  1. The Business of Double-Effect: The Ethics of Bankruptcy Protection and the Principle of Double-Effect.Henry S. Kuo - 2020 - Journal of Religion and Business Ethics 4 (11):1-25.
After the terrorist attacks of September 11, 2001, most legacy airlines filed for bankruptcy protection as a way to cut costs drastically, with the exception of American Airlines. This article applies the Principle of Double-Effect to the act of filing for Chapter 11 bankruptcy protection for reasons of management strategy, in particular, cost-cutting. It argues that the Principle can be a useful tool for discerning the ethicality of the action, and demonstrates the usefulness by proposing three double-effect criteria (...)

Debate about legal and policy reform has been haunted by a pernicious confusion about human nature, the idea that it is a set of rigid dispositions, today generally conceived as genetic, that is manifested the same way in all circumstances. Opponents of egalitarian alternatives argue that we cannot depart far from the status quo because human nature stands in the way. Advocates of such reforms too often deny the existence of human nature because, sharing this conception, they think it would (...)

  3. The Minimal Overlap Rule: Restrictions on Mergers for Creditors' Consensus.J. Alcalde, J. A. Silva & M. C. Marco-Gil - manuscript
As it is known, there is no rule satisfying Additivity in the complete domain of bankruptcy problems. This paper proposes a notion of partial Additivity in this context, to be called µ-additivity. We find that µ-additivity, together with two quite compelling axioms, anonymity and continuity, identify the Minimal Overlap rule, introduced by Neill (1982).

  4. Distributive Justice and the Relief of Household Debt.Govind Persad - 2018 - Journal of Political Philosophy 26 (3):327-343.
Household debt has been widely discussed among social scientists, policy makers, and activists. Many have questioned the levels of debt households are required to take on, and have made various proposals for assisting households in debt. Yet theorists of distributive justice have left household debt underexamined. This article offers a normative examination of the distributive justice issues presented by proposals to relieve household debt or protect households from overindebtedness. I examine two goals at which debt relief proposals aim: remedying disadvantage (...)

  5. Globalization and the Crisis in Detroit.Gail Presbey - 2015 - Perspectives on Global Development and Technology 15 (1-2):261-77.
This article reviews the recent crisis in Detroit focusing on the placement of an Emergency Manager in charge of financial decisions, and a bankruptcy process. This political disenfranchisement harmed the pensions of city employees and offered valuable real estate to investors at low prices. While the crisis was long in the making, with deindustrialization and residential segregation beginning in the 1950s, the crisis was exacerbated in 2008 with the mortgage crisis and with water shut-offs to residences. The greatest harms (...)

  6. Acedia: The Etiology of Work-engendered Depression.Steven James Bartlett - 1990 - New Ideas in Psychology 8 (3):389-396.
There has been a general failure among mental health theorists and social psychologists to understand the etiology of work-engendered depression. Yet the condition is increasingly prevalent in highly industrialized societies, where an exclusionary focus upon work, money, and the things that money can buy has displaced values that traditionally exerted a liberating and humanizing influence. Social critics have called the result an impoverishment of the spirit, a state of cultural bankruptcy, and an incapacity for genuine leisure. From a clinical (...)

  7. An Economic Examination of Collateralization in Different Financial Markets.Tim Xiao - manuscript
This paper attempts to assess the economic significance and implications of collateralization in different financial markets, which is essentially a matter of theoretical justification and empirical verification. We present a comprehensive theoretical framework that allows for collateralization adhering to bankruptcy laws. As such, the model can back out differences in asset prices due to collateralized counterparty risk. This framework is very useful for pricing outstanding defaultable financial contracts. By using a unique data set, we are able to achieve a (...)

  8. A New Model for Pricing Collateralized Financial Derivatives.Tim Xiao - 2017 - Journal of Derivatives 24 (4):8-20.
This paper presents a new model for pricing OTC derivatives subject to collateralization. It allows for collateral posting adhering to bankruptcy laws. As such, the model can back out the market price of a collateralized contract. This framework is very useful for valuing outstanding derivatives. Using a unique dataset, we find empirical evidence that credit risk alone is not overly important in determining credit-related spreads. Only accounting for both collateral arrangement and credit risk can sufficiently explain unsecured credit costs. (...)

