Most people believe that there are limits to the sacrifices that morality can demand. Although it would often be meritorious, we are not, in fact, morally required to do all that we can to promote overall good. What's more, most people also believe that certain types of acts are simply forbidden, morally off limits, even when necessary for promoting the overall good. In this provocative analysis Kagan maintains that despite the intuitive appeal of these views, they cannot be adequately defended. (...) What are virtue and vice, and how do they relate to other moral properties such as goodness and rightness? This book defends a perfectionist account of virtue and vice that gives distinctive answers to these questions. The account treats the virtues as higher‐level intrinsic goods, ones that involve morally appropriate attitudes to other, independent goods and evils. Virtue by itself makes a person's life better, but in a way that depends on the goodness of other things. This account was accepted (...) by many early twentieth‐ century consequentialists, including Franz Brentano, G. E. Moore, Hastings Rashdall, and W. D. Ross. The book elaborates it further than has been done before, describing its mathematical structure, connecting it to individual virtues and vices, and applying it to specific issues such as the morality of fantasy and the proper roles of private charity and the welfare state. This article argues that strong versions of the situationist critique of virtue ethics are empirically and conceptually unfounded, as well as that, even if one accepts that the predictive power of character may be limited, this is not a fatal problem for early Confucian virtue ethics. Early Confucianism has explicit strategies for strengthening and expanding character traits over time, as well as for managing a variety of situational forces. The article concludes by suggesting that Confucian virtue ethics represents a more (...) empirically responsible model of ethics than those currently dominant in Western philosophy. (shrink)

The predominant view of moral virtue can be traced back to Aristotle. He believed that moral virtue must involve intellectual excellence. To have moral virtue one must have practical wisdom - the ability to deliberate well and to see what is morally relevant in a given context. Julia Driver challenges this classical theory of virtue, arguing that it fails to take into account virtues which do seem to involve ignorance or epistemic defect. Some 'virtues of ignorance' are counterexamples to accounts (...) of virtue which hold that moral virtue must involve practical wisdom. Modesty, for example, is generally considered to be a virtue even though the modest person may be making an inaccurate assessment of his or her accomplishments. Driver argues that we should abandon the highly intellectualist view of virtue and instead adopt a consequentialist perspective which holds that virtue is simply a character trait which systematically produces good consequences. The contrast typically made between utilitarianism and virtue theory is overdrawn. Utilitarianism is a universal emulator: it implies that we should lie, cheat, steal, even appropriate Aristotle, when that is what brings about the best outcomes. In some cases and in some worlds it is best for us to focus as precisely as possible on individual acts. In other cases and worlds it is best for us to be concerned with character traits. Global environmental change leads to concerns about character (...) because the best results will be produced by generally uncoupling my behavior from that of others. Originally published in 1985 and now re-issued with a new preface, this study assesses the two major moral theories of ethical consequentialism and common-sense morality by means of mutual comparison and an attempt to elicit the implications and tendencies of each theory individually. The author shows that criticisms and defences of common-sense morality and of consequentialism give inadequate characterizations of the dispute between them and thus at best provide incomplete rationales for either of these influential moral views. Both theories face (...) inherent difficulties, some familiar but others mentioned for the first time in this work. One of the reasons why Kantian contractualism has been seen as an appealing alternative to utilitarianism is that it seems to be able to avoid utilitarianism's extreme demandingness, while retaining a fully impartial moral point of view. I argue that in the current state of the world, contractualist obligations to help those in need are not significantly less demanding than utilitarian obligations. I also argue that while a plausible version of utilitarianism would be considerably less demanding if the state of (...) the world were different, a central aspect of contractualism means that it would remain exceedingly demanding in any practically realizable state of the world. This article aims to make conceptual room for a view about political legitimacy called the power-liability account. The view claims that politi- cal legitimacy is a form of normative power that entails moral liability, but not necessarily a moral claim-right that entails moral duty. The power-liability account supports appealing interpretations of justified civil disobedience in the face of legitimate but unjust law at home and of justified human rights interventions that violate legitimate international law abroad. I argue here only for (...) the conceptual possibility of this view, not for its normative correctness. I believe that the power-liability view indeed is correct, but it often is thought that the view not only is false but also incoherent. Many hold that entailed duty and immunity are built into the meaning of the concept of political legitimacy. My task is to loosen these conceptual strictures. (shrink)

One familiar criticism of utilitarianism is that it is too demanding. It requires us to promote the happiness of others, even at the expense of our own projects, our integrity, or the welfare of our friends and family. Recently Ashford has defended utilitarianism, arguing that it provides compelling reasons for demanding duties to help the needy, and that other moral theories, notably contractualism, are committed to comparably stringent duties. In response, I argue that utilitarianism is even more demanding than is (...) commonly realized: both act- and rule-utilitarianism are committed to extremely stringent duties to wild animals. In this regard, utilitarianism is more demanding (and more counter-intuitive) than contractualism. (shrink)

