Ethical concepts are, or purport to be, normative. They make claims on us: they command, oblige, recommend, or guide. Or at least when we invoke them, we make claims on one another; but where does their authority over us - or ours over one another - come from? Christine Korsgaard identifies four accounts of the source of normativity that have been advocated by modern moral philosophers: voluntarism, realism, reflective endorsement, and the appeal to autonomy. She traces their history, showing how (...) each developed in response to the prior one and comparing their early versions with those on the contemporary philosophical scene. Kant's theory that normativity springs from our own autonomy emerges as a synthesis of the other three, and Korsgaard concludes with her own version of the Kantian account. The Metaphysics of Morals is Kant's major work in applied moral philosophy in which he deals with the basic principles of rights and of virtues. It comprises two parts: the 'Doctrine of Right', which deals with the rights which people have or can acquire, and the 'Doctrine of Virtue', which deals with the virtues they ought to acquire. Mary Gregor's translation, revised for publication in the Cambridge Texts in the History of Philosophy series, is the only complete translation of the (...) whole text, and includes extensive annotation on Kant's difficult and sometimes unfamiliar vocabulary. With this volume, Werner Pluhar completes his work on Kant's three Critiques, an accomplishment unique among English language translators of Kant. At once accurate, fluent, and accessible, Pluhar's rendition of the Critique of Practical Reason meets the standards set in his widely respected translations of the Critique of Judgement (1987) and the Critique of Pure Reason (1996).

Suppose that we want to frame a conception of reasons that isn't relativized to the inclinations of particular agents. That is, we want to identify particular things that count as reasons for acting simpliciter and not merely as reasons for some agents rather than others, depending on their inclinations. One way to frame such a conception is to name some features that an action can have and to say that they count as reasons for someone whether or not he is (...) inclined to care about them. The problem with the resulting conception, as we have seen, is that it entails the normative judgment that one ought to be inclined to care about the specified features, on pain of irrationality, and this normative judgment requires justification. The advantage of internalism is that it avoids these normative commitments. It says that things count as reasons for someone only if he is inclined to care about them, and so it leaves the normative question of whether to care about them entirely open. Yet if we try to leave this question open, by defining things as reasons only for those inclined to care about them, we'll end up with a definition that's relativized to the inclinations of particular agents—won't we? Not necessarily. For suppose that all reasons for acting are features of a single kind, whose influence depends on a single inclination. And suppose that the inclination on which the influence of reasons depends is, not an inclination that distinguishes some agents from others, but rather an inclination that distinguishes agents from nonagents. In that case, to say that these features count as reasons only for those who are inclined to care about them will be to say that they count as reasons only for agents—which will be to say no less than that they are reasons for acting, period, since applying only to agents is already part of the concept of reasons for acting. The restriction on the application of reasons will drop away from our definition, since it restricts their application, not to some proper subset of agents, but rather to the set of all agents, which is simply the universe of application for reasons to act. This paper criticizes two accounts of the normativity of practical principles: the empiricist account and the rationalist or realist account. It argues against the empiricist view, focusing on the Humean texts that are usually taken to be its locus classicus. It then argues both against the dogmatic rationalist view, and for the Kantian view, through a discussion of Kant's own remarks about instrumental rationality in the second section of the Groundwork. It further argues that the instrumental principle cannot stand alone. (...) Unless there are normative principles directing us to the adoption of certain ends, there can be no requirement to take the means to our ends. Constitutivism is the view that we can derive substantive normative conclusions from an account of the nature of action. Agency and the Foundations of Ethics explains the constitutivist strategy and argues that the attractions of this view are considerable: constitutivism promises to resolve longstanding philosophical puzzles about the metaphysics, epistemology, and practical grip of normative claims. Yet constitutivism faces a challenge: it must employ a conception of action that is minimal enough to be independently plausible, but substantial enough to yield (...) robust normative results. The current versions of constitutivism fall short on this score. However, we can generate a successful version by employing a more nuanced theory of action. Drawing on recent empirical work on human motivation as well as a model of agency indebted to the work of Nietzsche, the book argues that every episode of action aims jointly at agential activity and power. An agent manifests agential activity if she approves of her action, and further knowledge of the motives figuring in the etiology of her action would not undermine this approval. An agent aims at power if she aims at encountering and overcoming obstacles or resistances in the course of pursuing other, more determinate ends. These structural features of agency both constitute events as actions and generate standards of assessment for action. Using these results, the book shows that we can extract substantive normative claims from facts about the nature of agency. (shrink)

