We have the duty to object to things that people say. If you report something that I take to be false, unwarranted, or harmful, I may be required to say as much. In this paper, I explore how to best understand the distinctively epistemic dimension of this duty. I begin by highlighting two central features of this duty that distinguish it from others, such as believing in accordance with the evidence or promise‐keeping. In particular, I argue that whether we are (...) obligated to object is directly influenced not only by what other relevant members of the conversational context or community do, but also by the social status of the agent in question. I then show that these features are shared by the duty to be charitable, and the similarities between these two duties point to a potentially deeper explanation: while promise‐keeping is regarded as a classic perfect duty, charity is an imperfect one. I then argue that the duty to object can be modeled on a particular conception of imperfect duties, one that takes the duty to belong to communities and other collectives, rather than to individuals. I conclude by showing that this framework provides us with reason for accepting that there are imperfect epistemic duties in general. (shrink)

Toxic speech inflicts individual and group harm, damaging the social fabric upon which we all depend. To understand and combat the harms of toxic speech, philosophers can learn from epidemiology, while epidemiologists can benefit from lessons of philosophy of language. In medicine and public health, research into remedies for toxins pushes in two directions: individual protections (personal actions, avoidances, preventive or reparative tonics) and collective action (specific policies or widespread “inoculations” through which we seek herd immunity). This paper is the (...) beginning of a project of identifying potential inoculations and antidotes to toxic speech. The essay brings a social practice theory of language, with special reliance on language‐games and inferential roles, into conversation with concepts from the study of biologic toxins. Some speech harms are acute while others are chronic and insidious; they have different methods of delivery, come in variable doses, and not everyone is equally susceptible to the power to harm. I argue that of the many kinds of challenges we might issue against toxic speech, challenging its expressive commitments has the greatest potential to stop the damage. The essay explores the different sorts of protections that inoculations and antidotes might offer against discursive toxins and sketches how to imagine these in the practices that govern our speech. The paper does not make policy recommendations, but an epidemiology of discursive toxicity reveals several kinds of “more speech” that might fight against “bad speech.”. (shrink)

Do we insult, offend or slight a speaker when we refuse her testimony? Do we compliment, commend or extol a speaker when we accept her testimony? I argue that the answer to both of these questions is “yes”, but only in some instances, since these respective insults and compliments track the reasons a hearer has for rejecting or accepting testimony. When disbelieving a speaker, a hearer may insult her because she judges the speaker to be either incompetent as a knower (...) or insincere as a teller. However, there are many instances where we reject testimony without making this negative evaluation of the speaker, and as such, without paying her an insult. Testimonial compliments are fewer in number, and are not constitutive of “everyday” testimonial exchanges, since, speakers who are competent as knowers and sincere as tellers are merely behaving correctly in accordance with the norms of testifying. Nevertheless, deferring to an authority on belief can be complimentary to that speaker if by doing so we judge her to have some mastery in a particular domain. Testimonial insults and compliments have important moral implications, particularly with regard to epistemic injustice and therapeutic trust. (shrink)

