Argumentation is pervasive in everyday life. Understanding what makes a strong argument is therefore of both theoretical and practical interest. One factor that seems intuitively important to the strength of an argument is the reliability of the source providing it. Whilst traditional approaches to argument evaluation are silent on this issue, the Bayesian approach to argumentation (Hahn & Oaksford, 2007) is able to capture important aspects of source reliability. In particular, the Bayesian approach predicts that argument content and source reliability (...) should interact to determine argument strength. In this paper, we outline the approach and then demonstrate the importance of source reliability in two empirical studies. These experiments show the multiplicative relationship between the content and the source of the argument predicted by the Bayesian framework. (shrink)

According to the argument scheme approach, to evaluate a given scheme-saturating instance completely does entail asking all critical questions relevant to it. Although this is a central task for argumentation theorists, the field currently lacks a method for providing a complete argument evaluation. Approaching this task at the meta-level, we combine a logical with a substantive approach to the argument schemes by starting from Toulmin’s schema: ‘data, warrant, so claim’. For the yet more general schema: ‘premise; if premise, then conclusion; (...) so conclusion’, we forward a meta-level CQ-list that is arguably both complete and applicable. This list should inform ongoing theoretical efforts at generating appropriate object-level CQs for specific argument schemes. (shrink)

Popular textbook treatments of the fallacies approach to argument evaluation employ the Adversary Method identified by Janice Moulton (1983) that takes the goal of argumentation to be the defeat of other arguments and that narrows the terms of discourse in order to facilitate such defeat. My analysis of the textbooks shows that the Adversary Method operates as a Kuhnian paradigm in philosophy, and demonstrates that the popular fallacies pedagogy is authoritarian in being unresponsive to the scholarly developments in informal logic (...) and argumentation theory. A progressive evolution for the fallacies approach is offered as an authoritative alternative. (shrink)

The recent literature on ad hominem argument contends that the speaker’s character is sometimes relevant to evaluating what she says. This effort to redeem ad hominems requires an analysis of character that explains why and how character is relevant. I argue that virtue epistemology supplies this analysis. Three sorts of ad hominems that attack the speaker’s intellectual character are legitimate. They attack a speaker’s: (1) possession of reliabilist vices; or (2) possession of responsibilist vices; or (3) failure to perform intellectually (...) virtuous acts. Legitimate ad hominems conclude that we should not believe what a speaker says solely on her say-so. (shrink)

Three forms of the straw man fallacy are posed: the straw, weak, and hollow man. Additionally, there can be non-fallacious cases of any of these species of straw man arguments.

While the role of discourse connectives has long been acknowledged in argumentative frameworks, these approaches often take a coarse-grained approach to connectives, treating them as a unified group having similar effects on argumentation. Based on an empirical study of the straw man fallacy, we argue that a more fine-grained approach is needed to explain the role of each connective and illustrate their specificities. We first present an original corpus study detailing the main features of four causal connectives in French that (...) speakers routinely use to attribute meaning to another speaker, which is a key element of straw man fallacies. We then assess the influence of each of these connectives in a series of controlled experiments. Our results indicate each connective has different effects for the persuasiveness of straw man fallacies, and that these effects can be explained by differences in their semantic profile, as evidenced in our corpus study. Taken together, our results demonstrate that connectives are important for argumentation but should be analyzed individually, and that the study of fallacies should include a fine-grained analysis of the linguistic elements typically used in their formulation. In this paper I am concerned with the analysis of fragments of a discourse or text that express arguments suspected of being denials of the antecedent. I first argue that one needs to distinguish between two senses of ‘the argument expressed’. Second, I show that, with respect to one of these senses, given a Gricean account of the pragmatics of conditionals, some such fragments systematically express arguments that are valid.

