In the course of presenting a compelling and comprehensive framework for immigration justice, Brock addresses discriminatory immigration policies, focusing on recent attempts by the Trump administration to exclude Muslims from the U.S.. This essay critically assesses Brock’s treatment of the issue, and in particular the question of what made the Muslim ban and similar policies unjust. Through examining these issues, further questions regarding the immigration justice framework on offer arise.

This article goes behind stereotypes of Muslim veiling to ask after the representational structure underlying these images. I examine the public debate leading to the 2004 French law banning conspicuous religious signs in schools and French colonial attitudes to veiling in Algeria, in conjunction with discourses on the veil that have arisen in other western contexts. My argument is that western perceptions and representations of veiled Muslim women are not simply about Muslim women themselves. Rather than representing (...) Muslim women, these images fulfill a different function: they provide the negative mirror in which western constructions of identity and gender can be positively reflected. It is by means of the projection of gender oppression onto Islam, and its naturalization to the bodies of veiled women, that such mirroring takes place. This constitutes, I argue, a form of racialization. Drawing on the work of Fanon, Merleau-Ponty and Alcoff, I offer a phenomenological analysis of this racializing vision. What is at stake is a form of cultural racism that functions in the guise of anti-sexist and feminist liberatory discourse, at once posing a dilemma to feminists and concealing its racializing logic. As the title of the article suggests, “The Burqa Ban”: Legal Precursors for Denmark, American Experiences and Experiments, and Philosophical and Critical Examinations, the authors embark on a factually investigative as well as a reflective response. More precisely, they use The 2018 Danish “Burqa Ban”: Joining a European Trend and Sending a National Message (published as a concurrent but separate article in this issue of INTERNATIONAL STUDIES JOURNAL) as a platform for further analysis and discussion of different perspectives. These include (...) case-law at the international level while focusing attention on recent rulings and judicial reasoning by the ECtHR and the ECJ; critical thought-experiments in religion, morality, human rights, and the democratic public space; a contextualized account of burqa-wearing interventions by federal and state governments and, moreover, various courts in the United States; and philosophical commentary and, in some instances, criticism of the Danish and/or European (French, etc.) approach. The different contributions have different aims. The section on case-law at the international level reports on those central judgments that, in effect, helped to pave the path for the Kingdom of Denmark’s burqa ban. Concerning the concurring judges at the ECtHR, the opinions served to uphold a preexisting ban and to grant a wide margin of appreciation to the national authorities, thereby limiting the Court’s own review. -/- As regards to the ECJ, the legality of company rules that contain a policy of neutrality for the workplace was examined, with a similar outcome. The authors who discuss religion, morality, human rights and the democratic public space are endeavoring to, respectively, appeal to ethics as a testing stone for law and to both challenge and address several forms of “expressivist worry” in connection with face veils. In doing so, the authors ask a number of thought-provoking questions that hopefully will inspire public policymakers to careful analysis. While the section that is devoted to American perspectives highlights a comprehensive survey of political and legal responses to, in particular, full-face veils like the burqa, the relevant author also incorporates public perceptions and, in the course of examining these, draws a parallel to “the fate” of the hoodie. The constitutionality of burqa-wearing in America, so it also appears, is partially an open question, but differentiating between religious, political, or personal reasons is a de jure premise. Given that the Danish legislators who drafted law L 219 to ban burqa-wearing in public places rely on a reference to political Islam, they relegate religious and personal reasons to the private domain, thereby also adopting secularism as a premise. This is explored in the last author response of the article, more precisely, in an account of the underlying materialism that, in turn, is applied to Muslim women. If policymakers and legislators engaged in Thinking Things Through exercises, they could, as a minimum, avoid law-making strategies that are not in the spirit of the theory they themselves invoke, albeit tacitly. While the aim of, as it were, arresting culturally self-contradicting legislators is unique for the section in question, all the authors who contribute to the joint research project have one end-goal in common, namely to inform about important perspectives while at the same time opening up for parameters for (more) fruitful, constructive and (if need be) critical debate in the future. With this in mind, four recommendations are presented by the research director for the project. Legally, politically, socially and culturally, conflict-resolution should not translate the relationship between rulers and the ruled into a separation ideology, an instance of controllers versus the controlled. In this paper, we aim to complement and extend Cécile Laborde’s argument against the Swiss minaret ban, which emphasizes the exclusion of Muslim citizens from equal national belonging. We argue that if we take seriously the normativity that is embedded in the Swiss direct democratic context (Carens 2004), especially in its ability to determine the substance of national belonging, then the symbolic exclusion of Muslims from political belonging is more relevant than the former with regard to democratic justice. Section (...) 1 defines basic notions and presents some arguments that were circulated in Swiss public political debate during the referendum campaign. Section 2 will present extant arguments in normative political philosophy about the ban. Section 3 expands our argument, which can be summarized as follows: the double absence of recognition of Muslims as (i) equal autonomous subjects and (ii) as political agents calls into question the legitimacy of the direct democratic process that led to the ban, making it unjust by the standards implicit within democratic practices in Switzerland. One of the main questions Gillian Brock takes up in Justice for People on the Move (2020) is whether it is morally permissible for states to enact migration policies that discriminate on the basis of religion against those who wish to enter. The main focus of her discussion is on the United States context, and, in particular, the so-called ‘Muslim Ban’ enacted by President Donald Trump in 2017. While Brock offers a powerful critique of this policy, I argue that (...) it is insufficient on its own to support her claim that migration policies that discriminate on the basis of religion in general undermine the legitimacy of the states that enact them. I argue that this claim can be supported within her framework by showing that such policies necessarily display disregard for the human rights of existing members of the discriminating state. I conclude with some reflections on the strength of this account of the moral impermissibility of religious discrimination at the border. (shrink)

