Unethical behavior is important to study because it may have an adverse influence on organizational performance. This paper is an attempt to better understand why individuals behave as they do when faced with ethical dilemmas. We first explore the definition, theories and models of ethical behaviors and accountability. This discussion of societal ethics and accountability as forms of social control segues into a discussion of how accountability may influence ethical behaviors. Based on the business ethics and accountability literatures, we suggest (...) a number of research questions and hypotheses that need to be tested, as well as an appropriate research strategy. _Foucault’s Law_ is the first book in almost fifteen years to address the question of Foucault’s position on law. Many readings of Foucault’s conception of law start from the proposition that he failed to consider the role of law in modernity, or indeed that he deliberately marginalized it. In canvassing a wealth of primary and secondary sources, Ben Golder and Peter Fitzpatrick rebut this argument. They argue that rather than marginalize law, Foucault develops a much more radical, nuanced and coherent (...) theory of law than his critics have acknowledged. For Golder and Fitzpatrick, Foucault’s law is not the contained creature of conventional accounts, but is uncontainable and illimitable. In their radical re-reading of Foucault, they show how Foucault outlines a concept of law which is not tied to any given form or subordinated to a particular source of power, but is critically oriented towards alterity, new possibilities and different ways of being. _Foucault’s Law_ is an important and original contribution to the ongoing debate on Foucault and law, engaging not only with Foucault’s diverse writings on law and legal theory, but also with the extensive interpretive literature on the topic. It will thus be of interest to students and scholars working in the fields of law and social theory, legal theory and law and philosophy, as well as to students of Foucault’s work generally. In relation to education, there is in Foucault's approach a double emphasis which constitutes an ordering principle for this work.

This paper outlines a theoretical context for research into ‘the subject of ethics’ in terms of how students come to see themselves as self-reflective actors. I maintain that the ‘subject of ethics’, or ethical subjectivity, has been overlooked as a necessary aspect of creating politically transformative spaces in education. At the heart of egalitarian politics lies a fundamental tension between the equality of voices and the notion that one way of being or one voice may be deemed more legitimate than (...) another; which in turn puts the equality of beings into question. Building from Michel Foucault’s work regarding ethics and subjectivity, I suggest that a ‘subject of ethics’ can be viewed, in part, as a series of relations of self that form the horizon upon which a subject comes to work on themselves relative to moral codes and power relations. Ethical relations of self can be a useful concept for those interested in educational research that furthers social and ecological justice. In the conclusion of this paper I also discuss the limitations of locating ethics entirely within a constituted human subject. (shrink)

This paper illustrates the relevance of Foucault’s analysis of neoliberal governance for a critical understanding of recent transformations in individual and social life in the United States, particularly in terms of how the realms of the public and the private and the personal and the political are understood and practiced. The central aim of neoliberal governmentality (“the conduct of conduct”) is the strategic creation of social conditions that encourage and necessitate the production of Homo economicus, a historically specific form of (...) subjectivity constituted as a free and autonomous “atom” of self-interest. The neoliberal subject is an individual who is morally responsible for navigating the social realm using rational choice and cost-benefit calculations grounded on market-based principles to the exclusion of all other ethical values and social interests. While the more traditional forms of domination and exploitation characteristic of sovereign and disciplinary forms of power remain evident in our ”globalized” world, the effects of subjectification produced at the level of everyday life through the neoliberal “conduct of conduct” recommend that we recognize and invent new forms of critique and ethical subjectivation that constitute resistance to its specific dangers. The UK Chief Medical Officer’s 2016 Annual Report, Generation Genome, focused on a vision to fully integrate genomics into all aspects of the UK’s National Health Service. This process of integration, which has now already begun, raises a wide range of social and ethical concerns, many of which were discussed in the final Chapter of the report. This paper explores how the UK’s 100,000 Genomes Project —the catalyst for Generation Genome, and for bringing genomics into the NHS—is negotiating these ethical (...) concerns. The UK’s 100 kGP, promoted and delivered by Genomics England Limited, is an innovative venture aiming to sequence 100,000 genomes from NHS patients who have a rare disease, cancer, or an infectious disease. GEL has emphasised the importance of ethical governance and decision-making. However, some sociological critique argues that biomedical/technological organisations presenting themselves as ‘ethical’ entities do not necessarily reflect a space within which moral thinking occurs. Rather, the ‘ethical work’ conducted by organisations is more strategic, relating to the politics of the organisation and the need to build public confidence. We set out to explore whether GEL’s ethical framework was reflective of this critique, and what this tells us more broadly about how genomics is being integrated into the NHS in response to the ethical and social concerns raised in Generation Genome. The ‘European Space of Higher Education’ could be mapped as an infrastructure for entrepreneurship and a place where the distinction between the social and the economic becomes obsolete. Using Foucault's understanding of biopolitics and discussing the analyses of Agamben and Negri/Hardt it is argued that the actual governmental configuration, i.e. the economisation of the social, also has a biopolitical dimension. Focusing on the intersection between a politicisation and economisation of human life allows us to discuss a kind of ‘bio‐economisation’ , (...) a regime of economic terror and learning as investment. Finally it is argued how fostering learning, i.e. fostering life could turn into ‘let die’ and even into ‘make die’. (shrink)

The article analyses the boom of self-help discourses and their relationship with pedagogic discourses, with the purpose of marking the centrality of the individual in the practices of contemporaneous government. Two exercises are important in this analysis of an archaeological genealogical perspective: on the one hand, it comprehends the impact which self-help has in the life of its readers and practitioners, allowing the consolidation and broad diffusion of tools to guide one’s own life and define modes of being within the (...) world; on the other hand, thinking that the techniques provided by self-help may proceed in a millenary tradition of practices intended for the government itself. The study of the series self-help—education—government allows some of the main elements of these discourses to be identified and shows the centrality of the notion of learning among them. (shrink)

This paper explores the perceptions and experiences of four doctoral researchers to examine how research ethics committee (REC) processes have shaped and influenced specific health-based ethnographic studies. This paper considers how a universal tightening of ethical REC scrutiny at university level, as well as those governing the health and social care sector in the United Kingdom, impacts upon social research involving the inclusion of participants from certain groups. Increased restrictions in ethics scrutiny is justified as protecting vulnerable people from intrusive (...) research and is embedded in legislation, specifically the UK Mental Capacity Act 2005. The general international trend towards greater ethical scrutiny is heralded as an uncontested social good, yet this unquestioned assumption is tested in relation to qualitative social research methodologies that seek to explore the experiences of ?vulnerable? individuals. It is consequently argued that ethics review restrictions are in danger of disenfranchising sectors of the community, excluding them from engaging in social research activities that would serve to highlight their experiential and lived conditions. The enhanced bureaucratic control of the doctoral process in conjunction with the REC is also discussed as inhibiting proposed studies. (shrink)

ABSTRACTThis article examines anxiety, arguing that it is a systemic feature of neoliberalism which regenerates the economy and acts in a conservative manner, thereby effectively preventing social change. Anxiety is explored using psychoanalytic theory to extend Foucault’s conception of neoliberal governmentality as proposed in his lectures on neoliberalism at the Collège de France. Relying on Foucault’s notion of governmentality as an analytic perspective, this article does not present the economy or the state as the origin of power in neoliberalism. Rather, (...) these are seen as mediums of power, whereas the anchorage point of power relations is understood to be a particular form of governmentality. In neoliberalism, this anchorage point of power is largely supported and strongly characterised by anxiety.