In argumentation, metaphors are often considered as ambiguous or deceptive uses of language leading to fallacies of reasoning. However, they can also provide useful insights into creative argumentation, leading to genuinely new knowledge. Metaphors entail a framing effect that implicitly provides a specific perspective to interpret the world, guiding reasoning and evaluation of arguments. In the same vein, emotions could be in sharp contrast with proper reasoning, but they can also be cognitive processes of affective framing, influencing our reasoning and (...) behavior in different meaningful ways. Thus, a double (metaphorical and affective) framing effect might influence argumentation in the case of emotive metaphors, such as “Poverty is a disease” or “Your boss is a dictator,” where specific “emotive words” (disease, dictator) are used as vehicles. We present and discuss the results of two experimental studies designed to explore the role of emotive metaphors in argumentation. The studies investigated whether and to what extent the detection of a fallacious argument is influenced by the presence of a conventional vs. novel emotive metaphor. Participants evaluated a series of verbal arguments containing either “non-emotive” or “emotive” (positive or negative) metaphors as middle terms that “bridge” the premises of the argument. The results show that the affective coherence of the metaphor's vehicle and topic plays a crucial role in participants' reasoning style, leading to global heuristic vs. local analytical interpretive processes in the interplay of the metaphorical and the affective framing effects. As more and more sophisticated software is created to allow the mining of arguments from natural language texts, this paper sets out to examine the suitability of the well-established and readily available methods of corpus linguistics to the study of argumentation. After brief introductions to corpus linguistics and the concept of meta-argument, I describe three pilot-studies into the use of the terms Straw man, Ad hominem, and Slippery slope, made using the open access News on the Web corpus. The presence (...) of each of these phrases on internet news sites was investigated and assessed for correspondence to the norms of use by argumentation theorists. All three pilot-studies revealed interesting facts about the usage of the terms by non-specialists, and led to numerous examples of the types of arguments mentioned. This suggests such corpora may be of use in two different ways: firstly, the wider project of improving public debate and educating the populace in the skills of critical thinking can only be helped by a better understanding of the current state of knowledge of the technical terms and concepts of argumentation. Secondly, theorists could obtain a more accurate picture of how arguments are used, by whom, and to what reception, allowing claims on such matters to be evidence, rather than intuition, based. Populism is on the rise, especially in Western Europe. While it is often assumed that populist actors have a tendency for fallacious reasoning, this has not been systematically investigated. We analyze the use of informal fallacies by right-wing populist politicians and their representation in the media during election campaigns. We conduct a quantitative content analysis of press releases of right-wing populist parties and news articles in print media during the most recent elections in the United Kingdom and Switzerland in 2015. (...) The results show that fallacies are used in more than a third of all analyzed texts and overwhelmingly co-occur with populist key messages. Moreover, fallacies occur more often in populist parties’ press releases than in news articles and are more common in Switzerland compared to the United Kingdom. Normative theories of argumentation tend to assume that logical and dialectical rules suffice to ensure the rationality of argumentative discourse. Yet, in everyday debates people use arguments that seem valid in light of such rules but nonetheless biased and tendentious. This article seeks to show that the rationality of argumentation can only be fully promoted if we take into account its ethical dimension. To substantiate this claim, I review some of the empirical evidence indicating that people’s inferential reasoning is systematically (...) affected by a variety of biases and heuristics. Insofar as these cognitive illusions are typically unintentional, it appears that arguers may be biased despite their well-intended efforts to follow the rules of critical argumentation. Nevertheless, I argue that people remain responsible for the rationality of their arguments, given that there are a number of measures that they can (and ought to) take to avoid such distortions. I highlight the importance of argumentational virtues and critical thinking to rational debates, and describe a set of indirect strategies of “argumentative self-control”. (shrink)

The article develops and justifies, on the basis of the epistemological argumentation theory, two central pieces of the theory of evaluative argumentation interpretation: 1. criteria for recognizing argument types and 2. rules for adding reasons to create ideal arguments. Ad 1: The criteria for identifying argument types are a selection of essential elements from the definitions of the respective argument types. Ad 2: After presenting the general principles for adding reasons (benevolence, authenticity, immanence, optimization), heuristics are proposed for finding missing (...) reasons, for deductive arguments, e.g., semantic tableaux are suggested. Leading invasion biologists sometimes dismiss critics and criticisms of their field by invoking “the straw man” fallacy. Critics of invasion biology are also labelled as a small group of “naysayers” or “contrarians”, who are sometimes engaging in “science denialism”. Such unfortunate labels can be seen as a way to possibly suppress legitimate debates and dismiss or minimize reasonable concerns about some aspects of invasion biology, including the uncertainties about the geographic origins and complex environmental impacts of species, and the control (...) programs against species perceived as “invasive”. In assessing the quality of the debate in this area, we examine the validity of the use of various strategies, including the “straw man” concept, and explore a range of potential logical fallacies present in some recent prominent discussions about invasion biology and so-called “invasive” species. The goal is to add some clarity to the concepts involved, point out some problematic issues, and improve the quality of the debates as the discussions move forward. (shrink)