Evânia Reich presents the argument that the veil laws in France—the banning of the full-face coverings in public and the banning of the headscarf in public schools—are consistent with the emancipatory project of French Laïcité. According to this argument, the veils that Muslim women wear are symbols of their oppression, whereas French education seeks to liberate each individual and Laïcité serves as a bulwark against the creeping oppressive influence of religion. Unveiling Muslim women, then, is an act of (...) emancipation. In this essay, I argue that the view of French secularism as an emancipatory project to free women of the oppressive mechanism of the veil is an example of what Marilyn Frye calls the “arrogant eye.” In this essay, I offer an alternative approach on the veil following Frye’s notion of the “loving eye.”. Is there such a thing called “Islamic philosophy”? If there is one, what is it? What does it mean for philosophy to be Islamic? How does Islamic philosophy differ from non-Islamic one? Why do some Muslim scholars reject philosophy, ban its instruction, and even scorn its proponents? The present article will address all these questions and seeks to offer a balanced perspective on controversial issues pertaining to philosophy in Islamic intellectual context, drawing upon authoritative, primary sources. The first section (...) deals with definition and terminology, including the disagreement among scholars over which of these is the best appellation: ‘Islamic philosophy’, ’Muslim philosophy’, or ’Arabic philosophy’. This will be followed by a discussion of the main sources of Islamic philosophy and its impacts, as well as the aims and benefits of studying philosophy according to its exponents. The final section provides a critical appraisal of the arguments for and against philosophy that have been put forward by its defenders and its critics. Furthermore, the article also discusses three current approaches to Islamic philosophy, namely the mystical- hermeneutical such as advocated by Leo Strauss and Henry Corbin, the historical- philological study such as practiced Richard Walzer and Dimitri Gutas, and the philosophical-analytical approach such as espoused by Oliver Leaman and Lenn E. Goodman. A final word about the challenges and prospect of Islamic philosophical studies is in order, taking into account recent developments in various parts of the world following revival of interest in Avicenna, Averroes and al-Ghazali. In 2009, a law was passed in the Danish parliament, according to which judges cannot wear religious symbols in courts of law. First, I trace the development of this legislation from resistance to Muslim religious practices on the nationalist right to ideas in mainstream Danish politics about secularism and state neutrality – a process I refer to as ‘liberalization’. Second, I consider the plausibility of such liberal justifications for restrictions on religious symbols in the public sphere and, in particular, (...) for the ban on the wearing of religious symbols by judges. I argue that such justifications are flawed and so are not plausible corollaries of anti-Islamic justifications originating on the nationalist right. (shrink)

Plurality implies a public sphere in which different worldviews (e.g. Secular Humanist, Christian, Jewish, Muslim and others) coexist respecting each other. Banning the presence of one or several of them from the public sphere is questionable in principle, and divisive in practice.

