The current debates dealing with empathy, social cognition, and the problem of other minds widely accept the assumption that, whereas we can directly perceive the other’s body, certain additional mental operations are needed in order to access the contents of the other’s mind. Body-perception has, in other words, been understood as something that merely mediates our experience of other minds and requires no philosophical analysis in itself. The available accounts have accordingly seen their main task as pinpointing the operations and (...) mechanisms that enable us to move beyond body-perception—and here acts such as inference, simulation, and projection have usually been the main candidates. This whole setting, however, seems to rely on a somewhat Cartesian assumption, according to which body-perception fundamentally amounts to the perception of a material thing, res extensa, starting from which we then strive to grasp the other as a res cogitans. Insofar as one begins with the question of how we can discover and understand mindedness in things that cannot be directly perceived as minded, the Cartesian setting is already taken for granted—and this is, in fact, exactly what most of the available proposals seem to be doing. From a phenomenological point of view, the Cartesian setting is untenable and seriously misleads the whole debate. The present article reassesses the role and status of body-perception in empathy. Making use of the Husserlian theory of expressivity in particular, the article engages a phenomenological framework of analysis, challenges the above-mentioned assumption concerning the nature of body-perception, and argues for the immediate nature of empathy. Most moral philosophers who have recently expressed sympathy with feminist or ‘care-based’ perspectives on ethical theory have thought that such perspectives can make valuable contributions to more comprehensive ethical theories. Few have thought that an ethics of care can offer a complete normative theory. However, Michael Slote is one of the ambitious few. In his recent book, The Ethics of Care and Empathy, he seeks to show that a care-based perspective can do a lot of service in first-order moral and (...) political theory as well as in metaethics. Here is a quick overview of the book's content: In Chapter 1, Slote explicates the notion of empathy that is central in his ethics of care, which he locates within the sentimentalist paradigm, stemming from philosophers such as Hume and Hutcheson. Slote's account of empathy and moral development draws substantially on work by the psychologist Martin Hoffman. Chapter 2 discusses care ethics and our obligation to help others, including both the near and the distant needy. Chapter 3 aims to show how the notion of empathy can further the case for deontology in ethics. This article examines the recent introduction of forced ultrasound-beforeabortion measures in select U.S. states as an intervention of gendered biopower. These measures are drafted based on model legislation entitled the Woman’s Right to Know Act. Such legislation exploits a discourse of women’s health, but invests in fetal “life” by regulating the behavior of pregnant women so as to promote the carrying of pregnancies to term; the legislation also represents childbirth and motherhood as in the interest of women’s health. Ultimately, I (...) contend that Right to Know measures give the state permission to override the choices, rights, and interests of the population of pregnant women as a whole in an attempt to “protect” and optimize a supposedly vulnerable fetal population. Recently, we have seen various proposed laws that would require that women considering abortions be given ultrasounds along with explanations of these ultrasounds. Proponents of these laws could argue that they are assisting with autonomous abortion choices by providing needed information, especially about the ontological status of the fetus. Arguing against these proposed laws, I first claim that their supporters fail to appreciate how personalized an abortion choice must be. Second, I argue that these laws would provide the pregnant woman (...) no control over when and to what extent emotion is inserted into her deliberation. This unjustly inhibits her autonomy, making these ultrasound laws unjustified. (shrink)

Empathy can be characterized as a vicarious emotion that one person experiences when reflecting on the emotion of another. So characterized, empathy is sometimes regarded as a precondition on moral judgment. This seems to have been Hume's view. I review various ways in which empathy might be regarded as a precondition and argue against each of them: empathy is not a component, a necessary cause, a reliable epistemic guide, a foundation for justification, or the motivating force behind our moral judgments. (...) In fact, empathy is prone to biases that render it potentially harmful. Another construct—concern—fares somewhat better, but it is also of limited use. I argue that, instead of empathy, moral judgments involve emotions such as anger, disgust, guilt, and admiration. These, not empathy, provide the sentimental foundation for morality. (shrink)