The aim of this paper is to show that the French philosopher and historian of science Abel Rey played a more influential role in the formative phase of the Vienna Circle than hitherto supposed. On the whole, it will be argued that Rey's contribution had political impact. His interpretation of "modern physics" in 1907 in the face of the alleged "bankruptcy of science" should be appreciated as a masterpiece of applied enlightenment thought. As such, it was especially paradigmatic for (...)

There have been several recent lawsuits in which problem gamblers (or those affected by problem gambling) have sued casinos or other gaming companies for damages relating to bankruptcies, suicides, and other negative consequences of compulsive gambling. Although the legal cases have been decided in favor of the gaming companies, it can seem as though there is a moral residue in some of these cases: perhaps some of the actions of the gaming companies, though legal, have been morally problematic. This case (...)

  12. Five Variations of Transformative Law: Beyond Private and Public Interests.Poul F. Kjaer - 2023 - Erasmus Law Review 16 (2):1 - 7.
The regulation of the interfaces of private and public interests is a central and recurrent issue of modern law. The centrality of the distinction and the manifold conceptual and practical problems associated with it has moreover been exacerbated over the past fifty years through the dominance of the twin-episteme of law constituted by law and economics and human rights law. Against this background, an alternative approach to and concept of law, transformative law, is briefly introduced. An approach which implies replacing (...)

Over the years, mathematics and statistics have become increasingly important in the social sciences1 . A look at history quickly confirms this claim. At the beginning of the 20th century most theories in the social sciences were formulated in qualitative terms while quantitative methods did not play a substantial role in their formulation and establishment. Moreover, many practitioners considered mathematical methods to be inappropriate and simply unsuited to foster our understanding of the social domain. Notably, the famous Methodenstreit also concerned (...)

Raymond Carver's stories have received many labels: minimalism, K-mart fiction, low-rent tragedy, neo-realism. Paring language, plot, and characterization to the bone, Carver concentrates his stories on instances of judgment and choice. These climactic moments affect not only the characters, but also the reader, who is called to fill the gaps in the text. The gaps generally show the unrelatedness of the characters' responses to the situations in which they find themselves. Relying on formulae, concepts, and rules taken for granted as (...)

In the book, he presents how the media ruthlessly exploited this subject, accentuating the panic. Many major studies have predicted the emergence of such a pandemic, but have been ignored by all governments, declaring them to be exaggerated. Žižek believes that the current pandemic has led to the bankruptcy of the current "barbaric" capitalism, wondering if (...)

In their recent book, Judith Butler and Athena Athanasiou discuss the concept of dispossession in all its complexity, in the context of enforced austerity measures in Europe and a global Occupy movement. The concept of “dispossession” clarifies how we actually depend on others in a sustained social world, that in fact the self is social. I (...)

  21. The Paradox of Refuting Socrates' Paradox.Thomas Giourgas - 2008 - Dissertation, Edinburgh
What is paradoxical about the Socratic paradoxes is that they are not paradoxical at all. Socrates famously argued that knowledge is sufficient for virtue and that no one errs willingly. Both doctrines are discussed in the Protagoras between Socrates and the Abderian sophist, however the argumentative line that Socrates chooses to follow in order to refute ‘the many’ has raised a serious degree of controversy among scholars. Is Socrates upholding the hedonistic view? Or, is he only trying to show the (...)

The paper begins with a retrospective of the debates on the origin of life: the virus or the cell? The virus needs a cell for replication, instead the cell is a more evolved form on the evolutionary scale of life. In addition, the study of viruses raises pressing conceptual and philosophical questions about their nature, their classification, and their place in the biological world. The subject of pandemics is approached starting from the existentialism of Albert Camus and Sartre, the replacement (...)
