Can anti-deportation resistance be justified, and if so how and by whom may, or perhaps should, unjust deportations be resisted? In this paper, I seek to provide an answer to these questions. The paper starts by describing the main forms and agents of anti-deportation action in the contemporary context. Subsequently, I examine how different justifications for principled resistance and disobedience may each be invoked in the case of deportation resistance. I then explore how worries about the resister’s (...) motivation for engaging in the action and their epistemic position apply in the specific context of anti-deportation action and consider in what circumstances there is not merely a right but a duty to resist deportation. The upshot of this argument, I conclude, is that the liberal state ought to respond to anti-deportation action not by criminalising disobedience and resistance in this field, but rather by creating legal avenues for such actors to influence deportation decision-making. In the paper, I argue there is a whole political logistics to deportation. This is made visible by bringing the concept of microphysics to bear on the topic. Taking the case of enforced and escorted removals from the UK, I show that this logistics is vividly and graphically documented in the inspection reports. Hitherto largely ignored, inspection reports offer researchers a trove of information regarding the mechanisms and procedures of deportation. As I finally draw out, this focus can (...) speak to questions about the relationship of ethics to deportation: the inspection reports show how a certain form of ethical calculation, based on a risk-based approach to the use of force has been inscribed into the practices of deportation. El objetivo de este artículo es el de señalar las implicaciones del concepto de deporte a través del materialismo filosófico de Gustavo Bueno en su obra Ensayo de una definición filosófica de la Idea de Deporte. Desde esta perspectiva, Bueno llega a la conclusión de que no hay una idea unívoca de deporte, sino que nos encontramos ante un concepto sobre el que se han depositado diversas acepciones según el objetivo físico, político, social o religioso atribuido al deporte. Esta diversidad (...) conceptual habilita al docente de Educación Física a utilizar el deporte como un medio pedagógico encajándolo de diferentes formas en su planificación. La principal conclusión es que el deporte puede ser utilizado no solo desde la perspectiva centrada en la práctica del deporte en sí, con sus reglas y movimientos, o teniendo solo como objetivo la actividad física, sino que puede utilizarse con relación a otros ámbitos de la educación física como la expresión corporal o los deportes populares. Con relación al estado de Ecuador, el currículum de Educación Física genera espacios para pensar en la Educación Física desde la interdisciplinariedad de sus ámbitos y no solo desde lo estrictamente deportivo. Over one hundred years ago, the Supreme Court emphatically declared that deportation proceedings are civil, not criminal, in nature. As a result, none of the nearly 400,000 individuals who were deported last year enjoyed any of the constitutional protections afforded to criminal defendants under the Sixth or Eighth Amendments. Among those 400,000 were numerous detained juveniles and mentally ill individuals who, as a result of the civil designation, had no right to appointed counsel. These individuals were thus forced to (...) navigate the labyrinth of immigration law alone. Others were lawful permanent residents who had pled guilty to minor offenses upon the correct advice of counsel that they could not be deported. These individuals later became subject to deportation when Congress retroactively changed the law, unbound by the criminal prohibition against ex post facto laws. The dichotomy between the gravity of the liberty interest at stake in these proceedings––a lifetime of exile from homes and families in the United States––and the relative dearth of procedural protections afforded respondents, has always been intuitively unjust to some. However, over the past twenty years, as immigration and criminal law have become intertwined as never before, the intuitive sense of many has matured into a scholarly movement exploring the criminalization of immigration law. This movement has taken aim at the incoherence of deportation’s civil designation. Until recently, however, there was little reason to think the Supreme Court would wade into the waters of the resurgent debate over the nature of deportation proceedings. In Padilla v. Kentucky, 130 S.Ct. 1473 (2010), however, the Court surprised almost everyone as it went to great length to chronicle the criminalization of immigration law and ultimately concluded that deportation is - uniquely difficult to classify. The immediate impact of the Padilla decision is the critical recognition that criminal defendants have a right to be advised by their attorneys if a plea they are contemplating will result in deportation. However, I argue, that in time Padilla may come to stand for something much more significant in immigration jurisprudence. When we read Padilla in the context of the Supreme Court’s evolving immigration jurisprudence, there is good reason to believe that Padilla is a critical pivot point for the Court. Padilla marks the beginning of a significant reconceptualization of the nature of deportation toward the realization