“Free Will” is a philosophical term of art for a particular sort of capacity of rational agents to choose a course of action from among various alternatives. Which sort is the free will sort is what all the fuss is about. (And what a fuss it has been: philosophers have debated this question for over two millenia, and just about every major philosopher has had something to say about it.) Most philosophers suppose that the concept of free will is very (...) closely connected to the concept of moral responsibility. Acting with free will, on such views, is just to satisfy the metaphysical requirement on being responsible for one's action. (Clearly, there will also be epistemic conditions on responsibility as well, such as being aware—or failing that, being culpably unaware—of relevant alternatives to one's action and of the alternatives' moral significance.) But the significance of free will is not exhausted by its connection to moral responsibility. Free will also appears to be a condition on desert for one's accomplishments (why sustained effort and creative work are praiseworthy); on the autonomy and dignity of persons; and on the value we accord to love and friendship. It argues that this analysis permits an attractive and substantive explanation of what the distinctive normative authority of this concept amounts to, while also explaining why a clear statement of what such authority amounts to has been so elusive in the recent literature. The account given is contrasted with more familiar constitutivist theories, and briefly shows how (...) it answers “schmagency”-style objections to constitutivist explanations of normativity. This paper introduces constitutivism about practical reason, which is the view that we can justify certain normative claims by showing that agents become committed to these claims simply in virtue of acting. According to this view, action has a certain structural feature – a constitutive aim, principle, or standard – that both constitutes events as actions and generates a standard of assessment for action. We can use this standard of assessment to derive normative claims. In short, the authority of certain (...) normative claims arises from the bare fact that we are agents. Constitutivists hope to locate the foundations of ethics in the nature of action. They hope to find norms that are constitutive of agency. Recently David Enoch has argued that even if there are such norms, they cannot provide the last word when it comes to normativity, since they cannot tell us whether we have reason to be agents rather than shmagents. I argue that the force of the shmagency objection has been considerably overestimated, because philosophers on both sides of the (...) debate have failed to grasp the true source of the authority of agency’s constitutive norm. Some constitutivists believe that this authority is rooted in the inescapability of agency. Yet agency is not, in fact, inescapable. What actually grounds the authority of agency’s constitutive norm is the fact that there is no standpoint outside of agency from which we can intelligibly ask normative questions. (shrink)

Metaethical constructivism is the view that insofar as there are normative truths, they are not fixed by normative facts that are independent of what rational agents would agree to under some specified conditions of choice. The appeal of this view lies in the promise to explain how normative truths are objective and independent of our actual judgments, while also binding and authoritative for us. -/- Constructivism comes in several varieties, some of which claim a place within metaethics while others claim (...) no place within it at all. In fact, constructivism is sometimes defended as a normative theory about the justification of moral principles. Normative constructivism is the view that the moral principles we ought to accept are the ones that agents would agree to or endorse were they to engage in a hypothetical or idealized process of rational deliberation. -/- Metaethical constructivist theories aim to account for the nature of normative truths and practical reasons. They bear a problematic relation to traditional classifications of metaethical theories. In particular, there are disagreements about how to situate constructivism in the realism/antirealism debate. These disagreements are rooted in further differences about the definition of metaethics, the relation between normative and metaethical claims, and the purported methods pertinent and specific to metaethical inquiry. The question of how to classify metaethical constructivism will be addressed in what follows by focusing on the distinctive questions that constructivist theories have been designed to answer. Section 1 explains the origin and motivation of constructivism. Sections 2–4 examine the main varieties of metaethical constructivism. Section 5 illustrates related constructivist views, some of which are not proposed as metaethical accounts of all normative truths, but only of moral truths. Over the last two decades, Kant’s name has become closely associated with the “constitutivist” program within metaethics. But is Kant best read as pursuing a constitutivist approach to meta- normative questions? And if so, in what sense? In this essay, I’ll argue that we can best answer these questions by considering them in the context of a broader issue – namely, how Kant understands the proper methodology for philosophy in general. The result of this investigation will be that, while Kant (...) can indeed be read as a sort of constitutivist, his constitutivism is ultimately just one instance of a much more general approach to philosophy – which treats as fundamental our basic, self-conscious rational capacities. Thus, to truly understand why and how Kant is a constitutivist, we need to consider this question within the context of his more fundamental commitment to “capacities-first philosophy”. (shrink)

