In his deep and significant study of the thought of Max Scheler, Hans Urs von Balthasar writes that “the realm of the personal was Scheler’s innermost concern, more important to him than anything else, the sanctuary of his thought.” This is why Scheler again and again aligned himself with personalism in philosophy, as we can see from the introduction to his major work, Formalism in Ethics.

This article attempts to defend Kwame Gyekye’s moderate communitarianism (MC) from the trenchant criticism that it is as defective as radical communitarianism (RC) since they both fail to take rights seriously. As part of my response, I raise two critical questions. Firstly, I question the supposition in the literature that there is such a thing as radical communitarianism. I point out that talk of radical communitarianism is tantamount to attacking a “straw-man.” Secondly, I question the efficacy of the criticism that (...) MC does not take rights seriously, given that there is no account of what it means to take rights seriously in the African tradition. This criticism, insofar as it does not specify a criterion of what it means to take rights seriously, remains defective. The central contribution of this article is to call our attention to the fact that the intellectual culture of rights will surely be affected by Afro-communitarianism, which emphasises our duties to all. There are three major reasons that ideas associated with ubuntu are often deemed to be an inappropriate basis for a public morality. One is that they are too vague, a second is that they fail to acknowledge the value of individual freedom, and a third is that they a fit traditional, small-scale culture more than a modern, industrial society. In this article, I provide a philosophical interpretation of ubuntu that is not vulnerable to these three objections. Specifically, I construct a (...) moral theory grounded on southern African worldviews, one that suggests a promising new conception of human dignity. According to this conception, typical human beings have a dignity in virtue of their capacity for community, understood as the combination of identifying with others and exhibiting solidarity with them, where human rights violations are egregious degradations of this capacity. I argue that this account of human rights violations straightforwardly entails and explains many different elements of South Africa’s Bill of Rights and naturally suggests certain ways of resolving contemporary moral dilemmas in South Africa and elsewhere relating to land reform, political power and deadly force. In this chapter, a reprint of an article initially appearing in the Journal of Human Rights (2010), I spell out a conception of dignity grounded on African moral thinking that provides a plausible philosophical foundation for human rights, focusing on the particular human right not to be executed by the state. I first demonstrate that the South African Constitutional Court’s sub-Saharan explanations of why the death penalty is degrading all counterintuitively entail that using deadly force against aggressors is degrading as (...) well. Then, I draw on one major strand of Afro-communitarian thought to develop a novel conception of dignity as the view that what is special and inviolable about human nature is our capacity for harmonious relationships. I argue that a principle of respect for the dignity of such a capacity entails that the death penalty is an indignity but that deadly force in self- or other-defense need not be, and I contend that this African-inspired principle promises to do no worse than the more Western, Kantian principle of respect for autonomy at accounting for a broad range of human rights. In this article I compare and, especially, contrast Aristotle’s conception of virtue with one typical of sub-Saharan philosophers. I point out that the latter is strictly other-regarding, and specifically communitarian, and contend that the former, while including such elements, also includes some self-regarding or individualist virtues, such as temperance and knowledge. I also argue that Aristotle’s conception of human excellence is more attractive than the sub-Saharan view as a complete account of how to live, but that the African conception is (...) a strong contender for a limited group of the most important virtues related to morality qua rightness. I argue that, even supposing substantive principles of distributive justice entail that animals warrant constitutional protection, there are other, potentially weightier forms of injustice that would probably be done by interpreting a Bill of Rights as implicitly applying to animals, namely, formal injustice and compensatory injustice. Formal injustice would result from such a reading of the Constitution in that the state would fail to speak with one voice upon newly according legal rights to animals. Compensatory injustice would likely result from (...) such a reading, at least in a South African context, in that the law would not only suppress facets of culture that many Africans deem important to their self-conception, but also require spending scarce resources on animals that could have gone toward saving African lives and livelihoods. If the state must choose between acting for the sake of the urgent interests of animals and those of humans, humans must take priority, even assuming that animals have a worth that morally forbids harming them in our private lives. Care, we suspect, is initiated with an