The straw man fallacy consists in inappropriately constructing or selecting weak versions of the opposition’s arguments. We will survey the three forms of straw men recognized in the literature, the straw, weak, and hollow man. We will then make the case that there are examples of inappropriately reconstructing stronger versions of the opposition’s arguments. Such cases we will call iron man fallacies. The difference between appropriate and inappropriate iron manning clarifies the limits of the virtue of open-mindedness.

Even though tools for identifying and analyzing arguments are now in wide use in the field of argumentation studies, so far there is a paucity of resources for evaluating real arguments, aside from using deductive logic or Bayesian rules that apply to inductive arguments. In this paper it is shown that recent developments in artificial intelligence in the area of computational systems for modeling defeasible argumentation reveal a different approach that is currently making interesting progress. It is shown how these (...) systems provide the general outlines for a system of argument evaluation that can be applied to legal arguments as well as everyday conversational arguments to assist a user to evaluate an argument. False dilemma is a specific form of reasoning : despite the fact that it is based on a deductively valid argument form, it is rightly depicted as fallacy. A systematic exposition of false dilemma is missing in theoretical approaches to fallacies. This article formulates six criteria for a well-grounded exposition of a fallacy, suggesting also a systematic exposition of false dilemma. These criteria can be used to both explain, and categorise, the various false dilemma fallacies. The article introduces distinction between (...) four types of false dilemma : False quandary, Defeasible sound quandary, False obstruction and Defeasible sound obstruction. The types of criticism appropriate for each variant of false dilemma are suggested. Being able to discover false dilemma in situations when it is important to make good and free choices is a significant dimension of critical thinking. It may liberate us from accepting the consequences that necessarily follow from prearranged alternatives, when these are not the only alternatives possible. It may also liberate us from refraining from actions on the basis of obstructive disjunctive statements. In that respect, the faculty of critical thinking directed at uncovering reasoning based on false dilemma may also initiate the discovery of new alternatives, or discover the ways of unifying seemingly opposing alternatives. Thus, a well-developed ability to understand the tricky argumentative moves of false dilemma may be a good step towards initiating some features of creative thinking. (shrink)

Second, I show how attempts to embellish this form of reasoning by Douglas Walton and A.J. Kreider have been unnecessary and (...) unhelpful. Everyday life reasoning and argumentation is defeasible and uncertain. I present a probability logic framework to rationally reconstruct everyday life reasoning and argumentation. Coherence in the sense of de Finetti is used as the basic rationality norm. I discuss two basic classes of approaches to construct measures of argument strength. The first class imposes a probabilistic relation between the premises and the conclusion. The second class imposes a deductive relation. I argue for the second class, as the first class is (...) problematic if the arguments involve conditionals. I present a measure of argument strength that allows for dealing explicitly with uncertain conditionals in the premise set. (shrink)

Sanford Goldberg’s account of epistemic coverage constitutes a special case of Douglas Walton’s view that epistemic closure arises from dialectical argument. Walton’s pragmatic version of epistemic closure depends on dialectical norms for closing an argument, and epistemic coverage operates at the limits of argument closure because it minimizes dialectical exchange. Such closure works together with a shared hypothetical consideration to justify dismissal of surprising claims.