In recent work, Peter Railton, Julia Annas, and David Velleman aim to reconcile the phenomenon of “flow”—broadly understood as describing the “unreflective” aspect of skilled action—with one or another familiar conception of agency. While there are important differences between their arguments, Railton, Annas, and Velleman all make, or are committed to, at least one similar pivotal claim. Each argues, directly or indirectly, that agents who perform skilled unreflective actions can, in principle, accurately answer “Anscombean” questions—”what” and “why” questions— about what (...) they do. I argue against this claim and explore the ramifications for theories of skilled action and agency. (shrink)

The paper motivates a novel research programme in the philosophy of action parallel to the ‘Knowledge First’ programme in epistemology. It is argued that much of the grounds for abandoning the quest for a reductive analysis of knowledge in favour of the Knowledge First alternative is mirrored in the case of intentional action, inviting the hypothesis that intentional action is also, like knowledge, metaphysically basic. The paper goes on to demonstrate the sort of explanatory contribution that intentional action can make (...) once it is no longer taken to be a target for reductive analysis, in explaining other, non-intentional kinds of action and voluntariness. Constitutivists seek to locate the metaphysical foundations of ethics in nonnormative facts about what is constitutive of agency. For most constitutivists, this involves grounding authoritative norms in the teleological structure of agency. Despite a recent surge in interest, the philosophical move at the heart of this sort of constitutivism remains underdeveloped. Some constitutivists—Foot, Thomson, and Korsgaard (at least in her recent *Self-Constitution*)—adopt a broadly Aristotelian approach. They claim that the functional nature of agency grounds normative judgments about agents in much (...) the same way that the functional natures of artifacts and bodily organs ground normative judgments about those kinds of things. I argue that the neo-Aristotelian conclusions about goodness which follow so straightforwardly from teleological premises are not genuinely normative. Functions are not by their very nature normatively significant. Other constitutivists—notably J. David Velleman and Paul Katsafanas—eschew Aristotelian talk of functions in favor of an approach based on the idea that agency has a constitutive aim. Velleman and Katsafanas both claim that aims are normatively significant. I argue that the fact that agency has a constitutive aim is merely a fact about the motives that produce and regulate actions. And so we are still left with a gap between the teleological and the normative. I conclude by suggesting that constitutivists have failed to find a way to bridge this gap not because none exists, but rather because they have been looking in the wrong place. The constitutivist project can be salvaged, but only if it is supplemented with a reductive metanormative account of reasons for action, an account that links reasons to sound or successful practical reasoning. Constructivism in ethics is the view that insofar as there are normative truths, for example, truths about what we ought to do, they are in some sense determined by an idealized process of rational deliberation, choice, or agreement. As a “first-order moral account”--an account of which moral principles are correct-- constructivism is the view that the moral principles we ought to accept or follow are the ones that agents would agree to or endorse were they to engage in a hypothetical (...) or idealized process of rational deliberation. As a “metaethical account” – an account of whether there are any normative truths and, if so, what they are like – constructivism holds that there are normative truths. These truths are not fixed by facts that are independent of the practical standpoint, however characterized; rather, they are constituted by what agents would agree to under some specified conditions of choice. In working to provide a more precise definition of constructivism in metaethics, the focus of this entry, one faces two main difficulties. The first difficulty is that constructivism comes in several varieties, each of which claims a different niche within metaethics, and some claim no space at all. The second difficulty concerns where to place constructivism on the metaethical map in relation to realism and anti-realism. These are terms of art, and it is highly contested which views count as realist and which as antirealist. These two difficulties will be addressed in what follows by focusing on the distinctive questions that constructivist theories are designed to answer. Section §1 defines the scope of constructivism in ethics, in contrast to constructivism in political theory. Sections §§2-5 illustrate the main varieties of metaethical constructivism, which are designed to account for the nature of normative truths and practical reasons. Section §6 presents the main varieties of constructivist accounts of the justification of moral judgments of right and wrong. More and more people seem to think that constructivism - in political philosophy, in moral philosophy, and perhaps in practical reasoning most generally - is the way to go. And yet it is surprisingly hard to even characterize the view. In this paper, I go to some lengths trying to capture the essence of a constructivist position - mostly in the realm of practical reason - and to pinpoint its theoretical attractions. Metaethical constructivism is one of the main movements within contemporary metaethics – especially among those with Kantian inclinations. But both the philosophical coherence and the Kantian pedigree of constructivism are hotly contested. In the first half of this article, I first explore the sense in which Kant's own views might be described as constructivist and then use the resulting understanding as a guide to how we might think about Kantian constructivism today. Along the way, I hope to suggest that a (...) fairly diverse range of views within contemporary metaethics – including some without any explicit allegiance to Kant – may be thought of as pursuing a version of the resulting strategy. This paper has two goals. First, I offer an interpretation of Nietzsche’s puzzling claims about will to power. I argue that the will to power thesis is a version of constitutivism. Constitutivism is the view that we can derive substantive normative conclusions from an account of the nature of agency; in particular, constitutivism rests on the idea that all actions are motivated by a common, higher-order aim, whose presence generates a standard of assessment for actions. Nietzsche’s version of constitutivism is (...) based on a series of subtle claims about the psychology of willing and the nature of satisfaction, which imply that all actions aim at encountering and overcoming resistance (this is what Nietzsche means by “will to power”). Second, I argue that Nietzsche’s theory, thus interpreted, generates a new, a posteriori version of constitutivism that is not vulnerable to certain familiar objections. If this is right, then we can deploy Nietzschean ideas in order to make a substantive contribution to issues that are currently at the forefront of ethics and action theory. (shrink)