There's been a great deal of interest in epistemology regarding what it takes for a hearer to come to know on the basis of a speaker's say-so. That is, there's been much work on the epistemology of testimony. However, what about when hearers don't believe speakers when they should? In other words, what are we to make of when testimony goes wrong? A recent topic of interest in epistemology and feminist philosophy is how we sometimes fail to believe speakers due (...) to inappropriate prejudices – implicit or explicit. This is known as epistemic injustice. In this article, I discuss Miranda Fricker's groundbreaking work on epistemic injustice, as well as more recent developments that both offer critique and expansion on the nature and extent of epistemic injustice. A standing presumption in the literature is that devil’s advocacy is an inherently beneficial argumentative move; and that those who take on this role in conversation are paradigms of argumentative virtue. Outside academic circles, however, devil’s advocacy has acquired something of a notorious reputation: real-world conversations are rife with self-proclaimed devil’s advocates who are anything but virtuous. Motivated by this observation, in this paper we offer the first in-depth exploration of non-ideal devil’s advocacy. We draw on recent analyses of two (...) better known discursive practices—mansplaining and trolling—to illuminate some of the signature traits of vicious devil’s advocacy. Building on this comparative examination, we show that all three practices trade on a manipulation of illocutionary force; and we evaluate their respective options for securing plausible deniability. In the debate on epistemic injustice, it is generally assumed that testimonial injustice as one form of epistemic injustice cannot be committed (fully) deliberately or intentionally because it involves unconscious identity prejudices. Drawing on the case of sexual violence against refugees in European refugee camps, this paper argues that there is a form of testimonial injustice—willful testimonial injustice—that is deliberate. To do so, the paper argues (a) that the hearer intentionally utilizes negative identity prejudices for a particular purpose and (b) (...) that the hearer is aware of the fact that the intentionally used prejudices are in fact prejudices. Furthermore, the paper shows how testimonial injustice relates to recognition failures both in terms of a causal as well as a constitutive claim. In fact, introducing willful testimonial injustice can support the constitutive claim of such a relation that has so far received little attention. Besides arguing for a novel form of testimonial injustice and contributing to the recent debate on the relation between epistemic injustice and recognition failures, this paper is also motivated by the attempt to draw attention to the inhumane conditions for refugees at the border of Europe as well as elsewhere. People can be treated unjustly with respect to the level of credibility others accord to their testimony. This is the core idea of the philosophical idea of epistemic justice. It should be of utmost interest to criminal law which extensively deals with normative issues of evidence and testimony. It may reconstruct some of the long-standing criticisms of criminal law regarding credibility assessments and the treatment of witnesses, especially in sexual assault cases. However, philosophical discussions often overlook the intricate complexities of (...) real procedural law and its underlying considerations. In its present form, the philosophical notion of epistemic injustice provides limited insights into legal discourse; it necessitates translation and adaptation. This study contributes to this endeavor by examining the contentious issue of testimony from witnesses who have undergone trauma-focused psychotherapy. Since the 1980s, courts worldwide were troubled with cases of false accusations based on false memories generated by suggestive therapeutic interventions. As a result, such post-therapy testimonies are discounted in one way or another in many jurisdictions. However, courts are still confronted with such testimonies, and the modi vivendi legal systems have established to deal with them continue to give rise to concerns about unjust treatment of witnesses. The question is thus whether legal rules or established practices of evaluating testimony based on memories which resurfaced after psychotherapy are epistemically and legally just. The paper presents seven ways in which courts may assess such testimonies and examines them in light of epistemic and procedural justice. Some of them prima facie constitute a form of epistemic injustice because they discount testimonies to an unwarranted degree. But these injustices might be justified by overriding principles favoring defendants. Nonetheless, the idea of epistemic justice, more broadly understood, inspires two principles that may serve as a foundation for a future conception of epistemic justice adapted to the law. (shrink)

In this article, I will consider whether, and in what way, doxastic states can harm. I’ll first consider whether, and in what way, a person’s doxastic state can harm her, before turning to the question of whether, and in what way, it can harm someone else.