Abstract 1 This paper makes a preliminary case for a central and radical claim. I begin with Bernard Williams? seldom-faced argument that integrity cannot be a moral virtue because it lacks two key ingredients of moral virtues, namely a characteristic thought and motivation. Whereas, for example, generosity involves the thought that another could use assistance, and the motivation to actually give assistance, integrity lacks these two things essential to morally excellent responses. I show that several maneuvers aimed at avoiding Williams? (...) challenge fail and that others are likely to remain unpersuasive. The paper concludes by offering an argument to the best explanation: Williams? important insight is best explained by the supposition that integrity is an epistemic virtue, and an epistemic virtue of a practical sort. Most accounts of integrity agree that the person of integrity must have a relatively stable sense of who he is, what is important to him, and the ability to stand by what is most important to him in the face of pressure to do otherwise. But does integrity place any constraints on the kind of principles that the person of integrity stands for? In response to several recent accounts of integrity, I argue that it is not enough that a person (...) stand for what he believes in, nor even that he is committed to and stands for what, in his best judgement, is morally right. In our web of moral concepts integrity is internally related to a host of virtues which exclude weakness of will and dogmatism, and presuppose trustworthiness. Integrity requires that the principles stood for must be those that a morally good, morally trustworthy agent would stand for, and that the agent himself is morally trustworthy. (shrink)

This article defends three interconnected premises that together demand for a new way of dealing with moral responsibility in developing and using technological artifacts. The first premise is that humans increasingly make use of dissociated technological delegation. Second, because technologies do not simply fulfill our actions, but rather mediate them, the initial aims alter and outcomes are often different from those intended. Third, since the outcomes are often unforeseen and unintended, we can no longer simply apply the traditional (modernist) models (...) for discussing moral responsibility. We need to reinterpret moral responsibility. A schematic layout of a model on Social Role-Responsibility that incorporates these three premises is presented to allow discussion of a new way of interpreting moral responsibility. (shrink)

I discuss Bernard Williams’ ‘integrity objection’ – his version of the demandingness objection to unreasonably demanding ‘extremist’ moral theories such as consequentialism – and argue that it is best understood as presupposing the internal reasons thesis. However, since the internal reasons thesis is questionable, so is Williams’ integrity objection. I propose an alternative way of bringing out the unreasonableness of extremism, based on the notion of the agent’s autonomy, and show how an objection to this proposal can be outflanked by (...) a strategy that also outflanks the ‘paradox of deontology.’. Most act‐utilitarians now reject the direct utilitarianism of Bentham. They do so because they are convinced of what I call the paradox of utilitarianism—the thought that one cannot maximize happiness if one is trying to maximize happiness. Instead, they adopt some form of indirect utilitarianism (IU), arguing that the optimal decision procedure may differ markedly from the criterion of rightness for actions. Here I distinguish between six different versions of indirect utilitarianism, arguing that the weaker versions of IU also fall (...) prey to the paradox of utilitarianism, while the stronger versions of IU violate an overwhelmingly plausible moral principle, the principle that one ought to V only if one can V intentionally. According to the moral standards most of us accept and live by, morality generally permits us to refrain from promoting the good of others and instead engage in non-harmful projects of our own choice. This aspect of so-called ‘ordinary morality’ has turned out to be very difficult to justify. Recently, though, various authors, including Bernard Williams and Samuel Scheffler, have proposed “Integrity Theories” that would vindicate this aspect of ordinary morality, at least in part. They are generated by treating as (...) a default some moral theory, like consequentialism, that demands that we do a great deal of good. The theory is then modified so as to make room for individuals to pursue the projects they value most deeply, and perhaps their trivial interests as well—i.e., so as to respect individual integrity. This paper presupposes that Integrity Theories are correct and that, for the reasons given by others, they can explain why morality should grant us agent-centered prerogatives to pursue our own projects and interests. The goal is to extend this work in two respects. First, it will be shown that previous authors have not paid sufficient attention to ordinary morality’s conflicting pronouncements about agent-centered prerogatives. Second, it is argued that Integrity Theories can vindicate those conflicting intuitions by positing a special kind of obligations, relievable obligations. (shrink)