This paper presents a regress challenge to the selective psychological debunking of moral judgments. A selective psychological debunking argument conjoins an empirical claim about the psychological origins of certain moral judgments to a theoretical claim that these psychological origins cannot track moral truth, leading to the conclusion that the moral judgments are unreliable. I argue that psychological debunking arguments are vulnerable to a regress challenge, because the theoretical claim that ‘such-and-such psychological process is not moral-truth-tracking’ relies upon moral judgments. We (...) must then ask about the psychological origins of these judgments, and then make a further evaluative judgment about these psychological origins… and so on. This chain of empirical and evaluative claims may continue indefinitely and, I will argue, proponents of the debunking argument are in a dialectical position where they may not simply call a halt to the process. Hence, their argument cannot terminate, and its debunking conclusion cannot be upheld. (shrink)

: Radical meta-normative skepticism is the view that no standard, norm, or principle has objective authority or normative force. It does not deny that there are norms, standards of correctness, and principles of various kinds that render it possible that we succeed or fail in measuring up to their prerogatives. Rather, it denies that any norm has the status of commanding with objective authority, of giving rise to normative reasons to take seriously and follow its demands. Two powerful transcendental arguments (...) challenge this view. First, skepticism is said to be self-defeating: Settling what to accept, and in particular whether to accept skepticism, appears to be a reason-guided enterprise. How can skeptics coherently support their view by citing reasons in their favor after they just rejected them throughout? Second, there is the practical-deliberative version, most recently developed by David Enoch: We are essentially deliberative creatures. Yet deliberation appears to require that there are correct answers in the form of normative reasons to our practical questions. Thus confidence in the sensible nature of deliberation should inspire confidence in reasons. The essay undermines both transcendental arguments by demonstrating, first, how to support skepticism without deserting its tenets, and, second, how to deliberate in skeptical fashion. (shrink)