This Article explores the interpretation and construction of executive orders using as examples President Trump’s two executive orders captioned “Protecting the Nation From Foreign Terrorist Entry Into the United States” (the “Two Executive Orders”). President Trump issued the Two Executive Orders in the context of (among other things) Candidate Trump’s statements such as: “Islam hates us,” and “[W]e can’t allow people coming into this country who have this hatred.” President Trump subsequently provided further context including his tweet about the second (...) of his Two Executive Orders: “People, the lawyers and the courts can call [the second of the Two Executive Orders] whatever they want, but I am calling it what we need and what it is, a TRAVEL BAN!” Although President Trump replaced the first of the Two Executive Orders with the second one and although the Supreme Court by orders dated October 10, 2017 and October 24, 2017, vacated and remanded litigation involving the second order on grounds of mootness, the Two Executive Orders remain highly instructive for those who would understand the interpretation and construction of executive orders. This article therefore examines in detail the original speaker's (i.e., President Trump's) intended meaning and effect of the Two Executive Orders. It performs such examination using insights from the semiotic subfield of pragmatics, a semiotic subfield which explores how real-world people actually use, interpret, and construe language in various real-world contexts (including contexts where the issuer of the Two Executive Orders himself has claimed that “Islam hates us” and has tweeted “TRAVEL BAN!”). Using such insights of pragmatics, this Article also explores why reasonable judges thoroughly versed in legal theory, legal practice, and pragmatics should conclude that President Trump unlawfully targeted Muslims in the Two Executive Orders. This Article, among other things, also questions the sensibility of such notions as “facial legitimacy” to the extent such notions suggest text has meaning apart from context. In this article, I examine the discourse around evil from the perspective of philosophical anthropology. Through an analysis of the religious symbolism of evil and an associated quest for a complete study of being, I intend in this article to explore fresh ways of establishing the relation between our rhetorical practices of evil and moral responsibility. I draw on Ricoeur’s work on the primary symbols of evil, which can be seen as a means for clarifying and extending our understanding of (...) evil and moral responsibility. I employ the concept of “the double intentionality of symbol” to advance an expressive-performative model of speaking about the full shape of moral responsibility. At stake in my paper is the possibility of recognizing the need to valorise subordinate resources of knowledge that might prevent us from studying and responding to the elusive reality of evil in intellectual abstraction. Patients’ knowledge of hypertension and treatment has been found to affect health outcomes of hypertension. This study aimed to assess the impact of therapeutic patients’ education on knowledge of hypertension and lifestyle/dietary modification among hypertensive patients in Nigeria. The study was conducted among 317 hypertensive patients randomized into controlled and intervention groups (158 vs 159, respectively) between March 2021 and February 2022. Baseline knowledge of the patients was assessed and intervention was provided for the intervention group with a structured educational (...) program at a baseline and six months. Descriptive data were presented with a frequency table in percentage while the chi-square test and univariate logistic regression were used to determine the association between categorical variables. Out of the total 318 patients, 275 completed the study (response rate: 86.8%) with 136 in the control group and 139 in the intervention group. The mean age of the patients was 59.5 (±12.5) and patients >60 years (49.5%) were the most frequent age category. The baseline knowledge score of hypertension was 9.8 (±2.6) and 9.3 (±2.6) on a scale of 16 points in the control group and intervention group, respectively (P=0.060) while at six months 11.9 (±2.3) vs 10.8 (±2.4) (P<0.001) and 12 months 12.6 (±2.5) vs 9.5 (±2.0) (P<0.001), respectively. Knowledge of lifestyle/dietary modification in the control group and intervention group at baseline was 7.0 (±2.1) and 6.6 (±2.0), respectively, while at six months 7.5 (±1.5) vs 9.9 (±1.3) (P<0.001) and at 12 months 7.2 (±1.5) vs 10.4 (±1.2), respectively. Marital status, body mass index, and family history of hypertension were associated with knowledge of hypertension and lifestyle/dietary modification (P<0.001). The educational intervention provided was associated with a significant improvement in knowledge of hypertension and lifestyle/dietary modification. The marital status of the patients, body mass index and family history of hypertension influenced patients’ level of knowledge. (shrink)

This book deals with new proofs for the existence of God, solving the hard problem of consciousness and the Quranic correlation with logic and evidence on these subjects.

