This paper describes an approach to legal logic based on the formal analysis of argumentation schemes. Argumentation schemes a notion borrowed from the .eld of argumentation theory - are a kind of generalized rules of inference, in the sense that they express that given certain premises a particular conclusion can be drawn. However, argumentation schemes need not concern strict, abstract, necessarily valid patterns of reasoning, but can be defeasible, concrete and contingently valid, i.e., valid in certain contexts or under certain (...) circumstances. A method is presented to analyze argumentation schemes and it is shown how argumentation schemes can be embedded in a formal model of dialectical argumentation. (shrink)

Temporal logic arose at the border of philosophy and linguistics. From the seventies onward, it because a major tool also in computer science and artificial intelligence, which have turned into the most powerful source of new logical developments since. We discuss some recent themes demonstrating new connections with modal logic. In the course of this, we also point out some new types of open research questions.

There was a long tradition in philosophy according to which good reasoning had to be deductively valid. However, that tradition began to be questioned in the 1960’s, and is now thoroughly discredited. What caused its downfall was the recognition that many familiar kinds of reasoning are not deductively valid, but clearly confer justification on their conclusions. Here are some simple examples.

In many actual arguments, the conclusion seems intuitively to follow from the premisses, even though we cannot show that it follows logically. The traditional approach to evaluating such arguments is to suppose that they have an unstated premiss whose explicit addition will produce an argument where the conclusion does follow logically. But there are good reasons for doubting that people so frequently leave the premisses of their arguments unstated. The inclination to suppose that they do stems from the belief that (...) the only way in which an argument's conclusion can follow definitely from its premisses is to follow logically. I argue that this belief is mistaken. I propose a revision of the current generic conception of logical consequence, and its variant specifications, to avoid the paradoxes of strict implication. The revised conception can then be naturally extended to include also what we might call 'enthymematic consequence'. This concept is a kind of consequence, whose properties merit investigation. Dialogues and dialectics have come to playan important role in the field of ArtificialIntelligence and Law. This paper describes thelegal-theoretical and logical background of this role,and discusses the different services into whichdialogues are put. These services include:characterising logical operators, modelling thedefeasibility of legal reasoning, providing the basisfor legal justification and identifying legal issues,and establishing the law in concrete cases. Specialattention is given to the requirements oflaw-establishing dialogues.

It is often taken for granted by writers who propose--and, for that matter, by writers who oppose--'justifications' of inductions, that deduction either does not need, or can readily be provided with, justification. The purpose of this paper is to argue that, contrary to this common opinion, problems analogous to those which, notoriously, arise in the attempt to justify induction, also arise in the attempt to justify deduction.

The purpose of this paper is to communicate some developments in what we call the new logic. In a nutshell the new logic is a model of the behaviour of a logical agent. By these lights, logical theory has two principal tasks. The first is an account of what a logical agent is. The second is a description of how this behaviour is to be modelled. Before getting on with these tasks we offer a disclaimer and a warning. The disclaimer (...) is that although the new logic is significantly different from it, we have no inclination to see the new logic as a rival of mathematical logic. We do not advocate the displacement of, e.g. model theory, but rather its supplementation or adaptation. The warning is that, whereas mathematical logic must eschew psychologism, the new logic cannot do without it. Argumentation theory is a distinctly multidisciplinary field of inquiry. It draws its data, assumptions, and methods from disciplines as disparate as formal logic and discourse analysis, linguistics and forensic science, philosophy and psychology, political science and education, sociology and law, and rhetoric and artificial intelligence. This presents the growing group of interested scholars and students with a problem of access, since it is even for those active in the field not common to have acquired a familiarity with relevant aspects of (...) each discipline that enters into this multidisciplinary matrix. The aim of this book is to present the fundamental theoretical results concerning inference rules in deductive formal systems. Rule-applying legal arguments are traditionally treated as a kind of syllogism. Such a treatment overlooks the fact that legal principles and rules are not statements which describe the world, but rather means by which humans impose structure on the world. Legal rules create legal consequences, they do not describe them.