Event-causal libertarians maintain that an agent’s freely bringing about a choice is reducible to states and events involving him bringing about the choice. Agent-causal libertarians demur, arguing that free will requires that the agent be irreducibly causally involved. Derk Pereboom and Meghan Griffith have defended agent-causal libertarianism on this score, arguing that since on event-causal libertarianism an agent’s contribution to his choice is exhausted by the causal role of states and events involving him, and since these states and events leave (...) it open which decision he will make, he does not settle which decision occurs, and thus “disappears.” My aim is to explain why this argument fails. In particular, I demonstrate that event-causal libertarians can dismantle the argument by enriching the reductive base in their analysis of free will to include a state that plays the functional role of the self-determining agent and with which the agent is identified. When we make ethical claims, we invoke a kind of objective authority. A familiar worry about our ethical practices is that this invocation of authority involves a mistake. This worry was perhaps best captured by John Mackie, who argued that the fabric of the world contains nothing so queer as objective authority and thus that all our ethical claims are false. Kantians such as Christine Korsgaard and David Velleman offer accounts of the objectivity of ethics that do without the controversial (...) realist assumptions which gives rise to Mackie’s skepticism. They contend that our ethical claims correctly invoke objective authority not by corresponding to some normative pocket of the fabric of reality, but rather by expressing commitments that are inescapable. This Kantian strategy is often advertised as an alternative to traditional but “boring” metaethics. Its proponents promise to vindicate our ethical practices without entangling us in familiar metanormative disputes about the metaphysics, epistemology and semantics of ethics. In this paper, I argue that the Kantian strategy cannot make good on this promise. Considered as an attempt to sidestep traditional metaethics, it lacks the resources to produce the desired normative conclusions. The outlook for the Kantian strategy becomes more promising, though, if we pair it with one of two familiar metanormative theories: expressivism or reductionism. The resulting metaethically-loaded versions of the Kantian strategy can deliver the promised conclusions, but only by plunging straight into the quagmire of traditional metaethics. And there all of the familiar objections to expressivism and reductionism await. (shrink)

What is the motivational profile of admiration? In this article, I will investigate what form of connection between admiration and motivation there may be good reason to accept. A number of philosophers have advocated a connection between admiration and motivation to emulate. I will start by examining this view and will then present objections to it. I will then suggest an expanded account of the connection between admiration and motivation, according to which, admiration involves motivation to promote the value that (...) is judged to be present in the object of admiration. Finally, I will examine the implications of this account for the use of admiration in education. (shrink)

Deference to experts is normal in many areas of inquiry, but suspicious in morality. This is puzzling if one thinks that morality is relevantly like those other areas of inquiry. We argue that this suspiciousness can be explained in terms of the suspiciousness of deferring to an epistemic peer. We then argue that this explanation is preferable to others in the literature, and explore some metaethical implications of this result.

It is commonly held that Kant ventured to derive morality from freedom in Groundwork III. It is also believed that he reversed this strategy in the second Critique, attempting to derive freedom from morality instead. In this paper, I set out to challenge these familiar assumptions: Kant’s argument in Groundwork III rests on a moral conception of the intelligible world, one that plays a similar role as the ‘fact of reason’ in the second Critique. Can the question "Why do what morality requires?" be answered in such a way that anyone regardless of their desires or interests has reason to be moral? One strategy for answering this question appeals to constitutive arguments. In general, constitutive arguments attempt to establish the normativity of rational requirements by pointing out that we are already committed to them insofar as we are believers or agents. This study is concerned with the general prospects for such arguments. It starts by explaining (...) the general constitutive argument strategy, followed by an examination of constitutive arguments that have been given regarding theoretical reason and the instrumental principle in practical reason, and concluding with a discussion of some challenges to constitutive arguments in moral philosophy and some possible responses to these challenges. Mental acts are conspicuously absent from philosophical debates over the nature of action. A typical protagonist of a typical scenario is far more likely to raise her arm or open the window than she is to perform a calculation in her head or talk to herself silently. One possible explanation for this omission is that the standard ‘causalist’ account of action, on which acts are analyzed in terms of mental states causing bodily movements, faces difficulties in accommodating some paradigmatic cases (...) of mental action – or so I argue. After drawing out these objections to causalism, I outline a more promising approach. Building on previous work, I show how the approach I favour, on which the attempt to analyze action is dispensed with, provides a unified account of both mental and physical action. (shrink)

Business and Economic textbooks warn against committing the Sunk Cost Fallacy: you, rationally, shouldn't let unrecoverable costs influence your current decisions. In this paper, I argue that this isn't, in general, correct. Sometimes it's perfectly reasonable to wish to carry on with a project because of the resources you've already sunk into it. The reason? Given that we're social creatures, it's not unreasonable to care about wanting to act in such a way so that a plausible story can be told (...) about you according to which your diachronic behavior doesn't reveal that you've suffered, what I will call, diachronic misfortune. Acting so as to hide that you've suffered diachronic misfortune involves striving to make yourself easily understood while disguising any shortcomings that might damage your reputation as a desirable teammate. And making yourself easily understood to others while hiding your flaws will, sometimes, put pressure on you to honor sunk costs. (shrink)

