This article explores the compatibility of posing and authenticity in portraiture. Often understood as a source of inauthenticity, I propose that posing in fact functions as an artistic tool that can support a truthful portrayal. My argument first discusses authenticity in relation to portraiture through the lens of Bernard Williams’s idea of “truthfulness,” which relies on his notions of “accuracy” and “sincerity.” Second, I introduce a phenomenology of posing. I identify two aspects of posing that can be present in the (...) portrait; these are the “posing sitter,” who holds the actual physical pose, but also point out the use of a “posing effect” in the image, which I call the “posed sitter.” Third, I address the worry of posing as a source of inauthenticity and demonstrate how this can be reframed in order to lay bare its capacity for enhancing truthfulness. The pose then need not be regarded with suspicion of artifice that clouds the authenticity of the sitter; instead, it can offer an approach to truthfully portray the sitter. (shrink)

The phenomenological tradition is commonly understood as the domain of “philosophy of the subject”, and in this regard it is often criticized in contemporary thought. In respect to it, the originality of Michel Henry is to enter into this tradition by formulating to it an inverse objection: a mistake of the “historic” phenomenology is that it has not been able to conceive the subject in its own being or better, in its “interiority”. The aim of this paper is to determine (...) the meaning and scope of such criticism, the development of its consequences, not only regarding the positive concept of subjectivity but also in the sense of opening its possibilities to renew the understanding of artistic phenomenon. My aim in the present paper is to develop a new kind of argument in support of the ideal of liberal neutrality. This argument combines some basic moral principles with a thesis about the relationship between the correct standards of justification for a belief/action and certain contextual factors. The idea is that the level of importance of what is at stake in a specific context of action determines how demanding the correct standards to justify an action based on a specific (...) set of beliefs ought to be. In certain exceptional contexts –where the seriousness of harm in case of mistake and the level of an agent’s responsibility for the outcome of his action are specially high– a very small probability of making a mistake should be recognized as a good reason to avoid to act based on beliefs that we nonetheless affirm with a high degree of confidence and that actually justify our action in other contexts. The further steps of the argument consist in probing 1) that the fundamental state’s policies are such a case of exceptional context, 2) that perfectionist policies are the type of actions we should avoid, and 3) that policies that satisfy neutral standards of justification are not affected by the reasons which lead to reject perfectionist policies. L’objectif de cet article est de développer un nouveau type d’argument en faveur de l’idéal la neutralité libérale. Cet argument combine des principes moraux de base à une thèse concernant le rapport entre, d’une part, les standards de justification corrects d’une croyance/action et, d’autre part, certains facteurs contextuels. L’idée de fond est que l’importance de ce dont il est question dans un contexte spécifique d’actions détermine le niveau d’exigence des standards de justification pour une action basée sur un ensemble spécifique de croyances. Dans certains contextes exceptionnels – où l’importance du tort causé en cas d’erreur est grande et où le niveau de responsabilité de l’agent envers ses actions est élevé – une très petite probabilité d’erreur devrait être considérée comme une bonne raison d’éviter d’agir en suivant des croyances que, néanmoins, nous affirmons avec un haut niveau de confiance et qui justifient nos actions dans d’autres contextes. Les étapes de l’argumentation consistent à vérifier que 1) les politiques fondamentales de l’État sont un cas d’un tel type de contexte exceptionnel, 2) les politiques perfectionnistes sont le type d’actions que l’on devrait éviter, et 3) les politiques qui satisfont les standards de justification neutre ne sont pas affectées par les raisons qui nous poussent à rejeter les politiques perfectionnistes. Philosophers are often credited with particularly well-developed conceptual skills. The ‘expertise objection’ to experimental philosophy builds on this assumption to challenge inferences from findings about laypeople to conclusions about philosophers. We draw on psycholinguistics to develop and assess this objection. We examine whether philosophers are less or differently susceptible than laypersons to cognitive biases that affect how people understand verbal case descriptions and judge the cases described. We examine two possible sources of difference: Philosophers could be better at deploying concepts, (...) and this could make them less susceptible to comprehension biases (‘linguistic expertise objection’). Alternatively, exposure to different patterns of linguistic usage could render philosophers vulnerable to a fundamental comprehension bias, the linguistic salience bias, at different points (‘linguistic usage objection’). Together, these objections mount a novel ‘master argument’ against experimental philosophy. To develop and empirically assess this argument, we employ corpus analysis and distributional semantic analysis and elicit plausibility ratings from academic philosophers and psychology undergraduates. Our findings suggest philosophers are better at deploying concepts than laypeople but are susceptible to the linguistic salience bias to a similar extent and at similar points. We identify methodological consequences for experimental philosophy and for philosophical thought experiments. (shrink)

