The history of the regulation of animal research is essentially the history of the emergence of meaningful social ethics for animals in society. Initially, animal ethics concerned itself solely with cruelty, but this was seen as inadequate to late 20th-century concerns about animal use. The new social ethic for animals was quite different, and its conceptual bases are explored in this paper. The Animal Welfare Act of 1966 represented a very minimal and in many ways incoherent attempt to regulate animal (...) research, and is far from morally adequate. The 1985 amendments did much to render coherent the ethic for laboratory animals, but these standards were still inadequate in many ways, as enumerated here. The philosophy underlying these laws is explained, their main provisions are explored, and future directions that could move the ethic forward and further rationalize the laws are sketched. (shrink)
We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. The Supreme Court, Bronx County, declined to grant habeas corpus relief and order Happy’s transfer to an elephant sanctuary, relying, in part, on previous decisions that denied habeas relief for the NhRP’s chimpanzee clients, Kiko and Tommy. Those decisions use incompatible conceptions of ‘person’ which, when properly understood, are either philosophically inadequate or, in fact, compatible with Happy’s personhood.
In this brief, we argue that there is a diversity of ways in which humans (Homo sapiens) are ‘persons’ and there are no non-arbitrary conceptions of ‘personhood’ that can include all humans and exclude all nonhuman animals. To do so we describe and assess the four most prominent conceptions of ‘personhood’ that can be found in the rulings concerning Kiko and Tommy, with particular focus on the most recent decision, Nonhuman Rights Project, Inc v Lavery.
Bernard Williams thought that philosophy should address real human concerns felt beyond academic philosophy. But what wider concerns are addressed by Ethics and the Limits of Philosophy, a book he introduces as being ‘principally about how things are in moral philosophy’? In this article, we argue that Williams responded to the concerns of his day indirectly, refraining from explicitly claiming wider cultural relevance, but hinting at it in the pair of epigraphs that opens the main text. This was Williams’s (...) solution to what he perceived as the stylistic problem of how to pursue philosophy as cultural critique. Taking the epigraphs as interpretative keys to the wider resonances of the book, we show how they reveal Williams’s philosophical concerns – with the primacy of character over method, the obligation to follow orders, and the possibility of combining truth, truthfulness, and a meaningful life in a disillusioned world – to be recognisably rooted in the cultural concerns of post-war Britain. In the light of its epigraphs, the book emerges as the critique of a philosophical tradition’s inadequacies to the special difficulties of its cultural moment. (shrink)

Artykuł, opublikowany po raz pierwszy w 1979 r., jest jednym z najczęściej cytowanych tekstów filozoficznych z drugiej połowy XX wieku. Tekst Bernarda Williamsa zainicjował kilka ważnych debat, toczących się do dziś w etyce i filozofii działania. Zaproponowana przez niego interpretacja pojęcia racji działania jest, z jednej strony, niezwykle wpływowa, ale z drugiej bardzo niejednoznaczna i często krytykowana. Williams broni stanowiska, które z czasem zaczęto określać jako internalizm racji: pewne względy są racjami działania dla danego podmiotu tylko wtedy, gdy mają ścisły (...) związek z "subiektywnym układem motywacyjnym" tego podmiotu, czyli z jakimiś aspektami jego psychiki, charakteru, celów, pragnień, planów, relacji z innymi itd. Stwierdzenie, że ktoś ma rację, by coś zrobić (a jeśli uznajemy, że jest to racja przeważająca - to, że powinien to coś zrobić), znaczy więc wedle tego stanowiska tyle, że ten ktoś jest w stanie być motywowany, by to coś zrobić. W przeciwieństwie do tego stanowisko określane obecnie ako eksternalizm racji głosi, że pewne względy mogą być racjami działania dla danego podmiotu także wtedy, gdy odwołują się do niezależnych od jego układu motywacyjnego własności świata. Williams wychodzi od modelu działania nawiązującego do koncepcji Hume'owskiej, następnie przedstawia jego bardziej rozbudowaną wersję, omawia rolę namysłu, naturę potrzeb, a także przedstawia argument za internalizmem racji, określany jako argument z wyjaśniania działania. Głosi on, że nawet gdyby istniały zewnętrzne racje działania, niezwiązane z subiektywnym układem motywacyjnym danego podmiotu, to odwołanie się do nich nie byłoby w stanie wyjaśnić, dlaczego dany podmiot postąpił tak, a nie inaczej, gdyż "nic nie jest w stanie wyjaśnić (zamierzonych) działań podmiotu za wyjątkiem czegoś, co