appeal. Something appeals to us which becomes a matter of concern. In accordance with this concern, we develop a volition: we want that which promotes the thriving – even to the smallest extent – of that which has appealed to us, regardless of how we may establish what that entails. Eventually we take practical action: we act according to our volition. Immediately after this has taken effect, as the case may be, we release (...) the source of the appeal from our care. As far as we can see, this quartet – appeal, concern, volition and practice – covers the four constitutive moments of care, although these moments are only theoretically separable from one another. The practice, as we have said, follows the volition. The volition, however, has arisen because we wanted to foster the wellbeing, however we may have recognised this, of the subject from which the initial appeal came. We have thus placed our volition in the service of this wellbeing, that is to say: we have subjected ourselves to an ought which we instantiated ourselves with the acceptance of the appeal. This seems to us to be the decisive point: in the act of caring, we instantiate an ought, a regulative element, which we then willingly follow. In the process of caring, we thus bring forth an ought, from our own being as it were – and as short-lived as this may be – to which we subject ourselves: in the process of caring, normativity only appears at all because we produce a will in the interest of the subject of the initial appeal to which we then dedicate ourselves, as if this were not our own will. Normativity is thus, as we further suspect, to be understood as a descriptive term of a phenomenology of care, or indeed a phenomenology of normativity. The phenomenon of caring provides the first indication that the ought arises directly from the practical experience of our lives. The phenomenology of care seems to us to be of eminent importance for health care ethics. To denote professional caring, we use the term nursing. The professional caregiver purposefully exposes him/herself to appeals, making him/herself receptive to such an appeal and reliably allowing the appeal to become a concern. The first fundamental principle of nursing ethics thus appears to us to be: to make known one’s receptiveness to an appeal – in a particular situation at a particular time – and to process this appeal reliably such that it becomes a concern. This encompasses the professionalism of care at its initiation. We believe that a precise phenomenology of care will provide, on the one hand, an exact understanding of the genesis of normativity, and on the other hand, in its practical application, a definition of the professional care that is nursing and an ethics of nursing for the care-giving professions. Wir werden dabei – zumindest ausgehend von unserer Interpretationsgrundlage – allerdings nicht die um poli-tische deutsche Identität besorgten Bürger finden, sondern einen Bürger, den es schlicht an Bereitschaft fehlt, ihre Werte zu verteidigen. The aim of this article is to present a conceptualization of cultural groups and cultural difference that provides a middle course between the Scylla of essentialism and the Charybdis of reductionism. The method I employ is the social mechanism approach. I argue that cultural groups and cultural difference should be understood as the result of cognitive and social processes of categorization. I describe two such processes in particular: categorization by others and self- categorization. Categorization by others is caused by processes (...) of ascription: the attribution by outsiders of certain characteristics, beliefs, and practices to indi- viduals who share a specific attribute. Self-categorization is caused by processes of inscription and community-building: the adoption of certain beliefs and practices as a result of socialization and enculturation. I therefore shift the focus from groups to categories, and from categories to processes of categorization. I show that this analytical distinction between categorization by others and self-categorization can clarify an ambiguity in dominant debates in contemporary multiculturalism. I conclude by indicating how injustices, commonly associated with multiculturalism, can better be understood as socially generated injustices, and how government should deal with these injustices. Through the vehicle of Nicolas Sarkozy’s so-called “Dakar Address” we will analyse the West’s persisting lack of insight into the need for a Western decolonization. We will try to identify the dangers that come from this refusal, such as the abidance in colonial patterns, the enduring self-understanding as superior com-pared to Africa, and the persisting unwillingness to accept the colonial guilt. Decolonization has to be understood as a two-fold business. Decolonization is over-coming endured and perpetrated violence. It is not only (...) important that the colonial oppressed regain strength, it is equally important that the perpetrator of colonial violence understand their excess of violence and work on effecting its return impossible. We explain how Western thinking remains dangerous and untrustwor-thy if it refuses its own decolonization. Finally, we will draw attention to a fundamental pattern of Western thought that clashes with the fundamental values of the West: contempt. In a final step we suggest how this contempt can be overcome through desuperiorisation and the establishment of elative ethics. (shrink)

