The concept of dignity is pervasive in bioethics. However, some bioethicists have argued that it is useless on three grounds: that it is indeterminate; that it is reactionary; and that it is redundant. In response, a number of defences of dignity have recently emerged. All of these defences claim that when dignity is suitably clarified, it can be of great use in helping us tackle bioethical controversies. This paper rejects such defences of dignity. It outlines the four most plausible conceptions (...) of dignity: dignity as virtuous behaviour; dignity as inherent moral worth; Kantian dignity; and dignity as species integrity. It argues that while each conception is coherent, each is also fundamentally flawed. As such, the paper argues for a bioethics without dignity: an 'undignified bioethics.'. (shrink)

Human attitudes to animals have changed as non-humans have become more widely incorporated in the category of moral agents who deserve some respect. Parallels between the functioning of humans and non-humans have been made for thousands of years but the idea that the animals that we keep can suffer has spread recently. An improved understanding of motivation, cognition and the complexity of social behaviour in animals has led in the last 30 years to the rapid development of animal welfare science. (...) Early attempts to define welfare referred to individuals being in harmony with nature but the first usable definition incorporated feelings and health as part of attempts to cope with the environment. Others considered that welfare is only about feelings but it is argued that as feelings are mechanisms that have evolved they are a part of welfare rather than all of it. Most reviews of welfare now start with listing the needs of the animal, including needs to show certain behaviours. This approach has used sophisticated studies of what is important to animals and has replaced the earlier general guidelines described as freedoms. Many measures of welfare are now used and indicate how good or how poor the welfare is. Naturalness is not a part of the definition of welfare but explains why some needs exist. In recent years, welfare has become established as one of various criteria used to decide on whether a system is sustainable because members of the public will not accept systems that cause poor welfare. The study of welfare has become part of the scientific basis upon which important political decisions are made. (shrink)

Gifford Pinchot, the first official U.S. Forester, wrote: “There are just two things on this material earth—people and natural resources.” This philosophy apparently implies that all things other than people have only instrumental value. Environmentalists, even professional foresters, today believe that Gifford Pinchot’s system of forest management is both theoretically and practically inadequate. A difficult, and central, problem in the theory of environmental management is therefore to characterize exactly how Pinchot went wrong. If we knew that, we would be well (...) on our way to formulating a new theory of management, one that would be more adequate to the complexities of today’s environmental problems. (shrink)

I contrast two roles for environmental philosophers—“applied philosophy” and “practical philosophy”—and show that the strategy of applied philosophy encourages an axiological and monistic approach to theory building. I argue that the mission of applied philosophy, and the monistic theory defended by J. Baird Callicott, in particular, tends to separate philosophers and their problems from real management issues because applied philosophers and moral monists insist that theoretical exploration occurs independent of, and prior to, applications in particular situations. This separation of theory (...) and practice suggests that philosophers are likely to be effective in policy discussions only to the degree that they can offer unquestioned theories that adjudicate real problems. Callicott offers his monistic, ontological approach as universal guidance to environmental activists and decision makers, arguing that ecosystems and communities are moral subjects that can “own” their own inherent value. Callicott’s theory, however, faces a crucial, unanswered theoretical dilemma which illustrates the impossibility of the dual task Callicott has set for his theory—to provide a single, ontological unification of ethics under nonanthropocentric holism and to capture the fine nuances of ethical obligations as experienced in varied communities. I also show that monistic assumptions have led to an unfortunate interpretation ofAldo Leopold’s land ethic and that a pluralist and pragmatist direction is likely to provide a more efficacious and theoretically defensible direction for further study of environmental philosophy in a more practical mode. This article argues that it is not necessary to abolish all incidents of animal ownership in order to achieve justice for them. It claims that ownership does not grant owners a right to absolute control of their property. Rather, it argues that ownership is a much more qualified concept, conveying different rights in different contexts. With this understanding of ownership in mind, the article argues that it is possible for humans to own animals and at the same time to treat (...) them justly: to recognize that they possess moral status; to assign them meaningful rights; and to consider their interests equally. Conventional wisdom suggests that environmental pragmatists balk at the mere mention of intrinsic value. Indeed, the leading expositor of the pragmatic position in environmental philosophy, Bryan Norton, has delivered withering criticisms of the concept as it has been employed by nonanthropocentrists in the field. Nevertheless, I believe that Norton has left an opening for a recognition of intrinsic value in his arguments, albeit a version that bears little resemblance to most of its traditional incarnations. Drawing from John Dewey’s contextual approach (...) toward moral inquiry, I offer a reconstructed notion of intrinsic value that avoids the metaphysical pitfalls identified by Norton. I argue that this contextual understanding of noninstrumental claims has the advantage of turning our attention toward, and not away from, the critical realm of practice and policy, and that it is especially compatible with the norms of democratic deliberation. By way of example and in defense of my position, I conclude with a rejoinder to Holmes Rolston’s claims about the role of foundational intrinsic value commitments in settling the human-nature dilemma at Royal Chitwan National Park in Nepal. What does American pragmatism contribute to contemporary debates about human-animal relationships? Does it acknowledge our connections to all living things? Does it bring us closer to an ethical treatment of all animals?

