Ethical concepts are, or purport to be, normative. They make claims on us: they command, oblige, recommend, or guide. Or at least when we invoke them, we make claims on one another; but where does their authority over us - or ours over one another - come from? Christine Korsgaard identifies four accounts of the source of normativity that have been advocated by modern moral philosophers: voluntarism, realism, reflective endorsement, and the appeal to autonomy. She traces their history, showing how (...) each developed in response to the prior one and comparing their early versions with those on the contemporary philosophical scene. Kant's theory that normativity springs from our own autonomy emerges as a synthesis of the other three, and Korsgaard concludes with her own version of the Kantian account. In The Myth of Morality, Richard Joyce argues that moral discourse is hopelessly flawed. At the heart of ordinary moral judgements is a notion of moral inescapability, or practical authority, which, upon investigation, cannot be reasonably defended. Joyce argues that natural selection is to blame, in that it has provided us with a tendency to invest the world with values that it does not contain, and demands that it does not make. Should we therefore do away with morality, as we (...) did away with other faulty notions such as witches? Possibly not. We may be able to carry on with morality as a 'useful fiction' - allowing it to have a regulative influence on our lives and decisions, perhaps even playing a central role - while not committing ourselves to believing or asserting falsehoods, and thus not being subject to accusations of 'error'. Sentimental Rules is an ambitious and highly interdisciplinary work, which proposes and defends a new theory about the nature and evolution of moral judgment. In it, philosopher Shaun Nichols develops the theory that emotions play a critical role in both the psychological and the cultural underpinnings of basic moral judgment. Nichols argues that our norms prohibiting the harming of others are fundamentally associated with our emotional responses to those harms, and that such 'sentimental rules' enjoy an advantage in cultural evolution, (...) which partly explains the success of certain moral norms. This has sweeping and exciting implications for philosophical ethics. Nichols builds on an explosion of recent intriguing experimental work in psychology on our capacity for moral judgment and shows how this empirical work has broad import for enduring philosophical problems. The result is an account that illuminates fundamental questions about the character of moral emotions and the role of sentiment and reason in how we make our moral judgments. In this paper we propose to argue for two claims. The first is that a sizeable group of epistemological projects – a group which includes much of what has been done in epistemology in the analytic tradition – would be seriously undermined if one or more of a cluster of empirical hypotheses about epistemic intuitions turns out to be true. The basis for this claim will be set out in Section 2. The second claim is that, while the jury is (...) still out, there is now a substantial body of evidence suggesting that some of those empirical hypotheses are true. Much of this evidence derives from an ongoing series of experimental studies of epistemic intuitions that we have been conducting. A preliminary report on these studies will be presented in Section 3. In light of these studies, we think it is incumbent on those who pursue the epistemological projects in question to either explain why the truth of the hypotheses does not undermine their projects, or to say why, in light of the evidence we will present, they nonetheless assume that the hypotheses are false. In Section 4, which is devoted to Objections and Replies, we’ll consider some of the ways in which defenders of the projects we are criticizing might reply to our challenge. Our goal, in all of this, is not to offer a conclusive argument demonstrating that the epistemological projects we will be criticizing are untenable. Various social animal species have been noted to inhibit aggressive attacks when a conspecific displays submission cues. Blair (1993) has suggested that humans possess a functionally similar mechanism which mediates the suppression of aggression in the context of distress cues. He has suggested that this mechanism is a prerequisite for the development of the moral/conventional distinction; the consistently observed distinction in subject's judgments between moral and conventional transgressions. Psychopaths may lack this violence inhibitor. A causal model is developed showing how (...) the lack of this mechanism would explain the core behavioural symptoms associated with the psychopathic disorder. A prediction of such a causal model would be that psychopaths should fail to make the moral/conventional distinction. This prediction was confirmed. The moral philosophy of the first half of the twentieth century, at least in the English-speaking part of the world, has been largely devoted to problems of an ontological or epistemological nature. This concentration of effort by many acute analytical minds has not produced any general agreement with respect to the solution of these problems; it seems likely, on the contrary, that the wealth of proposed solutions, each making some claim to plausibility, has resulted in greater disagreement than ever before, (...) and in some cases disagreement about issues so fundamental that certain schools of thought now find it unrewarding, if not impossible, to communicate with one another. Moral philosophers of almost all schools seem to agree, however, that no major possibility has been neglected during this period, and that every proposed solution which can be adjudged at all plausible has been examined with considerable thoroughness. It is now common practice, for example, for the authors of books on moral philosophy to introduce their own theories by what purports to be a classification and review of all \emph{possible} solutions to the basic problems of analysis; and in many cases, indeed, the primary defense of the author's own position seems to consist in the negative argument that his own position cannot fail to be correct because none of the others which he has mentioned is satisfactory. As a procedure, reflective equilibrium is simply a familiar kind of standard scientific method with a new name. A theory is constructed to account for a set of observations. Recalcitrant data may be rejected as noise or explained away as the effects of interference of some sort. Recalcitrant data that cannot be plausibly dismissed force emendations in theory. What counts as a plausible dismissal depends, among other things, on the going theory, as well as on background theory and on knowledge (...) that may be relevant to under-standing the experimental design that is generating the observations, including knowledge of the apparatus and observation conditions. This sort of mutual adjustment between theory and data is a familiar feature of scientific practice. Whatever authority RE seems to have comes, I think, from a tacit or explicit recognition that it has the same form as this familiar sort of scientific inference. One way to see the rationale underlying this procedure in science is to focus on prediction. Think of prediction as a matter of projecting what is known onto uncharted territory. To do this, you need a vehicle—a