Some astronomers believe that we have discovered that Pluto is not a planet. I contest this assessment. Recent discoveries of trans-Neptunian Pluto-sized objects do not require that we exclude Pluto from the planets. But the obvious alternative, that classificatory revision is a matter of arbitrary choice, is also unpalatable. I argue that this classificatory controversy — which I compare to the controversy about the classification of the platypus — illustrates how our classificatory practices are laden with normative (...) commitments of a distinctive kind. I argue that the “norm-ladenness” of classification has philosophically significant ramifications for how we think about scientific disputes and debates in the metaphysics of classification such as the monism/pluralism debate. In ordinary conversation, speakers disagree not only about worldly facts, but also about how to use language to describe the world. For example, disagreement about whether Buffalo is in the American Midwest, whether Pluto is a planet, or whether someone has been canceled, can persist even with agreement about all the relevant facts. The speakers may still engage in “metalinguistic negotiation”—disputing what to mean by “Midwest”, “planet”, or “cancel”. I first motivate an approach to metalinguistic negotiation that generalizes a (...) Stalnakerian theory of communication by including linguistic commitments in the conversational common ground. Then, I turn to cases where the very status of a disagreement as metalinguistic or factual is unclear or contested. For example, after the publication of the New York Times Magazine’s 1619 Project, some responses claimed to identify factual errors, while others took those same “errors” to be matters of interpretation. I’ll consider how to extend our theorizing about metalinguistic negotiation to this type of (even more) “meta” disagreement, using the discussion following the 1619 Project as a case study. On my view, in most such cases, there will be a metalinguistic negotiation going on. Still, I explain several ways in which, despite a dispute being metalinguistic, the factualist side can sometimes receive important vindication. I also discuss why it can make sense for speakers to contest the status of a dispute. (shrink)

● Any given placement (e.g. Sun in Taurus; Mars in Capricorn; Mercury in the third house) is necessarily common to tens of thousands of people. Saturn in the ninth house, for example, will not behave the same or produce the same effects in the twenty or one hundred charts in which we find it there. In each case Saturn will behave in accordance with the rest of the astrographic/chart composition (as if we stayed in the same hotel in different epochs (...) or different people contracted the same disease; our stay will be different each time, according to the epoch, and each person’s symptoms will too, be different, according to their individual biochemistry; not to mention that each chart or astrography, like each genetic code or sequence, is unrepeatable). Certainly, “no planet can produce, on its own, what only the combined or concerted action of all can” (BUSTAMANTE, 2023, SPICA magazine, pp. 93-111). Hence the synergistic nature of the interpretative exercise (i.e., the whole is greater than all its parts). The fundamental component of the mathematical expression of the interpretive exercise is: astrological triangulation, the functional denomination for what we know as synthesis (WEISS, 1946; LEO, 1983, HAND, 1981). In order to demonstrate its usefulness, as well as the convenience of its mathematical expression, we have chosen two individuals (JEFFREY DAHMER, STEVEN SPIELBERG) whose astrographies do not—according to the community—explain their lives. The rest of the astrographies correspond to those of serial killers JOHN WAYNE GACY, DAVID CARPENTER, and TED BUNDY. ● We explain, by means of algebraic notations, the synthesis and the functional values that make up the synthesis. ● We take the Moon and Neptune as relevant bodies for the purpose of diagnosing or studying endocrine or neurohormonal issues, and Mars, Pluto, and Saturn as relevant planets for the purpose of inferring violence or sinister behaviour, upon the case, and quadratures or oppositions—and conjunctions—between Venus and the Moon, the Moon and Neptune, and the Sun or Venus and Neptune or Uranus as indicators of neurohormonal disorders and/or sexual deviance (APA definition) . ● We consider quadratures (90º) or oppositions (180º)—and conjunctions—between Mercury or the Moon and Saturn, or between Mars or the Moon and Saturn, Uranus, Neptune, and/or Pluto as powerful indications