Die Debatte um die politische Differenz stellt Kontingenz und Konfliktualität als fundamentale Eigenschaften des Politischen heraus. Dies stellt die postfundamentalistische Demokratietheorie, die auf Augenhöhe mit dieser Debatte argumentieren will, vor ein Problem: Durch die Kontingentsetzung aller normativen Begründungen ist zunächst unklar, welche Art von demokratischen Institutionen wie begründet werden kann, und sogar, ob es überhaupt eine von der postfundamentalistischen Sozialontologie ausgehend argumentierende normative Begründung für demokratische Institutionen geben kann. Meine These ist, dass Freiheit, verstanden als kontinuierliche selbstreflexive Kritik, derjenige normative (...) Begriff ist, der sich aus der Sozialontologie von Konflikt und Kontingenz herleiten lässt. Anders gesagt: Freiheit als Kritik ist derjenige Universalismus, der sich aus der Ontologie des Partikularismus ableitet. Freiheit als Kritik kann dabei einerseits das Operieren einiger Institutionen in liberal-pluralistischen Demokratien beschreiben, und andererseits als normativer Kritikbegriff für die Analyse ihrer Dysfunktionalität dienen. Um diese These zu begründen, gehe ich zurück zu einem Theoretiker, der eine Grundlage der aktuellen Debatte um das Politische bildet: Foucault, dessen Machttheorie als Ansatz einer Sozialontologie der Kontingenz und Konfliktualität gelten kann. Gleichzeitig hat Foucault den Begriff der Freiheit als den zu dieser Ontologie passenden normativen Begriff herausgestellt. Durch eine Rekonstruktion und Kritik der sozialphilosophischen Debatte um Freiheit in Foucaults Werk lässt sich der Begriff der Freiheit als Kritik systematisch bestimmen. So kann – mit Foucault gegen Foucault – gezeigt werden, dass er nur innerhalb einer pluralistischen und liberalen Demokratietheorie gedacht werden kann. (shrink)

Foucault's theory of power and subjectification challenges common concepts of freedom in social philosophy and expands them through the concept of 'freedom as critique': Freedom can be defined as the capability to critically reflect one's own subjectification, and the conditions of possibility for this critical capacity lie in political and social institutions. The article develops this concept through a critical discussion of the standard response by Foucault interpreters to the standard objection that Foucault's thinking obscures freedom. The standard response interprets (...) Fou-cault's later works, especially The Subject and Power, as a solution to the problem of freedom. It is mistaken, because it conflates different concepts of freedom that are present in Foucault's work. By differentiating these concepts, this paper proposes a new institutionalist approach to solve the problem of freedom that breaks with the partly anarchist underpinnings of Foucault scholarship: As freedom as critique is not given, but itself a result of subjectification, it entails a demand for 'modal robustness' and must therefore be institutionalized. This approach helps to draw out the consequences of Foucault's thinking on freedom for postfoundationalist democratic theory and the general social-philosophical discussion on freedom. (shrink)

Postfoundational political theory has been criticized for being incapable of establishing a normative basis for politics. This is because postfoundationalism's conception of the “political” as a radical contingency disproves the existence of an objective ground that would make it possible to evaluate political movements from a neutral position. In this article, I counter this critique by distinguishing between Chantal Mouffe's political theory and other postfoundational theories based on their respective normative implications. This is done by explicating how Mouffe's way (...) of conceptualizing the political implies a conservative political disposition. In order to accomplish this, I develop an understanding of the conservative political disposition, which refers to the normative idea that police power is necessary for producing and upholding a social order. Through an analysis of Carl Schmitt's theory, I elaborate that the conservative disposition is an attempt to justify the depoliticization of social relations. On the basis of this idea that some political theories have normative implications that are in line with the conservative disposition, I examine postfoundationalism. My argument is that while Mouffe's theory does imply the idea that police power is necessary, this is not the case with other postfoundational theories. On the contrary, other postfoundational democratic theories categorically deny that a form of power, namely police power, would be necessary. (shrink)

Wie können Freiheit und Widerstand innerhalb von Foucaults Theorie der Macht und Subjektivierung konzipiert werden? Diese zentrale Frage der Interpretation von Foucaults vielschichtigem Werk wurde breit diskutiert und dennoch nicht befriedigend beantwortet. Dass bis heute kaum Klarheit über den Status von Freiheit in Foucaults Werk erreicht werden konnte, liegt auch daran, dass die gängigen Interpretationen die verschiedenen Freiheitsbegriffe, die in Foucaults Werk zu finden sind, vermischen. Der Artikel bringt deshalb Ordnung in diese unübersichtliche Lage, indem er die verschiedenen Freiheitsbegriffe und (...) Freiheitsprobleme in Foucaults Werk differenziert. Dies ermöglicht ein besseres Verständnis von Foucaults Freiheitsdenken und Machttheorie und führt zu einem neuen Freiheitsbegriff: Freiheit als die Fähigkeit zur kritischen Reflexion der eigenen Subjektivierung. Weil diese "Freiheit als Kritik" nur durch politische Institutionen ermöglicht werden kann, produziert dieser Freiheitsbegriff neue Anschlüsse von Foucaults Denken an die normative politische Theorie und postfundamentalistische Demokratietheorie. How can freedom and resistance be conceived within Foucault's theory of power and subjectivation? This central question of the interpretation of Foucault's multi-layered work has been widely discussed and yet not satisfactorily answered. The fact that until today there has been little clarity about the status of freedom in Foucault's work is also due to the fact that the current interpretations confuse the various concepts of freedom which can be found in Foucault's work. The article therefore brings order to this confusing situation by differentiating the various concepts and problems of freedom in Foucault's work. This enables a better understanding of Foucault's thinking of freedom and his theory of power and leads to a new concept of freedom: freedom as the capability to critically reflect on one's own subjectivation. Because this "freedom as critique" can only be made possible by political institutions, this concept of freedom produces new connections from Foucault's thinking to normative political theory and post-fundamentalist democratic theory.
