The civilization of the world has become a threat and distorted environmental integrity in the 20th century. Therefore, environmental ethics is currently getting important in academic considerations. Various public and private institutions such as universities and research centers output throughout the world are now paying attention and seriousness to the environment. This paper focuses on what mankind ought to do regarding the cross-cuttingness of environmental problems.

Dans ce texte, nous tentons de montrer qu’à partir de son traitement de l’altérité d’autrui, la philosophie de Lévinas peut être présentée comme le dépassement intérieur de la phénoménologie de Merleau-Ponty développée dans la Phénoménologie de la perception. Nous commençons par exposer la conception de l’altérité exposée dans la Phénoménologie en éclairant l’intersubjectivité corporelle au fondement de la socialité. Nous tentons ensuite d’en dégager les possibles fondements d’une éthique merleau-pontienne axée sur l’expression-responsive, éthique qui ferait preuve d’une considération importante envers (...) l’altérité d’autrui. Puis, après avoir exploré les limites de cette conception, nous dégageons les concepts de trace et d’an-archie comme les points d’appui autorisant un dépassement intérieur de cette phénoménologie vers ce que Lévinas appelle l’éthique. Enfin, tout en présentant les grandes lignes de celle-ci grâce aux concepts clé de responsabilité et de substitution, nous tentons de mettre en relief un avantage qu’elle comporte eu égard à un problème rencontré par Merleau-Ponty en 1945. Determiner phrases embedded under a propositional attitude verb have traditionally been taken to denote answers to implicit questions. For example, 'the capital of Vermont' as it occurs in 'John knows the capital of Vermont' has been thought to denote the proposition which answers the implicit question 'what is the capital of Vermont?' Thus, where 'know' is treated as a propositional attitude verb rather than an acquaintance verb, 'John knows the capital of Vermont' is true iff John (...) knows that Montpelier is the capital of Vermont. The traditional view lost its popularity long ago, because it was thought to rest on the controversial assumption that determiner phases embedded under a propositional attitude verb function semantically in the same way as the corresponding wh-clauses. Here we defend the traditional assumption against objections. We then argue that wh-clauses are not to be given a uniform treatment as indirect questions. When occurring under a propositional attitude verb, wh-clauses are better treated as having a predicate-type semantic value. We conclude by considering some possible objections to the predicate view. In recent years, there has been a heated debate about how to interpret findings that seem to show that humans rapidly and automatically calculate the visual perspectives of others. In the current study, we investigated the question of whether automatic interference effects found in the dot-perspective task (Samson, Apperly, Braithwaite, Andrews, & Bodley Scott, 2010) are the product of domain-specific perspective-taking processes or of domain-general “submentalizing” processes (Heyes, 2014). Previous attempts to address this question have done so by implementing (...) inanimate controls, such as arrows, as stimuli. The rationale for this is that submentalizing processes that respond to directionality should be engaged by such stimuli, whereas domain-specific perspective-taking mechanisms, if they exist, should not. These previous attempts have been limited, however, by the implied intentionality of the stimuli they have used (e.g. arrows), which may have invited participants to imbue them with perspectival agency. Drawing inspiration from “novel entity” paradigms from infant gaze-following research, we designed a version of the dot-perspective task that allowed us to precisely control whether a central stimulus was viewed as animate or inanimate. Across four experiments, we found no evidence that automatic “perspective-taking” effects in the dot-perspective task are modulated by beliefs about the animacy of the central stimulus. Our results also suggest that these effects may be due to the task-switching elements of the dot-perspective paradigm, rather than automatic directional orienting. Together, these results indicate that neither the perspective-taking nor the standard submentalizing interpretations of the dot-perspective task are fully correct. (shrink)