of violence or mental disorders, upon the case. ● We have also regarded Sagittarius as a sign as expansive and abundant as its ruler, Jupiter, according to the best of its characterisations (or as an exceptionally swift and wild sign, according to other characterisations), and the fifth region of a natal chart as one closely related to fortune in a broad sense (material and immaterial). ● Because we advocate the idea that orbs should be predicated of the planet (size, speed), not the aspect itself, the gas giants (Jupiter, Saturn, Uranus, and Neptune) and the Sun have been granted up to 10º of orb (or 12º, in the case of broad influence ). We understand aspectual relationships as angular relationships held between two or more celestial bodies placed in signs with at least one property in common (according to our molecular theory of the ecliptic, compatible with the optical theory of the aspects from the Hellenistic tradition). Ouvrant la réflexion sur les enjeux de la perte massive de la biodiversité, l'article s'appuie sur la question élémentaire de l'importance de la diversité biologique pour l'homme, à la fois sur le plan économique, biologique et éthique. La maîtrise de la nature par l'homme se révèle être une illusion. La réalité étant celle de l'interaction, il est permis de dire que les sociétés humaines agis- sent sur leurs propres conditions en modifiant les équilibres biologiques pour satisfaire leurs besoins, sans pour (...) autant intégrer cette interaction fondamentale dans l'équation d'un rapport viable entre l'homme et la nature. L'approche récente par le biais des analyses des services éco- logiques constitue à cet égard un progrès sensible. Il aboutit néanmoins au constat de l'impos- sibilité pour l'humanité de se substituer aux mécanismes naturels permettant de tirer les ser- vices de la nature nécessaires à sa survie. Plutôt que de prétendre contrôler et maîtriser la nature à tout prix, l’homme devrait apprendre à se reconnaître comme une partie consciente de la nature et à vivre avec la vie qui l’entoure. Cet apprentissage soulève des défis scientifiques, humains et de gouvernance. Si Casey Rentmeester le fait débuter par une brève histoire du développement de la philosophie environnementale, précisant comment cette discipline a largement affaire à l’éthique appliquée et l’éthique normative, il y explique bientôt comment des philosophes tels que Naess, Thomson et Toadvine emploient aujourd’hui des méthodes non-traditionnelles — ecofeminism, ecophenomenology, deep ecology — pour explorer (...) des aspects négligés par le courant philosophique qui y domine. Avant de s’appuyer sur l’œuvre heideggérienne pour répondre aux questions peu examinées par cette tradition de pensée, l’A. décrit brièvement la manière dont certains des représentants de celle-ci — Siedel, Zimmerman et Foltz notamment — se servent de celle-là pour mieux saisir la position de l’homme dans la nature. À l’en croire, son but est double : utiliser d’abord la critique phénoménologique de la métaphysique établie par Heidegger pour montrer comment, au sein de cette dernière, notre compréhension de l’être a mené à une destruction de l’environnement, puis penser avec Heidegger pour chercher à ce problème une réponse post-métaphysique qu’il s’agirait d’esquisser si tant est qu’il y en ait une. Or, tel est le cas pour Casey Rentmeester, qui se tourne en définitive vers le taoïsme pour lui emprunter son image d’un environnement durable. (shrink)

Neil Gorsuch lauds judges who purport to “apply the law as it is, focusing backward, not forward, and looking to text, structure, and history to decide what a reasonable reader at the time of the events in question would have understood the law to be . . . .” It’s hard to see how such a form of Originalism withstands scrutiny. -/- First, using “reasonable reader” understandings rather than speaker meaning turns language and law on their heads. Audiences effectively become (...) the speakers in ordinary speech (since reader or audience meaning prevails), and audiences (and thus the ruled) effectively become the rulers when interpreting law (since audiences’ meaning prevails). -/- Second, since laws look forward to govern conduct, how can best legal practices keep such a backward focus? -/- Third, words (however understood by others at the time “originally” uttered) may or may not (depending on speaker and not reader meaning) signify concepts whose meanings embrace change over time. For example, the word “planet” used by a speaker before the discovery of Uranus and Neptune may or may not include further planets depending upon what the speaker meant by “planet.” (The