motywuje go działania". I explore what BernardWilliams means by regarding one’s action ‘purely externally, as one might regard anyone else’s action’, and how it links to regret and agent-regret. I suggest some ways that we might understand the external view: as a failure to recognize what one has done, in terms of Williams’s distinction between intrinsic and extrinsic luck, and as akin to Thomas Nagel’s distinction between an internal and external view. I argue that none of these captures what Williams was getting at (...) because they do not allow one to take a view on one’s action. I offer two alternative accounts. One turns around what we identify with, the other concerns what we care about. Both accounts capture how I might regret, rather than agent-regret, my own action. I demonstrate that these accounts can explain the relationship between an insurance payout and the external view, and they can explain the agent-relativity of agent-regret. (shrink)
When Bernard Williams died in June 2003, the obituary in The Times said that “he will be remembered as the most brilliant and most important British moral philosopher of his time”. It goes on to make clear that Williams was far from the dry, awkward, detached academic philosopher of caricature. -/- Born in Essex in 1929, Williams had an extraordinary and, in some respects, glamorous life. He not only enjoyed a stellar academic career – holding a series of distinguished (...) posts at Oxford, UCL, Cambridge and Berkeley – but was also a public figure in British political and cultural life. He played, for example, a leading role in several high profile government committees and reports, and served for almost two decades on the board of the English National Opera. He had, moreover, an easy confidence and charm, a lucidity of expression, and a sharp and, at times, acerbic wit (which could alarm both friends and foes alike). -/- Although these achievements and qualities are impressive, what he will be remembered for chiefly is his significant contribution to philosophy, which spanned a wide spectrum of topics. It is in the field of ethics, in particular, that his contributions are of the most lasting importance. And yet there is a real sense in which he remains a rather enigmatic figure – and the interpretation of his work continues to be a matter of considerable debate.... (shrink)
Judgment subjectivism is the view that x is good for S if and only if, because, and to the extent that S believes, under the proper conditions, that x is good for S. In this paper, I offer three related arguments against the theory. The arguments are about what judgment subjectivism implies about the well-being of welfare nihilists, people who believe there are no welfare properties, or at least that none are instantiated. I maintain that welfare nihilists can be benefited (...) and harmed. Judgment subjectivism is implausible because it implies otherwise. (shrink)
It is argued that physics must eventually expand to accommodate mind and consciousness but that this will require a new paradigm. The paradigm required will impinge on two problems on the borders of physics and philosophy: the relationship between physical space and perceptual space and the nature of the passage of time. It is argued that the resolution of both these problems may involve a 5-dimensional model, with the 5th dimension being associated with mental time, and this proposal may relate (...) to recent developments in brane cosmology. A description of consciousness must also entail a proper understanding of the specious present, the minimum timescale of conscious experience, this possibly being associated with a compactified extra dimension. Ethics education in post-graduate philosophy departments and professional schools involves disciplinary knowledge and textual analysis but is mostly unconcerned with the ethical lives of students. Ethics or values education below college aims at shaping students’ ethical beliefs and conduct but lacks philosophical depth and methods of value inquiry. The «values transmission» approach to values education does not provide the opportunity for students to express doubt or criticism of the proffered values, or to practice ethical inquiry. The «inquiry» approach to values (...) education recognizes the need and the capacity of young people to grapple with moral ambiguity and pluralism, to confront their own moral doubts, to criticize conventional norms and to engage in ethical inquiry. Values clarification, critical thinking and Philosophy for Children are inquiry approaches to values education, with important differences. Five wisdom practices common among early Greek and Roman philosophical schools should inform ethics education at all levels. First, philosophy was understood as the disciplined study and practice of living well. Second, knowledge