After the terrorist attacks of September 11, 2001, most legacy airlines filed for bankruptcy protection as a way to cut costs drastically, with the exception of American Airlines. This article applies the Principle of Double-Effect to the act of filing for Chapter 11 bankruptcy protection for reasons of management strategy, in particular, cost-cutting. It argues that the Principle can be a useful tool for discerning the ethicality of the action, and demonstrates the usefulness by proposing three double-effect criteria (...) that, when fulfilled, argues for the ethical justifiability the action in question. Debate about legal and policy reform has been haunted by a pernicious confusion about human nature, the idea that it is a set of rigid dispositions, today generally conceived as genetic, that is manifested the same way in all circumstances. Opponents of egalitarian alternatives argue that we cannot depart far from the status quo because human nature stands in the way. Advocates of such reforms too often deny the existence of human nature because, sharing this conception, they think it would (...) prevent changes they deem desirable. Both views rest on deep errors about what it is to have a nature and how genetics works. Human nature, like the nature of anything else, is a set of potentials to behave certain ways in given environments, not a nonsocial genetic something that inevitably produces the same result in any environment. To say that existing inequalities, are due to our genes, inalterable because heritable, ignores that genetic propensities may be differently manifested in different environments. Heritability has meaning only relative to an environment and a population and implies nothing about inevitability. A better sort of inegalitarian argument is that a proposed reform, given our nature, would be too costly even if possible. However, this sort of argument is too rarely supported by evidence and generally ignores the costs of existing inequalities. But egalitarians err in supposing that, if behavior is unconstrained by biology, the status quo is easily alterable. The environment may be extremely hard to change. Legal and policy debate should adopt a correct understanding of human nature as a set of propensities and ask of any proposed reform agreed to be otherwise desirable what and how alterable are its causes, genetic, environmental, or more accurately both. As it is known, there is no rule satisfying Additivity in the complete domain of bankruptcy problems. This paper proposes a notion of partial Additivity in this context, to be called µ-additivity. We find that µ-additivity, together with two quite compelling axioms, anonymity and continuity, identify the Minimal Overlap rule, introduced by Neill (1982).

Household debt has been widely discussed among social scientists, policy makers, and activists. Many have questioned the levels of debt households are required to take on, and have made various proposals for assisting households in debt. Yet theorists of distributive justice have left household debt underexamined. This article offers a normative examination of the distributive justice issues presented by proposals to relieve household debt or protect households from overindebtedness. I examine two goals at which debt relief proposals aim: remedying disadvantage (...) and stabilizing expectations. I then examine strategies for relieving existing debts such as debt abolition, forgiveness, bankruptcy, and mitigation, as well as strategies that aim to prevent future indebtedness, such as public provision or financing of costly goods and credit or interest rate regulations. This article reviews the recent crisis in Detroit focusing on the placement of an Emergency Manager in charge of financial decisions, and a bankruptcy process. This political disenfranchisement harmed the pensions of city employees and offered valuable real estate to investors at low prices. While the crisis was long in the making, with deindustrialization and residential segregation beginning in the 1950s, the crisis was exacerbated in 2008 with the mortgage crisis and with water shut-offs to residences. The greatest harms (...) were felt by African American families in the city. The article takes toll of the harms suffered and chronicles movements of resistance against Emergency Management and community organizing efforts. (shrink)

There has been a general failure among mental health theorists and social psychologists to understand the etiology of work-engendered depression. Yet the condition is increasingly prevalent in highly industrialized societies, where an exclusionary focus upon work, money, and the things that money can buy has displaced values that traditionally exerted a liberating and humanizing influence. Social critics have called the result an impoverishment of the spirit, a state of cultural bankruptcy, and an incapacity for genuine leisure. From a clinical (...) perspective, the condition has been diagnosed as widespread narcissism and obsessive work. -/- Acedia, a concept developed by the Scholastics, throws clarifying light on the origin of this form of depression. This paper attempts to assess the economic significance and implications of collateralization in different financial markets, which is essentially a matter of theoretical justification and empirical verification. We present a comprehensive theoretical framework that allows for collateralization adhering to bankruptcy laws. As such, the model can back out differences in asset prices due to collateralized counterparty risk. This framework is very useful for pricing outstanding defaultable financial contracts. By using a unique data set, we are able to achieve a (...) clean decomposition of prices into their credit risk factors. We find empirical evidence that counterparty risk is not overly important in credit-related spreads. Only the joint effects of collateralization and credit risk can sufficiently explain unsecured credit costs. This finding suggests that failure to properly account for collateralization may result in significant mispricing of financial contracts. We also analyze the difference between cleared and OTC markets. (shrink)