Foetal images have been central to the medicalized abortion debate since the 1960s. Feminists have extensively analysed such pictures, arguing that the pregnant body is separated from the foetus and erased from view, and that the rights of women and foetuses are set in opposition. In this article I introduce the latest image in this debate, the 3D sonogram, which is widely reported as new evidence for a reduction in the gestational time limit. Through close analysis of two examples, I (...) argue that the rhetorical use of these images can be characterized by a conflation of knowing with seeing. With the new clarity of sonograms to the untrained eye, image producers are legitimated by a discourse of public information and concerned citizens are called upon to exercise their rights to see/know. For feminist theory, this implies the need for continued analysis of the epistemology of foetal images and renewed focus on the subject position of the viewer. (shrink)

abstract In this paper we question the basis on which judgements are made about the ‘quality’ of the lives of people whose embodied experience is anomalous, specifically in cases of impairments. In moral and political philosophy it is often assumed that, suitably informed, we can overcome epistemic gaps through the exercise of moral imagination: ‘putting ourselves in the place of others’, we can share their points of view. Drawing on phenomenology and theories of embodied cognition, and on empirical studies, we (...) suggest that there are barriers to imagining oneself differently situated, or imagining being another person, arising in part from the way imagination is constrained by embodied experience. We argue that the role of imagination in moral engagement with others is to expand the scope of our sympathies rather than to enable us to put ourselves in the other's place. We argue for explicit acknowledgement that our assessments of others’ QOL are likely to be shaped by the specifics of our own embodiment, and by the assumptions we make as a consequence about what is necessary for a good quality of life. Although images are pervasive in public policy debates in bioethics, few who work in the field attend carefully to the way that images function rhetorically. If the use of images is discussed at all, it is usually to dismiss appeals to images as a form of manipulation. Yet it is possible to speak meaningfully of visual arguments. Examining the appeal to images of the embryo and fetus in debates about abortion and stem cell research, I suggest that bioethicists would be (...) well served by attending much more carefully to how images function in public policy debates. Deepening the inquiries she began in _Gender_ _Trouble,_ Butler offers an original reformulation of the materiality of bodies, examining how the power of heterosexual hegemony forms the "matter" of bodies, sex, and gender. Butler argues that power operates to constrain "sex" from the start, delimiting what counts as a viable sex. Written over a span of more than two decades, the essays by Iris Marion Young collected in this volume describe diverse aspects of women's lived body experience in modern Western societies. Drawing on the ideas of several twentieth century continental philosophers--including Simone de Beauvoir, Martin Heidegger, Luce Irigaray, Julia Kristeva, and Maurice Merleau-Ponty--Young constructs rigorous analytic categories for interpreting embodied subjectivity. The essays combine theoretical description of experience with normative evaluation of the unjust constraints on their freedom and opportunity that (...) continue to burden many women. The lead essay rethinks the purpose of the category of "gender" for feminist theory, after important debates have questioned its usefulness. Other essays include reflection on the meaning of being at home and the need for privacy in old age residences as well as essays that analyze aspects of the experience of women and girls that have received little attention even in feminist theory--such as the sexuality of breasts, or menstruation as punctuation in a woman's life story. Young describes the phenomenology of moving in a pregnant body and the tactile pleasures of clothing. While academically rigorous, the essays are also written with engaging style, incorporating vivid imagery and autobiographical narrative. Issues in reproductive ethics, such as the capacity of parents to ‘choose children’, present challenges to philosophical ideas of freedom, responsibility and harm. This book responds to these challenges by proposing a new framework for thinking about the ethics of reproduction that emphasizes the ways that social norms affect decisions about who is born. The book provides clear and thorough discussions of some of the dominant problems in reproductive ethics - human enhancement and the notion of the normal, reproductive liberty (...) and procreative beneficence, the principle of harm and discrimination against disability - while also proposing new ways of addressing these. The author draws upon the work of Michel Foucault, especially his discussions of biopolitics and norms, and later work on ethics, alongside feminist theorists of embodiment to argue for a new bioethics that is responsive to social norms, human vulnerability and the relational context of freedom and responsibility. This is done through compelling discussions of new technologies and practices, including the debate on liberal eugenics and human enhancement, the deliberate selection of disabilities, PGD and obstetric ultrasound.