By explaining the argument from ignorance in terms of the presumption of innocence, many textbooks in argumentation theory suggest that some arguments from ignorance might share essential features with some types of presumptive reasoning. The stronger version of this view, suggesting that arguments from ignorance and presumptive reasoning are almost indistinguishable, is occasionally proposed by Douglas Walton. This paper explores the nature and limits of the stronger proposal and argues that initial presumptions and arguments from ignorance are not closely connected. (...) There are three main reasons. First, the argument from ignorance, unlike typical presumptive reasoning, is a negative kind of inference. Second, the typical initial presumption is sensitive to a broader set of defeaters and thus assumes a higher standard of acceptability. Third, in dialectical terms, initial presumption and argument from ignorance bring different attacking rights and obligations. I conclude that Waltonian intuition is unsupported or, at best, is limited only to practical presumptions and practical arguments from ignorance. (shrink)

The history of fallacy theory is long, distinguished and, admittedly, checkered. I offer a bird eye view on it, with the aim of contrasting the standard conception of fallacies as attractive and universal errors that are hard to eradicate with the contemporary preoccupation with “non-fallacious fallacies”, that is, arguments that fit the bill of one of the traditional fallacies but are actually respectable enough to be used in appropriate contexts. Godden and Zenker have recently argued that reinterpreting alleged fallacies as (...) non-fallacious arguments requires supplementing the textual material with something else, e.g. probability distributions, pragmatic considerations, dialogical context. Thus fallacies remain gappy on all accounts, and this is the hallmark of their failure. However, I argue that such gappiness is typically unproblematic, and thus no more flawed than enthymematic argumentation in general. This, in turn, calls into question the usefulness of the very notion of fallacy. (shrink)

Measurement is said to be the basis of exact sciences as the process of assigning numbers to matter (things or their attributes), thus making it possible to apply the mathematically formulated laws of nature to the empirical world. Mathematics and empiria are best accorded to each other in laboratory experiments which function as what Nancy Cartwright calls nomological machine: an arrangement generating (mathematical) regularities. On the basis of accounts of measurement errors and uncertainties, I will argue for two claims: 1) (...) Both fundamental laws of physics, corresponding to ideal nomological machine, and phenomenological laws, corresponding to material nomological machine, lie, being highly idealised relative to the empirical reality; and also laboratory measurement data do not describe properties inherent to the world independently of human understanding of it. 2) Therefore the naive, representational view of measurement and experimentation should be replaced with a more pragmatic or practice-based view. This paper applies dialectical argumentation structures to the problem of analyzing the ad baculum fallacy. It is shown how it is necessary in order to evaluate a suspected instance of the this fallacy to proceed through three levels of analysis: an inferential level, represented by an argument diagram, a speech act level, where conditions for specific types of speech acts are defined and applied, and a dialectical level where the first two levels are linked together and fitted into formal dialogue (...) structures. Although the fallacy of composition is little studied and trivially illustrated, some view it as ubiquitous and paramount. Furthermore, although definitions regard the concept as unproblematic, it contains three distinct elements, often confused. And although some scholars apparently claim that fallacies are figments of a critic’s imagination, they are really proposing to study fallacies in the context of meta-argumentation. Guided by these ideas, I discuss the important historical example of Michels’s iron law of oligarchy.

The article examines Aristotle’s seminal discussion of the fallacy of begging the question, reconstructing its complex articulation within a variety of different, but related, contexts. I suggest that close analysis of Aristotle’s understanding of the fallacy should prompt critical reconsideration of the scope and articulation of the fallacy in modern discussions and usages, suggesting how begging the question should be distinguished from a number of only partially related argumentative faults.

Informal logic began in the 1970s as a critique of then-current theoretical assumptions in the teaching of argument analysis and evaluation in philosophy departments in the U.S. and Canada. The last 35 years have seen significant developments in informal logic and critical thinking theory. The paper is a pilot study of the influence of these advances in theory on what is taught in courses on argument analysis and critical thinking in U.S. and Canadian philosophy departments. Its finding, provisional and much-qualified, (...) is that the theoretical developments and refinements have had limited impact on instruction in leading philosophy departments. (shrink)

