The riddle of how to democratize the multi-level polity of the EU is answered by pointing to the empirical impact of an unfolding European public sphere. It is argued that there is a self-constituting dynamic of a European public sphere which abets the coupling of transnational spaces of communication with the institutional integration of the EU. From this perspective, democracy is not external to the EU, it is already part of the logic of European institution-building and governance and is fostered (...) by collective learning processes in which definitions of the collective good as well as conditions for appropriate forms of political participation are negotiated. In discussing the case of the EU’s constitutional reform, a theory of democratic functionalism is proposed which accounts for this specific form of democratization of the EU. (shrink)

This paper seeks to show that the proposition of 'double contingency' introduced by Parsons and defended by Luhmann and Habermas is insufficient under the conditions of contemporary communication societies. In the latter context, the increasing differentiation and organization of communication processes eventuated in the recognition of the epistemic authority of the public, which in turn compels us to conceptualize a new level of contingency. A first step is therefore taken to capture the role of the public in communication societies theoretically (...) by what may be called 'triple contingency'. Since the process of the definition of reality and its outcome, to which the response of the public is central, is best seen in constructivist terms, attention is also paid to relevant methodological and epistemological questions. Reflecting a revival of Peirce studies and the rediscovery of the pragmatist tradition in American philosophical thinking, this study articulates a contemporary and relevant interpretation that may offer a challenge to neo-pragmatists.

Evolution and learning are two analytically distinct concepts. People learn yet evolution (`change') does not necessarily take place. To clarify this problem the concept of learning is explicated. The first problem addressed is the question of who is learning. Here a shift from the single actor perspective to an interaction perspective is proposed (using Habermas and Luhmann as theoretical arguments for such a shift). Both, however, idealize the preconditions that interactants share while learning collectively. Against rationalist assumptions it is argued (...) that in order to learn people need a narratively based shared world. What do they learn? They acquire knowledge and they learn how to learn. This still does not solve the problem why they learn. Learning, it is argued, does not guarantee evolution but provides the mutations for evolutionary processes to take place. (shrink)

Since its appearance in English translation in 1996, Jurgen Habermas's Between Facts and Norms has become the focus of a productive dialogue between German and Anglo-American legal and political theorists. The present volume contains ten essays that provide an overview of Habermas's political thought since the original appearance of Between Facts and Norms in 1992 and extend his model of deliberative democracy in novel ways to issues untreated in the earlier work. Habermas's theory of democracy has at least three features (...) that set it apart from competing positions. First, it combines a concern with questions of normative justification with an empirical analysis of the social conditions necessary for the realization of democratic institutions. Second, at the heart of his model is the assertion of an internal relationship between liberalism and democracy. Finally, Habermas defends a conception of universal human rights that is not only sensitive to cultural differences but also calls for legal and political institutions that facilitate the cultivation of cultural and religious identities within pluralistic societies. These essays demonstrate the extraordinary power of Habermas's theory of democracy through a further engagement with Rawls's political liberalism and through original contributions to current debates over nationalism, multiculturalism, and the viability of supranational political institutions.
