How does consciousness vary across the animal kingdom? Are some animals ‘more conscious’ than others? This article presents a multidimensional framework for understanding interspecies variation in states of consciousness. The framework distinguishes five key dimensions of variation: perceptual richness, evaluative richness, integration at a time, integration across time, and self-consciousness. For each dimension, existing experiments that bear on it are reviewed and future experiments are suggested. By assessing a given species against each dimension, we can construct a consciousness profile for (...) that species. On this framework, there is no single scale along which species can be ranked as more or less conscious. Rather, each species has its own distinctive consciousness profile. (shrink)

‘Sentience’ sometimes refers to the capacity for any type of subjective experience, and sometimes to the capacity to have subjective experiences with a positive or negative valence, such as pain or pleasure. We review recent controversies regarding sentience in fish and invertebrates and consider the deep methodological challenge posed by these cases. We then present two ways of responding to the challenge. In a policy-making context, precautionary thinking can help us treat animals appropriately despite continuing uncertainty about their sentience. In (...) a scientific context, we can draw inspiration from the science of human consciousness to disentangle conscious and unconscious perception (especially vision) in animals. In light of recent breakneck pace in machine learning, questions about whether near-future artificial systems might be conscious and possess moral status are increasingly pressing. This paper argues that as matters stand these debates lack any clear criteria for resolution via the science of consciousness. Instead, insofar as they are settled at all, it is likely to be via shifts in public attitudes brought about by the increasingly close relationships between humans and AI users. Section 1 of the paper I (...) briefly lays out the current state of the science of consciousness and its limitations insofar as these pertain to machine consciousness, and claims that there are no obvious consensus frameworks to inform public opinion on AI consciousness. Section 2 examines the rise of conversational chatbots or Social AI, and argues that in many cases, these elicit strong and sincere attributions of consciousness, mentality, and moral status from users, a trend likely to become more widespread. Section 3 presents an inconsistent triad for theories that attempt to link consciousness, behaviour, and moral status, noting that the trends in Social AI systems will likely make the inconsistency of these three premises more pressing. Finally, Section 4 presents some limited suggestions for how consciousness and AI research communities should respond to the gap between expert opinion and folk judgment. (shrink)

Opponents to consciousness in fish argue that fish do not feel pain because they do not have a neocortex, which is a necessary condition for feeling pain. A common counter-argument appeals to the multiple realizability of pain: while a neocortex might be necessary for feeling pain in humans, pain might be realized differently in fish. This paper argues, first, that it is impossible to find a criterion allowing us to demarcate between plausible and implausible cases of multiple realization of pain (...) without running into a circular argument. Second, opponents to consciousness in fish cannot be provided with reasons to believe in the multiple realizability of pain. I conclude that the debate on the existence of pain in fish is impossible to settle by relying on the multiple realization argument. (shrink)

This paper argues for what I call modest ethical veganism: the view that it is typically wrong to use or eat products made from or by animals such as cows, pigs, or chickens. The argument has three central parts. First, I argue that a central explanation for the wrongness of causing suffering rests upon what it is like to experience such suffering, and that we have good reasons to think that animals suffer in ways that are relevantly analogous to humans. Second, I argue that animals can have better and worse lives, and that a central explanation for the wrongness of killing is that it deprives the victim of the valuable life that they would otherwise have had. Third, I argue that it is wrong to cooperate with massive wrongdoing. By consuming animal products, we typically support institutions that engage in massive and systematic wrongful treatment of animals. We thus ought to become vegan. (shrink)

