This book offers original accounts of a number of central social phenomena, many of which have received little if any prior philosophical attention. These phenomena include social groups, group languages, acting together, collective belief, mutual recognition, and social convention. In the course of developing her analyses Gilbert discusses the work of Emile Durkheim, Georg Simmel, Max Weber, David Lewis, among others.

One of the most distinguished living social philosophers, Margaret Gilbert develops and extends her application of plural subject theory of human sociality, first introduced in her earlier works On Social Facts and Living Together. Sociality and Responsibility presents an extended discussion of her proposal that joint commitments inherently involve obligations and rights, proposing, in effect, a new theory of obligations and rights. In addition, it demonstrates the extensive range and fruitfulness of plural subject theory by presenting accounts of social rules, (...) scientific change, political obligation, collective remorse, collective guilt, shared intention and an important class of rights and obligations. Much of the bioethical literature on parenthood does not address a fact about parenthood which deserves more attention: parental rights and obligations are attached to socially constructed institutional roles. Both the content of these roles, and the way in which they determine who a child’s parents will be, issue from social and legal institutions of parenthood, and this makes a difference to accounts of the moral basis of parenthood. I will argue that this poses a problem for the causal account (...) of parenthood: the variability of parental obligations, and their assignment, underscores the problems the causal account has with defining the relevant notion of cause and with fixing procreative costs. If institutional role obligations arise only through voluntary undertakings, then understanding moral parenthood as an institutional role makes the voluntarist account of parenthood more attractive. However, I must address two questions: whether such role obligations can arise non-voluntarily, and whether the voluntarist account can deal with common cases of parenthood. (shrink)

Procreation and Parenthood offers new and original essays by leading philosophers on some of the main ethical issues raised by these activities.

Shared agency is of central importance in our lives in many ways. We enjoy engaging in certain joint activities with others. We also engage in joint activities to achieve complex goals. Current approaches propose that we understand shared agency in terms of the more basic phenomenon of shared intention. However, they have presented two antagonistic views about the nature of this phenomenon. Some have argued that shared intention should be understood as being primarily a structure of attitudes of individual participants (...) and their interrelations (Bratman, Searle, Tuomela and Miller). Others have claimed that shared intention should be regarded as being primarily a normative transaction which gives rise to interpersonal obligations (Gilbert). In contrast to these approaches, I propose a compromise view. I argue that shared intention involves a complex socio-psychological structure which ensures, in the absence of special circumstances, the existence of relevant moral obligations. My argument involves two main steps. First, I show that shared intention includes important relations of mutual reliance between the participants. Then, I argue that the existence of these relations of mutual reliance in shared intention helps us explain why, failing special circumstances, shared intention generates those obligations. This provides, in my view, a solution to the vexed question of the relation between shared intention and interpersonal obligations. (shrink)

Typical agreements can be seen as joint decisions, inherently involving obligations of a distinctive kind. These obligations derive from the joint commitment' that underlies a joint decision. One consequence of this understanding of agreements and their obligations is that coerced agreements are possible and impose obligations. It is not that the parties to an agreement should always conform to it, all things considered. Unless one is released from the agreement, however, one has some reason to conform to it, whatever else (...) is true. In this sense, one is under an obligation to the other parties. The relevance of these points to the issue of political obligation is discussed. (shrink)

My primary aim is to call into question an influential notion of paternal responsibility, namely, that fathers owe support to their children due to their causal responsibility for their existence. I argue that men who impregnate women unintentionally, and despite having taken preventative measures, do not owe child support to their children as a matter of justice; their children have no right against them to support. I argue for this on the basis of plausible principles of responsibility which have been (...) used to defend abortion rights. I then consider the morally relevant differences between men and women, arguing that while in some cases these differences may justify differential treatment, their import should not be overstated - in many cases, the burden of child support will be too great to impose justly on fathers. This conclusion is not as undesirable as it may seem: I suggest feminist considerations in favor of revising the notion of paternal responsibility and considering alternative arrangements of child support.