and discursive thinking played a limited role in relation to the life worth living. Third, these schools taught certain contemplative or «spiritual» exercises, including meditation, examination of one’s conscience, fraternal correction, contemplation of the cosmos, practicing present-moment awareness and reflection on death. Fourth, many of these schools established philosophical communities that practiced collaborative research, dialogue, mutual correction, and the cultivation of philosophical friendship. Fifth, the primary aim of intellectual and contemplative practices in these schools was self-transformation, from states of confusion, restlessness, egotism, and craving, to states of temperance, compassion, and tranquility. Advocates of the use of intuitions in philosophy argue that they are treated as evidence because they are evidential. Their opponents agree that they are treated as evidence, but argue that they should not be so used, since they are the wrong kinds of things. In contrast to both, we argue that, despite appearances, intuitions are not treated as evidence in philosophy whether or not they should be. Our positive account is that intuitions are a subclass of inclinations to believe. (...) Our thesis explains why intuitions play a role in persuasion and inquiry, without conceding that they are evidential. The account also makes predictions about the structure of intuitions that are confirmed by independent arguments. (shrink)
Authors from Cicero to Smith held honor to be indispensable to make people see and do what is right. As they considered honor to be a social motive, they did not think this dependence on honor was a problem. Today, we tend to see honor as a self‐regarding motive, but do not see this as problematic because we stopped seeing it as a necessary incentive. Bernard Mandeville, however, agreed with the older authors that honor is indispensable, but agreed with (...) us moderns that it is a self‐interested motive. Honor might be necessary to keep society functioning, but that does not make it less self‐serving. Mandeville thus combined the classical preoccupation with honor and the modern view of man as self‐seeking. That our motivations are self‐serving is something we wish to hide from others and ourselves; society benefits because we generally behave well in order to live up to this inflated (self‐)image. Hypocrisy is the price we pay for living together peacefully. It is this sobering view on honor that sets Mandeville apart from later authors on the subject, particularly David Hume and Adam Smith. We develop an approach to the problem of de se belief usually expressed with the question, what does the shopper with the leaky sugar bag have to learn to know that s/he is the one making the mess. Where one might have thought that some special kind of “de se” belief explains the triggering of action, we maintain that this gets the order of explanation wrong. We sketch a very simple cognitive architecture that yields de se-like behavior on which the (...) action-triggering functionality of the belief-state is what counts it as de se rather than some prior property of being “de se” explaining the triggering of action. This functionality shows that action-triggering change in belief-state also undergirds a correlative change in the objective involved in the triggered action. This model is far too simple to have any claim to showing how the de se works for humans, but it shows, by illustration, that nothing mysteriously “subjective”” need be involved in this aspect of self-conception. While our exposition is very different from those of Perry and Recanati, all three of us are developing the same kind of view. (shrink)
This paper develops Bernard Williams’s suggestion that for philosophy to ignore its history is for it to assume that its history is vindicatory. The paper aims to offer a fruitful line of inquiry into the question whether philosophy has a vindicatory history by providing a map of possible answers to it. It first distinguishes three types of history: the history of discovery, the history of progress, and the history of change. It then suggests that much of philosophy lacks a (...) vindicatory history, for reasons that reflect philosophy’s character as a humanistic discipline. On this basis, the paper reconstructs Williams’s conception of what it means for philosophy to engage with its own history. The paper concludes that it is a mistake to think that a vindicatory history is what we would really like to have, and that in fact, the resulting picture gives philosophy several reasons to engage with its own history. Levi ben Gerson was a medieval astronomer who responded in an unusual way to the Ptolemaic tradition. He significantly modified Ptolemy’s lunar and planetary theories, in part by appealing to physical reasoning. Moreover, he