Abortion bans have been characterized as cruel especially in not allowing exceptions for rape or incest. The article first examines one approach to morally justifying bans based on the Doctrine of Double Effect (DDE) which distinguishes morally between killing or letting die intending death versus doing so only foreseeing death. It then presents some criticisms of the implications of the DDE but also argues that what the doctrine permits helps provide a ground for the permissibility of abortions even if the (...) fetus is a person. Whether there are limits on applying this argument is also considered. In conclusion, the article considers whether and why not permitting exceptions to bans for rape and incest is cruel and whether cruelty is a ground for opposition to bans. (shrink)

I argue that representations of the Muslim woman in the Western imaginary function as counter-images to the patriarchal ideal of Western woman. Drawing upon the work of Frantz Fanon (and supplementing it with a consideration of the role of gender), I show how the image of the veiled, Muslim woman is both othered and racialized. This “double othering,” I argue, serves: (i) To normalize Western norms of femininity. The social control of women and their bodies by liberal society (...) is hidden. Gender oppression is rather projected onto Muslim women, and identified with their societies, while remaining invisible within Western society. Western womanhood is taken to be “free” of such oppression. (ii) To deflect attention away from Western patriarchy, and promote complicity on the part of Western women with this society rather than other women. (iii) To represent Western femininity as an ideal that solicits women’s complicity universally. The attempt is to establish the superiority of Western society and its gender norms and morally justify the domination of other societies (in the name of civilization and the liberation of women). At Temple College, a community college in Texas, the administration forced Kerry Laird, a literature and composition professor, to remove from his office door the quote from Friedrich Nietzsche "Gott ist tot." The college says that to leave the phrase up would offend others and constitute an endorsement of the phrase. Laird, Cary Nelson, the national president of the American Association of University Professors, and William O. Stephens, chair of the American Philosophical Association Committee for the Defense of the Professional (...) Rights of Philosophers, see the ban as a violation of academic freedom and a double standard, since many other faculty members are permitted to display pro-religion statements and images on their doors. Malaysia faces a critical shortage of organ donors, with Muslims participating at lower rates compared to other ethnoreligious groups. This study investigates the sociocultural and religious factors shaping Muslim attitudes towards organ donation. Using both quantitative and qualitative methods, a survey conducted in Kuala Lumpur assessed Muslims’ willingness to donate organs, while an interview with the Head of the National Transplant Resource Centre explored cultural and religious influences. Findings reveal significant barriers, including misconceptions that organ donation is self-harm, concerns (...) about missing organs on Judgement Day, and beliefs regarding the sanctity of the human body in Islam. The study suggests that raising awareness through culturally sensitive campaigns, aligned with Sharīʿah principles, could address these concerns. This could potentially increase the number of Muslim organ donors, thus supporting the Sharīʿah goal of preserving life. (shrink)

According to what I call the ‘argument from public bads’, if a researcher deceived subjects in the past, there is a chance that subjects will discount the information that a subsequent researcher provides, thus compromising the validity of the subsequent researcher’s experiment. While this argument is taken to justify an existing informal ban on explicit deception in experimental economics, it can also apply to implicit deception, yet implicit deception is not banned and is sometimes used in experimental economics. Thus, experimental (...) economists are being inconsistent when they appeal to the argument from public bads to justify banning explicit deception but not implicit deception. (shrink)