Are there such things as moral truths? How do we know what we should do? And does it matter? Constructivism states that moral truths are neither invented nor discovered, but rather are constructed by rational agents in order to solve practical problems. While constructivism has become the focus of many philosophical debates in normative ethics, meta-ethics and action theory, its importance is still to be fully appreciated. In the second half of this essay, I discuss the robust conception of rationality that lies at the heart of the Kantian version of Rationalist Constructivism – offering some reasons to prefer this conception to the more minimal accounts of rationality associated with Humean views. I then go on to discuss some of the potential metaethical advantages of the resulting form of constructivism.

According to robust versions of virtue epistemology, the reason why knowledge is incompatible with certain kinds of luck is that justified true beliefs must be achieved by the agent . In a recent set of papers, Pritchard has challenged these sorts of views, advancing different arguments against them. I confront one of them here, which is constructed upon scenarios affected by environmental luck, such as the fake barn cases. My objection to Pritchard differs from those offered until now by Carter (...) , Jarvis or Littlejohn in that it is based on the claim that cognitive performances may not be properly considered as achievements beyond the scope of the agent’s intentional action—an idea that confers more explanatory power on my argument, and contributes to stregthening links between knowledge and agency. How should we interpret the popular objection that stigmatised subjects are not treated as individuals? The Eidelson View claims that stigma, because of its connection to stereotypes, violates an instance of the general requirement to respect autonomy. The Self-Presentation View claims that stigma inhibits the functioning of certain morally important capacities, notably the capacity for self-presentation. I argue that even if we are right to think that stigma violates a requirement to respect autonomy, this is insufficient to account for the (...) full weight of the charge that stigmatised subjects are not treated as individuals. We need the Self-Presentation View to explain a special threat to agency. I then address the worry that focusing on a concern with being treated as individuals opens the door to the suggestion that treating as superior can be just as morally troubling as stigma. This objection is fatal for the Eidelson View. But the Self-Presentation View has a number of resources for deflating the worry. We should not exclude the possibility of a moral symmetry between some cases of stigma and some cases of treating as superior. Rather, we should provide a nuanced account of the circumstances in which either phenomenon is detrimental for self-presentation. (shrink)

If a person's head moves, she may or may not have moved her head, and, if she did move it, she may have actively performed the movement of her head or merely, by doing something else, caused a passive movement. And, if she performed the movement, she might have done so intentionally or not. This short array of contrasts (and others like them) has motivated questions about the nature, variety, and identity of action. Beyond the matter of her moving, when (...) the person moves her head, she may be indicating agreement or shaking an insect off her ear. Should we think of the consequences, conventional or causal, of physical behavior as constituents of an action distinct from but ‘generated by’ the movement? Or should we think that there is a single action describable in a host of ways? Also, actions, in even the most minimal sense, seem to be essentially ‘active’. But, how can we explain what this property amounts to and defend our wavering intuitions about which events fall in the category of the ‘active’ and which do not? (shrink)

Conscience is an idea that has significant currency in liberal democratic societies. Yet contemporary moral philosophical scholarship on conscience is surprisingly sparse. This paper seeks to offer a rigorous philosophical account of the role of conscience in moral life with a view to informing debates about the ethics of conscientious objection in medicine. I argue that conscience is concerned with a commitment to moral integrity and that restrictions on freedom of conscience prevent agents from living a moral life. In section (...) one I argue that conscience is a principle of moral awareness in rational agents, and that it yields an awareness of the personal nature of moral obligation. Conscience also monitors the coherence between an agent’s identity-conferring beliefs and intentions and their practical actions. In section two I consider how human beings are harmed when they are forced to violate their conscience. Restrictions on the exercise of conscience prevent people from living in accord with their own considered understanding of the requirements of morality and undermine one’s capacity for moral agency. This article concludes with a consideration of how a robust theory of conscience can inform our understanding of conscientious objection in medicine. I argue that it is in the interest of individual practitioners and the medical profession generally to foster moral agency among doctors. This provides a prima facie justification for permitting at least some kinds of conscientious objection. (shrink)

