Carl Schmitt once defined himself as a theologian of jurisprudence. This chapter argues that his concept of political theology must be understood within the context of jurisprudence and not as a thesis concerning the use of religion within politics. In its earlier configuration, Schmitt’s political theology is a multifaceted response to two juridical critiques of sovereignty: those of Hans Kelsen; and those of Otto von Gierke and the English pluralist school. In this early phase, Schmitt’s political theology is centered on (...) the juridical conception of representation and on the state as fictional personality, primarily as it is found in Thomas Hobbes. Through his extensive engagement with Hobbes’s interpretation of the Trinity or persons of God, Schmitt shows howjurisprudence aids in the understanding of theology rather than the other way around. Dyzenhaus deals with the urgent question of how governments should respond to emergencies and terrorism by exploring the idea that there is an unwritten constitution of law, exemplified in the common law constitution of Commonwealth countries. He looks mainly to cases decided in the United Kingdom, Australia and Canada to demonstrate that even in the absence of an entrenched bill of rights, the law provides a moral resource that can inform a rule-of-law project capable of responding to situations which place (...) legal and political order under great stress. Those cases are discussed against a backdrop of recent writing and judicial decisions in the United States of America in order to show that the issues are not confined to the Commonwealth. In this strikingly original work, Paul W. Kahn rethinks the meaning of political theology. In a text innovative in both form and substance, he describes an American political theology as a secular inquiry into ultimate meanings sustaining our faith in the popular sovereign. Kahn works out his view through an engagement with Carl Schmitt's 1922 classic, _Political Theology: Four Chapters on the Concept of Sovereignty_. He forces an engagement with Schmitt's four chapters, offering a new version of each that is (...) responsive to the American political imaginary. The result is a contemporary political theology. As in Schmitt's work, sovereignty remains central, yet Kahn shows how popular sovereignty creates an ethos of sacrifice in the modern state. He reminds readers that American political life begins with the revolutionary willingness to sacrifice and that both sacrifice and law continue to ground the American political imagination. Sein Werk wird dabei freilich meist isoliert betrachtet und allenfalls auf den staatsrechtlichen Kontext bezogen. Im Mittelpunkt dieses Buches steht dagegen der politische Intellektuelle, der weit über die Grenzen seines Faches hinauswirkte. Besondere Aufmerksamkeit gilt dabei den Anfangs- und den Endjahren der Weimarer Republik. Während Schmitt in München Strategien zur Zähmung der Revolution entwickelte, setzte er sich in seinen Berliner (...) Jahren für eine autoritäre Transformation der Verfassung ein, die neben der äußersten Linken auch die äußerste Rechte von der Macht fernhalten sollte. Das geschah nicht nur in der Form der verfassungsrechtlichen Expertise für Regierungskreise, sondern auch durch publizistische Interventionen, bei denen der in Bonn gebildete Schülerkreis Schmitts eine tragende Rolle spielte. Here, I have tried to show that a second look at the young Schmitt's legal thinking does bring clarity to the 'confused'� and 'polemical' debate about his theoretical and political legacy. Pace Schmitt, it helps demonstrate that Schmitt's embrace of German fascism was anticipated by key elements of his thinking about the dilemma of legal indeterminacy -- well before Hitler's rise to power.

Presenting the first critical analysis of Carl Schmitt's _The Nomos of the Earth_ and how it relates to the epochal changes in the international system that have risen from the collapse of the ‘Westphalian’ international order. There is an emerging recognition in political theory circles that core issues, such as order, social justice, rights, need to be studied in their global context. Betrachtet man die Sekundärliteratur, fällt auf, dass es so gut wie keine Monographie gibt, die Schmitts rechtswissenschaftliches Werk juristisch würdigt. Diese Lücke will die hier vorgelegte Untersuchung schließen, indem sie den eindeutigen Schwerpunkt auf seine Beiträge zum Staats- und Völkerrecht legt. Das erfordert die Untersuchung seiner Stellung im zeitgenössischen Schrifttum und die Klärung der Frage, ob einzelne (...) seiner Positionen und Begriffe noch heute in der Staatsrechtswissenschaft präsent sind. Erst in zweiter Linie werden seine Schriften zu den Grundlagenfächern Rechtstheorie und Rechtsphilosophie, Verfassungsgeschichte und allgemeine Staatslehre gewürdigt.