This paper raises a moral issue for contemporary post-revolutionary Muslim intellectuals in Iran. According to traditional Islamic teachings, ethics enables people to transcend from this mundane world and offers guidance on ways to improve virtues. Most contemporary Iranian Muslim intellectuals have attempted to pave the way for accomplishing this goal. After clarifying the ways in which Iranian Muslim intellectuals have faith in virtue ethics as a best possible moral normative theory, we claim that virtue ethics fails to (...) support some of our modern problems in the realm of politics such as human rights and democracy. Also, we argue that virtue ethics is not a good theory for ordinary average people who have weakness of will. A preliminary conclusion of the paper will be that utilitarianism, generally, and principle of utility, specifically, is a better solution to the modern problems. This, we believe, has been overlooked from the eyes of post-revolutionary Muslim intellectuals. Yet, we suggest that among different versions of utilitarianism, rule-utilitarianism is more justified to do this job. (shrink)

This paper argues that one of the most valuable insights that Muslim-Americans ought to bring into the political arena is our affective response to the government of the United States' internal and foreign policies regarding Muslims. I posit the concept of empathy as one such response that ought to inform our foreign policy in a manner inclusive of Muslim-Americans. The scope of our epistemic privilege encompasses the affective response that crosses borders of the nation-state in virtue of our (...) propinquity to the narratives of Muslims globally. Such an affective response is crucial to our selves remaining multiplicitous and whole. Furthermore, I argue that we ought to access and assess those aspects of our identity that make us subject to suspicions of disloyalty, because it is precisely those aspects that can inform our social and political discourse in a more morally adequate and responsive way. My aim in this paper is to carve out a political understanding of the Muslim identity. The Muslim identity is shaped within a religious mold. Inseparable from this religious understanding is a political one that is valuable in its own right in order to secure any sustainable possibility of participating politically as Muslims within a democratic liberal democracy, such as the United States. Here I explore not the historical or theological formation of the Muslim identity, rather a (...) metaphysical understanding of it, in order to mobilize politically while avoiding the traps of essentialism. I begin with a brief overview of the early understandings of the term “identity politics” in the United States. Moving beyond interest-based movements I explore María Lugones' particular understanding of the self as multiplicitous. I then offer examples of the Muslim identity within the context of a social movement and individualist claims, in order to draw out the political aspects of the Muslim identity. In the final section I argue that the theological criteria that define “who counts as a Muslim” is a crucial aspect of how many Muslims may understand their identity as Muslims. However, I claim that in order to avoid the traps of marginalization of Muslim minorities, one must understand oneself as a multiplicitous political agent and that, furthermore, such an understanding is not at odds with Islam or one's own understanding of their identity as Muslim. The diversity of multicultural, multi-religious, and multi-ethnic groups and communities within Britain has created cohesion and integration challenges for different community groups and authorities to adapt to the current diverse society. More recently, there has been an increased focus on Muslim segregation in Britain in official reports and reviews. Those documents mentioned the Muslims’ segregation (directly or indirectly) for various reasons, and some recommendations have aimed to improve “community cohesion” in general and Muslims’ “integration” in particular. However, community participation (...) in the design or planning of regeneration and development projects has yet to be focused on, although these documents recommended promoting community cohesion and integration through these projects. Community participation in architecture—in its broader sense—is a crucial aspect that contributes towards fulfilling the tasks of serving communities with different religious and ethnic backgrounds. Muslims’ religious and cultural practices have been problematised in urban spaces and perceived as leading to social and spatial segregation. This paper intends to explore how secular urban spaces are used and perceived by Muslims through their religious and cultural practices. Therefore, the article