This essay investigates an underappreciated way in which trust and testimonial injustice are closely connected. Credibility deficit and credibility excess cases both (in their own distinctive ways) contribute to a speaker’s being harmed in her capacity a knower. But moreover, as we will show—by using the tools of a performance-theoretic framework—both credibility deficit and credibility excess cases also feature incompetent trusting on the part of the hearer. That is, credibility deficit and excess cases are shown to manifest qualities of thinkers (...) that are inconducive to trust’s being reliably fulfilled. What this implies is an interesting result about testimonial injustice: to the extent that we want to mitigate against testimonial injustice—one promising way to do so will be to target incompetent trusting of the sort that underlies it. We conclude by outlining and defending what we take to be a promising substantive version of such a mitigation strategy, one which is centred around the cultivation of higher-order trusting competences. Testimonial injustice occurs when hearers attribute speakers a credibility deficit because of an identity prejudice and consequently dismiss speakers’ testimonial assertions. Various philosophers explain testimonial injustice by appealing to interpersonal norms arising within testimonial exchanges. When conversational participants violate these interpersonal norms, they generate second-personal epistemic harms, harming speakers as epistemic agents. This focus on testimony, however, neglects how systematically misevaluating speakers’ knowledge affects conversational participants more generally. When hearers systematically misevaluate speakers’ conversational competence because of entrenched assumptions about what (...) speakers know, I call these conversational epistemic injustices. I argue the same epistemic harm in testimonial injustice arises for non-assertoric speech acts, generating conversational epistemic injustices. For across speech acts, deflated knowledge attributions create second-personal harms that prevent speakers from using their knowledge in linguistic exchanges, limiting their epistemic agency. These harms however are not reducible to linguistic harms, (e.g.,) silencing or discursive injustice. This article applies insight from how second-personal epistemic harm arises in testimonial exchanges to conversational exchanges more generally, demonstrating that epistemic injustices arise beyond testimonial exchanges and contexts of inquiry because deflated knowledge attributions undermine general conversational norms requiring participants assume each other’s conversational competence, generating conversational epistemic injustices. This paper provides a critical overview of recent work on epistemic blame. The paper identifies key features of the concept of epistemic blame and discusses two ways of motivating the importance of this concept. Four different approaches to the nature of epistemic blame are examined. Central issues surrounding the ethics and value of epistemic blame are identified and briefly explored. Ethnobiology has become increasingly concerned with applied and normative issues such as climate change adaptation, forest management, and sustainable agriculture. Applied ethnobiology emphasizes the practical importance of local and traditional knowledge in tackling these issues but thereby also raises complex theoretical questions about the integration of heterogeneous knowledge systems. The aim of this article is to develop a framework for addressing questions of integration through four core domains of philosophy - epistemology, ontology, value theory, and political theory. In each of (...) these dimensions, we argue for a model of “partial overlaps” that acknowledges both substantial similarities and differences between knowledge systems. While overlaps can ground successful collaboration, their partiality requires reflectivity about the limitations of collaboration and co-creation. By outlining such a general and programmatic framework, the article aims to contribute to developing “philosophy of ethnobiology” as a field of interdisciplinary exchange that provides new resources for addressing foundational issues in ethnobiology and also expands the agenda of philosophy of biology. I challenge the common view that trust is characteristically risky compared to distrust by drawing attention to the moral and epistemic risks of distrust. Distrust that is based in real fear yet fails to target ill will, lack of integrity, or incompetence, serves to marginalize and exclude individuals who have done nothing that would justify their marginalization or exclusion. I begin with a characterization of the suite of behaviors characteristic of trust and distrust. I then survey the epistemic and moral (...) hazards of distrust, in particular, distrust’s propensity to bias interpretation, to perpetuate itself, to confirm itself, to dishonor, and to insult. Taking seriously these moral and epistemic hazards requires taking affirmative measures to respond to them. I elaborate one such response: “humble trust”. The practice of humble trust issues from skepticism about the warrant of one’s own felt attitudes of trust and distrust, curiosity about who might be unexpectedly responsive to trust and in which contexts, and commitment to abjure and to avoid distrust of the trustworthy. Humble trust enables individuals to trust that they will be trusted. (shrink)

This volume has its roots in two recent developments within mainstream analytic epistemology: a growing recognition over the past two or three decades of the active and social nature of our epistemic lives; and, more recently still, the increasing appreciation of the various ways in which the epistemic practices of individuals and societies can, and often do, go wrong. The theoretical analysis of these breakdowns in epistemic practice, along with the various harms and wrongs that follow as a consequence, constitutes (...) an approach to epistemology that we refer to as non-ideal epistemology. In this introductory chapter we introduce and contextualise the ten essays that comprise this volume, situating them within four broad sub-fields: vice epistemology, epistemic injustice, inter-personal epistemic practices, and applied epistemology. We also provide a brief overview of several other important growth areas in non-ideal epistemology. (shrink)

In this paper we argue that ill persons are particularly vulnerable to epistemic injustice in the sense articulated by Fricker. Ill persons are vulnerable to testimonial injustice through the presumptive attribution of characteristics like cognitive unreliability and emotional instability that downgrade the credibility of their testimonies. Ill persons are also vulnerable to hermeneutical injustice because many aspects of the experience of illness are difficult to understand and communicate and this often owes to gaps in collective hermeneutical resources. We then argue (...) that epistemic injustice arises in part owing to the epistemic privilege enjoyed by the practitioners and institutions of contemporary healthcare services—the former owing to their training, expertise, and third-person psychology, and the latter owing to their implicit privileging of certain styles of articulating and evidencing testimonies in ways that marginalise ill persons. We suggest that a phenomenological toolkit may be part of an effort to ameliorate epistemic injustice. (shrink)

This article is an investigation into G. E. M. Anscombe's suggestion that there can be cases where belief takes a personal object, through an examination of the role that the activity of teaching plays in Anscombe's discussion. By contrasting various kinds of ‘teachers’ that feature in her discussion, it is argued that the best way of understanding the idea of believing someone personally is to situate the relevant encounter within the social, conversational framework of ‘engaged reasoning’. Key features of this (...) framework are highlighted, and are used to characterise the distinctive kind of teaching and learning germane to Anscombe's suggestion. (shrink)