same applies to the inclusion or exclusion of Pluto had the speaker used the word “planet” after the discovery of Pluto but before its exclusion by current science.) Unlike the “reasonable” reader of Gorsuch’s Originalism as phrased above, speakers run the gamut from reasonable to unreasonable, from informed to uninformed, and from thoughtful to thoughtless. -/- Fourth, to the extent a judge is principally “constrained” by a text or texts (as he may determine), by dictionaries that he chooses, and by “history” as the judge understands it, isn’t judicial activism encouraged rather than restrained? Talk of a “reasonable” reader masks the fact that there can be multiple “reasonable” conclusions of what a reasonable or unreasonable speaker meant. Is a judge not therefore left to pick definitions and applications of terms that accord with the judge’s understandings of history, understandings that may well be colored by the judge’s politics and judicial philosophy? This applies to principles as well as labels for things. Principles are also subject to multiple frames, and their terms are subject to multiple definitions therefore raising the very same questions just raised above. -/- Finally, such Originalism doesn’t merely fail with legal texts. It also fails when applied to other texts (including sacred texts such as the Ten Commandments) and when used to interpret art (such as “Landscape with the Fall of Icarus” often attributed to Bruegel and which inspired such great ekphrasis as Auden’s “Musée Des Beaux Arts”). The overarching goal of this book is to differentiate and provide a highly detailed descriptive account of a specific class of arguments. To simplify, let us consider the following example: suppose one aims to persuade that “Julius Caesar was a criminal.” To support that claim various arguments may be formulated, such as: a) Joseph Stalin murdered his political opponents who openly opposed him, thus he was a criminal. Julius Caesar did the same. Therefore, if Stalin was a criminal, then Caesar (...) was also a criminal. b) Most historians studying the history of the Roman Empire consider Julius Caesar to be a criminal, so he was one. c) The majority of people believe Julius Caesar was a criminal, so he was one. d) Anyone who murders or orders the killing of others is a criminal—regardless of whether it’s in defense of the country or to maintain power. Julius Caesar issued orders resulting in thousands of deaths, so he was a criminal. Argumentation theory distinguishes and extensively describes different types of arguments, each with its own definition, argumentation scheme, subtypes, and criteria for evaluation. We may, therefore, identify that: example (a) employs the argument from analogy, (b) is an argument from authority (ad auctoritate), and (c) is an argument from popular opinion (ad populum). What about (d)? Is there a theory for such arguments? Argument in the example (d) establishes the meaning of “criminal” by extending it to those who lead troops into battle or kill in self-defense, and in this way, Caesar can also be included in the extension of a “criminal” (regardless of whether he committed genocide or simply won battles). Although there are many concepts in argumentation theory and informal logic that explain various aspect of such arguments (e.g., persuasive definitions and persuasive quasi-definitions, attributions, classification arguments, etc.) there is no theory for such arguments—or rather—there was no until now. This book is aimed to provide a concept, classification, and assessment criteria for arguments which fix the meaning to support persuasion—namely, semantic arguments. Semantic arguments manifest themselves as a common and very powerful means of persuasion in various areas of human activity, including political discourse, advertising, science, law, and philosophy. This can be illustrated through an analysis of some examples: e.g., the redefinition of “planet” proposed in 2008 to exclude Pluto from the scope of this concept, the redefinition of the term “wetland” put forward by G.W. Bush in 1988, modifications of the definition of “human being” in disputes about abortion, or the definition of “vehicle” in cases of accidents involving electric scooters. The book’s goal is to provide a model of semantic argument—differentiating arguments that fix meaning for persuasive purposes, providing definition and scheme, constructing a comprehensive classification, and developing assessment criteria. This broader aim also fills a gap in argumentation theory regarding our understanding of semantic arguments and their actual and potential applications. (shrink)
