How should we approach the daunting task of renewing the ideal of equality? In this book, Christine Sypnowich proposes a theory of equality centred on human flourishing or wellbeing. She argues that egalitarianism should be understood as seeking to make people more equal in the constituents of a good life. Inequality is a social ill because of the damage it does to human flourishing: unequal distribution of wealth can have the effect that some people are poorly housed, badly nourished, ill-educated, (...) unhappy or uncultured, among other things. When we seek to make people more equal our concern is not just resources or property, but how people fare under one distribution or another. Ultimately, the best answer to the question, equality of what?, is some conception of flourishing, since whatever policies or principles we adopt, it is flourishing that we hope will be more equal as a result of our endeavours. Sypnowich calls for both retrieval and innovation. What is to be retrieved is the ideal of equality itself, which is often assumed as a background condition of theories of justice, yet at the same time, dismissed as too homogenising, abstract and rigid a criterion for political argument. We must retrieve the ideal of equality as a central political principle. In doing so, she casts doubt on the value of focussing on cultural difference, and rejects the idea of neutrality that dominates contemporary political philosophy in favour of a view of the state as enabling the betterment of its citizens. Racism, sexism, and other forms of injustice are more than just bad attitudes; after all, such injustice involves unfair distributions of goods and resources. But attitudes play a role. How central is that role? Tommie Shelby, among others, argues that racism is an ideology and takes a cognitivist approach suggesting that ideologies consist in false beliefs that arise out of and serve pernicious social conditions. In this paper I argue that racism is better understood as a set of practices, attitudes, (...) social meanings, and material conditions, that systematically reinforce one another. Attitudes play a role, but even the cognitive/affective component of ideologies should include culturally shared habits of mind and action. These habits of mind distort, obscure, and occlude important facts about subordinated groups and result in a failure to recognize their interests. How do we disrupt such practices to achieve greater justice? I argue that this is sometimes, but not always, best achieved by argument or challenging false beliefs, so social movements legitimately seek other means. (shrink)

This book seeks to remedy the contempt for law prominent in socialist writings. While political thinkers on the left are indisputably concerned with justice, they dismiss those legal institutions which, in liberal capitalist societies, have ensured some minimum measure of justice in citizens' lives. Marxists in particular have tended to reduce law to a capitalist apparatus necessary to mediate conflict between egoistic wills or social classes. The book argues against this doctrine by showing that however ideal a society socialists envisage, (...) legal institutions would be necessary to fairly adjudicate conflict between private and public interests. Each chapter takes up an issue in liberal jurisprudence to see how it would fare in a socialist theory which takes a constructive approach to law. The rule of law, natural and legal rights, obligations, and the sources of law are among the subjects covered. The book concludes that a socialist concept of law would enrich, not only debates about the nature of socialism, but also debates about community and justice which preoccupy `mainstream' political theory and jurisprudence. Neither philosophy in general, nor deconstruction in particular, should be thought of as a pioneering, path-breaking, tool for feminist politics. Recent philosophy, including Derrida's, helps us see practices and ideas as neither natural nor inevitable—but that is all it does. When philosophy has finished showing that everything is a social construct, it does not help us decide which social constructs to retain and which to replace.

During the past several decades, political philosophers have frequently clashed with one another over the question whether governments are morally required to remain neutral among reasonable conceptions of excellence and human flourishing. Whereas the numerous followers of John Rawls have maintained that a requirement of neutrality is indeed incumbent on every system of governance, other philosophers -- often designated as 'perfectionists' -- have argued against the existence of such a requirement. Liberalism with Excellence enters these debates not by plighting itself (...) unequivocally to one side or the other, but instead by reconceiving each of the sides and thus by redirecting the debates that have occurred between them. On the one hand, the book rejects the requirement of neutrality by contending that certain subsidies for the promotion of excellence in sundry areas of human endeavour can be proper and vital uses of resources by governments. Advocating such departures from the constraint of neutrality, the book presents a version of liberalism that can rightly be classified as 'perfectionist'. On the other hand, the species of perfectionism espoused in Liberalism with Excellence diverges markedly from the theories that have usually been so classified. Indeed, much of the book assails various aspects of those theories. What is more, the aspirational perfectionism elaborated in the closing chapters of the volume is reconcilable in most key respects with a suitably amplified version of Rawlsianism. Hence, by reconceiving both the perfectionist side and the neutralist side of the prevailing disputation, Liberalism with Excellence combines and transforms their respective insights. (shrink)