depended on his own observations, with instruments he invented, rather than on observations he found in literary sources. As a result of his close attention to the variation in apparent planetary sizes, a subject entirely absent from the Almagest, he discovered a new phenomenon of Mars and (...) noticed a serious flaw in Ptolemy’s treatment of the Moon. In this paper, I ask whether mishpat ivri (Jewish Law) is appropriately conceived as a “legal system”. I review Menachem Elon’s use of a “Sources” Theory of Law (based on Salmond) in his account of Mishpat Ivri; the status of religious law from the viewpoint of jurisprudence itself (Bentham, Austin and Kelsen); then the use of sources (and the approach to “dogmatic error”) by halakhic authorities in discussing the problems of the agunah (“chained wife”), which I suggest points to a (...) theory more radical than the “sources” theory of law, one more akin to the ultimate phase of the thought of Kelsen (the “non-logical” Kelsen) or indeed to some form of Legal Realism (with which that phase of Kelsen’s thought has indeed been compared)? I believe that as a teacher I must provide high quality content for my students. And all these should be available for free online so that bright students globally can choose which editions of a seminal text they can study. In every UG, PG examination, one is asked about the importance of the title of Shaw's play. In this paper I have illustrated by my own reading how one should and can approach the play. For scholars, my annotations referring to (...) John of Patmos may be interesting. I have deposited this paper here since I have shown the deep multiple philosophical mooring which Shaw affords but often even a discerning reader misses. (shrink)
To help clarify the concept of «teaching practice», this article analyzes a repository of professional skills of the teacher. It then examines how two groups of teacher educators attempting to use this repository to evaluate two teaching sessions (one secondary and one primary). Analyses revealed the difficulty in assessing a session from elements determined a priori from a list of skills. The evaluation of a teaching session seems to require the inclusion of its organic whole. Afin de contribuer à préciser (...) la notion de « pratique enseignante », le présent article analyse un référentiel de compétences professionnelles de l’enseignant. Il examine ensuite la manière dont deux groupes de formateurs d’enseignants tentent d’utiliser ce référentiel pour évaluer deux séances d’enseignement (une dans le secondaire et une dans le primaire). Les analyses révèlent la difficulté à évaluer une séance à partir d’éléments déterminés a priori dans une liste de compétences. L’évaluation d’une séance d’enseignement semble requérir la prise en compte de sa totalité organique. (shrink)
This research discusses Bernard Williams' critique of utilitarianism. I will address Williams' well-known “Integrity Objection” and clarify where his main issue with utilitarianism lies. Through this, I will demonstrate that the separation of the two viewpoints – the “inside viewpoint” and the “impartial viewpoint” - is the issue, as the utilitarian impartial viewpoint does not capture the value of ethical deliberations based on our inside viewpoint in which we presuppose our personal projects. Furthermore, I will argue that this interpretation (...) enables us to place the objection in the context of the critique of impartiality which is one of the central themes of Williams’ ethics. The authors describe the organization of a review of research literature on the relationship between Philosophy for/with Children (P4/wC) and religious education/education for spirituality (RE-EfS). They summarize a debate about whether the two are mutually enhancing or incompatible. They explain delimiting the scope of the project and present a grid of research questions used to analyze the literature. They summarize findings on how P4/wC is relevant to five categories of aims of RE-EfS: hermeneutical, cultural, socio-political, moral/spiritual, and epistemological. Many papers (...) in the latter category promote P4/wC as a method for children’s epistemic agency in constructing their religious beliefs. Some respond to objections that children may reject traditional beliefs. Few address potential confusion and angst of children asked to question and defend their religious views. The authors conclude that the pragmatic thrust of P4/wC in resisting a dichotomy between religious and scientific thinking is a value to post-secular society. (shrink)

Dopo aver esaminato le sue critiche all’idea di teoria etica normativa, offro un inquadramento metaetico della sua posizione e concludo mostrando le sue affinità con la riflessione etica degli antichi Greci e, in particolar modo, di Aristotele.
