Discusses the incompatibility of the concepts of free will and determinism and argues that moral responsibility needs the doctrine of free will.

Mainstream moral theories deal with situations in which the outcome of each possible action is well-determined and knowable. In order to make ethics relevant for problems of risk and uncertainty, moral theories have to be extended so that they cover actions whose outcomes are not determinable beforehand. One approach to this extension problem is to develop methods for appraising probabilistic combinations of outcomes. This approach is investigated and shown not to solve the problem. An alternative approach is then developed. Its (...) starting-point is that everyone has a prima facie moral right not to be exposed to risk. However, this right can be overridden if the risk-exposure is part of an equitable system for risk-taking that works to the advantage of the individual risk-exposed person. (shrink)

In this paper, I argue against Peter van Inwagen’s claim (in “Free Will Remains a Mystery”), that agent-causal views of free will could do nothing to solve the problem of free will (specifically, the problem of chanciness). After explaining van Inwagen’s argument, I argue that he does not consider all possible manifestations of the agent-causal position. More importantly, I claim that, in any case, van Inwagen appears to have mischaracterized the problem in some crucial ways. There is, no doubt, a temptation to treat preventions, such as ‘the father’s grabbing the child prevented the accident’, and cases of ‘causation’ by omission, such as ‘the father’s inattention was the cause of the child’s accident’, as cases of genuine causation. I think they are not, and in this paper I defend a theory of what they are. More specifically, the counterfactual theory defended here is that a claim about prevention or ‘causation’ by omission should be understood not as (...) being directly about actual genuine causation but primarily as a counterfactual claim about genuine causation.1 The relation between actual causation and the mere possibility of causation allows my theory to explain both the difference and the similarity between the two notions (causation and prevention/omission). Further, the difference explains certain intuitions we have and the similarity justifies and explains the fact that for practical purposes we usually treat preventions and omissions as if they were genuine causation. Finally, the fact that this counterfactual theory of prevention and omission takes causation as primitive suggests that it is consistent with any theory of causation. This allows us to construct two arguments against what I will call genuinism, the view that cases of prevention and ‘causation’ by omission really are cases of genuine causation. In section II I show that genuinism does not account for the so-called intuition of difference. In section III I outline a number of problems that various theories of causation have with preventions and ‘causation’ by omission. These problems are ipso facto problems for genuinism, whereas I show in section V how the counterfactual theory solves those problems. Further, I answer a genuinist argument based on another type of intuition—the genuinist intuition—by showing why we have that intuition and how it should be handled (section VI). (shrink)

The empiricist-compatibilist strategy falls, essentially, into two distinct stages of argument. Historically speaking, the first stage was initiated by Hobbes and the second stage was initiated by Hume. The first stage, which I shall refer to as the "compulsion argument" seeks to describe the general significance of the distinction between causation and compulsion for the "free will" dispute. The second stage of the empiricist-compatibilist strategy, which I shall refer to as the "regularity argument," endeavours to reconstruct the compulsion argument on (...) the foundation of the regularity theory of causation. My primary concern in this paper will be to examine the relation between these two stages of the empiricist-compatibilist strategy. Proponents of this strategy claim that the regularity argument strengthens the compatibilist position. I will argue, on the contrary, that the regularity argument generates serious difficulties for the compulsion argument and that it therefore weakens the compatibilist position. In this way I will be concerned to show that the traditional empiricist-compatibilist strategy suffers from significant internaltensions and that these tensions indicate that the regularity theory of causation does not serve as a particularly secure or congenial metaphysical foundation upon which to rest the compatibilist position as it is generally understood. This paper has two parts. In the first part, I concede an error in an argument I have given for the incompatibility of free will and determinism. I go on to show how to modify my argument so as to avoid this error, and conclude that the thesis that free will and determinism are compatible continues to be—to say the least—implausible. But if free will is incompatible with determinism, we are faced with a mystery, for free will undeniably exists, and (...) it also seems to be incompatible with indeterminism. In the second part of this paper, I will defend the conclusion that the concept of agent causation is of no use to the philosopher who wants to maintain that free will and indeterminism are compatible. I conclude that free will remains a mystery---that is, that free will undeniably exists and that there is a strong and unanswered prima facie case for its impossibility. (shrink)