In How We Get Along, philosopher David Velleman compares our social interactions to the interactions among improvisational actors on stage. He argues that we play ourselves - not artificially but authentically, by doing what would make sense coming from us as we really are. And, like improvisational actors, we deal with one another in dual capacities: both as characters within the social drama and as players contributing to the shared performance. In this conception of social intercourse, Velleman finds rational grounds (...) for morality, though not a rational guarantee. He maps a middle course between skepticism and rationalism, arguing that practical reasoning is 'pro-moral' without requiring moral action. The result is what he calls a 'Kinda Kantian metaethics'. How We Get Along is the summation of Velleman's thinking to date, incorporating and unifying previous work on agency, the self, the emotions, narrative and Kantian moral theory. (shrink)

There is a fairly widespread—and very infl uential—hope among philosophers interested in the status of normativity that the solution to our metaethical and, more generally, metanormative problems will emerge from the philosophy of action. In this essay, I will argue that these hopes are groundless. I will focus on the metanormative hope, but—as will become clear—showing that the solution to our metanormative problems will not come from what is constitutive of action will also devastate the hope of gaining significant insight (...) into first-order, normative truths by focusing on what is constitutive of action. Constitutivism argues that the source of the categorical force of the norms of rationality and morality lies in the constitutive features of agency. A systematic failure to be guided by these norms would amount to a loss or lack of agency. Since we cannot but be agents, we cannot but be unconditionally guided by these norms. The constitutivist strategy has been challenged by David Enoch. He argues that our participation in agency is optional and thus cannot be a source of (...) categorical demands. In this paper, I defend the viability of constitutivism by showing that agency is indeed a special ‘inescapable’ enterprise. Agency has the largest jurisdiction, and it is closed under rational assessment. This inescapability does not exempt constitutivism from raising the question whether agents have reason to be agents, but this question has to be taken up within agency. If this question is answered affirmatively, then—I argue—the criteria of practical correctness are self-ratifying in a non-circular way. This is sufficient to show the viability of the constitutivist strategy. Whether agents have conclusive reasons to be agents, however, is a matter to be addressed in the terms of particular versions of constitutivism. (shrink)

Constitutivists hope to locate the foundations of ethics in the nature of action. They hope to find norms that are constitutive of agency. Recently David Enoch has argued that even if there are such norms, they cannot provide the last word when it comes to normativity, since they cannot tell us whether we have reason to be agents rather than shmagents. I argue that the force of the shmagency objection has been considerably overestimated, because philosophers on both sides of the (...) debate have failed to grasp the true source of the authority of agency’s constitutive norm. Some constitutivists believe that this authority is rooted in the inescapability of agency. Yet agency is not, in fact, inescapable. What actually grounds the authority of agency’s constitutive norm is the fact that there is no standpoint outside of agency from which we can intelligibly ask normative questions. (shrink)

1. The Shmagency Challenge to Constitutivism In metaethics – and indeed, meta-normativity – constitutivism is a family of views that hope to ground normativity in norms, or standards, or motives, or aims that are constitutive of action and agency. And mostly because of the influential work of Christine Korsgaard and David Velleman, constitutivism seems to be gaining grounds in the current literature. The promises of constitutivism are significant. Perhaps chief among them are the hope to provide with some kind of (...) answer to the skeptic about morality or perhaps practical reason, and the hope to secure for practical reason a kind of objectivity that is consistent with its practical, motivationally engaged nature. The former philosophical motivation for constitutivism – most clearly present in much of Korsgaard’s relevant work[1] – relies on the fact that constitutive norms seem to be less mysterious than not-clearly-constitutive norms. There arguably is nothing mysterious about, say, the norms of certain reasonably-well-defined activities, like building a house, or playing chess. And challenges by the relevant skeptic – the one asking "Why should I make sure the house I’m building can shelter people from the weather?" or "Why should I not castle when my king is checked?" – seem very rare, barely intelligible, and anyway remarkably easy to cope with. We should explain to the misguided skeptic that if he doesn’t even try to build something that can protect people from the weather, he’s not in the business of building a house at all; that if she doesn’t even try to play by the rules of chess, she’s not in the business of playing chess at all; and so on. It would be nice, the constitutivist hope seems to go, if we had something equally powerful by way of a response to the skeptic asking "Why be moral?". The other main motivation for constitutivism – most clearly present in David Velleman’s relevant work[2] – starts from a commitment to some rather strong kind of existence-internalism about reasons: An agent has a reason to?, according to such views ), only if she can come to?, or at least to be motivated to?, by sound deliberation starting from her actual motivational set. Plato and Kant advance a constitutional model of the soul, in which reason and appetite or passion have different structural and functional roles in the generation of motivation, as opposed to the familiar Combat Model in which they are portrayed as independent sources of motivation struggling for control. In terms of the constitutional model we may explain what makes an action different from an event. What makes an action attributable to a person, and therefore what makes it an action, is (...) that it issues from the person''s constitution, and therefore from the person as a whole, rather than from some force working on or in the person. This in turn implies an account of what makes an action good: what makes an action good is that it is deliberated upon and chosen in a way that unifies the person into a constitutional system. Through deliberative action we constitute ourselves as unified agents. Platonic justice and Kant''s categorical imperative are shown to be normative standards for action because they are principles of self-constitution. (shrink)