Consequentialism is enticing, and yet it also seems overly demanding. As a result, many non-consequentialists try to explain why we aren’t required to maximize the good. One explanation is the Integrity Explanation: we aren’t required to maximize the good because morality must make room for us to pursue the projects we value most deeply. Some people hope that the Integrity Explanation will not just explain why consequentialism is false, but simultaneously vindicate the common-sense permission to generally refrain from promoting the (...) good of other people and instead spend our time on non-harmful actions of our choice. I argue that this hope is unrealistic, because if any version of the Integrity Explanation is correct, morality won’t contain broad permissions to refrain from promoting the good of others and do as we choose. Instead the basic structure of morality must be fundamentally different from what we usually take it to be. Our common-sense moral theories say that we take on responsibilities to others only in certain specific situations, but may otherwise engage in non-harmful actions of our choice. But if the Integrity Explanation is correct, then we are entitled to pursue our own interests to at least some extent, but unless we do, we come under obligations to maximize the good of others. Most moral theories purport to make claims upon agents, yet often it is not clear why those claims are ones that can be justifiably demanded of agents. In this paper, I develop a justification of moral requirements that explains why it is that morality makes legitimate claims on agents. This justification is grounded in the idea that there is an essential connection between morality and psychological well-being. I go on to suggest how, using this justification as a springboard, we might (...) be able to develop a viable theory of moral requirements that maintains the strict and demanding status we take to be distinctive of moral requirements, yet avoids worries of alienation. “That the imagination should be both free and yet of itself conformable to law, that is, that it should carry autonomy with it, is a contradiction.” So Kant writes to express as a paradox the epistemological problem that the feeling on which an aesthetic judgment is based must be free of the constraint provided by determinate concepts, for otherwise there will be no reason why it should be pleasurable, yet must also be subject to some kind of rule, for otherwise (...) the claim of universal validity which this judgment asserts will be irrational. And so understood, the remark is entirely rhetorical, for it is the express purpose of Kant’s main argument in the Critique of Aesthetic Judgment to show that this conception of the judgment of taste is coherent rather than contradictory. But taken from its intended context, the remark need not be rhetorical, for it can be seen as an expression of competing demands for aesthetic integrity, or demands for individual freedom and social agreement in the creation and reception of art which, unlike the two epistemological constraints on aesthetic judgment, cannot be simultaneously satisfied but which instead introduce a permanent source of instability into the history of art and taste. Indeed, it is even fitting that Kant’s remark has to be taken out of context to be given this interpretation, for although Kant lays the theoretical basis for such a picture of art history he also tries to suppress its consequence and to avert the destruction of the eighteenth-century ideal of aesthetic stability which is its inevitable outcome. Integrity is sometimes conceived in terms of the wholeness of the individual, such that persons who experience temptations or other sorts of inner conflicts, afflictions, or divisions of self would seem to lack integrity to a greater or lesser degree. I contrast this understanding of integrity—which I label psychological integrity —with a different conception which I call practical integrity . On the latter conception, persons can manifest integrity in spite of the various factors mentioned above, so long as they remain (...) true to their commitments in action and deliberation. Although psychological harmony is one feature reasonably associated with integrity, I suggest that practical integrity captures other features of character and action often (and reasonably) related to ascriptions of integrity. Practical integrity remains possible even for those who must confront, manage, and control factors that give rise to various kinds of inner conflict. (shrink)

When a person gives up an end of crucial importance to her in order to promote a moral aim, we regard her as having made a moral sacrifice. The paper analyzes these sacrifices in light of some of Bernard Williams’ objections to Kantian and Utilitarian accounts of them. Williams argues that an implausible consequence of these theories is that that we are expected to sacrifice projects that make our lives worth living and contribute to our integrity. Williams’ arguments about integrity (...) and meaning are shown to be unconvincing when the content of projects is left open. However, a look at his later arguments suggests a reason to be concerned about defensible ethical projects as understood through what he refers to as “the morality system”. The problem for theories of this type turns out to be not merely conflicts between ethical projects and moral demands but making sense of some of the ethically relevant features of these projects. Accommodations to moral theories that leave room for ethical projects may be insufficient to explain such features, for example in cases where agents demand more of themselves than the theories require. Making the theories more demanding is also problematic. Williams’ view about the role ethics plays in our conception of the life we want to lead provides a better account of these cases. (shrink)

It has apparently become fashionable of late to criticize utilitarianism for what is thought to be, in a word, its insensitivity. Utilitarianism is said to ignore the complexities of character of its agents, and because of this to impose upon them a burden they cannot well bear—a failure which, in the end, renders the adoption of the utilitarian goal fundamentally unappealing, since the more utilitarian agents try to maximize utility the more happiness is destroyed. More traditional criticisms have, of course, (...) centered around the issue of rights, obligations, and justice. The claim that utilitarianism must tolerate such unappealing practices as the punishment of the innocent has led many to reject it. At the same time, of course, perhaps just as many have defended it, demonstrating that no form of utilitarianism would allow much of this; some forms would allow none of it; and that lastly, and most importantly, it is question-begging to reject the theory for failing to acknowledge the existence of a thing when it is the very aim of that theory to call that existence into question. The debate over justice, although stirring, has often seemed destined to end in stale-mate. (shrink)