Several states have enacted specialized limited liability company legislation in an attempt to attract decentralized autonomous organizations. In this way, the regulatory competition debate surrounding states such as Wyoming, Tennessee, and Vermont, attempting to dethrone Delaware, has found a new battleground. According to Professor Lynn LoPucki, this will entail a regulatory race to the bottom, that is, a race to “laxity.” I disagree. In fact, deregulation has already been achieved in the traditional limited liability company form. The decentralized autonomous (...) organization limited liability company is no laxer or more attractive to investors, who will likely prefer the traditional limited liability company or even other entity forms, given the diversity of investors’ needs and aims. Moreover, some decentralized autonomous organization organizers may wish not to incorporate at all, hoping to avoid the law altogether. While increasingly risky, this strategy rests on the belief in the alegality liability shield, further diminishing the impact of the lex specialis approach. After analyzing the statutory developments and the scholarly and industrial commentary, I conclude that in decentralized autonomous organizations, as elsewhere, the regulatory race to the bottom is a fad. The Judges were drawing their last fleeting breaths shipwrecked and scattered upon the shores of historical-critical-grammatical-linear-modernist-masculine interpretation. "The narrative is primitive," they said. "The editors have made a mess," they exclaimed. "The conclusion is really an appendix," another said. Then the bible-acrobats jumped in pretending there was no literary carnage while at the same time drawing our eyes away from the literary carnage. "No, no, there (...) is an order to this disorderly book!" "Gideon is a man of faith," they explained. "Gideon is a sham," others retorted. "Long live the king," they cried. "Oh no, the king will bring down the nation," others said. Enter the latest literary critics and the fresh feminist readers to save the day. And save they have. Barry noted the irony. Cheryl called attention to the elaborate, spiraling labyrinth. Phyllis remembered the forgotten. Mieke heralded the incoherence. Deborah the Bee slings Barak with irony. Cowardly Jephthah sacrifices his virgin daughter immediately after he is filled with the spirit. Blind Samson remains stuck in some adolescent, Pinnochio-like stage milling around the same old vices. The Levite, the man of word and sacrifice, lies to the people and dismembers his wife. To beat it all the myopic narrator joins in lock step with the other blind characters stumbling around in the narrative. What manner of text is this? These Judges, these stories, are even more troubling now that we take them seriously. Now what do we do with Judges? The recent scholarship is most promising, but I think we must press forward, or is that backward, or perhaps to another plan. Perhaps Judges hearkens forward to the postmodern. What would Judges look like if we viewed the story through a postmodern lens? Would we see the text in another dimension? Would we let the characters live and breathe as confusing, confounding, intricate characters? Judges speaks to me. These judges, they teach me. How can I ever forget my reading of Judges? For once I found a text reflecting the madness of faith in my maddening world. For once I saw a text like Pablo. I heard the echo of Umberto. I noted the faint murmurings of Jacques. I danced a most joyous jig with Julia. I saw, up ahead, or was that behind me, or over to the side, Martin's flickering candle. Mieke, meet Jael. Barak, meet Barry. Jacques, meet Gideon. Background: As part of a consistent effort to examine and provide integrative medical approaches to the therapeutic offering for psychophysical health, this study investigates the utilization of Olfactory Virtual Reality (OVR) in an inpatient psychiatry unit, more specifically in the Shepardson 3 Inpatient Psychiatry Unit at the University of Vermont Medical Center, in Burlington, VT, USA. Objectives: The purpose of this protocol is to explore the therapeutic value of olfactory virtual reality (OVR) in the above described population, and to (...) collect statistically significant data to determine the feasibility of potential future OVR studies. Method: Direct subject observation and monitoring in the context of Olfactory Virtual Reality (OVR) sessions and Qualitative data collection via the administration of subject surveys, subdivided in: a) Pre-OVR experience, b) Immediate post-OVR experience, and c) 1-to-3-hour post-OVR experience questionnaires. Results: The research yielded positive outcomes in all areas investigated, despite challenges related to the utilization of the device itself, issues in individual olfactory threshold, and COVID-19 restrictions and limitations. Conclusion: The outcome of this study indicates that the utilization of olfactory virtual reality technologies is a safe and effective integrative approach to target several aspects of psychological and physical health such as anxiety, stress, and pain, in combination with the psychotherapeutic and pharmacological standards of care in inpatient psychiatry. In Fall 2012, Green Mountain College’s oxen team “Bill and Lou” became the focus of an international animal rights protest. The Guernsey team had plowed the fields of the small Vermont college farm together for a decade. Lou injured a rear leg twice over the summer and eventually became unable to support his own great weight. With administrative support, the college’s farm crew decided to slaughter the team. This was in keeping with an aim of the college’s Farm and (...) Food Project to “close the loop” with its dining services. At that time the mission of the environmentally-themed liberal arts college was to represent a community-wide ethos of responsibility for the systemic impact of human behaviors. Accordingly, the college farm sought to build a sustainable farming and food system that lifts the veil that separates consumers from the source of meat and livestock products. The basic idea was that if students wish to be change agents in the world, they need to understand the ins-and-outs of the systems in which that change can take place. So the college strove to bring the food system into the classroom. Chefs and farmers weren’t hidden away in kitchens and fields; they were brought into the educational process. Guided by faculty, staff, and administrative oversight, along with a thick sheaf of policies, this periodically meant that students made life-and-death decisions. (shrink)

Langdellian “science” and its “formalism” ignore ways form permits and even creates freedom of choice. For example, as Wordsworth notes, though the weaver is restricted by what his form of loom can weave, the weaver may nonetheless choose what and how he weaves. Furthermore, the loom creates weaving possibilities that do not exist without it. Such freedom alongside form is often lost on lawyers, judges, and teachers trained primarily in Langdellian redacted appellate cases where “facts” and other framed matters often (...) wrongly appear as simply given. Similarly, in the context of their redacted appellate cases, many current students may only see constraint in IRAC (Issue-Rule-Application-Conclusion) and other thought forms rather than the fastidious freedoms such forms both provide and create. -/- Overlooking such freedoms is not only misleading in itself. It also misses the need to study how such freedoms are and should be exercised. When facts are simply presented as “given” and strategic and other choices go unrecorded and unnoticed in redacted appellate opinions, no thorough analysis of these overlooked subjects can occur. This is extremely troubling since such overlooked subjects are at the very heart of the lawyer’s craft. -/- Attempting to remedy such Langdellian shortcomings, this article explores, among other things, five basic levels of thought and the framing choices in such levels of thought: references, issues, rules, application of rules, and conclusions. Though often merely taken as “given” in redacted appellate opinions, a good grasp of reference assures that parties are in fact talking about the same matter or matters (the “reference”). It also increases the likelihood of ascertaining and properly framing all the relevant “facts” in a manner reasonably and ethically consistent with a client’s real interests. Similarly, focusing on flexibility of issue framing both brings necessary focus on what is important in the reference and, to the extent reasonable and ethical, again increases the likelihood of frames most consistent with a client’s real interests. A good grasp of applicable rules and how to frame and apply them on its face increases the likelihood of representing a client well. A good grasp of conclusions and how to frame and hedge them also does the same. -/- Grasping the multilevel complexities in play at these multiple levels pushes us beyond briefing redacted appellate cases to the much more difficult and stimulating work of exploring and teaching good legal thought at all its levels.