This paper examines how three central aspects of personhood — the capacities of individuals, their normative status, and the social aspect of being recognized — are related, and how personhood depends on them. The paper defends first of all a ‘basic view’that while actual recognition is among the constitutive elements of full personhood, it is the individual capacities (and not full personhood) which ground the basic moral and normative demands concerning treatment of persons. Actual recognition depends analyti- cally on such (...) pre-existing normative requirements: it is a matter of responsiveness to them. The paper then discusses four challenges. The challenges claim that pace the basic view, the relevant capacities depend on recognition, that recognition seems to have normative rele- vance, and that the basic view cannot as such explain the equality either of persons, or of humans. Responding to these challenges amounts to refining the basic view accordingly. (shrink)

Othering is the construction and identification of the self or in-group and the other or out-group in mutual, unequal opposition by attributing relative inferiority and/or radical alienness to the other/out-group. The notion of othering spread from feminist theory and post-colonial studies to other areas of the humanities and social sciences, but is originally rooted in Hegel’s dialectic of identification and distantiation in the encounter of the self with some other in his “Master-Slave dialectic”. In this paper, after reviewing the philosophical (...) and psychological background of othering, I distinguish two kinds of othering, “crude” and “sophisticated”, that differ in the logical form of their underlying arguments. The essential difference is that the former is merely self-other distantiating, while the latter – as in Hegel’s dialectic – partially depends on self-other identification. While crude othering is closer to the paradigmatic notion of othering, sophisticated othering is closer to Hegel’s, but so is quasi-othering, which is nearly identical in form to sophisticated othering, but which misses the defining feature of othering – attributing relative inferiority and/or radical alienness. Because Hegel’s dialectic applies to any encounter of an interpreting self with some other, sophisticated or quasi-othering is at least potentially a very common occurrence in the interpretation of others, especially of those who do not belong to the in-group. However, although othering is usually undesirable, the Hegelian varieties can provide a “mirror”, which can be used as a tool to improve understanding of both the other and the interpreting self, and the malignant aspects of othering can be avoided through charity. The aim of this article is to explore the problem of social ontology. The form that the exploration will take is a development of the argument that I presented in The Construction of Social Realty[2]. I will summarize some of the results of that book and then develop the ideas further.

The increasingly common use of inclusive language (e.g., "he or she") in representing past philosophers' views is often inappropriate. Using Immanuel Kant's work as an example, I compare his use of terms such as "human race" and "human being" with his views on women to show that his use of generic terms does not prove that he includes women. I then discuss three different approaches to this issue, found in recent Kant-literature, and show why each of them is insufficient. I (...) conclude that the tension between gender-neutral and gender-specific views in Kant's work should be made explicit, and I offer several strategies for doing so. (shrink)

In this paper, I tried to show how Western attitude to reality can be traced to the divisive exclusivist type of mind-set behind Aristotle’s conception of the world. Igesture toward some of the severest consequences of approaching the world with such a mind-set, and how such has complicated matters in some of the major debates in African philosophy. By recourse to ibuanyidanda or complementary philosophy, the author explores ways of addressing some of the challenges approaches of this kind present in (...) view of resolving issues that have relevance for authentic existence. Man suffers from a very particular fate, namely that of being besieged by questions which he cannot answer and cannot ignore either. The ability to pose questions like these is a key characteristic of the fundamental existential situation of mankind. Every person must find his or her own particular method of coping with such questions. This makes up a significant part of the human maturing process. People with dementia, having already found their personal solution to cope with the problem of (...) these unanswerable questions, radically stumble into this existential situation once again. The problem of this repetition is that the people with dementia can only make limited use, if indeed any use at all, of their previously successful biographical strategies. The drama of human existence as such thus repeats itself within a person with dementia. We must recognise the seriousness of this task. We thus must support people with dementia in coping existentially with this renewed task in the best possible way. The existential dignity of this task is no different from that of a young person. This insight is very important for the care of patients: people with dementia should be recognised as a people in an existential situation. (shrink)

Our attempt in this paper is to reconstruct African traditional Metaphysics. The main problematic has to do with whether we can in any meaningful and coherent manner talk about a traditional metaphysics that covers or incorporates the inevitable nuances that go with cultural and individual differences. We have adopted the principles of charity where in hermeneutical studies we are allowed to carry out our interpretation with some sense of liberalism and assumption which is not harmful to the letter and spirit (...) of interpretation.We have therefore assumed that all Africans are bound to have more in common than with people of other continents. We have used Nigeria and Ghana as representative cultures in this studiy. We have attempted understanding the basis of African traditional metaphysics which has to do with ‘Being’ and its ontological appurtenances like personality, substance, etc, and to see how they differ from the western conception of Being. We examined the vitalist element of African traditional metaphysics and came to the conclusion that African traditional metaphysics includes and transcends the western explanatory indices. While the west limit their enquiry to experience and reason, the African go beyond that to employ extra empirical and extra-ratiocinative means often called extra-sensory perception. (shrink)

If the radical moment of the inauguration of modern philosophy is the rise of the Cartesian cogito, where are we today with regard to cogito? Are we really entering a post-Cartesian era, or is it that only now our unique historical constellation enables us to discern all the consequences of the cogito? The paper deals extensively with these questions on topics introduced by Catherine Malabou's Les nouveaux blessés (The New Wounded). Malabou proposed a critical reformulation of psychoanalysis, her starting point (...) being external shocks, brutal unexpected encounters or intrusions, due their properly traumatic impact on the way they touch a pre-existing traumatic "psychic reality". Malabou's basic reproach to Freud is that, when confronted with such cases, he succumbs to the temptation of meaning: he is not ready to accept the direct destructive efficiency of external shocks – they destroy the psyche of the victim (or, at least, wound it in an unredeemable way) without resonating in any inner traumatic truth. These cases of post-traumatic subjects show that if we take the "stories they are telling itself about itself," the narrative symbolic texture, away, something (or, rather nothing, a form of nothing) remains, which is nothing but the pure subject of the death drive. This is an idea of cogito at its purest, its "degree zero," and this is also the reason why today we so adamantly resist the spectre of cogito. (shrink)
