This essay examines the relationship between climate change and human rights. It argues that climate change is unjust, in part, because it jeopardizes several core rights – including the right to life, the right to food and the right to health. It then argues that adopting a human rights framework has six implications for climate policies. To give some examples, it argues that this helps us to understand the concept of “dangerous anthropogenic interference” (UNFCCC, Article 2). In addition to this, (...) it argues that if we adopt a human rights framework then any climate policies should also honour human rights, and so mitigation policies, for example, should not compromise people’s enjoyment of their human rights. A third implication, I argue, is that in addition to duties of mitigation and adaptation there will also be – if rights are violated – duties of compensation too. (shrink)

Early discussions of ?climate justice? have been dominated by economists rather than political philosophers. More recently, analytical liberal political philosophers have joined the debate. However, the philosophical discussion of climate justice remains in its early stages. This paper considers one promising approach based on human rights, which has been advocated recently by several theorists, including Simon Caney, Henry Shue and Tim Hayward. A basic argument supporting the claim that anthropogenic climate change violates human rights is presented. The paper has the following structure. In Section I, I introduce some important methodological preliminaries by asking: How should one reason about global environmental justice in general and global climate change in particular? Section II introduces the key normative argument; it argues that global climate change damages some fundamental human interests and results in a state of affairs in which the rights of many are unprotected: as such it is unjust. Section III addresses the complexities that arise from the fact (...) that some of the ill effects of global climate change will fall on the members of future generations. Section IV shows that some prevailing approaches are unable to deal satisfactorily with the challenges posed by global climate change. If the argument of this paper is correct, it follows that those who contribute to global climate change through high emissions are guilty of human rights violations and they should be condemned as such. Struggles for recognition are at the same time struggles over what it means to recognize and be recognized. Nancy Fraser and Axel Honneth propose two mutually exclusive ways to understand recognition: either as a matter of justice (Fraser) or as a matter of identity (Honneth). This article argues against the limitations of both of these construals of recognition, and offers a third way of construing it: as a matter of freedom. Recognition is not reducible, empirically or normatively, to any of (...) these, however. Moreover, it needs to be regarded both more critically and more openly since what we are dealing with is a practice and an ideal that is by its very nature deeply contestable and therefore (more than most practices and ideals) subject to unforeseeable historical and normative change. Rather than trying to fix the meaning of recognition in order to give it a determinate role in ambitious theories of justice, it would be better to proceed more sceptically, attentive both to the complexities of recognition relations and to alternative ways of conceiving them and going on with them differently from before.