aspires to inform the community participation in urban projects and demonstrates the role that Muslims’ inclusion in designing urban projects has in promoting cohesion and integration. The Ellesmere Green project in Burngreave, Sheffield, UK, is an empirical example of exploring this locally through semi-structured interviews with community members, leaders, and local authorities’ officials. The findings demonstrate that sacred and secular spaces are interconnected in Muslims’ everyday lives, and the boundaries between them are blurry. The data also show that having the ability to manifest their religious and cultural practices in secular urban spaces does not suggest the desire for segregation, nor does it reduce Muslims’ willingness to have social and spatial interactions with non-Muslims. The underlying objective of this project is to examine the ways in which the exclusionary status of Muslim-Americans remains unchallenged within John Rawls’ version of political liberalism. Toward this end, I argue that the stipulation of genuine belief in what is reasonably accessible to others in our society is an unreasonable expectation from minorities, given our awareness of how we are perceived by others. Second, using the work of Lisa Schwartzman, I show that Rawls’ reliance on abstraction of closed (...) society legitimizes the exclusion of citizens with marginal social locations. And finally, applying Charles Mills’ critique of ideal theory, I argue that Rawls’ idealization of a posture of civic friendship detracts from a discussion of equally significant societal values while sustaining existing social hierarchies. Muslim philosophers had been preoccupied with the question of interpretation since the Islamic Philosophy was first developed by its founder Al Kindi till its interpretative maturity by Ibn Rushd who represents the maturity of rationalism in Islamic Arab philosophy. Rational option was the most suitable for Arab Muslim civilization as it expresses the vitality of civilization and its ability to interact with other contemporary civilizations and trends. Islamic philosophy interpretation themes are various as they adopted the following terms: (...) -/- 1. Interpreting the approval of the Greek philosophy in Muslim culture. -/- 2. Interpreting the relationship between religion and philosophy. -/- 3. Interpreting the relationship between Mind and Mind ( Plato and Aristotle ) -/- 4. Interpreting the relationship between nature and Metaphysics. -/- The goals of interpretation for Muslim philosophers are different as Al Kind pointed that they are oriented towards the Greek philosophy in general and towards religion and philosophy in particular while Al Farabi pointed that they are oriented towards the Greek philosophy in general and towards Plato and Aristotle. Ibn Rushd opposed Al Ghazali ,the interpretation was focused on Aristotle's texts. He presented a legal verdict in working in philosophy. Many Muslims take the position that religious doubts constitute a serious problem for anyone who regards himself or herself as a Muslim, arguing that such a predicament may even result in apostasy. According to this position, the main problem with a Muslim who harbours religious doubts, a ‘Sceptical Muslim’, is that he or she is culpable for failing to respond appropriately to epistemic certainty about fundamental Islamic doctrine, primarily the existence of God and the Prophethood of Muhammad. In this paper I propose an approach to thinking about religion and politics that should inform how we think about liberalism and religion. I also consider how the conception of political authority defended by the prominent Muslim public intellectual Abdullahi Ahmed An-Na’im is a paradigm example of liberalism. In Part I I consider two approaches to religion and politics. According to the reductionist view, whether values that are central to a religious tradition can be reconciled to liberalism is more (...) a matter of doctrine than practice. By contrast a non-reductionist approach emphasizes that the relationship between political and religious values is influenced by a number of variables in addition to religious doctrine, including ethnicity, historical memory, political economy, and local politics. On this view, the path between religious and political convictions is anything but a straight line. In Part II I examine central arguments in An-Na’im’s work that are central to his version of liberalism, with a focus on liberty of conscience and religious freedom. To illustrate An-Na’im’s liberalism I focus on examples of claims about morality and theology, politics, and history. I conclude in Part III by considering how An-Na’im’s position is one example of what we would expect from a non-reductionist understanding of religion and politics. (shrink)