Abstract This essay will argue systematically and from a historical perspective that there is something to be said for the traditional claim that the human and natural sciences are distinct epistemic practices. Yet, in light of recent developments in contemporary philosophy of science, one has to be rather careful in utilizing the distinction between understanding and explanation for this purpose. One can only recognize the epistemic distinctiveness of the human sciences by recognizing the epistemic centrality of reenactive empathy for our (...) understanding of rational agency, that is, by emphasizing the psychological component in the concept of understanding that nineteenth-century philosophers like Droysen, in contrast to twentieth-century hermeneutic philosophers, still acknowledged. In addition, the essay will show in detail that merely pointing to the fact that narratives have a cognitive function in the domain of the human sciences, as is common among philosophers of history, does not provide us with a sufficient demarcation criterion for distinguishing between the human and natural sciences. Event-causal libertarians maintain that an agent’s settling of whether certain states-of-affairs obtain on a particular occasion can be reduced to the causing of events (e.g., bodily motions, coming to a resolution) by certain mental events or states, such as certain desires, beliefs and/or intentions. Agent-causal libertarians disagree. A common critique against event-causal libertarian accounts is that the agent’s role of settling matters is left unfilled and the agent “disappears” from such accounts—a problem known as the disappearing agent problem. Recently, Franklin (...) (Philos Stud 170:413–432, 2014) has argued that an “enriched” event-causal account can overcome this problem. Franklin, however, doesn’t consider whether, as Pereboom (J Philos 99:499–531, 2015) argues, the agent as decider of “torn decisions” disappears from even enriched accounts. As I show here, Franklin’s enriched account takes some modifying if it is to overcome Pereboom’s torn decision problem—a special case of the disappearing agent problem. However, as I also show, there is a more fundamental problem facing event-causal libertarian accounts. It is implausible that an agent qua event or state simultaneously settles whether and how she intervenes. The upshot is that events and/or states lack an ability essential to completely fulfilling an agent’s role qua settler. This isn’t a problem for agent-causal accounts like the one offered by Steward (A metaphysics for freedom. Oxford University Press, Oxford, 2012) because in as much as an agent qua substance settles whether her body moves in certain ways on certain occasions she simultaneously settles whether and how she intervenes. As a consequence, event-causal libertarians face a dilemma, or rather several, that agent-causal libertarians do not. This may ultimately be explained by the irreducibility of causation by agents to causation by events. (shrink)

Argues that "internalism about reasons" owes its appeal to a function argument from the nature of agency. Internalism is thus revealed as a species of ethical rationalism. (This paper introduces a volume of recent work on internal and external reasons.).

John Fischer has recently argued that the value of acting freely is the value of self-expression. Drawing on David Velleman’s earlier work, Fischer holds that the value of a life is a narrative value and free will is valuable insofar as it allows us to shape the narrative structure of our lives. This account rests on Fischer’s distinction between regulative control and guidance control. While we lack the former kind of control, on Fischer’s view, the latter is all that is (...) needed for self-expression. I first develop Fischer’s narrative account, focusing on his reliance on temporal loops as giving us control over the value of our lives. Second, I argue that the narrative account grants us greater power over the past than Fischer would allow: since narrative allows not only for changes in how we feel about episodes in our past but what those episodes in fact were, it allows for a kind of retroactive self-constitution. Finally, I suggest that this modification of the narrative view opens the possibility of a conception of freedom far stronger than guidance control. It does not give us the libertarian control over whether to choose A or B in the present, but it does provide a measure of control over the sort of person an agent has been, and thus whether she is the sort of person who will choose A or B in the future. Constitutivism holds that an account of what a thing is yields those normative standards to which that thing is by nature subject. We articulate a minimal form of constitutivism that we call _formal, non-epistemological constitutivism_ which diverges from orthodox versions of constitutivism in two main respects. First: whereas orthodox versions of constitutivism hold that those ethical norms to which people are by nature subject are sui generis because of their special capacity to motivate action and legitimate criticism, we argue that (...) these features are compatible with treating these norms as of a piece with those ‘formal’ natural-historical norms which can be used to assess living things. Second: unlike orthodox versions of constitutivism, our version does not seek to use a non-normative account of that kind of being which we are as a means of identifying those normative claims to which we are are by nature subject. We then indicate how our position can afford us the resources to address some of the familiar difficulties that face cognitivism in ethics. (shrink)