Many moral philosophers have criticized intensive animal farming because it can be harmful to the environment, it causes pain and misery to a large number of animals, and furthermore eating meat and animal-based products can be unhealthful. The issue of industrially farmed animals has become one of the most pressing ethical questions of our time. On the one hand, utilitarians have argued that we should become vegetarians or vegans because the practices of raising animals for food are immoral since they (...) minimize the overall happiness. Deontologists, on the other hand, have argued that the practices of raising animals for food are immoral because animals have certain rights and we have duties toward them. Some virtue ethicists remain unconvinced of deontic and consequentialist arguments against the exploitation of animals and suggest that a virtue-based approach is better equipped to show what is immoral about raising and using animals for food, and what is virtuous about ethical veganism. Animal welfare scientists face an acute version of the problem of inductive risk, since they must choose whether to affirm attributions of mental states to animals in advisory contexts, knowing their decisions hold consequences for animal welfare. In such contexts, the burden of proof should be sensitive to the consequences of error, but a framework for setting appropriate burdens of proof is lacking. Through reflection on two cases—pain and cognitive enrichment—I arrive at a tentative framework based on the principle of (...) expected welfare maximization. I then discuss the limitations of this framework and the questions it leaves open. (shrink)

Human–nonhuman chimeras have been the focus of ethical controversies for more than a decade, yet some related issues remain unaddressed. For example, little has been said about the relationship between the origin of transferred cells and the morally relevant capacities to which they may give rise. Consider, for example, a developing mouse fetus that receives a brain stem cell transplant from a human and another that receives a brain stem cell transplant from a dolphin. If both chimeras acquire morally relevant (...) capacities as a result of transplantation, and if those capacities are indistinguishable, should the difference in cell origin matter to how we classify these creatures? I argue that if morally relevant capacities are easy to detect, cell origin is irrelevant to how the chimera ought to be treated. However, if such capacities are hard to detect, cell origin should play a role in considerations about how to treat the chimera. (shrink)

I sketch briefly some of the more influential theories concerned with the moral status of nonhuman animals, highlighting their biological/physiological aspects. I then survey the most prominent empirical research on the physiological and cognitive capacities of nonhuman animals, focusing primarily on sentience, but looking also at a few other morally relevant capacities such as self-awareness, memory, and mindreading. Lastly, I discuss two examples of current animal welfare policy, namely, animals used in industrialized food production and in scientific research. Questions about fish consciousness and cognition are receiving increasing attention. In this paper, I explain why one must be careful to avoid drawing conclusions too hastily about this hugely diverse set of species.

In the long history of moral theory, non-human animals—hereafter, just animals—have often been neglected entirely or have been relegated to some secondary status. Since its emergence in the early 19th century, utilitarianism has made a difference in that respect by focusing upon happiness or well-being (and their contraries) rather than upon the beings who suffer or enjoy. Inevitably, that has meant that human relations to and use of other animals have appeared in a different light. Some cases have seemed easy: (...) once admit that the interests of animals matter and there can be little hesitation in condemning their cruel treatment. Among the more difficult cases has been the bearing of utilitarianism upon the use of animals in various kinds of research where, though the animals might suffer, there were believed to be prospects of great human benefit and where no cruel or malicious motives need be involved. What I shall provide in the current paper is an extended discussion of the bearing of utilitarianism upon practices of animal research. Since such practices have attracted both utilitarian criticism and defense, this will require the examination of arguments on both sides, including consideration of the human benefits, the animal costs, and the ways in which the one can be weighed against the other. Many traditional attempts to show that nonhuman animals are deserving of moral consideration have taken the form of an argument by analogy. However, arguments of this kind have had notable weaknesses and, in particular, have not been able to convince two kinds of skeptics. One of the most important weaknesses of these arguments is that they fail to provide theoretical justifications for why particular physiological similarities should be considered relevant. This paper examines recent empirical research on pain and, in particular, (...) explores the implications of the dissociation between the sensory and the affective pain pathways. It is argued that these results show that the belief that nonhuman animals experience pain in a morally relevant way is reasonable, though not certain. It is further argued that the proposal to explore the relationship between consciousness and various forms of learning challenges the aforementioned skeptics to provide more physiological details for their claims that nonhuman mammals are probably not conscious. The ethics of using nonhuman animals in biomedical research is usually seen as a subfield of animal ethics. In recent years, however, the ethics of animal research has increasingly become a subfield within research ethics under the term “animal research ethics”. Consequently, ethical issues have become prominent that are familiar in the context of human research ethics, such as autonomy or self-determination, harms and benefits, justice, and vulnerability. After a brief overview of the development of the field and a discussion (...) of relevant theoretical ethical frameworks, I consider two of these issues, namely autonomy and self-determination on the one hand, and harms and benefits on the other hand. My concern is with philosophical and ethical issues, rather than animal research oversight. I focus my discussion on nonhuman primates, as the most plausible nonhuman candidates for this approach. I conclude that the approach, although promising, depends strongly on the moral status of nonhuman research subjects. (shrink)