According to constitutivism, the objective authority of practical reason is to be grounded in the constitutive features of agency. In this paper, I offer a brief survey of the basic structure of constitutive argument about objectivity and consider how constitutivism might dispel the worry that it can only ground a conditional kind of authority. I then consider David Enoch’s original shmagency challenge and the response in terms of the inescapability of agency. In particular, I revisit the appeal to inescapability in (...) light of Enoch’s restatement of the challenge in 'Shmagency Revisited'. I argue that the revised challenge still fails but that it helps clarify: first, the distinction between external and internal challenges to constitutivism, and, second, the existence of at least different kinds of inescapability of agency (metaphysical, psychological, and dialectical). I argue that only dialectical inescapability is helpful to show that constitutivism is a viable metanormative theory. I conclude by claiming that an internal challenge to constitutivism is still possible in principle but that the burden of proof has shifted once again to the critics of constitutivism. (shrink)

This chapter develops a theory of categorical normativity, of those principles that have authority over us regardless of our ends and interests. It argues that there is an intimate connection between these norms and the conditions of agency. In this respect, it offers a version of constitutivism. But the version of constitutivism defended is unique in a few respects. First, it is naturalistic: agency is an emergent property, like the properties of biology and economics. Second, it is social: agency is (...) something constructed by the complex interaction of agents. And third, it supports the normativity of a particular contractualist procedure: adhering to Kant’s Formula of the Realm of Ends is a condition on agency, and so a categorical requirement. (shrink)

The paper is devoted to a certain way of thinking of the action of another. The posture of mind is characteristically expressed by a specific use of what G. E. M. Anscombe calls stopping modals. On this use, the sentence, “You can’t do that; it is mine,” registers the necessity of justice. My question is: what is the relation between the status of a person, a bearer of rights, the recognition of others as persons, and the practice of addressing the (...) demands of justice to one another? According to a certain strand in the tradition, the answer is: in the sphere of justice, a special union arises among language, mind, and world such that there is a sense in which addressing, recognizing, and being a person are one reality. The paper articulates the relevant sense of ‘one reality’ and offers an argument in support of the formula. In the course of the argument I suggest that this issue is central to understanding the philosophical significance of the second person and appreciating that it marks an irreducible and fundamental form of thought. A wave of recent philosophical work on practical rationality is organized by the following implicit argument: Practical reasoning is figuring out what to do; to do is to act; so the forms of practical inference can be derived from the structure or features of action. Now it is not as though earlier work, in analytic philosophy, had failed to register the connection between action and practical rationality; in fact, practical reasoning was usually picked out as, roughly, reasoning directed toward action. (...) But for much of the twentieth century, attention moved quickly away from this initial delineation of the subject area, to the interplay of beliefs and desires within the mind (Humean theories, including their Davidsonian and Williamsian variants), or to procedures for checking that a plan of action was supported by sufficient yet consistent reasons (Kantian theories), or to the ultrarefined sensibilities of the practically intelligent reasoner (Aristotelian theories). The hallmark of the emerging family of treatments to be surveyed here is, first, the sustained attention paid to answering the question, "What does it take to be an action (at all)?", and second, the use made of a distinction between full-fledged action and its lesser relatives. (Characterizations and terminology vary, but often the less robust alternative is called "mere activity" or "mere behavior".) Very schematically, these arguments for a theory of practical reasoning try to show that reasons brought to bear on choice must have some particular logical form, if action is not to lapse into something less than that. “Ethical life” is Hegel’s term for the actuality of what Kant calls an “ethical community.” As members of the same ethical community, human beings are related to one another as persons in and only in acting from nothing but respect for the same practical law. Kant and Hegel both take ethical life to be a necessary, nay, the highest, end of pure reason. I argue that this is correct. And I identify the idea of ethical life with the idea of (...) a peculiar form of love. Kant and Hegel disagree—in a curiously reciprocal fashion—about the reach of ethical life and about our capacity to know it to reside within our power: while Kant identifies ethical life with the actuality of the ethical community of all possible human beings, Hegel holds that it is necessarily limited to some particular body politic; and while Hegel thinks that to be a human being is to self-knowingly co-constitute an ethical community, Kant believes that it is to be unable to know oneself to even be apt for this. With Hegel and against Kant, I argue that the only way to have the idea of ethical life is to live it. But with Kant and against a naïve form of Hegelianism, I argue that to be conscious of oneself as a human being, a practically rational animal, is to be conscious of oneself as morally evil, i.e. as actively prone to deeming one’s own particularity the supreme law. I show that this entails Hegelian particularism. And I end by noting that this saddles the Hegelian with the task of demonstrating that ethical particularization belongs to the very idea of pure reason itself, objectively conceived. (shrink)