theory—that captures some invariant or pattern in what is known so that you can project it onto the unknown. How convincing the projection is depends on two factors: how sure one is of the observational base, and how sure one is that the theory gets the invariants right. The two factors are not independent, of course. One's confidence in the observational base will be affected by how persuasively the theory identifies and dismisses noise; one's confidence in the theory, on the other hand, will depend on one's confidence in the observations it takes seriously. Prediction is important as a test of theory precisely because verified predictions seem to show that the theory has correctly captured the general in the particular, that it has got the drift of the observational evidence in which our confidence is ultimately grounded. In his book A Theory of Justice, John Rawls introduces and employs the concept of “reflective equilibrium” as a method of testing which of rival moral theories is to be preferred. The introduction of this concept is plainly a significant event for moral philosophy. The criterion by which we decide to reject, say, utilitarianism in favour of a contractual theory of justice is, if anything, even more fundamental than the choice of theory itself, since our choice of moral theory may (...) well be determined by the criterion we use. How can intuitions be used to validate or invalidate a philosophical theory? An intuition about a case seems to be a basic evidential source for the truth of that intuition, i.e., for the truth of the claim that a particular example is or isn’t an instance of a philosophically interesting kind, concept, or predicate. A mental‐state type is a basic evidential source only if its tokens reliably indicate the truth of their contents. The best way to account for intuitions being (...) a basic evidential source is to interpret their subject matter in psychologistic terms. Throughout the 20th century, an enormous amount of intellectual fuel was spent debating the merits of a class of skeptical arguments which purport to show that knowledge of the external world is not possible. These arguments, whose origins can be traced back to Descartes, played an important role in the work of some of the leading philosophers of the 20th century, including Russell, Moore and Wittgenstein, and they continue to engage the interest of contemporary philosophers. (e.g., Cohen 1999, DeRose 1995, (...) Hill 1996, Klein 1981, Lewis 1996, McGinn 1993, Nozick 1981, Schiffer 1996, Unger 1975, Williams 1996) Typically, these arguments make use of one or more premises which the philosophers proposing them take to be intuitively obvious. Beyond an appeal to intuition, little or no defense is offered, and in many cases it is hard to see what else could be said in support of these premises. A number of authors have suggested that the intuitions undergirding these skeptical arguments are universal – shared by everyone (or almost everyone) who thinks reflectively about knowledge. In this paper we will offer some evidence indicating that they are far from universal. Rather, the evidence suggests that many of the intuitions epistemologists invoke vary with the cultural background, socioeconomic status and educational background of the person offering the intuition. And this, we will argue, is bad news for the skeptical arguments that rely on those intuitions. The evidence may also be bad news for skepticism itself – not because it shows that skepticism is false, but rather because, if we accept one prominent account of the link between epistemic intuitions and epistemic concepts, it indicates that skepticism may be much less interesting and much less worrisome than philosophers have taken it to be. To what extent can philosophical thought experiments reveal norms? Some ethicists have argued that certain thought experiments reveal that people draw a morally significant distinction between "doing" and "allowing". I examine one such thought experiment in detail and argue that the intuitions it elicits can be explained by "prospect theory", a psychological theory about the way people reason. The extent to which such alternative explanations of the results of thought experiments in philosophy are generally available is an empirical question.

Children, even very young children, distinguish moral from conventional transgressions, inasmuch as they hold that the former, but not the latter, would still be wrong if there was no rule prohibiting them. Many people have taken this finding as evidence that morality is objective, and therefore universal. I argue that reflection on the phenomenon of imaginative resistance will lead us to question these claims. If a concept applies in virtue of the obtaining of a set of more basic facts, then (...) it is authority independent, and we therefore resist the attempts of authorities to claim that it does not apply. Thus, the moral/conventional distinction is a product of imaginative resistance to claims that a concept does not apply when its supervenience base is in place (or vice versa). All we can rightfully conclude from the fact that children are disposed to make the moral/conventional distinction is that our moral concepts belong to the class of authority-independent concepts. Though the set of basic facts in virtue of which an authority-independent concept obtains must be objective, the concept itself might be conventional, inasmuch as we could easily draw its boundaries wider or narrower, or fail to have a concept that corresponds to these properties at all. This chapter discusses neurocognitive work relevant to moral psychology and the proposition that innate factors make important contributions to moral judgment. It reviews various sources of evidence for an innate moral faculty, before presenting brain-imaging data in support of the same conclusion. It is argued that our moral thought is the product of an interaction between some ‘gut-reaction’ moral emotions and our capacity for abstract reflection.

Tamara Horowitz criticizes the use of thought experiments by Warren Quinn and others to support a version of the Doctrine of Doing and Allowing. She argues that because a competing empirical explanatory hypothesis for our common agreement on the correct outcome in those thought experiments is true we should conclude that our intuitions concerning those examples do not provide support for the Doctrine of Doing and Allowing. Other authors have reached similar conclusions. I argue that the argument misconstrues the role (...) of higher order reflection on first order intuitive moral judgements in moral thinking. Appropriately appreciating that role will require us to reject Horowitz's claim that she has undermined arguments from Quinn's examples to the conclusion that there is a morally significance difference between doing and allowing. This paper criticizes Analytic philosophy with its reliance on intuitions in pursuit of conceptual analysis. Rejecting naturalism as an alternative philosophical method, I offer in its place a pragmatic and revisionary conception of philosophical method. I explain the method of Analytic philosophy and show why reliance on intuitions is essential to that method, which is unable to provide substantive answers to philosophical problems. I further show that reflective equilibrium or wide analysis requires some criterion of intuition choice and that this (...) criterion can be applied directly to definitions themselves. (shrink)