This article is focused on some conditions in today’s world of globalized media, which are producing either an uncritical acquiescence or fright in Muslim societies as a result of the interaction between these societies and the contemporary Western powers that represent modernity and postmodernity on the global stage. The rise of fundamentalism, a tendency toward returning to the roots and stringently insisting upon some pure and literal interpretation of them, in almost all the religions of the world is a (...) manifestation of this fright. The central concern of this article is to suggest that fundamentalism is neither the only nor the most reasonable response for Muslim societies in the face of contemporary modernity. Muslims need to adopt an independent and critical attitude toward modernity and reshape their societies in the light of the ethics of the Qur’an, keeping in view the historical link between Islam and science in as much as Islamic culture paved the way for emergence of modern science during European Renaissance. The necessity of a pluralistic or contextualized modernization of Muslim societies is discussed along with the need for the removal of cultural duplicity in the role of the West in relation to Muslim societies. All this leads to an overall proposal for modernization which is given towards the end. (shrink)

Until recently, the problem of traumatic brain injury in sports and the problem of performance enhancement via hormone replacement have not been seen as related issues. However, recent evidence suggests that these two problems may actually interact in complex and previously underappreciated ways. A body of recent research has shown that traumatic brain injuries, at all ranges of severity, have a negative effect upon pituitary function, which results in diminished levels of several endogenous hormones, such as growth hormone and gonadotropin. (...) This is a cause for concern for many popular sports that have high rates of concussion, a mild form of TBI. Emerging research suggests that hormone replacement therapy is an effective treatment for TBI-related hormone deficiency. However, many athletic organizations ban or severely limit the use of hormone replacing substances because many athletes seek to use them solely for the purposes of performance enhancement. Nevertheless, in the light of the research linking traumatic brain injury to hypopituitarism, this paper argues that athletic organizations’ policies and attitudes towards hormone replacement therapy should change. We defend two claims. First, because of the connection between TBI and pituitary function, it is likely many more athletes than previously acknowledged suffer from hormone deficiency and thus could benefit from hormone replacement therapy. Second, athletes’ hormone levels should be tested more rigorously and frequently with an emphasis on monitoring TBI and TBI-related issues, rather than simply monitoring policy violations. (shrink)

Originally introduced by Plato and Aristotle, Moderation Theory in Ethics is the most prevalent theory of ethics among Islamic scholars. Moderation Theory suggests that every virtue or excellence of character lies in the mean between two vices: excess or defect. Every ethical virtue comes from moderation in actions or emotions and every ethical vice comes from excess or defect. This paper suggests that while Islamic scholars have been influenced by this doctrine, they have also developed and re-conceptualized it in innovative (...) ways. Kindī, Miskawayh, Avicenna, Rāghib Isfahānī, Nasīr al-Dīn Ṭusī, and others are among the Islamic contributors to the subject. Some of their innovations in this theory are as follows: bringing together Aristotle's doctrine of the mean with Plato's psychology (by Kindī), dividing virtues into four higher genuses, dividing vices into eight higher genuses, setting various kinds of vices and virtues under these higher genuses (by Miskawayh), adding the vice qualitative criteria to Aristotle's vice quantitative criteria (excess and defect) (by Ṭusī), dividing various conceptualizations of justice (by Avicenna), adding religious and mystical virtues into the existing list of virtues (by Rāghib Isfahānī), and proposing a comprehensive model for curing diseases of the soul. This paper seeks to establish the main contributions of these Muslim scholars to Moderation Theory and elaborate on this theory’s evolution within the Islamic world. (shrink)

Để đạt được các mục tiêu giảm biến đổi khí hậu, bảo vệ môi trường và môi sinh, đồng thời đảm bảo sự phát triển bền vững, cũng như là công lý cho cả con người và thiên nhiên, chính quyền và hệ thống tư pháp cần hiểu rõ bản chất bản chất của các mâu thuẫn dẫn đến cuộc chiến pháp lý về môi trường. Bài viết này có mục đích tìm hiểu bối cảnh phức tạp của các cuộc chiến pháp lý về môi trường, làm sáng tỏ tầm quan trọng và kết quả tiềm tàng của chúng, từ đó chỉ ra một số lỗ hổng pháp lý và khiếu kiện môi trường tại Việt Nam. Many scholars and activists favor banning illicit businesses, especially given that such businesses constitute a large part of the global economy. But these businesses are commonly operated as if they are subject only to the ethical norms their management chooses to recognize, and as a result they sometimes harm innocent people. This can happen in part because there are no effective legal constraints on illicit businesses, and in part because it seems theoretically impossible to dispose definitively of arguments that support (...) moral relativism. Progress is being made, however, towards a “second best” arrangement consisting of widespread institutional agreements regarding ethical norms. This development might eventually enable us to transcend moral relativism in some respects. Indeed, although some business ethicists who examine illicit business practices accept moral relativism, others attempt to surmount it. The latters’ endeavor, I show, is cross-cultural in nature in that it involves businesses that are deemed illicit in at least one but not every culture. I then recall some traditional solutions and their limits: ideological teachings are culture-specific, hence both temporally and spatially limited; legal constraints, though potentially helpful, are too diverse hence often narrow in reach. Especially problematic are defense industry businesses, which are inherently transcultural and, though uniquely harmful, are not effectively banned in any culture. Harm to quality of life (QoL) can, however, be measured. So I recommend institutional support for international human rights tied to QoL data as a workable way to counter moral relativism regarding illicit businesses. (shrink)

