In this article, we develop and defend an account of the normative significance of nonhuman animal agency. In particular, we examine how animals’ agency interests impact upon the moral permissibility of our interactions with them. First, we defend the claim that nonhuman animals sometimes have rights to self-determination. However, unlike typical adult humans, nonhuman animals cannot exercise this right through the giving or withholding of consent. This combination of claims generates a puzzle about the permissibility of our interactions with nonhuman (...) animals. If animals sometimes have rights to self-determination, but lack the capacity to consent, then when, if ever, is it permissible for us to touch them, hold them, bathe them, or confine them? In the second half of the article, we develop a solution to this puzzle. We argue that while we cannot obtain animals’ consent, they can engage in authoritative communications of will through acts of “assent” and “dissent.”. (shrink)

Philosophers disagree about the moral status of harm-enabling, or behavior by which an agent removes an obstacle to the completion of a threatening sequence. I argue that enabling harm is equivalent to doing harm, at least when an agent withdraws a resource to which neither she nor the victim has any prior moral claim. This conclusion reinforces the common objection that deontological appeals to the doing/allowing distinction cannot easily handle cases involving the withdrawal of aid. I defend the Doctrine of Doing and Allowing: the claim that doing harm is harder to justify than merely allowing harm. A thing does not genuinely belong to a person unless he has special authority over it. The Doctrine of Doing and Allowing protects us against harmful imposition – against the actions or needs of another intruding on what is ours. As I write this, in November 1971, people are dying in East Bengal from lack of food, shelter, and medical caxc. The suffering and death that are occurring there now axe not inevitable, 1101; unavoidable in any fatalistic sense of the term. Constant poverty, a cyclone, and a civil war have turned at least nine million people into destitute refugees; nevertheless, it is not beyond Lhe capacity of the richer nations to give enough assistance to reduce any further suffering to (...) very small proportions. The decisions arid actions of human beings can prevent this kind of suffering. Unfortunately, human beings have not made the necessary decisions. At the individual level, people have, with very few exceptions, not responded to the situation in any signihczmt way. Generally speaking, people have not given large sums to relief funds; they have not written t0 their parliamentaxy representatives demanding increased government assistance; they have not demonstrated in the streets, held symbolic fasts, or done anything else directed toward providing thc refugees with the means to satisfy their essential needs. At thc government level, no govcrmmcnt has given the sort of massive aid that would enable the refugees to survive fm: more than a few days. Britain, for instance, has given rather more than most countries. It has, to date, given £14,750,000. For comparative purposes, B1~itain’s share of thc nonreccverabla development costs of the Anglo-French Concorde project is already in excess of £275,000,000, and on present estimates will reach £440,000,¤00. The Hybrid View endorses utilitarianism about animals and rejects utilitarianism about humans. This view has received relatively little sustained attention in the philosophical literature. Yet, as we show, the Hybrid View underlies many widely held beliefs about zoos, pet ownership, scientific research on animal and human subjects, and agriculture. We develop the Hybrid View in rigorous detail and extract several of its main commitments. Then we examine the Hybrid View in relation to the view that human use of animals constitutes (...) a special relationship. We show that it is intuitively plausible that our use of animals alters our moral obligations to animals. That idea is widely believed to be incompatible with the sort of utilitarian approach in animal ethics that is prescribed by the Hybrid View. To overturn that conventional wisdom, we develop two different principles concerning the moral significance of human use of animals, which we call the Partiality Principle and the Strengthening Principle. We show that the Partiality Principle is consistent with several key commitments of the Hybrid View. And, strikingly, we show that the Strengthening Principle is fully consistent with all of the main commitments of the Hybrid View. Thus we establish the surprising result that utilitarians about animals can coherently offer a robust and intuitively appealing account of the moral significance of animal use. (shrink)

One familiar criticism of utilitarianism is that it is too demanding. It requires us to promote the happiness of others, even at the expense of our own projects, our integrity, or the welfare of our friends and family. Recently Ashford has defended utilitarianism, arguing that it provides compelling reasons for demanding duties to help the needy, and that other moral theories, notably contractualism, are committed to comparably stringent duties. In response, I argue that utilitarianism is even more demanding than is (...) commonly realized: both act- and rule-utilitarianism are committed to extremely stringent duties to wild animals. In this regard, utilitarianism is more demanding (and more counter-intuitive) than contractualism. (shrink)

This paper employs (and defends where needed) a familiar four-part methodology for assessing moral theories. This methodology makes the most popular kind of moral pluralism--here called Ross-style pluralism--look extremely attractive. The paper contends, however, that, if rule-consequentialism's implications match our considered moral convictions as well as Ross-style pluralism's implications do, the methodology makes rule-consequentialism look even more attractive than Ross-style pluralism. The paper then attacks two arguments recently put forward in defence of Ross-style pluralism. One of these arguments is that (...) no moral theory containing some single normative principle to justify general pro tanto duties can do justice to the ineliminable role of judgment in moral thinking. The other argument is that no such theory is plausible in light of the fact that our moral ideas come from disparate historical sources. (shrink)

I argue that this view faces a largely neglected puzzle regarding the moral relevance of an agent's past behavior. Consider an agent who chooses to save five people rather than one, where the one person's life is in jeopardy because of something the agent did earlier. How are the agent's obligations affected by the fact that his now letting the one (...) die would retroactively make it the case that he has killed? I argue that the most promising deontological responses to this question are difficult to defend. Further, it is unclear how the deontologist can resolve a further set of cases, in which commonsense intuition indicates that an agent is required to terminate a threat she initiated more recently in preference to a threat she initiated less recently.