Bernard Williams’ books demand an unusual amount of work from readers. This is particularly true of his 1985 magnum opus, Ethics and the Limits of Philosophy—a work so charged with ideas that there seems to be nothing more to say, and yet at the same time so pared-down and tersely argued that there seems to be nothing left to take away. Reflecting on the book five years after its publication, Williams writes that it is centrally concerned with a Nietzschean (...) question: the question of philosophy’s authority, in particular when it comes to telling us how to live. Some ethical theories seem implicitly committed to the idea that philosophy has everything to tell us about how to live. This Williams rejects. But the question then is how much philosophy has to tell us, and as critical as Williams may be of philosophy’s ambitions in this regard, his answer is certainly not nothing. The book even suggests some things that philosophy might say. But what Williams emphatically insists on, both in the book and in his later reflection on it, is that the question needs to be taken more seriously than it has been. (shrink)

This article relates the ideas of Stanisław Brzozowski (1878-1911) with those of Bernard Stiegler (1952-2020), both of whom problematize the "work" of art understood as a labor practice. Through the conceptual analysis of epigenetics and epiphylogenetics for aesthetic theory, I claim that both thinkers develop practical concepts relevant to contemporary art philosophy. First, I present an overview of Brzozowski's aesthetics, for whom literature and the arts are linked with ethics, and aesthetic form is tied with moral judgment. Then, I (...) continue with an outline of Stiegler's, for whom the role of artists is to sculpt a new culture and historical epoch called the Neganthropocene. Finally, the notion of "work" as a type of memory practice is analyzed. The comparison shows that Stiegler develops epigenetics phenomenologically via memory ("tertiary retentions") and phylogenetics to epiphylogenetics. Both philosophers argue against determinism. This study suggests that their key ideas advance and complement each other. (shrink)
Abstract In light of the complexity of unfolding disasters, the diversity of rapidly evolving events, the enormous amount of generated information, and the huge pool of casualties, emergency responders (ERs) may be overwhelmed and in consequence poor decisions may be made. In fact, the possibility of transporting the wounded victims to one of several hospitals and the dynamic changes in healthcare resource availability make the decision process more complex. To tackle this problem, we propose a multicriteria decision support service, based (...) on the Analytic Hierarchy Process (AHP) method, that aims to avoid overcrowding and outpacing the capacity of a hospital to effectively provide the best care to victims by finding out the most appropriate hospital that meets the victims’ needs. The proposed approach searches for the most appropriate healthcare institution that can effectively deal with the victims’ needs by considering the availability of the needed resources in the hospital, the victim’s wait time to receive the healthcare, and the transfer time that represents the hospital proximity to the disaster site. The evaluation and validation results showed that the assignment of hospitals was done successfully considering the needs of each victim and without overwhelming any single hospital. (shrink)
Ontology is one strategy for promoting interoperability of heterogeneous data through consistent tagging. An ontology is a controlled structured vocabulary consisting of general terms (such as “cell” or “image” or “tissue” or “microscope”) that form the basis for such tagging. These terms are designed to represent the types of entities in the domain of reality that the ontology has been devised to capture; the terms are provided with logical defi nitions thereby also supporting reasoning over the tagged data. Aim: This (...) paper provides a survey of the biomedical imaging ontologies that have been developed thus far. It outlines the challenges, particularly faced by ontologies in the fields of histopathological imaging and image analysis, and suggests a strategy for addressing these challenges in the example domain of quantitative histopathology imaging. The ultimate goal is to support the multiscale understanding of disease that comes from using interoperable ontologies to integrate imaging data with clinical and genomics data. (shrink)
Disaster response is a highly collaborative and critical process that requires the involvement of multiple emergency responders (ERs), ideally working together under a unified command, to enable a rapid and effective operational response. Following the 9/11 and 11/13 terrorist attacks and the devastation of hurricanes Katrina and Rita, it is apparent that inadequate communication and a lack of interoperability among the ERs engaged on-site can adversely affect disaster response efforts. Within this context, we present a scenario-based terrorism case study to (...) highlight the challenges of operational disaster command and response. In this article, which is based on the French emergency response doctrine, we outline a semantics-based common operational command system that is designed to guarantee an efficient information flow among ERs. Our focus is on offering to all ERs, a real-time operational picture of the situation in order to enable multilevel coordination among firefighters, police, healthcare units, public authorities, and other stakeholders. Our approach consolidates information to promote timely sharing of data among ERs. The proposed system is based on an ontology that has been developed to represent the different types of knowledge on the part of ERs, providing a shared vocabulary that covers a variety of interoperability concerns. Moral luck is an important issue in meta- ethics. Its conflict to principle of control make challenges to moral moral assessment, moral judgment and moral responsibility. Bernard Williams is the first philosopher who uses the expression "moral luck" and