The nature of the relation between jurisprudential theories and first-order legal judgments is a strangely uncontroversial matter in contemporary legal philosophy. There is one dominant conception of the relation according to which jurisprudential theories are second-order or meta-legal theories that specify the ultimate grounds of first-order legal judgments. According to this conception, difficult first-order legal disputes are to be resolved by jurisprudential theorizing. According to an alternative conception that Ronald Dworkin has influentially advocated, jurisprudential theories are not second-order theories about (...) the nature of law, but instead covert first-order legal theories. These two conceptions of the relation between jurisprudential theories and first-order legal judgments dominate the contemporary legal philosophical scene and crowd out other possible conceptions. This article scrutinizes the two conceptions, and in the process raises the possibility of a different and arguably more credible conception. According to this new conception, our first-order legal views and a jurisprudential theory that we accept are supposed to form a mutually disciplining and supporting set of views that we accept in our pursuit of the epistemic ideal of wide reflective equilibrium. The two sets of views are supposed to constrain and discipline each other; but neither is meant to underwrite, certify, or ultimately determine the contents of the other. This new conception, which allows the relation between jurisprudential theories and first-order legal judgments to be much looser, untidier, and more complex than what the two dominant conceptions imply, should facilitate progress in legal philosophy and in first-order legal thinking. Intuitions are widely assumed to play an important evidential role in ethical inquiry. In this paper I critically discuss a recently influential claim that the epistemological credentials of ethical intuitions are undermined by their causal pedigree and functional role. I argue that this claim is exaggerated. In the course of doing so I argue that the challenge to ethical intuitions embodied in this claim should be understood not only as a narrowly epistemological challenge, but also as a substantially ethical one. Starting from Proust’s distinction between the self-attributive and self-evaluative views on metacognition, this paper presents a third view: self-mindshaping. Based on the notion of mindshaping as the core of social cognition, the self-mindshaping view contends that mindshaping abilities can be turned on one’s own mind. Against the self-attributive view, metacognition is not a matter of accessing representations to metarepresent them but of giving shape to those representations themselves. Against the self-evaluative view, metacognition is not blind to content but relies heavily (...) on it. We characterize our view in terms of four issues that, according to Proust, distinguish the previous approaches, namely, whether metacognitive mechanisms are the same as those employed to access other minds, whether metacognitive control requires conceptual representation, whether metacognition is propositional, and whether metacognitive access is linked to mental action. After describing some of the mechanisms for self-mindshaping, we show how this view regards metacognition as grounded on social interaction mechanisms, conceptually driven, possibly, but not necessarily, propositional, and engaged in the practical regulation of mental states. Finally, we examine the prospects for the primacy of self-mindshaping as the primary metacognitive function. We argue that self-attributive processes typically subserve the practical goals emphasized by the mindshaping view, and that the evaluative role played by procedural metacognition can be grounded on social cues rather than on experiential feelings. Even if this is not enough to claim the primacy of self-mindshaping, it still appears as a third kind of metacognition, not reducible to the other two. (shrink)

According to the moral encroachment thesis, moral features of a situation can affect not just what we’re practically justified in doing but also what we’re epistemically justified in believing. This paper offers a new rationale for that thesis, drawing on observations about the role of reflection in agency.