This paper will highlight how the existing approaches to the Strawman Fallacy and the Principle of Charity are unable to fully accommodate the problems of interpreting children’s arguments. A lack of charity is as problematic as an excess of charity when arguing with children, and can contribute to misinterpretation of arguments. An application of moderate charity avoids the pitfalls of misrepresenting children. However, interpreting children’s arguments with the appropriate amount of charity is a challenging task. The argumentative context is relevant (...) in determining the interpretive approach and the extent of charity that can be justified. The context of arguing with children necessitates an Ethics of Care-based approach to interpretation. Michael Gilbert’s concept of coalescent argumentation exemplifies how Ethics of Care can be realized during argumentative exchanges involving children. (shrink)

This essay addresses the collapse/incoherence problem for normative frameworks that contain both fundamental values and rules for promoting those values. The problem is that in some cases, we would bring about more of the fundamental value by violating the framework’s rules than by following them. In such cases, if the framework requires us to follow the rules anyway, then it appears to be incoherent; but if it allows us to make exceptions to the rules, then the framework “collapses” into one (...) that doesn’t make use of rules in the first place. The chapter begins with an examination of happiness and truth as fundamental values in Mill’s work, which lead into parallel versions of the collapse/incoherence problem in ethics and epistemology. It then sets out the collapse problem for rule-consequentialist approaches in ethics, truth-directed accounts of justification in epistemology, and epistemological approaches to argument cogency. Disagreements come in all shapes and sizes, but epistemologists and argumentation theorists have singled out a special category referred to as deep disagreements. These deep disagreements are thought to pose philosophical and practical difficulties pertaining to their rational resolution. In this paper, I start with a critique of the widespread claim that deep disagreements are qualitatively different from normal disagreements because they arise from a difference in ‘fundamental principles’ or ‘hinge commitments.’ I then defend the following two claims: All disagreements (...) are deep to the extent that they are actual disagreements. This first claim implies, I will argue, that disagreements typically regarded as normal can be explained away as misunderstandings or communicative mishaps. The resolution of a disagreement can be rational either through a joint experience of mutually recognized facts or through an exchange of arguments that leads to a reformulation of the disagreement that, in this new form, lends itself to a resolution through a joint experience of mutually recognized facts. I conclude with a reflection on the consequences of these two theses for the idea of deep disagreement and that of rational resolution. (shrink)

I characterize the deductivist ideal of justification and, following to a great extent Toulmin’s work The Uses of Argument, I try to explain why this ideal is erroneous. Then I offer an alternative model of justification capable of making our claims to knowledge about substantial matters sound and reasonable. This model of justification will be based on a conception of justification as the result of good argumentation, and on a model of argumentation which is a pragmatic linguistic reconstruction of Toulmin’s (...) model of argument. In this paper I will consider several interpretations of the fallacy of secundum quid as it is given by Aristotle in the Sophistical Refutations and argue that they do not work, one reason for which is that they all imply that the fallacy depends on language and thus fail to explain why Aristotle lists this fallacy among the fallacies not depending on language, amounting often to a claim that Aristotle miscategorises this fallacy. I will argue for a reading that preserves (...) Aristotle’s categorization by a quite different account of how qualifications function. (shrink)

In academic contexts the appeal to authority is a quite common but seldom tested argument, either because we accept the authority without questioning it, or because we look for alternative experts or reasons to support a different point of view. But, by putting ourselves side by side an already accepted authority, we often rhetorically manoeuvre to displace the burden of the proof to avoid the fear to present our opinions and to allow face saving.

I consider some uses of citations in academic writing and analyze them as instances of the “appeal to expert opinion” argumentative scheme to show that the critical questions commonly linked to this scheme are difficult to apply. I argue that, by considering citations as special communicative and argumentative situated acts, their use in real practice can be explained more adequately. Adaptation to the audience and to the social constraints is common and necessary in order to collaborate with others and to (...) advance in a discipline, but also to attain rhetorical goals that differ from strictly cognitive ones. Since a clear account of the fallacy of false disjunctive syllogism is missing in the literature, the fallacy is defined and its three types are differentiated after some preliminaries. Section 4 further elaborates the differentia specifica for each of the three types by analyzing relevant argument criticism of each, as well as the related profiles of dialogue. After defining false disjunctive syllogisms, it becomes possible to distinguish between a false dilemma and a false disjunctive syllogism: section 5 analyzes their similarities (...) and section 6 explains their differences. I will argue that the standard formulation of non-factualism in terms of a denial of truth-aptness is consistent with a version of deflationsim. My line of argument assumes the use conception of meaning. This brings out an interesting consequence since mostly the philosophers who endorse the use conception of meaning, e.g. Paul Horwich, hold that deflationism is inconsistent with the strategy of implementing non-factualism in terms of a denial of truth-aptness and thereby urge a reformulation of non-factualism.