This paper presents a new model for pricing OTC derivatives subject to collateralization. It allows for collateral posting adhering to bankruptcy laws. As such, the model can back out the market price of a collateralized contract. This framework is very useful for valuing outstanding derivatives. Using a unique dataset, we find empirical evidence that credit risk alone is not overly important in determining credit-related spreads. Only accounting for both collateral arrangement and credit risk can sufficiently explain unsecured credit costs. (...) The aim of this paper is to show that the French philosopher and historian of science Abel Rey played a more influential role in the formative phase of the Vienna Circle than hitherto supposed. On the whole, it will be argued that Rey's contribution had political impact. His interpretation of "modern physics" in 1907 in the face of the alleged "bankruptcy of science" should be appreciated as a masterpiece of applied enlightenment thought. As such, it was especially paradigmatic for (...) Philipp Frank's "positivist" defense of the theory of relativity and quantum mechanics against the irrationalist tendencies of the 1920s and 1930s. There have been several recent lawsuits in which problem gamblers (or those affected by problem gambling) have sued casinos or other gaming companies for damages relating to bankruptcies, suicides, and other negative consequences of compulsive gambling. Although the legal cases have been decided in favor of the gaming companies, it can seem as though there is a moral residue in some of these cases: perhaps some of the actions of the gaming companies, though legal, have been morally problematic. This case (...) invites students to explore this possibility by introducing them to the facts surrounding the lawsuits and highlighting some of the most salient moral considerations. The regulation of the interfaces of private and public interests is a central and recurrent issue of modern law. The centrality of the distinction and the manifold conceptual and practical problems associated with it has moreover been exacerbated over the past fifty years through the dominance of the twin-episteme of law constituted by law and economics and human rights law. Against this background, an alternative approach to and concept of law, transformative law, is briefly introduced. An approach which implies replacing (...) the notions of private and public interests with the concepts of legally constituted public power and societal power. In order to analyse the potential and limits of transformative law, five legal phenomena, central to the other contributions to this special issue, are analysed: public interest litigation; legal mobilisation in the preliminary ruling procedure; bankruptcy proceedings; third-party litigation and the Meta Oversight Board. Over the years, mathematics and statistics have become increasingly important in the social sciences1 . A look at history quickly confirms this claim. At the beginning of the 20th century most theories in the social sciences were formulated in qualitative terms while quantitative methods did not play a substantial role in their formulation and establishment. Moreover, many practitioners considered mathematical methods to be inappropriate and simply unsuited to foster our understanding of the social domain. Notably, the famous Methodenstreit also concerned (...) the role of mathematics in the social sciences. Here, mathematics was considered to be the method of the natural sciences from which the social sciences had to be separated during the period of maturation of these disciplines. All this changed by the end of the century. By then, mathematical, and especially statistical, methods were standardly used, and their value in the social sciences became relatively uncontested. The use of mathematical and statistical methods is now ubiquitous: Almost all social sciences rely on statistical methods to analyze data and form hypotheses, and almost all of them use (to a greater or lesser extent) a range of mathematical methods to help us understand the social world. Additional indication for the increasing importance of mathematical and statistical methods in the social sciences is the formation of new subdisciplines, and the establishment of specialized journals and societies. Indeed, subdisciplines such as Mathematical Psychology and Mathematical Sociology emerged, and corresponding journals such as The Journal of Mathematical Psychology (since 1964), The Journal of Mathematical Sociology (since 1976), Mathematical Social Sciences (since 1980) as well as the online journals Journal of Artificial Societies and Social Simulation (since 1998) and Mathematical