Reissued here in its corrected second edition of 1864, this essay by John Stuart Mill argues for a utilitarian theory of morality. Originally printed as a series of three articles in Fraser's Magazine in 1861, the work sought to refine the 'greatest happiness' principle that had been championed by Jeremy Bentham, defending it from common criticisms, and offering a justification of its validity. Following Bentham, Mill holds that actions can be judged as right or wrong depending on whether they promote (...) happiness or 'the reverse of happiness'. Although attracted by Bentham's consequentialist framework based on empirical evidence rather than intuition, Mill separates happiness into 'higher' and 'lower' pleasures, arguing for a weighted system of measurement when making and judging decisions. Dissected and debated since its first appearance, the essay is Mill's key discussion on the topic and remains a fundamental text in the study of ethics. (shrink)

John Rawls is one of the most influential thinkers of the twentieth century. Contemporary political philosophy has been reshaped by his seminal ideas and most current work in the discipline is a response to them. This book introduces his central ideas and examines their contribution to contemporary political thought. In the first part of the book Catherine Audard focuses on Rawls' conception of political and social justice and its justification as presented in his groundbreaking A Theory of Justice. This includes (...) sustained examination of Rawls' moral philosophy and its core thesis, the primacy of justice, the complex relation between Rawls' views and utilitarianism, and his most famous concept, the Original Position Device. In the second half of the book, Audard explores Rawls' more practical concerns for stability and political consensus, citizenship and international justice, and shows the continuity between these concerns and his earlier work. Th is paper investigates the epistemic powers of democratic institutions through an assessment of three epistemic models of democracy : the Condorcet Jury Th eorem, the Diversity Trumps Ability Th eorem, and Dewey's experimentalist model. Dewey's model is superior to the others in its ability to model the epistemic functions of three constitutive features of democracy : the epistemic diversity of participants, the interaction of voting with discussion, and feedback mechanisms such as periodic elections and protests. It views democracy as (...) an institution for pooling widely distributed information about problems and policies of public interest by engaging the participation of epistemically diverse knowers. Democratic norms of free discourse, dissent, feedback, and accountability function to ensure collective, experimentallybased learning from the diverse experiences of diff erent knowers. I illustrate these points with a case study of community forestry groups in South Asia, whose epistemic powers have been hobbled by their suppression of women's participation. (shrink)

Mill’s claim that representative government can be democratic, and as such “the ideally best form of government”, rests on the virtues of public deliberation, which he sees both as a means for pursuing just political decisions and as a means of participation for the widest citizenry. His view has been criticized, by Schmitt in particular, for assuming that free discussion can dissolve the conflict of social forces and that it leads to the discovery of the truth. But does it really (...) depend on such premises? The focus of the paper is the tension between the search for truth and the need for inclusion in Mill’s theory of representative government. An examination of the role played by freedom of discussion suggests that far from sublimating social conflict or guaranteeing the correctness of political decisions, the deliberative process regulates the conflict of opinions, understood as a violent struggle over truth, on an egalitarian basis. British philosopher and economist John Stuart Mill is the author of several essays, including Utilitarianism - a defence of Jeremy Bentham's principle applied to the field of ethics - and The Subjection of Women, which advocates legal equality between the sexes. This work, arguably his most famous contribution to political philosophy and theory, was first published in 1859, and remains a major influence upon contemporary liberal political thought. In it, Mill argues for a limitation of the power of government and (...) society over the individual, and defines liberty as an absolute individual right. According to the still much debated 'harm principle', power against the individual can only be exercised to prevent harm to others. Full of contemporary relevance, this essay also defends freedom of speech as a necessary condition of social and intellectual progress. (shrink)

ABSTRACTIt is often held that disagreement over non-normative facts is less significant to the project of public justification than disagreement over relevant moral norms. But this dismissal of non-normative factual disagreement is unjustified—an ad hoc attempt to save the ideal of public justification from the endemic actual disagreement that threatens it. Disagreement over norms is relevant to political legitimacy; so, too, is disagreement over facts. I draw two implications from this point. First, inasmuch as accounts of public justification typically involve (...) a unanimity condition, public justification should not be thought a desideratum of political legitimacy. Second, virtuous political praxis will often involve enforcing legislation in spite of unresolved non-normative factual disagreement. That is, with respect to legitimacy, there is nothing morally amiss about such legislation. Clearly these last claims presuppose some basis for legitimacy other than agreement; I will only gesture at what this might be. Assuming that much actual legislation is indeed legitimate, though—in spite of extant normative and non-normative disagreement—I go so far as concluding that such a basis, whatever it is, must exist. I argue that Mill's view of individuality also plays an important role in promoting social pluralism and respect for difference. Firstly, I argue that in Mill's theory individuality is not merely an individual good but also a social good. Secondly, I argue that by expressing his appreciation of diversity, Mill's liberalism goes beyond tolerating difference and pluralism. His position is that pluralism should be appreciated rather than merely tolerated. Mill's appreciation of difference resonates with Iris Marion Young's ideal of the (...) unoppressive city. However the structure of Mill's theory does place limits on the exercise of individual liberty. These limits are set down by the Liberty Principle in the essay On Liberty. I look at some cases. First, I examine the tensions between individuality and autonomy as they bump up against the needs of human connection.