Energy justice is often conceived of as consisting of distributive, procedural, and recognitional justice. This article adds epistemic justice, which engages with the question of how the exchange of knowledge can be shaped fairly. Energy issues ramify across social worlds, connecting to multiple knowledge systems. The conventional elements of energy justice place specific demands on how different knowledge systems must be accommodated. Epistemic work must be done to bridge epistemological differences and pay due respect to different forms of knowledge. Energy (...) justice should not neglect this epistemic work, and it cannot be assumed that it is sufficient to invite stakeholders to the discussion arena. I argue that fair ways of dealing with knowledge and fair opportunities for citizens to contribute knowledge to energy affairs are crucial to achieving energy justice of any general form. Also, this epistemic justice is not to be seen as yet another pillar of energy justice but a concern that runs through all pillars of energy justice. (shrink)

Zeugenschaft ist heute wichtiger denn je – und das nicht trotz, sondern vielmehr gerade wegen der gewachsenen Möglichkeiten, jederzeit und überall das Geschehen technisch aufzunehmen und einer breiten Öffentlichkeit zugänglich zu machen. Zeugenschaft ist jedoch nicht nur eine epistemische Praxis, sondern auch eine Form sozialen Engagements, wie die sozialen Protestbewegungen der letzten Jahre gezeigt haben. In den aktuellen Debatten um Zeugenschaft ist allerdings eine gewisse Verengung hin auf die epistemischen Aspekte des Zeugnisgebens zu beobachten. Dagegen versucht der Artikel, Praktiken der (...) Zeugenschaft auf ihre ethischen und politischen Implikationen hin zu befragen. Dabei gilt es, kritisch auf die Normen zu reflektieren, die Zeugenschaft ermöglichen oder verhindern. Zugleich impliziert jedes Zeugnis ein politisches Moment, insofern sich das Wahrsprechen des Zeugen bzw. der Zeugin selbst als politischer Akt interpretieren lässt. Zeugnisgeben erweist sich damit, so die These, nicht nur als eine epistemische, sondern auch als eine ethische und politische Praxis, ohne dass diese Elemente aufeinander reduzierbar wären. (shrink)

Based on a mixed-methods study involving triad tasks and ethnobiological models, we analyze local categories and knowledge of key ethnospecies of fish exploring partial overlaps between artisanal fishers’ and academic knowledge in a fishing community in northeast Brazil. We argue that fishers’ and academic knowledge overlaps may provide common ground for transdisciplinary collaboration, while their partiality requires reflection on epistemological and ontological differences. Here, we show how knowledge of artisanal fishers can complement academic knowledge and bring about tensions that need (...) to be addressed through intercultural dialogue. By integrating a general philosophical framework of partial overlaps with a mixed-methods study on fishers’ knowledge, we show how ethnobiology can contribute to reflective and empirically-grounded transdisciplinary practices. This paper re-examines the debate between those who, with Miranda Fricker, diagnose the primary, non-contingent harm of testimonial injustice as a kind of epistemic objectification and those who contend it is better thought of as a kind of epistemic othering. Defenders of the othering account of the primary harm have often argued for it by presenting cases of testimonial injustice in which the testifier’s epistemic agency is affirmed rather than denied, even while their credibility is unjustly impugned. In previous work, (...) I have instead argued that such cases suggest that we need to enrich our conception of epistemic objectification in ways encouraged by Martha Nussbaum’s cluster analysis of objectification. Here I continue to make the case for this approach, and I consider the othering account in more detail. I focus in particular on Gaile Pohlhaus Jr.’s arguments for a version of the othering account in terms of the notion of derivatization, which turns on the idea that only such an account can enable us to properly understand the harms of testimonial injustice, in particular the ways in which it interferes with a subject’s epistemic agency and autonomy, and I’ll argue that such arguments should not sway us. Finally, I’ll further support my contention that it is illuminating and helpful to think of the primary harm of testimonial injustice in terms of epistemic objectification, though I will concede that the notion of epistemic othering may offer further helpful resources for understanding how subjects can be harmed by testimonial injustice. Anscombe famously said, “It is an insult and it may be an injury not to be believed.” But what is it to believe someone? My aim is to show that understanding what it is to believe someone requires a conception of a distinctive kind of interpersonal reasoning. To do so, I develop an analogy between interpersonal reasoning and an Anscombean conception of practical reasoning. I suggest that the distinctive ‘form’ of interpersonal reasoning is recognition. I furthermore argue that this is (...) to be understood as a primarily logical, rather than epistemological point. In concluding, I explain why a notion of interpersonal reasoning makes available an ethics of thought and, specifically, an account of testimonial injustice. (shrink)