Anthropology and Cultural Theory (since 2000) were established. What is more, societies such as the Society for Mathematical Psychology (since 1976) and the Mathematical Sociology Section of the American Sociological Association (since 1996) were founded. Similar developments can be observed in other countries. The mathematization of economics set in somewhat earlier (Vazquez 1995; Weintraub 2002). However, the use of mathematical methods in economics started booming only in the second half of the last century (Debreu 1991). Contemporary economics is dominated by the mathematical approach, although a certain style of doing economics became more and more under attack in the last decade or so. Recent developments in behavioral economics and experimental economics can also be understood as a reaction against the dominance (and limitations) of an overly mathematical approach to economics. There are similar debates in other social sciences. It is, however, important to stress that problems of one method (such as axiomatization or the use of set theory) can hardly be taken as a sign of bankruptcy of mathematical methods in the social sciences tout court. This chapter surveys mathematical and statistical methods used in the social sciences and discusses some of the philosophical questions they raise. It is divided into two parts. Sections 1 and 2 are devoted to mathematical methods, and Sections 3 to 7 to statistical methods. As several other chapters in this handbook provide detailed accounts of various mathematical methods, our remarks about the latter will be rather short and general. Raymond Carver's stories have received many labels: minimalism, K-mart fiction, low-rent tragedy, neo-realism. Paring language, plot, and characterization to the bone, Carver concentrates his stories on instances of judgment and choice. These climactic moments affect not only the characters, but also the reader, who is called to fill the gaps in the text. The gaps generally show the unrelatedness of the characters' responses to the situations in which they find themselves. Relying on formulae, concepts, and rules taken for granted as (...) common knowledge, Carver's characters make choices and judgments which reveal the displacement of their consciousness of themselves and of the world. In trying to fill the gaps, the reader finds himself/herself in the same stance of making judgments and choices, and of looking at his/her own displacement. This predicament is more poignantly conveyed in the early stories, collected in Will You Please Be Quiet, Please?, Furious Seasons, and What We Talk About When We Talk About Love, since Carver writes about people "on the other side of the tracks," that is, on the edges of the sites of power and decisions. Bartenders, wage workers, and salespeople, Carver's characters in these early stories see their lives always threatened by joblessness, bankruptcy, and homelessness. In the later stories, collected in Cathedral and Where I'm Calling From, Carver explores possibilities in conversation, storytelling, and rituals that celebrate the here and now of each occasion and allow the merging of voices and feelings that places the individual's consciousness in the world. Following the declaration of the COVID-19 pandemic, Slavoj Žižek published a book called "Pandemic!: COVID-19 Shakes the World", which triggered a wave of reactions. In the book, he presents how the media ruthlessly exploited this subject, accentuating the panic. Many major studies have predicted the emergence of such a pandemic, but have been ignored by all governments, declaring them to be exaggerated. Žižek believes that the current pandemic has led to the bankruptcy of the current "barbaric" capitalism, wondering if (...) the path that humanity will take is a neo-communism (he describes himself as a "radical leftist" and a "communist in a qualified sense”). Žižek argues these ideas with the pandemic socio-political measures of German Chancellor Angela Merkel and the President of France, and the temporary nationalization of the railways by Boris Johnson. "Even [US President Donald] Trump transferred billions of dollars to the public. He issued calls to take over the private sector insofar as medical supplies are concerned." The authors of the book have come to the conclusion that it is necessary to effectively use modern management mechanisms and development strategies of economic entities in order to increase the efficiency of their activities. Basic research focuses on diagnostics threat of bankruptcy, assessment of bioenergy potential, intellectual property, efficiency of corporate governance, use of information support, ensuring competitiveness of banking institutions, functioning of the tax system and its decentralization, assessment of the investment climate and investment risks, functioning of (...) a small business. The research results have been implemented in the different models of cluster structures, mechanisms for monitoring the quality of health care, predicting the convergence of economic development, innovative development models, and development strategies of economic entities in various sectors of the economy in the context of euro integration. The results of the study can be used in decisionmaking at the level of international business, ministries and departments that regulate the processes development of economic systems, ensuring stability and efficiency. The results can also be