Constructivist approaches in epistemology and ethics offer a promising account of normativity. But constructivism faces a powerful Schmagency Objection, raised by David Enoch. While Enoch’s objection has been widely discussed in the context of practical norms, no one has yet explored how the Schmagency Objection might undermine epistemic constructivism. In this paper, I rectify that gap. First, I develop the objection against a prominent form of epistemic constructivism, Belief Constitutivism. Belief Constitutivism is susceptible to a Schmagency Objection, I argue, because (...) it locates the source of normativity in the belief rather than the agent. In the final section, I propose a version of epistemic constructivism that locates epistemic normativity as constitutive of agency. I argue that this version has the resources to respond to the Schmagency Objection. (shrink)

We may succed in the fulfilment of our desires but still fail to properly own our practical life, perhaps because we acted as addicts, driven by desires that are alien to our will, or as “wantons,” satisfying the desires that we simply happen to have (Frankfurt, 1988 ). May we equally fail to own the outcomes of our epistemic life? If so, how may we attain epistemic ownership over it? This paper explores the structural parallellism between practical and epistemic rationality, (...) building on Williamson’s ( 2002 ) suggestion that we should commence with successful performances as the foundation for both domains, be it action or knowledge. By highlighting the limitations of higher-order regulative approaches in epistemology, exemplified by Sosa ( 2007, 2011, 2015, 2021 ), the paper introduces a form of teleological epistemic constitutivism inspired by Velleman ( 2000, 2009 ). The proposal is that epistemic ownership is not attained in the mere pursuit of truth or knowledge, but requires furthermore a struggle to understand what we know. (shrink)

This chapter develops and defends an account of reason: to reason is to scrutinize one’s attitudes by consulting the perspectives of other persons. The principal attraction of this account is its ability to vindicate the unique of authority of reason. The chapter argues that this conception entails that reasoning is a robustly social endeavor—that it is, in the first instance, something we do with other people. It is further argued that such social endeavors presuppose mutual respect on the part of (...) those participating in them. The account therefore yields a form of Kantian constructivism: we have an unconditional duty of respect for persons because such a duty is implicit in the very nature of reasoning. -/- . (shrink)

Constitutivists believe that we can derive universally and unconditionally authoritative norms from the conditions of agency. Thus if c is a condition of agency, then you ought to live in conformity with c no matter what your particular ends, projects, or station. Much has been said about the validity of the inference, but that’s not my topic here. I want to assume it is valid and talk about what I take to be the highest ambition of constitutivism: the prospect of (...) grounding moral requirements in the conditions of agency. If this can be done, then we can show that everyone is bound by the demands of morality, and we can do so without the customary entanglements—queer normative entities, an implausibly powerful moral sense, or divine lawgivers. Understanding and controlling our minds is one of the most fascinating features of human cognition. It has often been assumed that this ability requires a theoretical understanding of psychological states. This assumption has recently been put under pressure by so called mindshaping approaches. We agree that these approaches provide us with a new way of self-understanding and that they enable a very powerful form of self-regulation which we label narrative control. However, we insist that there still is a crucial role (...) for a theoretical understanding of psychological states in human cognition. We argue that this is because a theoretical understanding is necessary for all intentional control of the mind. Some compatibilists have responded to the manipulation argument for incompatibilism by proposing an historical theory of moral responsibility which, according to one version, requires that agents be morally responsible for having their pro-attitudes if they are to be morally responsible for acting on them. This proposal, however, leads obviously to an infinite regress problem. I consider a proposal by Haji and Cuypers that addresses this problem and argue that it is unsatisfactory. A wave of recent philosophical work on practical rationality is organized by the following implicit argument: Practical reasoning is figuring out what to do; to do is to act; so the forms of practical inference can be derived from the structure or features of action. Now it is not as though earlier work, in analytic philosophy, had failed to register the connection between action and practical rationality; in fact, practical reasoning was usually picked out as, roughly, reasoning directed toward action. (...) But for much of the twentieth century, attention moved quickly away from this initial delineation of the subject area, to the interplay of beliefs and desires within the mind (Humean theories, including their Davidsonian and Williamsian variants), or to procedures for checking that a plan of action was supported by sufficient yet consistent reasons (Kantian theories), or to the ultrarefined sensibilities of the practically intelligent reasoner (Aristotelian theories). The hallmark of the emerging family of treatments to be surveyed here is, first, the sustained attention paid to answering the question, "What does it take to be an action (at all)?", and second, the use made of a distinction between full-fledged action and its lesser relatives. (Characterizations and terminology vary, but often the less robust alternative is called "mere activity" or "mere behavior".) Very schematically, these arguments for a theory of practical reasoning try to show that reasons brought to bear on choice must have some particular logical form, if action is not to lapse into something less than that.