that it is neither truly civil nor criminal. Rather, deportation is different. It is a unique legal animal that lives in the crease between the civil and criminal labels. This article explores the evolving arch of Supreme Court jurisprudence regarding the quasi-criminal nature of deportation proceedings and articulates a principled mechanism by which the scope of respondents’ rights can be defined under this new framework. This paper argues that liberal states are wrong to forcibly separate through deportation the unauthorized immigrant parents of member children and that states must therefore regularize such unauthorized immigrants. While most arguments for regularization focus on how deportation wrongs the unauthorized immigrants themselves, I ground my argument in how deportation wrongs the state’s members, namely the unauthorized immigrants’ member children. Specifically, forced separation through deportation wrongs affected children by violating a basic right to sustain the intimate (...) relationships with their parents on which they rely for their development into fully autonomous agents. Several political theorists argue that states have rights to self-determination and these rights justify immigration restrictions. Call this: the self-determination argument for immigration restrictions. In this article, I develop an objection to the self-determination argument. I argue that if it is morally permissible for states to restrict immigration because they have rights to self-determination, then it can also be morally permissible for states to deport and denationalize their own citizens. We can either accept that it is permissible for states to (...) deport and denationalize their own citizens or reject the self-determination argument. To avoid this implication, we should reject the self-determination argument. That is, we should also reject the conclusion that rights to self-determination can justify any significant immigration restrictions. (shrink)

Historically, the great powers used small nations without a homeland, land and stable moral values as atool for their politics, and the Armenians were one of the few such nations. The Armenians who settled in the Caucasus under the patronageof christian Europe and tsar Russia have repeatedly committed genocide of Azerbaijanis over the past two centuries and facilitated the deportation of the local population. The Armenian atrocities that began in the 19th century and had no analogues in the 20th (...) century were finally brought to an end in the 44-day war and the Azerbaijani army successfully completed the Great Return. Initially, the Armenian occupants were expelled from Nagorno-Karabakh and seven adjacent regions, and now the second stage has begun- a successful return to the ancestral lands of ancient Western Azerbaijan. Since 2023, the UK government's response to the “migrant crisis” has revolved around two controversial flagship policies: the deportation of asylum seekers to Rwanda, and the detention of migrants aboard a giant barge. In this short article, I examine the colonial and gendered dimensions of the two policies, finding them to be examples of the coloniality of gender. What this indicates, I suggest, is that the purpose of these policies is not merely to deter potential migrants—particularly LGBTQIA+ migrants—but also (...) to create a political narrative that allows the Conservative Party to garner right-wing votes by participating in high-profile culture wars; namely, the debate over transgender rights and the debate over how the UK should reckon with its imperial past. This article brings an account of reasonable expectations to bear on the question of when unauthorized immigrants have a right to be regularized—that is, to be formally guaranteed freedom from the threat of deportation. Contrary to the current literature, which implicitly relies on a flawed understanding of reasonable expectations, this article argues that only those unauthorized immigrants who have both been tacitly permitted by the state despite lacking formal authorization and have remained long enough to develop deep social roots (...) in the state have a right to regularization. States restrict immigration on a massive scale. Governments fortify their borders with walls and fences, authorize border patrols, imprison migrants in detention centers, and deport large numbers of foreigners. Unjust Borders: Individuals and the Ethics of Immigration argues that immigration restrictions are systematically unjust and examines how individual actors should respond to this injustice. Javier Hidalgo maintains that individuals can rightfully resist immigration restrictions and often have strong moral reasons to subvert these laws. This book makes the case that unauthorized (...) migrants can permissibly evade, deceive, and use defensive force against immigration agents, that smugglers can aid migrants in crossing borders, and that citizens should disobey laws that compel them to harm immigrants. This brief article, appearing in Issue #2 of The Cambridge Journal of Law, Politics and Art, published online on 22 November 2022), explores Nietzsche's perspective on the perils of mass psychosis in modern society and the threat it entails in accommodating increasingly repressive systems of social control against the background of the COVID pandemic, and drawing on the example of Novak Djokovic's deportation from Australia in January 2022.

