This article examines the principle of wealth maximization, as developed by Richard Posner, seeking to dispel misunderstandings, address criticisms, and contextualize its role in legal and political philosophy. The paper first delineates the distinction between the concepts of experienced utility and decision utility, elucidating how the latter is fundamental to the principle of wealth maximization. Next, the authors engage with criticisms of wealth maximization, including issues relating to basic needs, individual rights, and distributive justice. The paper contends that these aspects (...) of ‘justice’ can be understood as emergent properties of efficiency. The article then presents affirmative arguments for wealth maximization by connecting it to social contract theory and demonstrating its consistency with the tenets of liberal democracy. By analyzing the concept from both Hobbesian and Rawlsian perspectives, the paper illustrates the merits of the wealth maximization principle in relation to social contract theory. In conclusion, the article argues that wealth maximization serves as a robust and justifiable framework for legal and philosophical analysis, ultimately offering a better fit with the principles of liberal democracy than competing normative theories. By reconsidering all the available sources (from Simon du Val’s inquisitorial summons of November 1276 to the Continuatio brabantina, from the Fiore to the X canto of Dante’s Paradiso, from William of Tocco to Peckham’s letters) the article calls into question the thesis – still widely shared – according to which Siger of Brabant died in Italy, and more precisely in Orvieto, at the Papal Court, before November 1284. Above all, from a doctrinal point of view, it shows how it (...) is completely implausible that Peckham could refer to Siger of Brabant when, in his letter to the University of Oxford of November 10, 1284, he mentions two Seculars as the main defenders or ‘inventors’ of the thesis of the uniqueness of the substantial form in the human compound. The end of Siger in Italy could thus be, for the most part, a ‘black legend’, like that of the poisoning of Thomas Aquinas on behalf of Charles of Anjou. The article closes by showing some possible implications, even of a methodological nature, of this different approach. (shrink)

The standard view of classical cognitive science stated that cognition consists in the manipulation of language-like structures according to formal rules. Since cognition is ‘linguistic’ in itself, according to this view language is just a complex communication system and does not influence cognitive processes in any substantial way. This view has been criticized from several perspectives and a new framework (Embodied Cognition) has emerged that considers cognitive processes as non-symbolic and heavily dependent on the dynamical interactions between the cognitive system (...) and its environment. But notwithstanding the successes of the embodied cognitive science in explaining low-level cognitive behaviors, it is still not clear whether and how it can scale up for explaining high-level cognition. In this paper we argue that this can be done by considering the role of language as a cognitive tool: i.e. how language transforms basic cognitive functions in the high-level functions that are characteristic of human cognition. In order to do that, we review some computational models that substantiate this view with respect to categorization and memory. Since these models are based on a very rudimentary form of non-syntactic ‘language’ we argue that the use of language as a cognitive tool might have been an early discovery in hominid evolution, and might have played a substantial role in the evolution of language itself. The processes of computation and automation that produce digitized objects have displaced the concept of an image once conceived through optical devices such as a photographic plate or a camera mirror that were invented to accommodate the human eye. Computational images exist as information within networks mediated by machines. They are increasingly less about what art history understands as representation or photography considers indexing and more an operational product of data processing. Through genealogical, theoretical, and practice-based investigation, this dissertation project (...) traces a lineage of computation through images from early cybernetics to contemporary machine learning under algorithmic capitalist conditions of political economy. Objects include mundane examples such as smartphone cameras to sublime examples such as the imaging of black holes. It articulates new conditions and forms of perception and surveillance that result from contemporary technological development in computation. The project builds on theorists of computational media such as Friedrich Kittler, Wendy Hui Kyong Chun, Jussi Parikka, Shane Denson, and Alexander Galloway to examine the interplay between perception, computation, and epistemology. Further theoretical contribution builds on the work of Luciana Parisi and Jacques Ranciére’s articulation of aesthetics, and Michel Foucault’s gesture towards a heterotopia. Finally, it draws from Donna Haraway’s metaphors of the cyborg and sympoiesis to frame the capacity of art to transfigure the limitations of digital network culture into new possibilities for being. Here, it curates practices by Danielle Brathwaite-Shirley, Harun Farocki, Morehshin Allahyari, and Pierre Huyghe. (shrink)