Different sort of people are interested in personal identity. Philosophers frequently ask what it takes to remain oneself. Caregivers imagine their patients’ experience. But both philosophers and caregivers think from the armchair: they can only make assumptions about what it would be like to wake up with massive bodily changes. Patients with a locked-in syndrome (LIS) suffer a full body paralysis without cognitive impairment. They can tell us what it is like. Forty-four chronic LIS patients and 20 age-matched healthy medical (...) professionals answered a 15-items questionnaire targeting: (A) global evaluation of identity, (B) body representation and (C) experienced meaning in life. In patients, selfreported identity was correlated with B and C. Patients differed with controls in C. These results suggest that the paralyzed body remains a strong component of patients’ experienced identity, that patients can adjust to objectives changes perceived as meaningful and that caregivers fail in predicting patients’ experience. The EDPS Ethics Advisory Group (EAG) has carried out its work against the backdrop of two significant social-political moments: a growing interest in ethical issues, both in the public and in the private spheres and the imminent entry into force of the General Data Protection Regulation (GDPR) in May 2018. For some, this may nourish a perception that the work of the EAG represents a challenge to data protection professionals, particularly to lawyers in the field, as well as to companies (...) struggling to adapt their processes and routines to the requirements of the GDPR. What is the purpose of a report on digital ethics, if the GDPR already provides all regulatory requirements to protect European citizens with regard to the processing of their personal data? Does the existence of this EAG mean that a new normative ethics of data protection will be expected to fill regulatory gaps in data protection law with more flexible, and thus less easily enforceable ethical rules? Does the work of the EAG signal a weakening of the foundation of legal doctrine, such as the rule of law, the theory of justice, or the fundamental values supporting human rights, and a strengthening of a more cultural approach to data protection? Not at all. The reflections of the EAG contained in this report are not intended as the continuation of policy by other means. It neither supersedes nor supplements the law or the work of legal practitioners. Its aims and means are different. On the one hand, the report seeks to map and analyse current and future paradigm shifts which are characterised by a general shift from analogue experience of human life to a digital one. On the other hand, and in light of this shift, it seeks to re-evaluate our understanding of the fundamental values most crucial to the well-being of people, those taken for granted in a data-driven society and those most at risk. The objective of this report is thus not to generate definitive answers, nor to articulate new norms for present and future digital societies but to identify and describe the most crucial questions for the urgent conversation to come. This requires a conversation between legislators and data protection experts, but also society at large - because the issues identified in this report concern us all, not only as citizens but also as individuals. They concern us in our daily lives, whether at home or at work and there isn’t a place we could travel to where they would cease to concern us as members of the human species. (shrink)

Garreta Leclercq, uno de los principales objetivos del liberalismo contemporáneo, surgido a partir de la obra de John Rawls, consiste en brindar una conexión coherente entre tres ideas básicas: la de legitimidad política -según la cual los principios que guían el accionar estatal no deberían poder ser rechazados razonablemente por los ciudadanos razonables-, la de neutralidad de justificación -de acuerdo con la cual el Estado no debe apelar a la verdad de doctrinas comprehensivas para fundamentar su ejercicio del poder político - y la de persona razonable, es decir, un individuo que, por un lado, renuncia a usar el poder estatal para imponer su doctrina como verdadera y, por el otro, participa del esfuerzo cooperativo para alcanzar fundamentos políticos que sean independientes de la aceptación de una determinada doctrina comprehensiva.