When animal ethicists deal with welfare they seem to face a dilemma: On the one hand, they recognize the necessity of welfare concepts for their ethical approaches. On the other hand, many animal ethicists do not want to be considered reformist welfarists. Moreover, animal welfare scientists may feel pressed by moral demands for a fundamental change in our attitude towards animals. The analysis of this conflict from the perspective of animal ethics shows that animal welfare science and animal ethics highly (...) depend on each other. Welfare concepts are indispensable in the whole field of animal ethics. Evidence for this can be found by analyzing the structure of theories of animal ethics and the different ways in which these theories employ welfare concepts. Furthermore, the background of values underneath every welfare theory is essential to pursue animal welfare science. Animal ethics can make important contributions to the clarification of underlying normative assumptions with regard to the value of the animal, with regard to ideas about what is valuable for the animal, and with regard to the actions that should follow from the results of animal welfare science. In Anglo-American society, virtually every moral theory of any note, including any plausible form of utilitarianism, places great stress upon autonomy, treats it as intimately bound up with morality, and regards it as of considerable moral significance to normal adult humans and to the value of their lives. In these respects, Kantianisms, contracturalisms, rightstheories, and utilitarianisms are very alike. They are also alike in that their emphasis upon autonomy inevitably sets up fully autonomous beings as something of a special or (...) privileged class, against which the lives of nonautonomous beings, such as infants, the very severely mentally-enfeebled, the seriously brain-damaged, the irreversibly comatose, and animals are viewed and their value assessed. The attempts theorists of all stripes make to squeeze as many beings as possible into the autonomous class illustrate the special or privileged caracter of that class in our moral thinking. (shrink)

Over the last years, Norway has revised its animal welfare legislation. As of January 1, 2010, the Animal Protection Act of 1974 was replaced by a new Animal Welfare Act. This paper describes the developments in the normative structures from the old to the new act, as well as the main traits of the corresponding implementation and governance system. In the Animal Protection Act, the basic animal ethics principles were to avoid suffering, treat animals well, and consider their natural needs (...) and instincts. In addition, a principle for balancing our duties towards animals with the needs and interests of humans was expressed by the formulation unnecessary suffering. These principles (only with slightly different formulations) are retained in the new act. The novelty of the new act is shown by its explicit intention to promote respect for animals and its recognition of animals’ intrinsic value. Whereas intrinsic value is only given a symbolic function, the notion of respect is intended to have practical consequences. One interpretation of respect for animals is taking the animal’s integrity—and not only welfare—into account. Another is to see the introduction of respect as a call to animal keepers to provide animals with welfare exceeding the minimum requirements. In several respects, the legal system now seems to leave more responsibility to the individual animal keeper—and to citizens in general. I argue that if the authorities really do want to promote respect for animals, they must at the same time initiate activities to achieve this. In my perspective the challenge is to provide adequate measures to achieve in practice the intended respect for animals expressed in the new act. (shrink)

Animal ethics has tended to follow an analytical approach and has focused much attention on moral reason and theory. Recently, some have argued this to be a fundamental problem. The 'paradigmatic account' claims that instead of reason and theory, ethics ought to emphasize common paradigms and meanings. Since these paradigms and meanings tend to be anthropocentric, the pro-animal arguments presented within animal ethics ought to be viewed critically. The paper explores two variants of this account: anthropocentric casuistry and the Wittgensteinian (...) approach. It is maintained that, although the importance of paradigms and meanings ought to be recognized, both of these approaches face severe difficulties that make them, without further development, an unfruitful basis for ethics concerning non-human animals. The continuing existence of zoos and their good purposes such as conservation, science, education, and recreation, can be ethically justified only if zoos guarantee the welfare of their animals. The usual criteria for measuring animal welfare in zoos are physical health, long life, and reproduction. This paper looks at these criteria and finds them insufficient. Additional criteria are submitted to expand the range of welfare considerations: natural and abnormal behavior; freedom and choice; and dignity. All these criteria should play a (...) role in analyzing zoo animal welfare and interests but dignity has the overriding part because it impacts on both animal and human interests. (shrink)

By giving sympathy a central role, Adam Smith’s Theory of Moral Sentiments (1759) can be regarded as one of the ‘enlightened’ moral theories of the Enlightenment, insofar as it widened the scope of moral consideration beyond the traditionally restricted boundary of human beings. This, although the author himself does not seem to have been aware of this fact. In this paper, I want to focus on two aspects which I think lead to this conclusion. First, by making sentience the requisite (...) to be taken into moral consideration, nonhuman animals in Smith’s moral theory can count as moral patients towards whom we should exercise the virtue of beneficence (if not justice). Secondly, Smith’s idea of morality as working in concentric circles –generating more stringent duties towards those closer to us– could explain and perhaps also justify our caring for some nonhuman animals, especially pets.