Winds of change, from the political perspective in Mexico, invite us to reformulate the methodological vision for the direction of public policy in the field of social development, directing their actions towards the construction of a methodological proposal that allows us to direct ourselves towards achieving higher levels of Well-being Social in our country, as a desirable objective of public policy and which is expected to be inclusive, participatory and democratic. -/- In this sense, it is important to recognize that (...) the current debate, in the academic and political sphere, questions what is being well? What is the life that is worth living? And that, additionally, the recognition of the satisfaction of life goals, at an individual and collective level, which invites us to reflect, if the current economic and social policy and strategy has produced results in what we envision as social welfare? Is a new approach necessary to solve the problem? What strategy should it be to consider the new methodological approach that seeks social welfare? And what components should be considered in the measurement of social welfare? This document is an invitation to review the concept of social welfare, as a proposal whose purpose is to correct the deficiencies or historical deficiencies suffered by the population, in the elemental enjoyment of social rights, a situation that causes social backwardness, marginalization, and that it is aimed at the impossibility of participating in the social decisions of the community and in collective decisions, such as: speaking, proposing, being heard and demanding compliance with fundamental human rights such as: health, food, housing, employment and security, among others. These deficiencies in the enjoyment of social and human rights are seen in the presence of social exclusion, and that together these social deficiencies explain the degree of multidimensional poverty suffered by the population in rural and urban areas. It is here that he invites us to reflect: what is the problem that social welfare seeks to solve? Multidimensional poverty, social exclusion, social backwardness or social inequality? And consequently, how to define the components to identify social welfare? -/- The document is made up of three sections: i) Social welfare: A retrospective look; ii) Social Welfare, an integrative view: The contribution of Sen, Naussbam, Rawls, Actis Di Pasquale and Keyes; and iii) Social Welfare: The recognition of limits in economic development -/- The first section presents a review of the proposals, which in the area of economic development have been presented since 1968 in the Human Condition Project, until the 2015 proposal of Sustainable Development Goals. -/- In the second section, the contributions of (Rawls, 1995), (Sen, 1982), (Nussbaum, 2011), (Keyes, 1998) , (Actis Di Pasquale, 2015) and (Actis Di Pasquale, 2017) are presented in order to present an integrative approach to the concept of social welfare. Beginning with a survey of the shortcoming of theories of organology/media-as-externalization of mind/body—a philosophical-anthropological tradition that stretches from Plato through Ernst Kapp and finds its contemporary proponent in Bernard Stiegler—I propose that the phenomenological treatment of media as an outpouching and extension of mind qua intentionality is not sufficient to counter the ̳black-box‘ mystification of today‘s deep learning‘s algorithms. Focusing on a close study of Simondon‘s On the Existence of Technical Objectsand Individuation, I argue that the process-philosophical work of Gilbert (...) Simondon, with its critique of Norbert Wiener‘s first-order cybernetics, offers a precursor to the conception of second-order cybernetics (as endorsed byFrancisco Varela, Humberto Maturana, and Ricardo B. Uribe) and, specifically, its autopoietic treatment of information. It has been argued by those such as Frank Pasquale that neuro-inferential deep learning systems premised on predictive patterning, suchas AlphaGo Zero, have a veiled logic and, thus, are ̳black boxes‘. In detailing a philosophical-historical approach to demystify predictive patterning/processing and the logic of such deep learning algorithms, this paper attempts to shine a light on such systems and their inner workingsàla Simondon. Im Beitrag wird die Apple-Watch vor dem Hintergrund ihrer „Ästhetik der Existenz“ als biopolitisches Artefakt und kontrollgesellschaftliches Dispositiv, vor allem aber als kybernetische Black Box aufgefasst und analysiert. Ziel des Aufsatzes ist es, aufzuzeigen, dass sich in dem feedbacklogischen Rückkopplungsapparat nicht nur grundlegende Diskurse des digitalen Zeitalters (Prävention, Gesundheit, bio- und psychopolitische Regulierungsformen etc.) verdichten, sondern dass dieser schon ob seiner inhärenten Logik qua Opazität Transparenz, qua Komplexität Simplizität (d.h. Orientierung) generiert und damit nicht zuletzt ein ganz spezifisches Menschenbild forciert. (...) In methodischer Hinsicht sollen zur Aufschlüsselung der für die digitale Gesellschaft repräsentativen Black Box „Apple-Watch“ wirksame Begriffskonstellationen der Kybernetik – d.h. Feedback, Regulierung, Selbstkontrolle und nicht zuletzt das Prinzip des „schwarzen Kastens“ selbst (Wiener/ Ashby), in dem sich schon die Funktion des Apparats als (Selbst-)Regulierungstool zwischen In- und Outputs reflektiert – in den Blick genommen und mit behavioristischen Konzepten (besonders solche der Gegenwart, d.h. nudging-Konzepte etc.) kontextualisiert werden. Auf dieser Grundlage lässt sich schließlich, so die These, nicht nur ein Subjektivierungsmodell ableiten, sondern auch eine (durchaus realpolitisch wirksame) Regierungskunst („kybernetische Gouvernementalität“) dekodieren. In diesem Zusammenhang ist schließlich die These zu plausibilisieren, dass das zeitgenössische „Sicherheitsregime“ des ‚new dark age‘ (Bridle) respektive der ‚Black-Box-Society‘ (Pasquale) sich nicht auf „die Unterdrückung von Subjektivität [bezieht], sondern vor allem auf ihre ‚(Selbst)-Produktion‘, […] auf die […] Förderung von Selbsttechnologien, die an Regierungsziele gekoppelt werden können.“ (Lemke) Entsprechend fragt der Aufsatz, welche – auch politischen – Auswirkungen die exzessive Verbreitung dieser und ähnlicher „smart devices“ zeitigt: Denn nicht zuletzt lässt sich, mediiert über derartige datengenerierende schwarze Kästen, eine Form der Regierung und des Regierbar-Machens erkennen, die weniger explizit-imperativisch auf Subjekte als vielmehr implizit-suggestiv auf Datenpunkte und -profile einwirkt.