Epistemic injustice is a widely discussed phenomenon in many sub-disciplines (including epistemology, ethics, feminist philosophy, social and political philosophy). Yet, there is very little literature on its connection to the philosophy of sports. Here I explore the intersection between epistemic injustice and sports, focusing on testimonial injustice. I argue that there exist clear-cut cases of testimonial injustice in sport that arise when athletes attempt to communicate information. After highlighting the theoretical connections between various cases, I explore the more ambitious claim (...) that sport performances themselves carry linguistic content. This claim allows us to see the biased negative judgment of sport performances in a new light, as constituting a further and distinctive form of testimonial injustice. I show how the case of figure-skater Surya Bonaly can be understood as a real-life instantiation of this form of testimonial injustice. I conclude by explaining why it is philosophically fruitful to understand these wrongs through the lens of testimonial injustice. (shrink)

The diagnosis of autism is on the rise. Autistic people, parents, professionals, and policy makers alike face important questions about the right approach toward autism. For example, there are questions about the desirability of early detection, the role and consequences of underlying cognitive theories, and whether autism is a disorder to be treated or an identity to be respected. How does the fact that autism is a heterogeneous concept affect the answers to these questions? Who has the authority or knowledge (...) to speak on behalf of people with autism? In this paper, we describe a cluster of research topics which should be on the agenda of the emerging field of autism ethics. These topics include the very concept of autism itself, the question whether autism is primarily an identity or a disorder, the ethical questions that parents of autistic children face, metaethical questions, the ethical consequences of epistemological questions, and a cluster of questions related to social justice, stigma, and paternalism. In this paper, I defend the claim, made by G. E. M. Anscombe and J. L. Austin, that you can insult someone by refusing her testimony. I argue that refusing someone’s testimony can manifest doubt about her credibility, which in the relevant cases is offensive to her, given that she presupposed her credibility by telling what she did. I conclude by sketching three applications of my conclusion: to the issue of valuable false belief, to the issue of testimonial injustice, and (...) to the issue of skepticism about testimonial knowledge. In this paper I examine unjust deficits of criticism, or what I call cases of “critical injustice.” In paradigm cases of testimonial injustice, prejudice leads one person to give insufficient credibility to another. In paradigm cases critical injustice, prejudice leads one person to offer insufficient criticism of another. Here I articulate the concept of critical injustice and give an explanation of why it is a species of injustice. I also describe a non-prejudicial species of critical injustice and discuss a possible (...) tension between the goal of preventing testimonial injustice and the goal of preventing critical injustice. ABSTRACT The focus of this essay is Kant's argument in the Groundwork for the Metaphysics of Morals III that regarding oneself as rational implies regarding oneself as free. After setting out an interpretation of how the argument is meant to go, I argue that Kant fails to show that regarding oneself as free is incompatible with accepting universal causal determinism. However, I suggest that the argument succeeds in showing that regarding oneself as rational is inconsistent with accepting universal causal determinism (...) if one accepts a certain, plausible view of the explanation of events. RESUMEN El ensayo se enfoca en el argumento de Kant en la Fundamentación de la metafísica de las costumbres III según el cual considerarse racional implica verse a uno mismo como libre. Se interpreta la forma en que debe entenderse el argumento y se afirma que Kant no logra demostrar que considerarse libre es incompatible con la aceptación del determinismo casual universal. No obstante, se sugiere que el argumento sí logra demostrar que considerarse a uno mismo como racional es incompatible con la aceptación del determinismo casual universal, si se acepta una cierta versión plausible de la explicación de los eventos. The aim of this paper is to articulate and defend a particular role for ethico-political values in social epistemology research. I begin by describing a research programme in social epistemology—one which I have introduced and defended elsewhere. I go on to argue that by the lights of this research programme, there is an important role to be played by ethico-political values in knowledge communities, and an important role in social epistemological research in describing the values inhering in particular knowledge communities. I conclude by noting how, even as it expands its focus beyond the traditional one to include descriptions of our “knowledge practices,” this sort of project relates to some of the core questions that have been pursued by traditional epistemology. ABSTRACT In this paper I argue that there are possible cases in which the demands of justice and the norms of epistemology cannot be simultaneously satisfied. I will bring out these normative clashes in terms of the now-familiar phenomenon of testimonial injustice (Fricker 2007). While the resulting argument is very much in the spirit of two other sorts of argument that have received sustained attention recently – arguments alleging epistemic partiality in friendship, and arguments that motivate the hypothesis of moral (...) encroachment on the epistemic – I suggest how the argument from epistemic injustice differs from, and is stronger than, both of those arguments. The implications of the present argument are several: we must (i) reconceive the role of identity-prejudice in testimonial injustice, (ii) modify the way we think about how justice and epistemology bear on testimonial transactions, and (iii) understand the mutuality of speech exchanges in ways that do not privilege any particular participant’s epistemic perspective.
