at the forefront of public discourse, this article seeks to understand moments of crisis vis-à-vis critique as a key feature of critical social theory. It addresses Jürgen Habermas’s strong claim that this relationship accounts for a ‘model of analysis’ concerned with grasping the ‘diremptions’ of social life. To elaborate this reading, the article pays attention to the main problems Habermas identifies in conventional ways of understanding the concepts of ‘crisis’ and (...) ‘critique’ in social theory. The aim is to examine the mode in which he reconsiders each of these terms and then reasserts the dialectical link between them. I reconstruct this relationship by taking as cases two of his most substantive works of social theorizing: The Theory of Communicative Action, and Between Facts and Norms. Based on this interpretation, I suggest that though Habermas contributes to resituating the practice of critique as a communicative translation of objective crisis, he does not adequately account for another key movement: when critique actually initiates, enacts and furthers the moment of crisis. In this article, I assess Jürgen Habermas’s defence of civil disobedience as ’the guardian of legitimacy’ in democratic societies. I suggest that, despite its appeal, the defence as it stands is incomplete. The problem relates to his account of the justification of this mode of protest. Although Habermas wants to defend civil disobedience as a response to inadequacies in deliberative democratic procedures, he does not provide us with a clear and compelling account of these inadequacies. In order to provide such (...) an account, I examine the various ways in which the illegitimate circulation of social power can distort democratic processes. Civil disobedience can be seen as a legitimate response to inequalities in social power, a defence that builds on the strengths of Habermas’s approach while transcending its limitations. ABSTRACT:Partnerships between companies and NGOs have received considerable attention in CSR in the past years. However, the role of NGO legitimacy in such partnerships has thus far been neglected. We argue that NGOs assume a status as special stakeholders of corporations which act on behalf of the common good. This role requires a particular focus on their moral legitimacy. We introduce a conceptual framework for analysing the moral legitimacy of NGOs along three dimensions, building on the theory of deliberative democracy. (...) Although often cast by realists as an exemplar of moralist or rationalist thinking, Jürgen Habermas and certain commentators on his work reject this characterisation, highlighting elements of his thought that conflict with it. This article will examine dimensions of Habermas’s work that relate to many realist concerns in political theory. I argue that while he escapes the commonplace caricature of an abstract thinker who is inattentive to real world affairs, Habermas’s claims in relation to communication, historical and empirical context, and (...) the development of rights in history, reveal a narrow consideration of what defines context and a progressivist narrative of history that fails to address seemingly outdated beliefs and political forces. An analysis of these issues can serve to inform understandings of these topics in realist thought and in political theory more broadly. (shrink)

Agonistic democrats have enriched debates on the political challenge of pluralism by raising awareness for the depth of disagreements and the political potentials of conflict. However, they have so far failed to explore the shape of institutional settings that are conducive to agonism and show how the agonistic stance may, in a very practical sense, strengthen democracies’ capacity to deal with pluralism and conflict. This article argues that this ‘institutional deficit’ of agonistic democracy can be overcome. It develops an approach (...) that reads theories of agonistic democracy as accounts of conflict regulation and uses principles of agonistic politics as measures for a critical assessment of institutional design. A discussion of a test case that is prominent in the recent literature on democratic innovations for pluralist societies—mini-publics—demonstrates that the principles of agonistic conflict regulation as developed by Mouffe, Connolly and Tully provide the basis for both a critique of certain institutions and a development of alternative designs. In this article we will suggest that the traditional account of the freedom of expression needs revision. The emergence of Internet media has shown that the traditional ideal of a plurality of voices does not in itself lead to fruitful public spheres. Inspired by Foucault’s interpretation of the Greek concept parrhesia we suggest that the plurality of voices should be supplemented with an ideal of courageous truth-telling. We will furthermore argue that the notion of courage has two dimensions that should (...) be taken into account. On the one hand a Derridean reading of courage brings out a disruptive and aporetic feature of courage. On the other hand, courage also needs to be articulated through some kind of goal, which in a public setting calls for a deliberative dimension. We conclude by suggesting that public spheres with courageous truth-telling will facilitate societies in which strong voices and opinions are continuously challenged by less strong voices. (shrink)