Several influential philosophers and scientists have advanced a framework, often called Neo-Cartesianism (NC), according to which animal suffering is merely apparent. Drawing upon contemporary neuroscience and philosophy of mind, Neo-Cartesians challenge the mainstream position we shall call Evolutionary Continuity (EC), the view that humans are on a nonhierarchical continuum with other species and are thus not likely to be unique in consciously experiencing negative pain affect. We argue that some Neo-Cartesians have misconstrued the underlying science or tendentiously appropriated controversial views (...) in the philosophy of mind. We discuss recent evidence that undermines the simple neuroanatomical structure-function correlation thesis that undergirds many Neo-Cartesian arguments, has an important bearing on the recent controversy over pain in fish, and places the underlying epistemology framing the debate between NC and EC in a new light that strengthens the EC position. This piece surveys recent work on the ethics of food production and distribution, paying closest attention to animal agriculture, plant agriculture, food justice, and food sovereignty.

One of the most controversial areas of animal research is the use of nonhuman primates for fundamental research. At the centre of the controversy is the question of whether the benefits of research outweigh the harms. We argue that the evaluation of harms and benefits is highly problematic. We describe some common procedures in neurological research using nonhuman primates and the difficulties in evaluating the harm involved. Even if the harm could be quantified, it is unlikely that it could be (...) meaningfully aggregated over different procedures, let alone different animals. A similar problem arises for evaluating benefits. It is not clear how benefits could be quantified, and even if they could be, values for different aspects of expected benefits cannot be simply added up. Sorting harms and benefits in three or four categories cannot avoid the charge of arbitrariness and runs the risk of imposing its structure on the moral decision. The metaphor of weighing or balancing harms and benefits is inappropriate for the moral decision about whether to use nonhuman primates for research. Arguing that the harms and benefits in this context are incommensurable, we suggest describing the moral consideration of harms and benefits as a coherent trade-off. Such a decision does not require commensurability. It must be well-informed about the suffering involved and the potential benefits, it must be consistent with the legal, regulatory and institutional framework within which it is made, and it must cohere with other judgments in relevant areas. This article surveys recent work on some issues in the ethics of food consumption. It is a companion to our piece on food justice and the ethics of food production.

Non-reductive physicalists have long held that the special sciences offer explanations of some phenomena that are objectively superior to physical explanations. This explanatory “autonomy” has largely been based on the multiple realizability argument. Recently, in the face of the local reduction and disjunctive property responses to multiple realizability, some defenders of non-reductive physicalism have suggested that autonomy can be grounded merely in human cognitive limitations. In this paper, I argue that this is mistaken. By distinguishing between two kinds of abstraction (...) I show that the greater explanatory relevance of some special science predicates (to certain explananda) is both non-anthropocentric and not solely based on considerations of multiple realizability. This shows that the explanatory autonomy of the special sciences is safe from the local reduction and disjunctive property strategies, even if they are successful responses to the multiple realizability argument. Questions about robots feeling pain are important because the experience of pain implies sentience and the ability to suffer. Pain is not the same as nociception, a reflex response to an aversive stimulus. The experience of pain in others has to be inferred. Danaher’s (Sci Eng Ethics 26(4):2023–2049, 2020. ) ‘ethical behaviourist’ account claims that if a robot behaves in the same way as an animal that is recognised to have moral status, then its moral status should also be assumed. (...) Similarly, under a precautionary approach (Sebo in Harvard Rev Philos 25:51–70, 2018. ), entities from foetuses to plants and robots are given the benefit of the doubt and assumed to be sentient. However, there is a growing consensus about the scientific criteria used to indicate pain and the ability to suffer in animals (Birch in Anim Sentience, 2017. ; Sneddon et al. in Anim Behav 97:201–212, 2014. ). These include the presence of a central nervous system, changed behaviour in response to pain, and the effects of analgesic pain relief. Few of these criteria are met by robots, and there are risks to assuming that they are sentient and capable of suffering pain. Since robots lack nervous systems and living bodies there is little reason to believe that future robots capable of feeling pain could (or should) be developed. (shrink)

