Natural Justice is a bold attempt to lay the foundations for a genuine science of morals using the theory of games. Since human morality is no less a product of evolution than any other human characteristic, the book takes the view that we need to explore its origins in the food-sharing social contracts of our prehuman ancestors. It is argued that the deep structure of our current fairness norms continues to reflect the logic of these primeval social contracts, but the (...) particular fairness norm a society operates is largely a product of cultural evolution. In pursuing this point, the book proposes a naturalistic reinterpretation of John Rawls' original position that reconciles his egalitarian theory of justice with John Harsanyi's utilitarian theory by identifying the environment appropriate to each. In _Beyond Prejudice_, Evelyn B. Pluhar defends the view that any sentient conative being—one capable of caring about what happens to him or herself—is morally significant, a view that supports the moral status and rights of many nonhuman animals. Confronting traditional and contemporary philosophical arguments, she offers in clear and accessible fashion a thorough examination of theories of moral significance while decisively demonstrating the flaws in the arguments of those who would avoid attributing moral rights to nonhumans. Exposing the traditional (...) view—which restricts the moral realm to autonomous, fully fledged "persons"—as having horrific implications for the treatment of many humans, Pluhar goes on to argue positively that sentient individuals of any species are no less morally significant than the most automomous human. Her position provides the ultimate justification that is missing from previous defenses of the moral status of nonhuman animals. In the process of advancing her position, Pluhar discusses the implications of determining moral significance for children and "abnormal" humans as well as its relevance to population policies, the raising of animals for food or product testing, decisions on hunting and euthanasia, and the treatment of companion animals. In addition, the author scrutinizes recent assertions by environmental ethicists that all living things or that natural objects and ecosystems be considered highly morally significant. This powerful book of moral theory challenges all defenders of the moral status quo—which decrees that animals decidedly do not count—to reevaluate their convictions. (shrink)

They argue that we need to reassess our use of animals and, indeed, rethink the standard positions in the debate.

Which nonhuman animals experience conscious pain?1 This question is central to the debate about animal welfare, as well as being of basic interest to scientists and philosophers of mind. Nociception—the capacity to sense noxious stimuli—is one of the most primitive sensory capacities. Neurons functionally specialized for nociception have been described in invertebrates such as the leech Hirudo medicinalis and the marine snail Aplysia californica (Walters 1996). Is all nociception accompanied by conscious pain, even in relatively primitive animals such as Aplysia, (...) or is it the case, as some philosophers continue to maintain, that conscious experiences are the exclu- sive province of human beings? What philosophical and scientific resources are presently available for assessing claims lying between these extremes? (shrink)

It is usually assumed to be possible, and sometimes even desirable, for consequentialists to make judgments about both the rightness and the goodness of actions. Whether a particular action is right or wrong is one question addressed by a consequentialist theory such as utilitarianism. Whether the action is good or bad, and how good or bad it is, are two others. I will argue in this paper that consequentialism cannot provide a satisfactory account of the goodness of actions, on the (...) most natural approach to the question. I will also argue that, strictly speaking, a consequentialist cannot judge one action to be better or worse than another action performed at a different time or by a different person. Even if such theories are thought to be primarily concerned with rightness, this would be surprising, but in the light of recent work challenging the place of rightness in consequentialism1, it seems particularly disturbing. If actions are neither right (or wrong) nor good (or bad), what moral judgments do apply to them? Doesn't the rejection of both rightness and goodness, as applied to actions, leave consequentialism unacceptably impoverished? On the contrary, I will argue that consequentialism is actually strengthened by the realization that actions can only be judged as better or worse than possible alternatives. (shrink)

Satisficing and maximizing versions of consequentialism have both assumed that rightness is an alI-or-nothing property. We argue thal this is inimical to the spirit of consequentialism, and that, from the point of view of the consequentialist, actions should be evaluated purely in terms that admit of degree. We first consider the suggestion that rightness and wrongness are a matter of degree. If so, this raises the question of whether the claim that something is wrong says any more than that it (...) is bad. We consider the possibility that a consequenlialist should simply equate wrongness with badness. We reject this on the grounds that there is not a satsifactory way for a consequentialist to account for the badness of actions, as opposed to states of affairs. We explore two concepts of wrongness: to do something wrong is to be blameworthy; and the fact that something is wrong creates a reason not to do it. We argue that the first of these is not available to the consequentialist because of her views on blame, and that the second is just as much a feature of badness as of wrongness. We conclude that the consequentialist can make no sense of the concept of wrongness. (shrink)

The invocation of moral rights in moral/social debate today is a recipe for deadlock in our consideration of substantive issues. How we treat animals and humans in part should derive from the value of their lives, which is a function of the quality of their lives, which in turn is a function of the richness of their lives. Consistency in argument requires that humans with a low quality of life should be chosen as experimental subjects over animals with a higher (...) quality of life. (shrink)