When the French philosopher Sarah Kofman committed suicide in 1994 she left behind an impressive oeuvre in which both the autobiographical genre and the treatment of women play a central role. Her theoretical re ections on both topics situate themselves in the interstices between psychoanalysis, feminism and deconstruction and share a common concern: the respect of alterity in all its guises. Kofman's resistance to the authoritative claim of the retrospective closure underlying traditional autobiographies is closely related to her celebration of (...) an e ®criture parricide, a mode of writing which undoes the repression of multiplicity and otherness. Shortly before her death Kofman published an autobiographical account of her own childhood years after the deportation and death of her father in a concentration camp. This article addresses the striking discrepancies between the theoretical positions Kofman defends throughout her philosophical writings and the autobiographical turn of her own last words. (shrink)

In his book, Romaphobia: The Last Acceptable form of Racism, Aidan McGarry gives a powerful analysis of anti-Roma racism in Europe. His aims in the book are to highlight the plight of European Roma and to anal- yse the underlying causes of their persecution. The quandary, as McGarry sees it, is that Roma persecution in Europe has persisted unabated for over six hundred years. As soon as Roma appeared in Europe in the late fourteenth century they were traded as slaves, (...) or targeted by laws calling for assimilation or death. Roma were targeted for mass extermination during the Holocaust, and even now, they face widespread persecution across Europe. Italian interior minister Matteo Salvini, for instance, insists on compiling a “Gypsy Registry” and cleansing Italian neighbour- hoods of Roma camps. The French government targets Roma settlements for demolition and, in defiance of European laws, deports around twenty thousand Roma to other countries every year. Targeted murders of Roma in Hungary, Slovakia, and the Ukraine are encouraged, and ignored. Tabloid newspapers in the UK drum up anti-Roma sentiment. Indeed, the Daily Mail even cite former UK opposition leader Jeremy Corbin’s past attempts to protect Roma from eviction in London as a reason for his unsuitability to become Prime Minister—in modern Britain, compassion for Gypsies is a sign of questionable character. For McGarry, then, this persistence is central to the puzzle of Romaphobia—why does this form of racism remain unchallenged and acceptable? (shrink)

Empiezo con algunos comentarios famosos del filósofo (psicólogo) Ludwig Wittgenstein porque Pinker comparte con la mayoría de la gente (debido a la configuración predeterminada de nuestra psicología innata evolucionada) ciertos prejuicios sobre el funcionamiento de la mente, y porque Wittgenstein ofrece una visión única y profunda del funcionamiento del lenguaje, el pensamiento y la realidad (que él consideraba más o menos coextenso) que no se encontraba en ningún otro lugar. Ahí esta sólo referencia a Wittgenstein en este volumen, lo que (...) es más desafortunado teniendo en cuenta que él era el analista más brillante y original del lenguaje. -/- En el último capítulo, usando la famosa metáfora de la cueva de Platón, resume bellamente el libro con una visión general de cómo la mente (lenguaje, pensamiento, psicología intencional)-un producto de egoísmo ciego, moderado sólo ligeramente por el altruismo automatizado para cerca parientes que llevan copias de nuestros genes (Fitness inclusivo)--funciona automáticamente, pero trata de terminar en una nota optimista al darnos la esperanza de que, sin embargo, podemos emplear sus vastas capacidades para cooperar y hacer del mundo un lugar digno para vivir. -/- Pinker es ciertamente consciente de, pero dice poco sobre el hecho de que mucho más sobre nuestra psicología se deja fuera de lo incluido.