Ethicists have commonly appealed to science to bolster their arguments for elevating the moral status of nonhuman animals. I describe a framework within which I take many ethicists to be making such appeals. I focus on an apparent gap in this framework between those properties of animals that are part of the scientific consensus, and those to which ethicists typically appeal in their arguments. I will describe two different ways of diminishing the appearance of the gap, and argue that both (...) of them present challenges to ethicists seeking a firm scientific basis for their claims about the moral status of animals. I argue that more clarity about the role of appeals to science by applied ethicists leads to questions about the effectiveness of such appeals, and that these questions might best be pursued empirically. On my view, every bone, every fossil, and every putrid whiff of carrion that one smells on a hike in the country is just as good evidence for a divine intervention as it is for the suffering of an animal.

While the science of animal consciousness has seen a surge of new work, its most basic methodology remains highly disputed. In this paper I identify four candidate norms of inquiry that have been implicitly introduced in the recent literature. I call these (1) expansive theorizing, (2) indirect inquiry, (3) lowering epistemic standards, and (4) inflating epistemic standards. In each section, an instantiation of the norm of inquiry is discussed, and the broader lessons that can be taken from avoiding it are (...) drawn out. Interestingly, each of these candidate norms of inquiry have something in common: they implicitly hold that, to study animal consciousness, ordinary scientific standards must in some way be departed from. The overarching claim of this paper is that this is a mistake. In response to this, I propose four alternative candidate norms of inquiry. I call these (1) weighted development, (2) evidential foundations, (3) knowledge directed, and (4) anti-proof. The overarching norm of ‘no exceptionalism’ is then proposed with the goal of establishing a minimal methodological consensus. (shrink)

This chapter addresses the extent to which nonhuman animals are conscious. Most important perhaps is what criteria should be used in making such a determination.

On Don Marquis’s future of value account of the wrongness of killing, ‘what makes it wrong to kill those individuals we all believe it is wrong to kill, is that killing them deprives them of their future of value’. Marquis has recently argued for a narrow interpretation of his future of value account of the wrongness of killing and against the broad interpretation that I had put forward in response to Carson Strong. In this article I argue that the narrow (...) view is problematic because it violates some basic principles of equality and because it allows for some of the very killing that Marquis sets out to condemn; further, I argue that the chief reason why Marquis chooses the narrow view over the broad view – namely that the broad view would take the killing of some nonhuman animals to be also wrong – should rather be considered a welcome upshot of the broad view. Animal pain and suffering is mostly caused by humans, particularly by the human use of domestic animals. This calls for the recognition of animal pain and suffering. My focus is on pain-related suffering. I argue for recognition in the phenomenological sense of giving adequate regard to pain experience in animals and their capacity to express it in their own species-specific terms, in a way that will motivate us to prevent it. My advocacy for the recognition of pain in animals consequently (...) includes a consideration of moral and political action to avert their suffering. (shrink)

Philosophers think of pain less and less as a paradigmatic instance of mentality, for which they seek a general account, and increasingly as a rich and fruitful topic in its own right. Pain raises specific questions: about mentality and consciousness certainly, but also about embodiment, affect, motivation, and value, to name but a few. The growth of philosophical interest in pain has gone hand-in-hand with the growth of pain science, which burgeoned in the 1960s. This is no accident: developments in (...) pain science have prompted philosophers to take account of empirical data, and to revisit their assumptions about pain. Pain, in short, demands interdisciplinary investigation, hence while this entry focuses on the philosophy of pain, it makes liberal reference to empirical literature along the way. This entry’s focus is on physical pains, that is pains that are felt in bodily locations, not emotional suffering more broadly, such as grief or disappointment. The entry also does not address pain’s place in ethical theories; its focus is rather on issues that arise within philosophy of mind. Even so, part of what makes pain such an interesting and important topic is that the questions it raises span boundaries, and normative questions concerning pain’s badness, on the one hand, and its value, on the other, are never far away. In this paper I present a psychofunctionalist argument for conceptualism, the thesis that conscious visual experience is a conceptual state rather than a nonconceptual state. The argument draws on the holistic character of functionalist accounts of mind, together with the “Two Visual Systems Hypothesis” notably defended by Melvyn Goodale and David Milner.

