Though the revised edition of A Theory of Justice, published in 1999, is the definitive statement of Rawls's view, so much of the extensive literature on Rawls's theory refers to the first edition. This reissue makes the first edition once again available for scholars and serious students of Rawls's work.

Two essays on utilitarianism, written from opposite points of view, by J. J. C. Smart and Bernard Williams. In the first part of the book Professor Smart advocates a modern and sophisticated version of classical utilitarianism; he tries to formulate a consistent and persuasive elaboration of the doctrine that the rightness and wrongness of actions is determined solely by their consequences, and in particular their consequences for the sum total of human happiness. In Part II Bernard Williams offers a sustained (...) and vigorous critique of utilitarian assumptions, arguments and ideals. He finds inadequate the theory of action implied by utilitarianism, and he argues that utilitarianism fails to engage at a serious level with the real problems of moral and political philosophy, and fails to make sense of notions such as integrity, or even human happiness itself. Kevin Sauvé has recently argued in this journal that David Gauthier's conception of ‘morals by agreement’ is inimical to the development of long-term productive investment and sustainable levels of resource exploitation. According to Sauvé, this is because society is confronted with an intergenerational interaction problem whose strategic equilibrium is suboptimal. However, unlike the ‘contemporaneous Prisoner's Dilemma’ that Gauthier analyzes, the intergenerational version cannot be solved by an appeal to constrained maximization. As a result, Sauvé claims, Gauthier cannot effectively address the (...) question of intergenerational justice.The portion of Sauvé's argument that concerns me is the following:Gauthier solves the contemporaneous Prisoner's Dilemma by ensuring that each person will cooperate only if all others cooperate, and indeed his conception of morality is aimed at ensuring that all individuals incur the costs as well as the benefits of social cooperation. But the contemporaneous solution cannot be applied to the Intergenerational Dilemma: if each generation will save for the next only if the previous generations have also saved, none will ever save. Is a policy of economic growth compatible with the neutrality of the State? Some liberals (Rawls, Dworkin, Ackerman, Larmore, Kymlicka) think so. I do not. I begin by explaining and discussing the different meanings of the neutrality thesis, then I show that, whatever meaning we give to the idea of neutrality, it is very difficult to argue convincingly that a policy of economic growth does not favour some conceptions of the good.

This book addresses the perennial question: What is justice?

Is morality rational? In this book Gauthier argues that moral principles are principles of rational choice. He proposes a principle whereby choice is made on an agreed basis of cooperation, rather than according to what would give an individual the greatest expectation of value. He shows that such a principle not only ensures mutual benefit and fairness, thus satisfying the standards of morality, but also that each person may actually expect greater utility by adhering to morality, even though the choice (...) did not have that end primarily in view. In resolving what may appear to be a paradox, the author establishes morals on the firm foundation of reason. Gauthier's argument includes an account of value, linking it to preference and utility; a discussion of the curcumstances in which morality is unnecessary; and an application of morals by agreement to relations between peoples at different levels of development and different generations. Finally, he reflects on the assumptions about individuality and community made by his account of rationality and morality. (shrink)

Should the current members of a community compensate the victims of their ancestor’s emissions of greenhouse gases? I argue that the previous generation of polluters may not have been morally responsible for the harms they caused.I also accept the view that the polluters’ descendants cannot be morally responsible for their ancestor’s harmful emissions. However, I show that, while granting this, a suitably defined notion of moral free-riding may still account for the moral obligation of the polluters’ descendants to compensate the (...) current victims of their ancestors’ actions. A concept of transgenerational free-riding is defined. Objections to the idea of using free-riding as part of a theory of justice are rejected. Two different views of moral free-riding are contrasted, with consequences for the amount of compensation to be exigible from the polluters’ descendants. Some final considerations are devoted to the possible relevance of this free-riding-based view for other issues of historical injustice. (shrink)

In this article, we explore the implications of a Rawlsian theory for intergenerational issues. First, we confront Rawls's way of locating his `just savings' principle in his Theory of Justice with an alternative way of doing so. We argue that both sides of his intergenerational principle, as they apply to the accumulation phase and the steady-state stage, can be dealt with on the bases, respectively, of the principle of equal liberty (and its priority) and of the difference principle. We then (...) proceed by focusing on the implications of applying maximin to his steady-state stage. One central claim is that, in principle, Rawlsians should consider not only generational dissavings, but also generational savings, as unfair. This principle suffers a series of exceptions on which we focus in the fourth section of the article. In some cases, growth can be maximin compatible. (shrink)

Est-il moralement acceptable de transmettre aux générations futures des déchets nucléaires ou une biodiversité réduite à une peau de chagrin ? Les personnes futures sauraient-elles être titulaires de droits alors qu'elles n'existent pas ? Est-il juste de revoir à la baisse le montant des retraites pour lesquelles des pensionnés ont cotisé toute leur vie ou de transférer aux générations à venir une dette publique considérable ? Chacune de ces questions a trait à différents domaines de notre existence. Pourtant, un fil (...) rouge les relie : celui de la justice entre les générations. Brûlantes d'actualité, ces interrogations se voient bien souvent offrir pour seule réponse le dénuement relatif de nos théories. Ainsi, des concepts comme ceux de " droit acquis " en matière de pensions ou de " développement durable " ne sauraient faire office d'arguments s'ils ne s'appuient pas sur un solide arrière-fond théorique issu de la philosophie morale et politique. Car l'économie publique ou la biologie des populations ne peuvent suffire à aiguiller les citoyens et leurs représentants sur les choix qui leur incombent en matière intergénérationnelle. La philosophie a aussi son rôle à jouer, à la condition qu'elle ait la modestie d'être à l'écoute d'autres disciplines, l'exigence d'articuler clairement ses présupposés, et le courage de se frotter à la pratique [4ème de couverture ]. Libertarian justice arguably permits much that is harsh. It might plausibly be thought to generate only minimal obligations on the part of present people toward future generations. This turns out not to be so, at least on Nozick's version of libertarian justice, which is among the most thoroughly worked-out versions. Nozickian justice generates extensive obligations to future people. This provides an indirect argument for environmentalist policies such as resource conservation and wilderness preservation. The basis for these obligations is Nozick's use (...) of Locke's proviso, which is spelled out using the notion of the baseline. This paper explains how the extensive obligations are implied by the core ideas of Nozickian justice. There is also a discussion of some of the difficulties involved in understanding the notion of the baseline. However, these difficulties do not destroy the theoretical basis for obligations to future generations contained within Nozickian justice. Provided that libertarian justice involves some such device as Locke's proviso the enforcement of substantial environmentalist policies comes within the ambit of the libertarian minimal state.
