Dietmar Hübner and Lucie White question the ethical justification of employing risky neurosurgical interventions to treat imprisoned psychopaths. They argue that (1) such interventions would confer no medical benefit on the psychopath as there is no “subjective suffering” involved in psychopathy and (2) psychopaths could not voluntarily consent to such procedures because they could have no “internal motivation” for doing so. In the course of their discussion, the authors insightfully show that certain aspects of the psychopath’s personality structure are especially (...) relevant to assessing the ethics of risky treatment options. As I argue, however, the particular conclusions that the authors draw are too strong. A deeper look at the psychopathic profile casts doubt on (1) and (2). In some cases, psychopaths can be plausibly construed as experiencing subjective suffering on account of their disorder and as appropriately motivated to voluntarily consent to neurosurgical treatment. After arguing for this view, I suggest that the psychopath’s consent to neurosurgical intervention might nonetheless be problematic, as their emotional incapacities might preclude their abilities to adequately appreciate the relevant risks. I develop here a Kantian framework for understanding conscience in order to examine whether moral flaws of psychopaths are traceable to their dysfunctional conscience. When understood as the reflective capacity for moral self-assessment that triggers certain emotional reactions, conscience proves to be a fruitful tool for explaining psychopathic moral incompetence. First, I show how the unrealistic moral self-assessment of psychopaths affects their competence in judging moral issues and in being motivated to act morally. While many profound philosophical questions arise about psychopaths, I wish to draw attention to two limitations in current debates. First, philosophers mainly deal with offender and forensic populations neglecting so-called ‘successful’ psychopaths. Second, philosophers mainly focus on the issue of empathy and responsibility, while relatively little attention is paid to volitional aspects. I address these two limitations together and argue that ‘successful’ psychopaths are volitionally constrained. This article aims to argue in favour of two different kinds of responsibility: moral and organizational. I present the notion of moral responsibility and, specifically, moral accountability, which stands at the centre of the later discussion. I address Coleen Macnamara’s view of accountability, a model of enforcement involved in setting demands and sanctions. Then I account for some cases of morally impaired persons’ failure to respond adequately to moral demands, in contrast to their capacity to respond effectively to organizational demands. (...) I take the latter findings to show that there are two distinct kinds of accountability, moral and organizational. While moral accountability is connected to the arousal of emotions, I claim that organizational accountability is related to inner-organizational reactive procedures associated with employment benefits or sanctions. Philosophers have urged that considerations about the psychopath’s capacity for practical rationality can help to advance metaethical debates. These debates include the role of rational faculties in moral judgment and action, the relationship between moral judgment and moral motivation, and the capacities required for morally responsible agency. I discuss how the psychopath’s capacity for practical reason features in these debates, and I identify several takeaway lessons from the relevant literature.