This paper offers preliminary notes on Buddhism in modern Muslim exegesis with an emphasis on Tafsir al-Qasimi by Muhammad Jamal al-Din al-Qasimi (1866–1914) and al-Mizan fi Tafsir al-Qurʾan by Muhammad Husayn Tabatabaʾi (1892-1981). The research adopts a qualitative design using content analysis to collect the data. In this paper two main questions regarding both exegetes will be explored. The first question concerns the sources of both scholars for their information about Buddhism by including the discussion in their exegesis. The (...) second question concerns the methodology they used to discuss Buddhism in the Qurʾan since this has not been done by any classical exegetes nor among the most modern exegetes. Studies have found that the approach of the two exegetes is different from both the classical and modern exegetes because their work also contains resources from the fields of comparative religion and the history of religion to make their work relevant in the current context and reliable to be referred to by any parties. The author concludes that both al-Qasimi and Tabatabaʾi used analysis (taḥlil) in discussing verses related to the position of the Buddha. (shrink)

The aim of this paper is to examine whether it is morally wrong to ban only male citizens from leaving a country in wartime, and if it is, why it is the case. Following Russia’s invasion of Ukraine, President Volodymyr Zelensky declared martial law and ordered general mobilization, at the same time prohibiting male citizens aged 18 to 60 from crossing the border. The justifiability of the ban is in dispute, and opponents have made a case in both legal and (...) moral dimensions. In the moral dimension, there are arguments based on consequentialism, individual freedom, and fairness or non-discrimination. In this paper, I focus on the third argument and argue that the ban unfairly and morally wrongfully discriminates against male Ukraine citizens on the basis of their gender. First, I define discrimination and apply it to our case. Second, moving from the descriptive definition of discrimination to its moral wrongness, I argue that the male-only ban is unfair and morally unjustified. Third, I argue that the ban can also be deemed morally wrong from one of the prominent views in the field of the ethics of discrimination, namely the deliberative freedom view. (shrink)

This paper tries to explain the relationship between Muslims' problems and violence in the light of a clear distinction between Islam and Islamic political thought. This research emphasizes on the fact that Koran and Sunnah aim at guiding mankind to the right path of knowing and worshipping God; they are not political treatises; Islam could live without a Muslim State even before the instauration of the prophet's State; nowadays, millions of Muslims live under the rule of non Muslim (...) governments or Muslim governments that do not enforce the Islamic law, yet Islam continues to flourish; hence, no Islamic political thought, albeit useful and justified at a certain time, place, or circumstances is to be sanctified because that will certainly lead to a political blockage which could yield violence. There are two dominant approaches towards understanding medieval Muslim philosophy: Greek ancestry approach and religiopolitical context approach. In the Greek ancestry approach, medieval Muslim philosophy is interpreted in terms of its relation to classical Greek philosophy, particularly to the philosophy of Plato and Aristotle. The religiopolitical context approach, however, views a thorough understanding of the religious and political situation of that time as the key to the proper understanding of medieval Muslim philosophy. Notwithstanding the immense significance of (...) the two approaches for understanding medieval Muslim philosophy, the question on the reason behind medieval Muslim philosophers’ preference for Plato’s Republic over Aristotle’s Politics in political philosophy is not accurately answered. This preference is usually attributed either to the availability or unavailability of the text or to the suitability or unsuitability of the text for Islamic theological views. However, this article shows that neither the availability or unavailability of text nor its suitability or unsuitability for Islamic religious and theological views can appropriately explain medieval Muslim philosophers’ preference for Plato’s Republic over Aristotle’s Politics in their political thought. This article proposes that the key to understand this preference lies in understanding the transmission of Greek philosophy to medieval Muslim philosophers. Contribution: This study highlights the significance of the thorough understanding of the transmission of Greek philosophy to medieval Muslim world as one of the important approaches towards proper understanding of medieval Muslim philosophy, particularly medieval Muslim political philosophy.