The importance of speech acts for analyzing and evaluating argumentation in cases where it is suspected that the ad baculum fallacy has been committed is demonstrated in this paper by using a typical textbook example of this fallacy. It is shown how the argument in the example can be analyzed and evaluated using the devices of Gricean implicature and indirect speech acts. It is shown how these two devices can be applied to extrapolate the evidence furnished by the text and (...) dialectical context of the example. (shrink)

The main aim of this paper is to consider how various types of social crises create contexts in which the general assumption comes to full expression that without knowledge of relevant data, correct decisions cannot be made or adequate measures taken to overcome the crisis. Such contexts, on the one hand, increase the importance of successful discovery of the truth both for individuals and for society as a whole, which affects the tightening of epistemic standards, while on the other hand (...) they enlarge some old or bring new cognitive barriers that negatively affect the reliability of various cognitive methods. The key role of epistemic responsibility is illustrated with the examples of two crises that have befallen us during the last few years: the migrant crisis and the pandemic crisis. (shrink)

Arguments sometimes appeal to sex by invoking the sexuality of a model or a person or the promise of sexual gratification. When sexual gratification is not a relevant consideration, the appeal seems to be fallacious. We will address when this may be an appropriate line of reasoning -- there is such a thing as “sex appeal”--and when it may be biased to assume the relevance of sexuality. Advertising, which provides infinite examples of appeal to sex, may be questionable as a (...) case of argumentation, as opposed to some other sort of negotiation or communication, especially perhaps in its reliance on visual imagery. Yet, more classic textual cases of appeal to sex can be found, as well as what may be reasonable enough practical advice about making oneself sexually attractive. Its appropriate role sometimes as a practical consideration suggests that appeal to sex is analogous to appeal to force, or ad baculum, which can be relevant in a negotiation dialogue, Douglas Walton argues. So, it deserves at least the same attention from argumentation scholars, and perhaps even more from critical thinking educators in cultures more saturated with sexuality than with threats. (shrink)

In this paper I develop and defend a form of argumentative normativity that is not based on fundamental principles. I first argue that research agendas that aim to discover fundamental principles of ‘good’ argumentative discourse share one crucial weak spot, viz. circularity. I then argue that this weak spot can be avoided in a pancritical view of normativity.

This volume presents a selection of papers reflecting key theoretical issues in argumentation theory. Its six sections are devoted to specific themes, including the analysis and evaluation of argumentation, argument schemes and the contextual embedding of argumentation. The section on general perspectives on argumentation discusses the trends of empiricalization, contextualization and formalization, offers descriptions of the analytical and evaluative tools of informal logic, and highlights selected principles that argumentation theorists do and do not agree upon. In turn, the section on (...) linguistic approaches to argumentation focuses on the problem of distinguishing between explanation and argument, while also elaborating on the role of verbal indicators of argument schemes. This paper is a study of debate practices as seen in the Nyāyasūtra and a number of commentaries. It concentrates on the ‘Points of Defeat ’, i.e., those occasions that if met in debate would entail defeat. The conditions under which a debater would meet with defeat were discussed widely in India and have also attracted considerable attention from modern scholars. In order to better understand this subject, use is made of some of the intuitions about language and conversation that (...) we owe to the philosopher H. P. Grice as well as of some recent theoretical advances in argumentation theory and informal logic, particularly of those most influenced by Grice’s thought. The Points of Defeat are studied both individually and as a group and it is shown that they point towards the practice of debating as being a rational, cooperative and goal-directed activity. (shrink)