Fish farming is one of the fastest growing sectors of agriculture, attracting considerable attention to the question of whether existing farming regulations and animal welfare laws are adequate to deal with the expanding role of fish in feeding humans. The role of fish as model organisms in scientific research is also expanding -- a majority of research biology departments now keep zebrafish for the purposes of genome biology, and they are used widely used for basic neuroscience research. However, due to (...) their diversity and distance from mammalian biology, fish pose difficult questions for the application of legal and ethical principles of animal welfare. This paper reviews the developing legal and scientific context in which such questions must be answered. (shrink)

Our ethical obligations to another being depend at least in part on that being’s capacity for a mental life. Our usual approach to inferring the mental state of another is to reason by analogy: If another being behaves as I do in a circumstance that engenders a certain mental state in me, I conclude that it has engendered the same mental state in him or her. Unfortunately, as philosophers have long noted, this analogy is fallible because behavior and mental states (...) are only contingently related. If the other person is acting, for example, we could draw the wrong conclusion about his or her mental state. In this article I consider another type of analogy that can be drawn between oneself and another to infer the mental state of the other, substituting brain activity for behavior. According to most current views of the mind–body problem, mental states and brain states are non-contingently related, and hence inferences drawn with the new analogy are not susceptible to the alternative interpretations that plague the behavioral analogy. The implications of this approach are explored in two cases for which behavior is particularly unhelpful as a guide to mental status: severely brain–damaged patients who are incapable of intentional communicative behavior, and nonhuman animals whose behavioral repertoires are different from ours and who lack language. Animal models are used in experiments in the behavioural neurosciences that aim to contribute to the prevention and treatment of cognitive and affective disorders in human beings, such as anxiety and depression. Ironically, those animals that are likely to be the best models for psychopathology are also likely to be considered the ones that are most morally problematic to use, if it seems probable that (and if indeed they are initially selected as models because) they have experiences that are similar (...) to human experiences that we have strong reasons to avoid causing, and indeed aim to alleviate (such as pain, anxiety or sadness). In this paper, against the background of contemporary discussions in animal ethics and the philosophy of animal minds, we discuss the views that it is morally permissible to use animals in these kinds of experiments, and that it is better to use less cognitively complex animals (such as zebrafish) than more complex animals (such as dogs). First, we criticise some justifications for the claim that human beings and more complex animals have higher moral status. We argue that contemporary approaches that attribute equal moral status to all beings that are capable of conscious strivings (e.g. avoiding pain and anxiety; aiming to eat and play) are based on more plausible assumptions. Second, we argue that it is problematic to assume that less cognitively complex animals have a lesser sensory and emotional experience than more complex beings across the board. In specific cases, there might be good reasons to assume that more complex beings would be harmed more by a specific physical or environmental intervention, but it might also be that they sometimes are harmed less because of a better ability to cope. Determining whether a specific experiment is justified is therefore a complex issue. Our aim in this chapter is to stimulate further reflection on these common assumptions behind the use of animal models for psychopathologies. In order to be able to draw more definite conclusions, more research will have to be done on the influence of cognitive complexity on the experience of (human and non-human) animals. (shrink)

I start by defining sentience and giving an analysis of the epistemological problems that plague its scientific study; this consists mainly in justifying that the attribution of sentience is underdetermined by the data. Second I show that as a result of this situation of underdetermination, most of the types of arguments used to infer sentience from the data are inconclusive and lead to a stalemate. Third, I argue that the stalemates arise from a foundationalist epistemology which needlessly leads to skeptical (...) conclusions; as an alternative, I propose to adopt a coherentist framework and defend a process of ‘epistemic iteration’ (Chang 2004) within that framework, which I argue gives us a way out of the underdetermination.
