    Pragmatist reinterpretations of both deliberative‐communicative theory and legal positivism point out the mentalist fallacy entailed by these prevalent models. I argue that pragmatist approaches imply analogous erroneous beliefs since they presuppose as given the shared perception of social contexts.     This article argues, in opposition to a common interpretation of Wittgenstein deriving from Winch, that there is nothing especially problematic about the social sciences. Familiar Wittgensteinian theses about language, notably on the open-endedness of linguistic rules and on the importance of family resemblance concepts, have great relevance not only to the social sciences but also to much of the natural sciences. The differences between scientific and ordinary language are much less sharp than Winch, and probably Wittgenstein, supposed.

    I show that Wittgenstein's critique of G.H. Hardy's mathematical realism naturally extends to Paul Benacerraf's influential paper, ‘Mathematical Truth’. Wittgenstein accuses Hardy of hastily analogizing mathematical and empirical propositions, thus leading to a picture of mathematical reality that is somehow akin to empirical reality despite the many puzzles this creates.