tries to show that the contradiction between “moral” and “luck” is not so serious. Against Kantian’s idea and also our intuitions Williams doesn’t believe that morality is immune of luck and that unlike other values, is accessible to all people. If (...) moral value is accessible to all, according to his idea, it should be not only immune of luck but also supreme. Giving some examples, Williams by concepts like justification, regret and retrospective, shows that morality hasn’t these characteristics. Dividing moral luck into four types: resultant, circumstantial, constitutive and causal, Thomas Nagel puts Williams' moral luck under the first type and criticizes it. This study seeks to explain Bernard Williams’ viewpoint on moral luck. At first it clears types of moral luck, principle of control and its contradiction with moral luck, then after explaining Williams’ account of moral luck criticizes it. Nagel’s criticisms and others show that although they accept the existence of moral luck and also their account is compatible to williams’ but they deny williams’ success in defending of this phenomenon. Finally, despite of all critiques, it seems that Williams’ failure in defense of moral luck didn’t decrease the importance of this matter, but made some stronger ideas were appeared by Thomas Nagel in this regard. In order to improve our understanding of the components that reflect functionally important processes during reward anticipation and consumption, we used principle components analyses (PCA) to separate and quantify averaged ERP data obtained from each stage of a modified monetary incentive delay (MID) task. Although a small number of recent ERP studies have reported that reward and loss cues potentiate ERPs during anticipation, action preparation, and consummatory stages of reward processing, these findings are inconsistent due to temporal and spatial overlap (...) between the relevant electrophysiological components. Our results show three components following cue presentation are sensitive to incentive cues (N1, P3a, P3b). In contrast to previous research, reward‐related enhancement occurred only in the P3b, with earlier components more sensitive to break‐even and loss cues. During feedback anticipation, we observed a lateralized centroparietal negativity that was sensitive to response hand but not cue type. We also show that use of PCA on ERPs reflecting reward consumption successfully separates the reward positivity from the independently modulated feedback‐P3. Last, we observe for the first time a new reward consumption component: a late negativity distributed over the left frontal pole. This component appears to be sensitive to response hand, especially in the context of monetary gain. These results illustrate that the time course and sensitivities of electrophysiological activity that follows incentive cues do not follow a simple heuristic in which reward incentive cues produce enhanced activity at all stages and substages. In this paper, I will examine Bernard Williams' critique of the Morality System and defend it from a repeated objection by showing my reading of Williams. According to this reading, the Morality System is an alienated ethics: it has certain idiosyncrasies which ordinary ethics lacks.
In the management of biomedical data, vocabularies such as ontologies and terminologies (O/Ts) are used for (i) domain knowledge representation and (ii) interoperability. The knowledge representation role supports the automated reasoning on, and analysis of, data annotated with O/Ts. At an interoperability level, the use of a communal vocabulary standard for a particular domain is essential for large data repositories and information management systems to communicate consistently with one other. Consequently, the interoperability benefit of selecting a particular O/T as a (...) standard for data exchange purposes is often seen by the end-user as a function of the number of applications using that vocabulary (and, by extension, the size of the user base). Furthermore, the adoption of an O/T as an interoperability standard requires confidence in its stability and guaranteed continuity as a resource. (shrink)
In today’s society of humans and machines, automation, animation, and ecosystems are terms of concern. Categories of life and technology have become mixed in governmental policies and drive economic exploitation and the pathologies of everyday life. This book both curiously and critically advances the term that underlies these new developments: machine.
Four initial postulates are presented (with two more added later), which state that construction of the physical universe proceeds from a sequence of discrete steps or "projections" --- a process that yields a sequence of discrete levels (labeled 0, 1, 2, 3, 4). At or above level 2 the model yields a (3+1)-dimensional structure, which is interpreted as ordinary space and time. As a result, time does not exist below level 2 of the system, and thus the quantum of action, (...) h, which depends on time (since its unit is time•energy), also does not exist below level 2. This implies that the quantum of action is not fundamental, and thus e.g. that the physical universe cannot have originated from a quantum fluctuation. When the gravitational interaction for the model is developed, it is seen that the basic ingredient for gravity is already operating at level 1 of the system, which implies that gravity, too, is not fundamentally quantum mechanical (since, as stated, h only kicks in at level 2) --- perhaps obviating the need for a quantum theory of gravity. Further arguments along this line lead to the conclusion that quantum fluctuations cannot be a source of gravity, and thus cannot contribute to the cosmological constant --- thereby averting the cosmological constant problem. Along the way, the model also provides explanations for dark energy, the beginning and ending of inflation, quark confinement, and more. Although the model dethrones the quantum, it nevertheless elevates an idea in physics that was engendered by quantum mechanics: the necessary role of "observers" in constructing the world. (shrink)