used by students and young scientists in modern concepts of the development of economic entities in the context of institutional transformations of the global environment. The paper discusses the concept of "crisis" in the context of the city of Detroit's bankruptcy under the rule of the Governor-appointed Emergency Manager. In their recent book, Judith Butler and Athena Athanasiou discuss the concept of dispossession in all its complexity, in the context of enforced austerity measures in Europe and a global Occupy movement. The concept of “dispossession” clarifies how we actually depend on others in a sustained social world, that in fact the self is social. I (...) will use their reflections as a springboard for analysis of the imposition of an emergency manager on the City of Detroit and the subsequent bankruptcy hearings for the city, which along with the mortgage and foreclosure crisis and now recent water shut-offs have resulted in dispossessing the poorest of the poor from their modest possessions. However Detroit is also the scene of a robust response, as people take to the streets in acts of solidarity to demand their city back. As Athena and Butler caution, activists should not fall into reinforcing the disastrous concept of personhood reinforced by possession. There are other ways of engaging with each other politically to forge a common cause that escape the negative aspects of “possession.” The project of getting people together at the grassroots, knowing each other, finding strength in leaning on each other, finding confidence to challenge the status quo that is tearing communities apart – that is the activism that is ongoing in Detroit. What is paradoxical about the Socratic paradoxes is that they are not paradoxical at all. Socrates famously argued that knowledge is sufficient for virtue and that no one errs willingly. Both doctrines are discussed in the Protagoras between Socrates and the Abderian sophist, however the argumentative line that Socrates chooses to follow in order to refute ‘the many’ has raised a serious degree of controversy among scholars. Is Socrates upholding the hedonistic view? Or, is he only trying to show the (...) bankruptcy of the explanation of akrasia as ‘being overcome by pleasure’ which ‘the many’ advocate? Socrates intends to do the latter, showing that this hedonistic explanation of akrasia leads to absurdity. Plato’s and Socrates’ identification of goodness with pleasure would mark a sudden and unexplained departure from their moral theories, and would render the Socratic denial of akrasia an argument with limited range –only for those assuming hedonism. If we are correct to hold that Socrates does not intend to identify the good with the pleasant, then we are immediately put against a new and much more difficult challenge; that is, to suggest how the Socratic denial of akrasia could regain its catholic plausibility against the commonsensical stance to akrasia, namely that people act against their best judgment due to their impotence to resist to motivational forces such as pleasure, pain, fear, passion and love. Socrates does not offer any other explicit account –apart from the hedonistic one- of how his doctrine could be catholically defended; hence the task of decoding the Socratic line of thought is far from an easy one. The key move in order to decode the puzzling Socratic doctrine is to understand how Socrates treats the notion of ‘knowledge’. For Socrates, moral knowledge is distinguished from mere belief; in this sense, only knowledge has the commanding power which enables one to sustain his best evaluative judgment against other motivational forces and only knowledge is sufficient for the virtuous conduct. By contrast, as mere belief is susceptible to other motivational forces like pleasure, pain, fear, etc. its possessor will, in turn, be susceptible to the revision of his intentions which derive from his best value judgment. In the Protagoras, Socrates implies that intentions grounded on belief can be ‘dragged around’ by desire; and according to my view in this paper, this Socratic stance allows a non-epistemic interpretation of his thesis. According to the traditional epistemic interpretation of the Socratic denial of akrasia, one’s wrongdoing is always a miscalculation that takes place on his practical syllogism. However, my understanding of the Socratic denial of akrasia allows cases of one even going against his best judgment, when his judgment is based on belief. In that sense, a judgment grounded on belief has insufficient power to guarantee that the chosen action will follow, whereas only judgments grounded on knowledge have a commanding and lordly power. For Socrates, everyone always goes for the good but only those with knowledge can infallibly discover and act on the good. Those with mere belief can only reach an apparent good, which may be good or bad. The motivation for the good is not unshakeable for those with mere belief since the grounding of their belief is scarcely strong enough to hold on the correct intention. Socrates therefore holds that the grounding of knowledge influences the motivational state of the moral agent. Thereupon, my interpretation differs from others in suggesting that for Socrates not all the cases of akrasia are cognitive mistakes in their judgment. The purpose of this article is to examine restructuring procedures according to existing UAE laws and draft legislation on bankruptcy.

Despite the diversity of perceptions of what postmodernity is, there is a point of convergence between a significant part of the scholars of the theme, which is characterizing this period as a period of bankruptcy and disbelief in totalizing ideas. Through the eyes of Emil Cioran, we see the great ideologies and metanarratives as desired eschatologies, defined by the author as utopias, in which, not only is a possibility of a rationalized end composed, but also an adequate form of (...) end. In this work, we intend to extract concepts for what modernity and post-modernity become, to present characteristics of the conception of this and how these same characteristics are present in the writings of Emil Cioran, specifically in his essays “Genealogy of fanaticism” and “Mechanism of utopia”. On September 7, 2008 the executive administration of American President George W. Bush announced that his government would take over the giant mortgage finance companies Fannie Mae and Freddie Mac, costing the citizens $200 billion. One week later, the 160 year-old American investment bank Lehman Brothers filed for the largest bankruptcy in U.S. history. What would soon be known worldwide as “the financial crisis” had begun. In response to that crisis, less than a month later, on October 3, 2008, (...) the United States Congress passed the Emergency Economic Stabilization Act of 2008, which established the Troubled Asset Relief Program and authorized the use of $700 billion in taxpayer funds to bail out the banking and finance industry. As a result, the U.S. Treasury reports that the total bailout gave Bank of America $45 billion, Citigroup Bank $45 billion, AIG Bank $40 billion, J. P Morgan $25 billion, Wells Fargo $25 billion, General Motors $10.4 billion, Goldman Sachs $10 billion, Morgan Stanley $10 billion, GMAC $5 billion, and Chrysler corporation, a mere $4 billion. This response to a perceived crisis was not limited to the United States. On October 12, 2008—in one day alone—the United Kingdom coughed up the equivalent of €679 billion in bank relief. And in Germany, Der Spiegel reported on December 23, 2008 “The German government whipped its €480 billion bank bailout package through parliament in record time.". (shrink)

The paper begins with a retrospective of the debates on the origin of life: the virus or the cell? The virus needs a cell for replication, instead the cell is a more evolved form on the evolutionary scale of life. In addition, the study of viruses raises pressing conceptual and philosophical questions about their nature, their classification, and their place in the biological world. The subject of pandemics is approached starting from the existentialism of Albert Camus and Sartre, the replacement (...) of the exclusion ritual with the disciplinary mechanism of Michel Foucault, and about the Gaia hypothesis, developed by James Lovelock and supported in the current pandemic by Bruno Latour. The social dimensions of pandemics, their connection to global warming, which has led to an increase in infectious diseases, and the deforestation of large areas, which have caused viruses to migrate from their native area (their "reservoir") are highlighted below. The ethics of pandemics is approached from several philosophical points of view, of which the most important in a crisis of such global dimensions is utilitarianism which involves maximizing benefits for society in direct conflict with the usual (Kantian) view of respect for people as individuals. After a retrospective of the COVID-19 virus that caused the current pandemic, its life cycle and its history, with an emphasis on the philosophy of death, the concept of biopower initially developed by Foucault is discussed, with reference to the practice of modern states of control of the populations and the debate generated by Giorgio Agamben who states that what is manifested in this pandemic is the growing tendency to use the state of emergency as a normal paradigm of government. An interesting and much debated approach is the one generated by the works of Slavoj Žižek, who states that the current pandemic has led to the bankruptcy of the current "barbaric" capitalism, wondering if the path that humanity will take is a neo-communism. Another important negative effect is desocialization, with the conclusion of some philosophers that we cannot exist independently of our relationships with others, that a person's humanity depends on the humanity of those around him. The last section is dedicated to forecasting what the world will look like after the pandemic, and there are already signs of a paradigm shift, including the sudden disappearance of the "wall" ideology: a cough was enough to make it suddenly impossible to avoid the responsibility that every individual has it towards all living beings for the simple fact that he is part of this world, and of the desire to be part of it. The whole is always involved in part, because everything is, in a sense, in everything and in nature there are no autonomous regions that are an exception. The COVID-19 pandemic seems to restore the supremacy that once belonged to politics.
